房屋建設(shè)施工合同

1、 房屋建設(shè)施工合同甲方：乙方：依據(jù)中華人民共和國(guó)合同法，中華人民共和國(guó)建筑法及國(guó)家有關(guān)規(guī)定，為了確保甲方房屋施工順利進(jìn)行，為明確雙方在建設(shè)項(xiàng)目施工過(guò)程中的權(quán)利和義務(wù)，本著雙方責(zé)、權(quán)、利，經(jīng)甲、乙雙方協(xié)商，特訂立本合同。一：工程慨況該工程位于（）磚混五層樓房，基礎(chǔ)為鈴筏形基礎(chǔ)；一、二層為現(xiàn)澆板，其余樓層為預(yù)制板，構(gòu)造柱，圈梁，木瓦屋面等。二：承包方式甲方以包料不包工的方式承包給乙方。三：工程承包范圍按甲方提供施工圖，乙方負(fù)責(zé)所有施工機(jī)械（木模，釘子，鐵絲，腳平架等），從基礎(chǔ)土方工程到房屋竣工中的瓦工，木工，鋼筋工等所有施工內(nèi)容。外墻正立面貼外墻磚，其它墻面為水利砂漿。五層樓地面貼地面磚，衛(wèi)生間，

2、廚房，樓梯踏步所有貼墻地磚。四：承包價(jià)格及付款方式1：價(jià)格：140元平方米（建筑面積）。建筑面積按照國(guó)家規(guī)定計(jì)算方式計(jì)算，增減工程量按照市場(chǎng)行情，雙方協(xié)商解決。2：基礎(chǔ)竣工后付款人民幣5000元整；每一層主體蓋板完工后付款人民幣4000元整，內(nèi)外粉刷完工后付款XX0元整，春節(jié)前無(wú)質(zhì)量問(wèn)題余款一次性付清，（如有質(zhì)量問(wèn)題返工達(dá)標(biāo)后，另外賠材料）。五：工期及安全責(zé)任工期從2023年6月28日到2023年10月28日竣工。推遲一天罰款200元天，由甲方在工程款中扣除。施工期間1：本工程所有安全事項(xiàng)均由乙方負(fù)責(zé)，乙方應(yīng)按工程的要求負(fù)責(zé)施工過(guò)程中的安全管理工作，因乙方及其員工原因造成的一切人員、財(cái)產(chǎn)損失均

3、由乙方負(fù)責(zé)；第三人造成乙方及其員工傷害的，由第三人負(fù)責(zé)，與甲方無(wú)關(guān)。2、施工中乙方不得從事與施工無(wú)關(guān)的事，專業(yè)施工人員持證上崗；高空作業(yè)部分必須在采取切實(shí)可行的安裝措施下方可施工，地面必須安排適當(dāng)監(jiān)護(hù)人員，電焊作業(yè)注意防火等。施工過(guò)程中本合同項(xiàng)下的任何權(quán)利、義務(wù)，乙方不得轉(zhuǎn)讓給第三人，特別是不得轉(zhuǎn)包、分包否則甲方有權(quán)終止合同，慨不結(jié)算，乙方無(wú)條件賠償。以上合同望雙方遵守各自責(zé)任，本合同一式二份，自簽字日期生效。甲方：乙方：年月日 租賃合同tenancy agreement一、出租人：landlord:承租人：tenant:（以下簡(jiǎn)稱甲方）（hereinafterhirin:ft referre

11、致使甲方未能如期收取租金或因而發(fā)生費(fèi)用開(kāi)支，甲方可以扣留部分或全部押金抵付。if party b breaks any part of this contract, such as not paying the rent punctuallypktuli, or if party b caused damages to the leased property, party a has the right to retain part or all of the deposit in compensation,kmpensein. 發(fā)生條款情形，押金不足抵付時(shí)，乙方必須按接到甲方付款通知后十天內(nèi)

13、paid by cheque, all charges incurred will be borne by party b.六、其它費(fèi)用：other charges: 乙方在租賃期內(nèi)所用的水、電和煤氣費(fèi)用，每月按實(shí)際耗用量結(jié)算，乙方按單繳付。during the period of the tenancy, all charges for use of water, electricity and gas are payable by party b monthly according to consumptionknsmpn, and on receipt of bills. 乙方所用電話按

16、ment. 租賃期內(nèi)，未經(jīng)甲方同意，乙方不能轉(zhuǎn)讓其所租房屋，私自轉(zhuǎn)讓無(wú)效。during the period of tenancy, unless with the agreement of party a, party b cannot sub-let or let in part or in full the leased property. 乙方應(yīng)愛(ài)護(hù)房屋及其設(shè)備，如因使用不當(dāng)導(dǎo)致?lián)p壞負(fù)責(zé)賠償。party b must return the property and its contents to party a in good and workable condition, other

17、wise party b must pay compensation to party a. 在房屋內(nèi)已有的裝飾和設(shè)備之外，乙方如需增加設(shè)備或其它裝飾須征得甲方同意。租賃期滿必須恢復(fù)原狀，并承擔(dān)其費(fèi)用，經(jīng)甲方驗(yàn)收認(rèn)可后歸還甲方。in addition to the decoration and equipment already in the property, if party b wishes to make any alterations or decorate the property, party a must consent. on completion of the tenanc

18、y, party b must hand-over the property to party a in its original condition, and all fees arising from such work and to be borne by party b.八、爭(zhēng)議的解決：arbitration:凡執(zhí)行本合同或與本合同有關(guān)的爭(zhēng)議，由雙方友好協(xié)商解決；協(xié)商不成, 提請(qǐng)中國(guó)有關(guān)經(jīng)濟(jì)合同仲裁機(jī)構(gòu)調(diào)解；調(diào)解不成，提請(qǐng)中國(guó)有關(guān)經(jīng)濟(jì)合同仲裁機(jī)構(gòu)仲裁。in the case of disputes arising over this agreement, the two parties

22、服務(wù)對(duì)象所包括的設(shè)備明細(xì)及服務(wù)內(nèi)容：3在甲、乙雙方簽定合同之前，甲方應(yīng)對(duì)本協(xié)議服務(wù)對(duì)象所包括的服務(wù)設(shè)備進(jìn)行一次全面檢測(cè)，確認(rèn)設(shè)備運(yùn)行情況，并提供檢測(cè)報(bào)告，由雙方簽字確認(rèn)，如果發(fā)現(xiàn)故障，需要更換部件，則部件費(fèi)用由乙方負(fù)擔(dān)，甲方有責(zé)任提供報(bào)價(jià)供乙方參考。二、電腦及網(wǎng)絡(luò)定期維護(hù)保養(yǎng)1、地點(diǎn)：甲方實(shí)施上門服務(wù)地點(diǎn)為協(xié)議約定使用所在地。2、周期：電腦及網(wǎng)絡(luò)需每月上門服務(wù)壹次，如有特殊情況需隨時(shí)響應(yīng)。（不得超叁次）3、初次安裝調(diào)試完畢，負(fù)責(zé)對(duì)乙方進(jìn)行一次電腦基本使用培訓(xùn)。4、服務(wù)報(bào)告：每次甲方在為乙方提供保養(yǎng)服務(wù)后，需現(xiàn)場(chǎng)填寫服務(wù)記錄，如實(shí)反映電腦及網(wǎng)絡(luò)的運(yùn)轉(zhuǎn)情況，并由甲乙雙方簽字確認(rèn)。5、保證乙方單臺(tái)電

23、腦操作系統(tǒng)正常運(yùn)行，互聯(lián)網(wǎng)與局域網(wǎng)暢通無(wú)阻，而其它應(yīng)用軟件不在服務(wù)范圍之內(nèi)，但應(yīng)盡力給予乙方提供技術(shù)指導(dǎo)，不提供殺毒軟件、用戶需自行購(gòu)買殺毒軟件或通過(guò)本公司代買。6、故障隱患：如甲方在為乙方提供服務(wù)時(shí)發(fā)現(xiàn)有故障隱患，需要維修或更換部件，甲方需與乙方協(xié)商，由乙方?jīng)Q定是否進(jìn)行維修或更換部件，費(fèi)用由乙方承擔(dān)。三、電腦及網(wǎng)絡(luò)臨時(shí)緊急服務(wù)1、地點(diǎn)：甲方實(shí)施上門服務(wù)地點(diǎn)為協(xié)議包括電腦使用所在地。2、時(shí)間：每周一至周五9：00-16：30（不包括節(jié)、假日）為甲方執(zhí)行本協(xié)議的標(biāo)準(zhǔn)時(shí)間，甲方在接到乙方維修要求電話后6-8個(gè)小時(shí)之內(nèi)為本協(xié)議的標(biāo)準(zhǔn)響應(yīng)時(shí)間（限市區(qū)內(nèi),不含夜間，特殊情況除外）。區(qū)外根據(jù)實(shí)際情況而定。

24、如乙方需要甲方在標(biāo)準(zhǔn)工作時(shí)間以外進(jìn)行維修工作，乙方必須在周一至周五的工作時(shí)間內(nèi)提前通知甲方，否則，甲方有權(quán)拒絕乙方的要求。收費(fèi)標(biāo)準(zhǔn)按照（附件二）執(zhí)行。3、乙方在本協(xié)議所包括的服務(wù)設(shè)備出現(xiàn)故障后要及時(shí)通知甲方，并將出現(xiàn)故障的情況如實(shí)告知甲方，以協(xié)助甲方維修人員做出正確判斷,因故障現(xiàn)象未如實(shí)告知甲方所產(chǎn)生的后果由乙方承擔(dān)。4、如果乙方服務(wù)設(shè)備故障嚴(yán)重，而無(wú)法現(xiàn)場(chǎng)修復(fù)，必須由甲方拿回大修，甲方需經(jīng)乙方同意。5、更換部件：a、部件更換可能會(huì)影響辦公設(shè)備的功能、性能，甲方要在與乙方協(xié)商認(rèn)同后進(jìn)行。b、甲方為乙方提供的更換部件必須保證為原裝部件，如有特殊情況，甲方需在與乙方協(xié)商認(rèn)同后更換與原部件應(yīng)用功能與技術(shù)指標(biāo)相近的部件。c、更換部件的費(fèi)用由乙方承擔(dān)，甲方有義務(wù)提供部件的報(bào)價(jià)，供乙方參考確認(rèn)，報(bào)價(jià)中的部件價(jià)格不得高于該設(shè)備的生產(chǎn)商在本市授權(quán)的維修（服務(wù)）中心提供的部件價(jià)格。乙方可以在第三家（設(shè)備供應(yīng)商或直接代理商）處購(gòu)買部件，但須甲方驗(yàn)收。6、服務(wù)人員：本協(xié)議簽定后，甲方應(yīng)為乙方提供固定的上門維護(hù)人員，如有更換，甲方需事先通知乙方。7、服務(wù)記錄：在服務(wù)工作完成后，
