2、s, PartyA and PartyB sign this contract on the basis of equality, free and mutual consultation.一、工作內容1、Working Contents1.1 甲方因生產需要,同意聘用乙方為本公司員工,職位為。乙方同意接受該安排,遵守勞動紀律和職業(yè)道德,執(zhí)行勞動安全規(guī)程,提高職業(yè)技能,完成生產(工作任務。To meet the production demand, Party A agrees to employ Party B as . 7、ment after approval by relevant government authorities and Party B shall execute it of his own will.四、薪酬4、 Remuneration4.1 甲方支付乙方的每月基本工資為人民幣元。上述薪酬不包括甲方按公司補貼規(guī)定按月向乙方支付的所有補貼。Party A pays RMB to Party B as basic wage per month. The aforesaid remuneration exclu des all subsidies paid to Party B pursuant

8、to Party As stipulation.4.2 甲方嚴格執(zhí)行國家有關最低工資的規(guī)定和標準。Party A shall strictly implement relevant regulations and standard per the lowest wage.4.3 甲方的發(fā)薪日期為每月 15 日。Party A shall pay the wage on the 15 day every month.五、勞動保護與勞動條件5、 Labor Protection and Labor Conditions5.1 甲方須對乙方進行勞動安全、業(yè)務技術及勞動紀律等方面的教育和培訓,并根據(jù)國

9、家對勞動保護、安全生產的要求,為乙方提供必要的生產(工作條件,保障乙方的安全健康。Party A shall give Party B education and training programs relating to labor safety, professional skills and labor disciplines etc. According to the requirements of state labor protection and safe-production, Party A shall provide necessary working condition

10、to ensure Party Bs safety and health.六、社會保險和福利6、 Social Insurance and Welfare6.1 甲方依法替乙方辦理各項社會保險并繳納保險費用。但依法規(guī)定之分攤比例,屬于乙方須自行負擔之各項社會保險金,由甲方于每月發(fā)薪時,從乙方薪資中代扣代繳。Party A shall transact social insurance and pay them for Party B. Party A shall withhold the social security contribution legally undertook by Par

11、ty B when paying the remuneration every month.6.2 乙方享有國家規(guī)定的所有法定假日。Party B will take all statutory holidays stipulated by the State.6.3甲方實行年休假制度,乙方連續(xù)工作滿一年以上的可享受有薪年假,申請享受辦法按甲方制定的年假規(guī)定執(zhí)行。Party A carries out annual vocation system, Party B can take paid annual vocation after continuously working for 1 ye

12、ar and the applying procedure for annual vocation shall be done pursuant to Party As stipulation.七、乙方責任7 Party Bs Responsibility7.1 乙方必須認真工作和勞動,保質保量地完成自己的生產任務。Party B must work earnestly and accomplish its own tasks with quality and quantity.7.2 乙方必須如實匯報工作,積極配合和協(xié)助上級的工作。Party B must report its job ac

13、cording to the facts and shall cooperate with its uppers and assist their jobs.7.3 乙方應嚴格履行甲方依法制定的規(guī)章制度和員工手冊。Party B shall strictly implement the rules and regulations and Handbook legally stipulated by Party A.7.4 乙方應愛護甲方的財物,對由于本人責任造成的直接經(jīng)濟損失,必須予以賠償并接受甲方的處罰。Party B shall take good care of Party As pro

14、perty and he/she must indemnify direct damage due to his/her liability and accepts Party As punishment.7.5 乙方在勞動合同有效期內未經(jīng)甲方事先書面同意,不得為另一家雇主工作。Party B can not work for another employer without Party As written consent in the duration of Labor Contract.7.6 乙方應嚴格保守甲方的商業(yè)秘密,不得向任何第三方泄露。Party B shall strictl

15、y keep Party As trade secret and can not divulge to any third party7.7 如實陳述履歷和學歷。Party B shall state his/her curriculum vitae and educational background according to the facts.7.8 如甲方委派乙方培訓(包括海外培訓,乙方必須遵守甲方的培訓條規(guī)和承諾。Party B shall observe Party As training rules and undertaking when Party A assigns Par

16、ty B to be trained.八、甲方無償解除合同8 Cancellation of the Contract without Compensation by Party A若符合下列情況之一的,甲方可以隨時解除合同,而不必給予乙方任何經(jīng)濟補償: Party A may cancel the Contract at any time without compensation to Party B under the following circumstances:8.1 當乙方在試用期內不符合甲方的職工錄用條件,甲方無須給予乙方解除的原因。When Part y B is proven

17、 to be unqualified for Party As employment conditions during probation period, Party A need not give Party B the reason for cancellation.8.2 乙方嚴重違反甲方依法制定的規(guī)章制度和勞動紀律。Party B seriously violates rules and regulations, labor discipline legally stipulated by Party A.8.3 乙方嚴重失職,營私舞弊,給甲方利益造成重大損失。Party B ser

18、iously neglects his/her duty and grafts resulting in Party As great loss. 8.4乙方違反中國法律,受到司法處罰或追究刑事責任。Party B violates the laws of PRC and gains judicial punishment or is found a guilty.九、甲方有償解除合同9 Cancellation of the Contract with Compensation by Party A有下列情形之一的,甲方可以解除勞動合同,但是應當提前30天以書面形式通知乙方或支付一個月基本工

19、資代替,并依法支付乙方經(jīng)濟補償金或補助費。Under the following circumstances, Party A may cancel the Contract with 30 days prior written notice to Party B or paying one month basic wage instead and legally pay economic compensation or subsidy to Party B.9.1 乙方患病或非因工受傷,醫(yī)療期滿后仍不能從事原工作或由甲方另行安排的工作的。Party B is ill or non-work-

20、related injured, and unable to do the former job or other job assigned by Party A after medical treatment.9.2 乙方不能勝任工作,經(jīng)過培訓或調整工作崗位,仍不能勝任的。Party B is not competent for the job and still remains so after training or adjustment of the post.9.3 本合同訂立時所依據(jù)的客觀情況發(fā)生重大變化,致使本合同無法履行,甲乙雙方不能就變更本合同達成協(xié)議的。The basis

21、for the conclusion of the contract has greatly changed so that the contract can no longer be carried out, while both parties can not reach an agreement on modifying the contract by mutual negotiation.9.4甲方瀕臨破產,進入法定整頓期間或者生產經(jīng)營狀況發(fā)生嚴重困難,達到當?shù)厝嗣裾?guī)定的嚴重困難企業(yè)標準,確須裁減人員,并按法定程序解除勞動合同的。Party A is close to bankru

22、ptcy and enters into legal rectification period or it is in a severe difficulty to meet the standard of severe difficult enterprise stipulated by the local government and the retrenchment is needed, and then Party A cancels the contract according to legal procedure.十、乙方要求解除合同10 Cancellation of the C

23、ontract at Party Bs request10.1 乙方要求解除勞動合同,應當提前三十天以書面形式通知甲方,但必須依照11.2條款賠償甲方。Party B shall give 30days prior written notice to Party A when requesting to cancel the Contract, but he/she shall indemnify Party A according to Article 11.2.10.2 乙方在下列情況下,可隨時通知甲方解除勞動合同。Under the following circumstances, Pa

24、rty B may inform Party A to terminate the Contract at any time.a. 在試用期內。Be in probation period.b. 甲方不按照勞動合同支付勞動報酬或者提供勞動條件的。Party A didnt pay the remunerati on or provide working conditions according to the Contact.c. 甲方以暴力威脅或者非法限制人身自由的方法強迫乙方工作的。Party A forces Party B to work by means of force, threa

25、t or illegal restriction of personal freedom. 十一、 違約責任 11 Liability for Breach of Contract 11.1 甲方依第 9 條提前解除合同,應按法律規(guī)定向乙方支付經(jīng)濟補償金。 Party A shall legally pay economic compensation to Party B when canceling the Contract pursuant to Article Night. 11.2 乙方違約不履行合同,應按培訓合同的約定及法律法規(guī)的規(guī)定賠償甲方的經(jīng)濟損失。 Party B shall

26、indemnify Party A for its economic loss according to laws and regulations and Training Agreement when he/she breaches the Contract. 十二、 合同附件 12 Annexes of the Contract 12.1 本合同的附件為本合同不可分割的組成部分,與本合同具有相等的法律效力。 The Annexes are indivisible parts of this contract and they have the same effect as this con

27、tract. 12.2 甲方依法制定的員工手冊及各項規(guī)章制度是本合同的附件。 Handbook and other rules and regulations legally stipulated by Party A are annexes of this Contract. 十三、 勞動爭議 13 Labor Dispute 甲乙雙方若發(fā)生勞動爭議,應通過友好協(xié)商解決;若不能解決,可以向當?shù)赜泄茌牂嗟膭?動爭議仲裁委員會申請仲裁;對仲裁不服的,可向人民法院起訴。提出仲裁的一方應當在勞動 爭議發(fā)生之日起 60 天內向勞動爭議仲裁委員會提出書面申請;當事人對仲裁裁決不服的,可以 在收到仲裁裁決

28、書之日起 15 天內向人民法院起訴。 If labor dispute occurs, both parties shall resolve it through consultation. In case of failing to reach an agreement, each party may submit the dispute to Labor Dispute Arbitration Committee having jurisdiction. If rejecting the award, each party can take a proceeding. The party

29、applying for arbitration shall submit the arbitration application to Labor Dispute Arbitration Committee within 60 days when the labor dispute arises. If rejecting the award, the party can sue to the court within 15 days after receipt of the award. 十四、 合同生效 14 Effectiveness of the Contract 本合同自甲、乙雙方簽訂后生效。 This contract is effective by signatures of b
