甲方（以下簡稱“甲方”）：

乙方（以下簡稱“乙方”）：

根據(jù)《中華人民共和國合同法》及相關(guān)法律法規(guī)的規(guī)定，甲乙雙方在平等、自愿、公平、誠實(shí)信用的原則基礎(chǔ)上，就甲方向乙方提供車庫設(shè)備回收服務(wù)事宜，達(dá)成如下協(xié)議：

第一條車庫設(shè)備回收范圍

1.1甲方同意將位于________（地址）的車庫設(shè)備（具體設(shè)備清單詳見附件1）全部回收給乙方。

1.2乙方同意按照本合同約定的價(jià)格和方式購買甲方所提供的車庫設(shè)備。

第二條車庫設(shè)備回收價(jià)格

2.1乙方根據(jù)甲方提供的設(shè)備清單和市場評估價(jià)，同意以人民幣（大寫）：________元整（小寫）：￥_________元的價(jià)格購買甲方所提供的車庫設(shè)備。

2.2雙方確認(rèn)，上述價(jià)格包括但不限于設(shè)備的拆除、搬運(yùn)、回收等費(fèi)用。

第三條回收時(shí)間及方式

3.1甲方應(yīng)在本合同簽訂后的____個(gè)工作日內(nèi)，將所提供的車庫設(shè)備運(yùn)至乙方指定的地點(diǎn)。

3.2乙方應(yīng)在收到甲方所提供的車庫設(shè)備后，____個(gè)工作日內(nèi)完成設(shè)備的驗(yàn)收工作。

3.3乙方應(yīng)在設(shè)備驗(yàn)收合格后____個(gè)工作日內(nèi)，向甲方支付合同約定的回收價(jià)格。

第四條雙方義務(wù)

4.1甲方應(yīng)保證所提供的車庫設(shè)備符合國家法律法規(guī)及行業(yè)標(biāo)準(zhǔn)，且具有完全的使用權(quán)和處置權(quán)。

4.2乙方應(yīng)按照本合同約定的價(jià)格和時(shí)間向甲方支付回收款項(xiàng)。

4.3雙方應(yīng)按照誠實(shí)信用的原則，履行本合同的約定，共同維護(hù)雙方的合法權(quán)益。

第五條違約責(zé)任

5.1如甲方未能按照本合同約定的時(shí)間、地點(diǎn)提供設(shè)備，或所提供的設(shè)備不符合合同約定的質(zhì)量標(biāo)準(zhǔn)，甲方應(yīng)向乙方支付違約金，違約金為本合同回收價(jià)格的____%。

5.2如乙方未能按照本合同約定的時(shí)間支付回收款項(xiàng)，乙方應(yīng)向甲方支付滯納金，滯納金為本合同回收價(jià)格的____%。

第六條爭議解決

6.1雙方在履行本合同過程中發(fā)生的爭議，應(yīng)首先通過友好協(xié)商解決；如協(xié)商不成，任何一方均有權(quán)向合同簽訂地人民法院提起訴訟。

第七條其他約定

7.1本合同一式兩份，甲乙雙方各執(zhí)一份。

2.2Theabovepriceincludes,butisnotlimitedto,thecostsofequipmentdismantling,transportation,andrecyclingasagreeduponbytheparties.

Article3:RecyclingTimeandMethod

3.1PartyAshalltransportthegarageequipmenttothedesignatedlocationofPartyBwithin__workingdaysafterthesigningofthiscontract.

3.2PartyBshallcompletetheacceptanceoftheequipmentwithin__workingdaysafterreceivingitfromPartyA.

Article4:ObligationsoftheParties

4.1PartyAshallguaranteethatthegarageequipmentprovidedmeetsnationallaws,regulations,andindustrystandards,andthatPartyAhasthecompleteownershipanddisposalrightsovertheequipment.

4.2PartyBshallpaytherecyclingpricetoPartyAinaccordancewiththetermsofthiscontract.

4.3PartyCshallactindependentlyandimpartiallytoinspectandverifytheequipmentandshallprovideawritteninspectionreporttoPartyAandPartyB.

Article5:BreachofContractLiabilities

5.1IfPartyAfailstoprovidetheequipmentattheagreedtimeandplaceortheequipmentprovideddoesnotmeettheagreedqualitystandards,PartyAshallpayaliquidateddamagesamountingto__%ofthecontractpriceasapenaltyforbreachofcontract.

5.2IfPartyBfailstomakethepaymentoftherecyclingpriceattheagreedtime,PartyBshallpaylatefeesamountingto__%ofthecontractpriceasapenaltyfordelay.

Article6:DisputeResolution

4.3PartyCshallactindependentlyandimpartiallytoinspectandverifytheequipmentandshallprovideawritteninspectionreporttoPartyAandPartyB.

Article5:BreachofContractLiabilities

5.1IfPartyAfailstoprovidetheequipmentattheagreedtimeandplaceortheequipmentprovideddoesnotmeettheagreedqualitystandards,PartyAshallpayaliquidateddamagesamountingto__%ofthecontractpriceasapenaltyforbreachofcontract.

5.2IfPartyBfailstomakethepaymentoftherecyclingpriceattheagreedtime,PartyBshallpaylatefeesamountingto__%ofthecontractpriceasapenaltyfordelay.
