論自媒體時代的知識產(chǎn)權(quán)保護(hù)摘要由于我國成文法具有無法避免的滯后性、自媒體知識產(chǎn)權(quán)具有的法律上與計算機(jī)網(wǎng)絡(luò)技術(shù)上的雙重復(fù)雜的特性，在自媒體迅速發(fā)展的今天，我國自媒體領(lǐng)域?qū)χR產(chǎn)權(quán)的保護(hù)體系并未有效建立。相比于傳統(tǒng)的知識產(chǎn)權(quán)，網(wǎng)絡(luò)知識產(chǎn)權(quán)具有以下特點(diǎn)：打破了傳統(tǒng)知識產(chǎn)權(quán)的地域性、專有性和時間性等特點(diǎn)，權(quán)利人的智力成果傳播范圍可以在瞬間達(dá)到全球各個角落，由此產(chǎn)生的知識產(chǎn)權(quán)侵權(quán)案件具有時間更短、范圍更廣、侵權(quán)人更多等特性。而網(wǎng)絡(luò)發(fā)展進(jìn)入自媒體時代后，更是在知識產(chǎn)權(quán)保護(hù)的各個方面涌現(xiàn)出了許多新的挑戰(zhàn)與問題。立法上的滯后加之侵權(quán)手段之多、侵權(quán)成本之小、侵權(quán)利潤之巨導(dǎo)致了在自媒體平臺上知識產(chǎn)權(quán)的侵權(quán)案件頻發(fā)，各個類型的侵權(quán)手段層出不窮，越來越多人的合法權(quán)益受到侵害。長此以往，不僅將影響互聯(lián)網(wǎng)自媒體平臺的發(fā)展，更會給社會文化、科學(xué)領(lǐng)域的創(chuàng)新積極性帶來巨大的損害。本文希望通過調(diào)查網(wǎng)絡(luò)自媒體侵權(quán)傳播的現(xiàn)狀、分析我國現(xiàn)有立法、對比參照各國有關(guān)立法、借鑒以往知識產(chǎn)權(quán)制度面對新興媒體的對策以期找出更好的調(diào)和自媒體傳播快捷個性的優(yōu)勢與保護(hù)著作權(quán)人專有權(quán)利之間矛盾的方法：加強(qiáng)自媒體提供平臺監(jiān)管，嚴(yán)格自媒體平臺提供者責(zé)任，建立便捷快速維權(quán)渠道，創(chuàng)立新的利益分享模式。AbstractDuetoourstatuteisunavoidablelag,withselfintellectualpropertyrightsofmedialawandcomputernetworktechnology,thedoublecomplexcharacteristicsinfrommediarapiddevelopmenttoday,China'smediainthefieldofintellectualpropertyrightsprotectionsystemhasnotbeeneffectivelyestablished.Comparedtothetraditionalintellectualpropertyright,networkintellectualpropertyrightshasthefollowingcharacteristics:theresultingintellectualpropertyinfringementcaseswithshorterandwider,therightinfringementpersonmorepropertiesbrokethetraditionalintellectualpropertyofgeographical,exclusiveandtimecharacteristicsandintellectualachievementsofthepropagationofhumanrightscaninstantlyreacheverycorneroftheglobe.Anddevelopmentofthenetworkintosincetheeraofmedia,istheemergenceofamanynewproblemsandchallengesintheaspectsoftheprotectionofintellectualpropertyrights.Thelegislativelagcoupledwithmeansoftort,tortcostssmall,infringingprofitsgiantleadstoselfmediaplatformontheintellectualpropertyrightsofthefrequentcasesofinfringement,varioustypesoftortmeansemergeinendlessly,thelegitimaterightsandinterestsofmoreandmorepeopleinfringed.Continuouslyforalongtime,willnotonlyaffecttheInternetsincethedevelopmentofmediaplatform,itwillbringgreatharmtothesocial,culture,scienceandinnovationinitiative.Inthispaper,thehopethroughthenetworkinvestigationfromthemediadisseminationofinfringingthepresentsituation,analysisofourexistinglegislation,comparedwithreferencetotherelevantnationallegislation,fromtheprevioussystemofintellectualpropertyinthefaceofnewmediastrategiesinordertofindabetterharmonicfastmediapersonalityadvantageandprotectionasthemethodoftheconflictsbetweentherightofproprietaryrightsoftheperson:strengthenfromthemediasupervisionplatform,strictlyfromthemediaplatformpr
