IT-IS-HEREBY-DECIDED

ARTICLE1:

Allprivateorpublicperson,physicalorlegalshallhavetherightstoconstructabuildingontheirowntitledlandandsuchrightsshallbeprotectedbythisAnukret.AnyConstructionPermitissuedpriortheconstructionstart-upshallbeconsideredaslegaldocumentoftheConstruction.Theprocessofpermitapplicationshallbedescribedinthe1st

SectionofthisAnukret.Inordertoprovidehabitation,particularlyforthepoorpeople,theconstructionpermitshall

notberequiredforsmallwoodenhabitationspursuanttotheprovisionsdeterminedinArticle3ofthisAnukret.Inordertoensurepublicsafetyandhealthaswellastoreservenecessarypublicareasforurbanplaningoragriculturaldevelopment,

thegeneralprovisions

ofconstructionshalldeterminetherightsandobligationstodevelopurbanareasandagriculture,todeterminethedutiesandobligationsofpopulationandpublicinstitutionsforpublicandprivate

construction.Theconstruction

permitshallbegranteduponthecomplianceofprovisionsdeterminedinSection2ofthisAnukret.Intheabsenceoflanduseplanandan

approvalmasterplanapprovedbytheRoyalGovernment,theseprovisionsshallbeenforced.Theseprovisionsshallbesupplementedincompliancewiththelocalsituationwithinthe

frameworkofactualconstructionprovisions

ofthelanduseplanofprovincesandmunicipalities.

TheKhmerversionistheofficialversionofthisdocument.

ThisAnukretshallnotbeappliedtotheauthorizedexistingbuildings.Forun-authorizedexistingbuildingsthatseriouslyaffectedtopublicinterestorbeauty,theRoyalGovernmentoritsdulyauthorizedrepresentativeshalldemandthedemolitionoftheconstructionupontheproposalofthecompetentauthorities.

CHAPTER1.:CONSTRUCTION

PERMIT

REQUIREMENT

CONSTRUCTIONSSUBJECTTOPRIORCONSTRUCTION

PERMITS.

Allconstructionsinthecitiesorprovincialtownsshallbesubjectedtoconstructionpermits.

Allnewconstructionsshallbesubjecttoconstructionpermits

Reconstruction,expansionsandflooradditions

ofexistingbuildingshallbesubjectedto

constructionpermit.

Renovationofexistingbuildings

buildingshallbesubjectedtoconstructionpermitifthey

modify:

-

thecharacteristic

offacades.

-

theaspectofbuildings;

-

sanitaryinstallations

andsewerconnections;

-

treatedwastewaterinstallationconnectedtosewersystem;

-

floorareas

-

premises

openedtothepublic,

-

Allsubstantiveworkswiththeeffectofmodifyingtheconfigurationoftheground(fillings,ditches,conversionofagriculturallandintodevelopedlots)orthecharacteristicofasite(suppressionofapondoracanalorcomponentsofthedrainagesystem,existenttreecutting,etc…)

Theconstructionorrenovationofinstallationswithpotential

firedangers(installationoftanks,fueldepots,flammableproductsstorage,premiseswithpublicaccessetc…)renovationoffactories,thecreationof

advertisingpanel,thecreation

oftelevisionantennae,solarcollectorsandallhangingstructuretoabuildingandborderingthestreetorexposedtotheview,

theconstruction

permitsprocedureshallbeseparatelydeterminedbytheprovincialandmunicipalityhalls.

ARTICLE3.CONSTRUCTION

NOT

SUBJECTTOTHECONSTRUCTIONPERMIT

-Thepopulationsmallhabitationslocatedintheruralareasor

farawayfromtheNationalroads,railroads,tourismresorts,nationalpatrimonyandprotectedareas,regardlessofitssizeorconstructionmaterials.

-

maintenanceandrepairworks,which

donotmodifythestructureorthecharacteristicsoftheconstruction

arenotsubjecttotheconstructionpermit.Thefollowingconstructionsshallbesubjectedtoasimplepreliminarydeclarationtothelocalauthority:

-placesofcult

-the“salas”“salaschhatien”(publicaccommodationplaces)

-smallstateconstructions

necessarytoprovidepublicfunctional

supportstothesites,hangarsTheKhmerversionistheofficialversionofthisdocument.

CHAPTER

2:AUTHORITYTOISSUECONSTRUCTIONPERMITS

ARTICLE4.AUTHORITYOFPROVINCIALANDMUNICIPALADMINISTRATION

4.1.ProvincialandMunicipaladministrationshallhavethe

authoritytoissuealltheconstructionpermitsundertheirjurisdiction.

4.2.TheconstructionpermitsshallbesignedbythedelegateoftheRoyalGovernmenttotheMunicipalityorgovernorsoftheprovincesandmunicipalordulyappointedvicegovernors.Reasonofdenialofconstructionpermitshallbenotifiedinwriting.

ARTICLE

5:

AUTHORITY

OFTHE

GOVERNMENT

5.1.Sometimes,someconstructionpermitsshallbeunderthejurisdictionoftheauthorityofthegovernment.Thegovernmentistheonlyinstitution,whichcanissuetheconstructionPermitsforthefollowingbuildingcategories:

-industrialandcommercial

buildingsofmore

than

3000m2offloorspace,

-hotelsshallbeconsideredascommercial

buildings,

-buildings

useforagriculturalexploitation

of500haandmore,

-

airportsandports,railwayandvehiclestations,

-public

andprivatefacilitiesofmore

of3000m2offloorspaceandextensionincludingexistingbuildingsofasurfaceofmoreof3000m2(cultural,sports,education,administration,tourist,health,energy,water..),

-constructionsinprotectedsitesforthe

benefitoftheenvironment,landscapeandhistoricalarchaeological

andculturalheritage.

-buildingsclassifiedasnationalheritage.

-constructionsonareas,whichsharedtheviewwithhistoricalmonuments,

-defensestructuresandworksandmilitarybuildings.

5.2.Insuchcase,theconstructionpermitsshallbesignedbyaChairmanoftheNationalCommitteeofLandManagement,Urban

PlanningandConstructionupontheapprovaloftheconcernedauthorities.

ARTICLE6.THEPROVINCIALORMUNICIPALCOMMITTEEINCHARGEOFISSUANCEOFTHECONSTRUCTIONPERMIT.

6.1AUTHORITY

Inaccordancewitharticle18oftheLawonLandManagement,UrbanPlanningandConstruction,aCommitteefortheissuancetheconstructionpermitsshallbecreated,intheabsenceoflanduseandconstructionplan.ThisCommitteeshallbechairedbythedelegateoftheRoyalGovernmenttotheMunicipalityortheGovernorsoftheprovinces.

TheCommitteeshallreviewallconstructionpermitapplications.AftertheCommitteeinchargeofissuance

oftheconstructionpermithadissuedandreviewedtheapplication,thedelegateoftheRoyalGovernmenttotheMunicipalityandtheGovernorsofprovincesshallsubmititsreportanditsadvisestotheNationalCommitteeofLandManagement,UrbanPlanningandConstructionforitsdecision.

6.2

COMPOSITIONOFTHECOMMITTEE

TheCommitteeiscomposedofthefollowing:

-delegateoftheRoyalGovernmenttotheMunicipalityortheGovernoroftheprovince:

Chairman

-cadastreoffice,

member

-urbanplanningandconstructionorconstruction

offices,(ifany)member

-publicworkoffice,

member

-environmentaloffice,

member

-culturalandfineartoffice,

member

-representativesofconcernedinstitutionwithconstructionproject

member

TheKhmerversionistheofficialversionofthisdocument.

-

localofficeofurbanplanningaffairs

member

TheCommitteeisempoweredtoconveneandhearallpersons,whohassubmittedaconstruction

permitsandthebuildingownersifheisnottheapplicantassoonastheapplicationisofficially

recorded.

CHAPTER3:INSTRUCTIONONTHECONSTRUCTIONPERMITS

ARTICLE7

NoconstructionpermitsshallbeissuedifitisnotcompliancetotheMasterPlanandtotheLandUsePlaniftheyexistandtothegenerallanduserulesifthetwoprecedingdocumentsdonotexist.Thismeasureshallbeapplied

toindividualsaswellastolegalpersonsbothpublicandprivate.

ARTICLE8:

Theconstructionpermitsapplicationsshall

bedepositedforPhnomPenhandtheothermunicipalitiesattheconstructionpermitoffice(urbanplanningandconstructionunit),forprovincesattheofficeof“Srok”chieforthegovernoroftheprovince(constructionunit).Areceiptofthedeposittheconstructionpermitsshallbeissuedtoallapplicantswhentheapplicationfileiscompleted.

ARTICLE9.CONTENTOFTHECONSTRUCTION

PERMIT

APPLICATION

Theconstructionpermitapplicationshallbe

submittedonanofficialformalongwiththefollowingminimumplan,in10copiesfoldedintheformat(21x29.7cm):

9.1.

apropertytitleorapossessiontitleoratemporaryoccupationpermits,

9.2.

apropertysheet.Thisplanshallbedonebyasurveyororbyanagentofthecadastraloffice.Thisplanshallbedated,signedbyitsmakerandapprovedbythecadastraloffice.Onthisplanfigure,thefollowingshallbeincluded:

-thestatusofthelot,whichisthesubjectoftheapplication,thestatusofadjacentlots,accesstothelot

andtheirstatus(publicorprivate,nameoftheproprietor);

-thenameornumberoftheroadsandstreet;

-thesurfaceareaofthelot

-existingconstructionsonthelot(location

andheight)

-existingconstructionsonadjacent

lot,theirsizeandtheirheight

-thescaleoftheplan,anglesanddimensionsofeachofitssides,

-

theorientationlandmarks

-thealignment

topublicroads.

9.3.

-locationoftheconstructionswhichisthe

objectoftheapplicationonthelotwithdistancescoordinatesbetweenthebuildingsandthelotboundariesanddistancetoexistingneighboringbuilding;

-utilizationofpartsoftheun-builtterrainwithindicationofsoilspecifications,futureandexistingbuilding,automobilesparkingandfences(heightandlocation);

-pipesystem(materials,diameters,slopes,levels)withhookupwiththepublicsewersystemanddrinkingwatersupply,septictanks,well.

-landmarkafterconstructions

9.4.

Calculationsheetforthebuildingsizeandtheadditionalutilizationindex.Forrenovations,expansionsofthefloor,theplansshallreflectclearlythepreexistingconditions,thedemolitions,theproposedfinishedproducts.EachMunicipalityandProvinceshallspecifyinaprovincialormunicipalcircularthecontentandtheadditionalinformationneededfortheconstructionpermitapplication.Additionaldocumentscanberequestedfromtheapplicantforreasonpertainingtohydraulicconstraints,protectionagainst

pollution,publicorder,protectionofthepatrimonyandlandscapes.

9.10AfterreceivingtheConstructionPermitandbeforeconstructionsstartup,thereshallbeadetailedblueprintofbuildingsignedbytheMinistryofPublicWorksandTransport.

ARTICLE10.OFFICIALLANGUAGE

TheconstructionpermitapplicationshallbeentirelywritteninKhmerlanguage.TheEnglishorFrenchtextcouldbeenclosedasattachment.

ARTICLE11.SIGNATURESONTHEAPPLICATION

Allconstruction

permitapplication

andplans

shallbesignedbytheownerofthelandandtheprojectapplicant.

Whentheapplicant

isnottheowner,theapplicantshallequallysigntheapplication.TheprojectapplicantcanonlybealicensedCambodianarchitectorapersonofCambodiannationality,notablyaconstructionengineerapprovedbythecompetentauthorityorKhmerarchitectcommitteewhichoversee

thearchitectureworkattheproposalintheCambodianarchitect

council.Intheeventtheconstructionsexceed500m2,theprojectshallonlybedonebyaCambodianarchitect.

ARTICLE12.ADVERTISEMENT

OFTHECONSTRUCTION

PERMITS

ANDPUBLICINQUIRY

Thecompetentauthoritiesinformthepublicofthesubmissionoftheconstructionpermitsbydisplayingitattheseatofthe“Khan”,the“Srok”orthegovernorandattheproposedconstruction

site.Theofficialsubmissiondateoftheapplicationismentioned

inthefileandmadeknowntotheapplicant.Furthermore,forbuildingsandworksofacertainimportanceorsusceptiblebytheirnaturetocause

security,healthorpublicsafety

disturbances,thepublicshallbe

informedofthesubmissionofsuchconstructionpermitsbyanyothermeansdeemedefficient

whiletakingintoaccountthemeansofinformation.AcircularoftheSeniorMinisteroftheCultureandArts,LandManagement,UrbanPlanning

andConstruction

shalldetermine

thelistofbuildingsandworksconcerned.TheKhmerversionistheofficialversionofthisdocument.

Allconcerned

personsshallhaveaccesstothefileatofficeoftheconstructionpermitsoftheMunicipality

ofPhnomPenhorthe“Srok”,within25daysandtofilecomplaintsorclaimswiththecompetent

authorities.

Theserecoursesareincludedinthefile.

Thelocalauthoritiestakeintoaccounttheobservationscollectedinthecourseoftheinquiryandsubmitareporttothegovernorwithina5daysperiod.Thegovernororthecommissionoftheconstructionpermits,(ifitexists)decidesonthevalidityoftherecourse.

ARTICLE13.INQUIRIESWITHTHECOMPETENTOFFICES

Thecommissionoftheconstructionpermits,(if

itexists)and,inothercases,theofficesofconstructionandurbanplanningofprovincesormunicipalitiesshallcollectthecommentsfromthecompetentofficesandestablishasynthesis.

ThesewrittencommentsaswellasthesynthesisshallbeforwardedtothegovernoroftheprovinceandforPhnomPenh,tothedelegateoftheRoyalGovernmentforitsreviewanapproval.Intheabsenceofthecommissionoftheconstructionpermits,thefollowingofficesshallbemandatorilyconsulted:

-thecadastraloffice,

-theofficeoftheurbanplanningandconstruction,

-theofficeofpublicwork,

-theofficeofcultureandfineart,

-theofficeoffinances

-theofficeofenvironment

-therepresentativesofconcernedinstitutions

ARTICLE

14.DECISION

PERIOD

Thedecisionperiodforconstructionpermitapplicationshallbefixedat45workingdays.Thisperiodshallcountfromthedayallthedocumentsrequiredfortheconstructionpermitapplication

havebeenprovided.Onthatdate,theapplicantshallbeinformedofthedecision,whetherit’sanapprovaloradenialbasedontheinformationcollected.Thedateofthisfirstdayshallbedeterminedbythecommissionoftheconstructionpermits,(ifitexists)orbytheofficeofurbanplanningandconstructioninothercases.Ifmodificationsarerequiredbythecompetentauthoritiestotheapplicant,anewperiodof45daysshallbecountedfromtheofficialdate

ofthesubmissionoftherevisedconstruction

permits.Denialofconstructionpermitsandrequiredmodificationsshallbenotifiedinwritingtotheapplicantbythecompetentauthorities.

CHAPTER4:

FORMALITIES

AFTERTHEISSUANCEOFTHECONSTRUCTIONPERMITS

ARTICLE15.

ISSUANCEOFTHECONSTRUCTIONPERMITS

Theconstructionpermitsshallbedeliveredto

theapplicantbytheauthoritythatgrantsthepermits.Acopyofthepermitsalongwiththecompletefile(plans,annex,notice…)shallbemandatorilykeptintherecordsoftheadministrationoftheProvinceortheMunicipality.Intheeventthepermitsisunderthecompetenceofthegovernment,acopyshallbeequallykeptintherecordsoftheNationalCommitteeofLandManagement,UrbanPlanningandConstruction.

ARTICLE16.EXPIREDCONSTRUCTION

PERMITSANDABANDONEDWORKS

16.1Theconstruction

permitsshallceasetobevalidifworkshavenotbeenundertakenwithinaperiodofayearfromthedateofsigningontheconstructionpermit.

TheKhmerversionistheofficialversionofthisdocument.Such

permitcouldberenewableoncefromthenotification

ofthepermits.Theconstruction

shallbedeemed

begunwhenthefoundation

bases

completed.Forflooradditions,theconstructionshallbedeemedbegunwhenthefirstpoleis

completed.

16.2Whenworksaresuspendedsincemoreofayear,theadministrationoftheCityortheProvincecandemandtheircompletionorthedemolitionofconstructionsbegunwithdiscountinsuitableplacestateforadetermineddateandtoexpenseoftheholderofthepermits.

ARTICLE17.

CONSTRUCTIONSTART-UP

Theconstructionstart-upshallnotbeauthorizedbeforethedeliveranceoftheconstructionpermitsandbeforetheapprovalofthedetailplansofconstruction.Allconstructorsinchargeofaconstructionshallinsureatitsownriskthatproperauthorizationshavebeengranted.Theconstructionpermitholdershallkeptonthework-sideacopyofthedocumentissuingtheconstructionpermitsatthe

disposalofmunicipalorprovincialofficialsinchargeofcontrols.Acopyofalldetailplansof

constructionshallbeheldat

thedisposalofmunicipalorprovincialofficialsontheworksite.

ARTICLE18.WORKSPROGRESS

18.1Thechiefofthe“Khan”or“Srok”shallbeinformedbythecontractorafterreceivingtheconstructionpermitsandtheapprovalofdetailplansofconstructionandthoseplansshallberegisteredatthecompetentoffices.Beforestartingaconstruction,thecontractorshallhaveaconstructionstart-uppermitfromtheprovincialandmunicipalofficeofLandManagement,UrbanPlanningandConstruction.Thetechnicalcompetentinstitutionsshallfollowupthefollowingworks:

-afterthepostingofbuildingstakesfortheconstruction

-afterthefoundationworksandbeforetheconstructionofthefirstfloor

-attheendofthemajorworks(foundations,poles,wallsandfloor…)

-duringtheconnections

ofsewers,waterandelectricity

systems

18.2Anychangeofcontractorduringconstructionshallbeannouncedtothecompetentauthorities.

ARTICLE19.

ORGANIZATIONOFCONSTRUCTIONSITES

Storageofconstructionmaterialsonthepublicgroundshallbeforbidden:

-

whentheconstructionworksnecessitateusageofthepublicground,thisencroachmentshallbelimitedto2metersawayfromthesidewalk.Thisencroachmentshallbefencedthroughoutthedurationoftheconstruction.

-

allencroachments

shallberemoved

aweekaftertheendoftheconstruction

-

allmaterialsleftfromthedemolitionorconstructionorrehabilitation

shallbecleanedupwithinoneweekaftertheendoftheworks

-

thechiefsofKhanorSrokshallhavetheobligationintheeventofnoncompliance,toordersuchcleanupattheexpensesofthecontractor.

ARTICLE20.CONTROLANDSUSPENSIONOFWORKS

TheMunicipalandprovincialadministrationcanatalltimetovisitandcontrolworksitesandinspecttheapprovedplans.If

theyobserveanyirregularities,theyshallnotifytheminwritingtothecontractorandrequestedthattheyareremediedwithinadeterminedperiod.Intheeventofnon-complianceorincompletecompliancewiththe

ordersreceived,animmediateworksuspensionshallbeorderedbytheMunicipalorprovincialadministration.TheKhmerversionistheofficialversionofthisdocument.

TheMunicipalortheProvincialadministrationcanrequesttothecompetentcourtstoissueanordertodemolishortorectifyattheexpensesandrisksofthecontractor,allirregularworksandthoseundertakenwithoutauthorization.Dependingonthegravityoftheirregularities,equipmentandmaterialsoftheconstructionsitescouldbeseized.

ARTICLE21.CERTIFICATEOFCOMPLIANCE

Therecipientshallnotifythecompletionoftheworkstothechiefof“Khan”or“Srok”.Atthecompletionoftheconstruction,the“Khan”orthe“Srok”withtheofficeoftheconstructionpermits(officeofurbanplanningandconstruction)canascertaintheconformitybetweenthefinishedconstructionandtheconstructionasspecifiedintheconstructionauthorized

permits.

Thecomplianceshallberefusedifthebuildingsizeorsurfacesoffloorbuiltexceedthoseauthorized.Thecomplianceshallberefusediftheaspectofthebuildingissubstantiallydifferenttotheconstruction

permit.Incaseofnoncompliance,themunicipalorprovincialadministrationcandemandtheownertomodifythebuildingtocomplywiththeoneasauthorizedintheissuedconstructionpermit.Incaseofnon-compliancetheMunicipalorProvincialadministrationshallfileacomplainttothecompetentcourtstoorderitso.Acertificateofcomplianceissuedbythemunicipalortheprovincialadministrationshallbemandatoryforbuildingusedbythepublic-hotels,offices,aswellasforworkpremisesinwhichactivitiesforremunerationareperformed.Suchcertificateshallbeobtainedbeforetheopeningofthesaidpremises.Acertificateofcomplianceissuedbythemunicipalortheprovincialadministrationshallbemandatoryforbuildingconstructedinurbanornaturallandscapesorsiteswhichpresentahistorical,archaeologicalorpatrimonialcharacterorwhichsharetheviewwithahistoricalmonument.

CHAPTER5:DEMOLITION

PERMITS

ARTICLE22:

Allownerorrepresentativedesiringtodemolishanexistingbuildingotherthanaprecariousstructureshallbeforehandsubmitademolitionpermitapplicationtotheconstructionpermitoffice.Thedemolition

permit

application

shallcompriseofthefollowings:

-

theplanofthelotandthebuilding,photographsofthebuildingorallnecessarydocuments.

-forallbuildingregisteredonthelistofthepatrimony,thedemolitionpermitsapplication

Thedemolitionpermitsshallbeimmediatelyandpublicannouncedthroughvisiblepostingofthenoticepublic

onthesiteofthedemolitionproject.

Demolition

worksshallnotbeundertakenlessof15daysaftertheissuanceofthepermit.

Incaseofsilent,thedemolitionpermitsshallbeconsideredgrantedwithin3monthafterthedateofsubmissionoftheapplication.

Denialofsuchapplicationshallbenotifiedtotheapplicantinwriting.TheKhmerversionistheofficialversionofthisdocument.

ARTICLE23:

Alltheotherrulesapplicabletotheconstructionpermitapplicationshallequallybeapplicabletodemolitionpermitsapplication.

CHAPTER6:PENALTIESANDAPPEALS

ARTICLE24.PENALTIES

Allconstructionstartedbeforetheissuanceoftheconstructionpermitsbythecompetentauthoritiesshallbesubjecttopenalties.Theconstructionworkshallbestoppedimmediately.Individualswhoviolatetheorderoftheofficialsandpublicagentsshallbesubjecttojudicialproceedingsandworkequipmentshallbeconfiscated.Intheeventofrepeating,apettyfineshallbeimposed.IftheworksstillcontinuethecaseshallbedeferredtoaCourtwhichshallissueaCourtOrder.

ARTICLE25:APPEALS

Alldecisionregardingtheconstructionpermit

applicationcanbesubjectedto,beforeallrecoursestoacompetentcourt,anappealinfrontofacompetentauthoritytoreviewsuchdecisionasdefinedinarticles4and5ofthisAnukret.

Thecompetentauthorityisempoweredtonegotiatewiththeappellant.Intheeventthenegotiationreachadeadlock,theappellantcanappealtotheChairmanoftheNationalCommitteeofLandManagement,UrbanPlanningandConstructionwhenthecompetentauthorityistheprovincialgovernorordelegateoftheRoyalGovernmenttotheMunicipality

ortothePrimeMinisterwhenthecompetentauthorityistherepresentativeofRoyalGovernment.Tothisend,alitigationsection

shallbecreatedforeachProvince,municipalityandintheNationalCommitteeofLandManagement,UrbanPlanningandConstruction..

SECTION2:

GENERALLANDUSERULES

ARTICLE26:

Intheabsenceoflanduseplanandanapprovedmasterplan,thefollowinggenerallanduserulesshallbecoveredonthetotalityoftheterritoryoftheKingdomofCambodiaandhavetoberespectbyallprivateorpublicperson,physicalormoralpersonfortheissuanceofconstructionpermits.

ARTICLE27.SECURITYANDPUBLICHEALTH

Constructionpermitsshallberefusediftheseconstructionsbytheirsituation,theirnatureortheirdimensionsareofsuchnatureastoadverselyaffectthehealthorthepublicsecurityorareexposedtopollutionortorisks.

27.1.

AREASATRISKS(dangerousarea)Constructionpermitsshallberefusedonallareasatrisk,landslidezones,inundatedzones,banksofrivers,“preks”,“stungs”and“pongs”whenthelackofterrainsoliditypresentsadangerforpersonsandpossessions.Const
