1、租賃協(xié)議翻譯PREMISES LEASE CONTRACT本合同雙方當(dāng)事人Parties hereto出租方(甲方)Lessor (hereinafter referred to as Party A)承租方(乙方)Lessee(hereinafter referred to as Party B)根據(jù)國(guó)家有關(guān)法律、法規(guī)和本市有關(guān)規(guī)定,甲、乙雙方在平等自愿的基礎(chǔ)上,經(jīng)友好協(xié)商一致,就甲方將其合法擁有的房屋出租給乙方使用,乙方承租使用甲方房屋事宜,訂立本合同。Party A and B have, inrespect of leasingthe legitimatepremises owned

2、by Party A to Party B, reached an agreementthrough friendly consultation to conclude the followingcontractunder the relevantnationallaws and regulations, aswell as the relevant stipulations of the city.1一、建物地址1. Location of the premises甲方將其所有的位于 _ 市_ 區(qū)_ 的房屋及其附屬設(shè)施在良好狀態(tài)下出租給乙方_ 使用。扒雞批發(fā)PartyA willlease

Size of the premises出租房屋的登記面積為平方米(建筑面積)The registered size of the leased premises is squaremeters (Gross size )三、租賃期限3. Lease term租賃期限自 _ 年 _月 _ 日起至 _ 年_ 月_ 日止,租期為期 _ 年,甲方應(yīng)于 _

Party A will issue a written receipt afterreceiving the payment.3. 如乙方逾期支付租金超過七天, 則每天以月租金的 0.3 支付滯納金;如乙方逾期支付租金超過十天,則視為乙方自動(dòng)退租,構(gòu)成違約,甲方有權(quán)收回房屋,并追究乙方違約責(zé)任。3)Where the rentalis more than 7 working days overdue ,Party B will pay 0.3 percent of monthly rental as overdue fineev

8、ery day, ifthe rentalbe paid 10 days overdue , PartyB willbe deemed to have withdrawn from the premises and breach thecontract.In thissituation, PartyA has the rightto take backthe premises and take actions against party Bs breach.五、押金5. Deposit1. 為確保房屋及其附屬設(shè)施之安全與完好, 及租賃期內(nèi)相關(guān)費(fèi)用之如期結(jié)算,乙方同意于 _ 年_ 月 _ 日前支

9、付給甲方押金_ 元整,甲方在收到押金后予以書面簽收。41)Guarantying the safety and good conditions of the premises and attached facilities and account of relevant feesare settled on schedule during the lease term, party B shallpay to party A as a deposit before _(month)(day)_ (year ) Party A shall issue a written receipt afte

10、r receiving the deposit.2. 除合同另有約定外,甲方應(yīng)于租賃關(guān)系消除且乙方遷空、點(diǎn)清并付清所有應(yīng)付費(fèi)用后的當(dāng)天將押金全額無息退還乙方。2) Unless otherwise provided for by this contract,Party A willreturnfullamount of the depositwithoutintereston the day when this contract expires and party B clears thepremises and has paid all due rental and other expens

11、es.3. 因乙方違反本合同的規(guī)定而產(chǎn)生的違約金、 損壞賠償金和其它相關(guān)費(fèi)用,甲方可在押金中抵扣,不足部分乙方必須在接到甲方付款通知后十日內(nèi)補(bǔ)足。3)In case partyB breaches thiscontract, partyA hasright to deduct the default fine, compensation for damage orany other expenses fromthedeposit.Incase thedepositis notsufficient to cover such items, Party B should pay theinsuff

12、iciencywithin tendays afterreceiving thewrittennotice5of payment from Party A.4. 因甲方原因?qū)е乱曳綗o法在租賃期內(nèi)正常租用該物業(yè), 甲方應(yīng)立即全額無息退還押金予乙方, 且乙方有權(quán)追究甲方的違約責(zé)任。4)IfParty B cant normallyuse the apartment becauseof Party A, PartyA should returnthe depositto Party B at once.And Party B has the rightto ask forthe compensati

13、on from PartyA.六、甲方義務(wù)6. Obligations of Party A1. 甲方須按時(shí)將房屋及附屬設(shè)施 (詳見附件)交付乙方使用。1)Party A will provide the premises and attachedfacilities( see the appendix of furniturelistfor detail) onschedule to Party B for using.2. 房屋設(shè)施如因質(zhì)量原因、 自然損耗、不可抗力或意外事件而受到損壞,甲方有修繕并承擔(dān)相關(guān)費(fèi)用的責(zé)任。如甲方未在兩周內(nèi)修復(fù)該損壞物,以致乙方無法正常使用房屋設(shè)施,乙方有權(quán)終止

14、該合約,并要求退還押金。2)In case the premise and attached facilities are6damaged by quality problems, natural damages or accidents,Party A will be responsible to repair and pay the relevantexpenses. IfParty A cant repairthe damagedfacilitiesin twoweeks so that B has the right the deposit.Party B cant use the f

15、acilitiesnormally , Partyto terminatethe contractand Party A must return3. 甲方應(yīng)確保出租的房屋享有出租的權(quán)利, 如租賃期內(nèi)該房屋發(fā)生所有權(quán)全部或部分轉(zhuǎn)移、設(shè)定他項(xiàng)物權(quán)或其他影響乙方權(quán)益的事件,甲方應(yīng)保證所有權(quán)人、他項(xiàng)權(quán)利人或其他影響乙方權(quán)益的第三者能繼續(xù)遵守本合同所有條款,反之如乙方權(quán)益因此遭受損害,甲方應(yīng)負(fù)賠償責(zé)任。3)Party A willguarantee the lease rightof the premise.In case of occurrenceof ownership transferin who

16、le or in partand other accidents affecting the right of lease by party B.party A shallguarantee that the new owner, and other associated ,third parties shall be bound by the terms of this contract.Otherwise , Party A will be responsible to compensate party Bs losses.4. 甲方應(yīng)為本合同辦理登記備案手續(xù), 如因未辦理相關(guān)登記手續(xù)致該

17、合同無效或損害乙方租賃權(quán)利,應(yīng)由甲方負(fù)責(zé)賠償,且甲方應(yīng)承擔(dān)該合同相關(guān)的所有稅費(fèi)。74)Party A must registerthiscontractwith the relevantgovernment authority If not doing so resulting that thiscontractis invalidor Party Bs rightof leasingmay be damaged,Party A should take the allresponsibilities.Party A should alsobear the all the relevant ta

18、xes七、乙方義務(wù)7. Obligations of Party B1. 乙方應(yīng)按合同的規(guī)定按時(shí)支付租金及押金。1)PartyB willpay the rentaland the depositon time.2. 乙方經(jīng)甲方同意, 可在房屋內(nèi)添置設(shè)備。 租賃期滿后,乙方將添置的設(shè)備搬走,并保證不影響房屋的完好及正常使用。2)Party B may add newfacilitieswith Party As approval.When this contract expires, Party B may take away the addedfacilities without chang

19、ing the good conditions of the premises for normal use.3. 未經(jīng)甲方同意, 乙方不得將承租的房屋轉(zhuǎn)租或分租, 并愛護(hù)使用該房屋如因乙方過失或過錯(cuò)致使房屋及設(shè)施受損,乙方應(yīng)承擔(dān)賠償責(zé)任。83)Party B will not transfer the lease of the premisesor sublet it without Party As approval and should take goodcare of the premises. Otherwise, Party B will be responsibleto comp

20、ensate any damages of the premises and attached facilities caused by its fault and negligence.4. 乙方應(yīng)按本合同規(guī)定合法使用該房屋, 不得擅自改變使用性質(zhì)。乙方不得在該房屋內(nèi)存放危險(xiǎn)物品。否則,如該房屋及附屬設(shè)施因此受損,乙方應(yīng)承擔(dān)全部責(zé)任。4)PartyB willuse the premises lawfullyaccordingtothis contract without changing the nature of the premises andstoringhazardous mate

21、rialsin it.Otherwise , PartyB willberesponsible for the damages caused by it.5. 乙方應(yīng)承擔(dān)租賃期內(nèi)的水、電、煤氣、電話費(fèi)、收視費(fèi)、一切因?qū)嶋H使用而產(chǎn)生的費(fèi)用,并按單如期繳納。5)Party B will bear the cost of utilities such astelephone communications , water , electricityand gas on timeduring the lease term.八、合同終止及解除的規(guī)定8. Termination and dissolutio

22、n of the contract91. 乙方在租賃期滿后如需續(xù)租, 應(yīng)提前一個(gè)月通知甲方, 由雙方另行協(xié)商續(xù)租事宜。在同等條件下乙方享有優(yōu)先續(xù)租權(quán)。1)Within one month before the contractexpires , PartyB will notify Party A if it intends to extend the lease. In this situation , two parties will discuss matters over the extension. Under the same terms Party B has the prior

23、ity to lease the premises.2. 租賃期滿后,乙方應(yīng)在 日內(nèi)將房屋交還甲方;任何滯留物,如未取得甲方諒解, 均視為放棄,任憑甲方處置,乙方?jīng)Q無異議。2)Whenthe lease term expires , Party B will return the premises and attached facilities to Party A within days. Anybelongingsleftin itwithoutParty A's previousunderstandingwill be deemed to be abandoned by Part

In this situation,Party A has the right to dispose of it and Party B will raiseno objection.3. 本合同一經(jīng)雙方簽字后立即生效; 未經(jīng)雙方同意,不得任意終止,如有未盡事宜,甲、乙雙方可另行協(xié)商。3)This contract will be effective after being signed by both parties. Any party has no right to terminate thiscontract without another partys agreement.

25、 Anything not10covered in this contract will be discussed separately by bothparties.九、違約及處理9. Breach of the contract1. 甲、乙雙方任何一方在未征得對(duì)方諒解的情況下, 不履行本合同規(guī)定條款,導(dǎo)致本合同中途終止,則視為該方違約,雙方同意違約金為 _ 元整,若違約金不足彌補(bǔ)無過錯(cuò)方之損失, 則違約方還需就不足部分支付賠償金。1)During the lease term , any party whofailsto fulfillany article of this contract without the other party'sunderstanding will be deemed to breach the contract. Bothparties agree that the default fine will be_ .
