第頁共頁場地租賃合同英文場地租賃合同英文。合同編號:ContractNumber:出租方〔甲方〕:Lessor〔PartyA〕:承租方〔乙方〕Lessee〔PartyB〕:根據《中華人民共和國合同法》及其他法律法規(guī)的規(guī)定,甲乙雙方在自愿、平等、公平、老實信譽的根底上,就會展場地租賃的有關事宜達成如下協議。Inaccordancewith“ContractLawofthePeople‘sRepublicofChina”andotherrelevantlawsandregulations,thePartieshave,basedontheprinciplesofequality,willingness,fairness,honestandcredit,enteredintotheContractconcerningissuesrelatedtoleaseofexhibitionplaceandagreedasfollows:第一條租賃場地及用處Article1LeasePlaceandPurpose1.詳細位置:Location:2.用處:用于乙方舉辦活動。Purpose:tousefortheactivitiesofbyPartyB.第二條租賃期限Article2TermofLease1.租賃期限為:至;第三條使用時限Article3TimeLimitedofUse1.乙方使用租賃區(qū)域的時限為時至時。在租賃期限內,乙方應在約定的時限內使用租賃區(qū)域;如乙方需在約定時限之外使用租賃區(qū)域的,應提早征得甲方同意并向甲方支付超時使用費,超時費用按照方式計算。PartyBwillusetheleaseareafrom‘clockto’clock.Withinthetermoflease,PartyBshallusetheleaseareawithinthestipulatedtime,andshallobtainPartyA‘sapprovalinpriorandpayovertimeusefeetoPartyAincasePartyBusestheleaseareabeyondthestipulatedtime.第四條租金支付Article4RentalPayment1.租金的計算按照以下標準計算:Therentalshallbecalculatedas:2.租金預付PrepaymentofRental3.定金:甲方在前向乙方支付定金元〔最高不得超過總價款〔20%〕。Earnestmoney:PartyAshallpayPartyBtheearnestmoneyof〔notmorethan20%ofthetotalcontractpriceatmost〕before.預付款:甲方在前向乙方支付預付款元。Advancepayment:PartyAshallpayPartyBtheadvancepaymentofbefore4余款支付:Paymentofremainingmoney:5支付方式:Paymentmethod:第五條甲方提供的根本效勞Article5BasicServicesProvidedbyPartyA1.在租賃期限內甲方向乙方提供以下根本效勞:PartyAwillprovidePartyBwiththefollowingbasicserviceswithinthetermoflease:〔1〕租賃區(qū)域和公共區(qū)域的原建筑照明。Lightingoftheoriginalbuildingsintheleaseareaandpublicarea;〔2〕15-20名效勞人員。15-20waiter;〔3〕音響系統(tǒng)及燈光系統(tǒng)AcousticsystemandLightingsystem;〔4〕其他:提供DJ一名Otherstipulations:SupplyaDJforLessee;2.如乙方需甲方提供根本效勞之外的其他效勞,雙方應另行達成補充協議。AsupplementagreementshallbeenteredintobetweenthePartiesincasePartyBneedsotherservicesprovidedbyPartyAinadditiontobasicservices.第六條設施的使用Article6UseofFacilities1.甲方應在簽約前向乙方如實說明與租賃區(qū)域有關的場地情況,并向乙方提供場地設施技術數據等書面資料。乙方應向甲方如實說明會展情況,并根據甲方提供的數據資料判斷場地是否滿足會展需求。PartyAshallprovidetrueinformationregardingsituationoftheleaseareatoPartyBbeforesigningtheContract,togetherwithwrittenmaterialsincludingon-sitefacilitiesandtechnicaldata.PartyBshallprovidetrueinformationoftheexhibitiontoPartyA,andtojudgeiftheplacecouldmeettheexhibitionrequirementsinaccordancewiththedatamaterialsprovidedbyPartyA.甲方未如實提供場地、設施的有關情況而造成乙方辦展活動無法順利進展的,應賠償由此給乙方造成的損失;乙方未如實說明展品情況,造成場地設施無法滿足展品需要的,乙方自行承當損失,造成甲方場地設施損壞的,應承當賠償責任。IncasePartyAfailstoprovidetrueinformationoftheplaceandfacilities,whichcausesPartyBafailureintheexhibition,PartyAshallpensatePartyBforanylossincurred;PartyBshallbearthelossifPartyBfailstostateclearlythesituationofexhibitssothatthesitefacilitiescouldnotmeettheneeds,andshallundertaketheliabilityofpensationincaseofdamagetoPartyA‘sfacilities.2.甲方協助乙方進展展臺搭建、安裝、拆卸、搬遷及善后等工作。乙方進展上述活動時不應阻礙甲方場地內的其他展覽和活動。PartyAmayassistPartyBwithbuilding,installation,dismantling,removingoftheboothandafter-treatmentatitsowncost,whichshallnotinterferewithotherexhibitionsandactivitiesinsidePartyA‘splace.3.在租賃期限內,雙方應共同保持租賃區(qū)域和公共區(qū)域的清潔和暢通。Withinthetermoflease,thePartiesshalltogetherkeeptheleaseareaandpublicareacleanandunobstructed.4.如無甲方書面特別答應,以下物品制止進入甲方場館:ThefollowingarticlesshallnotbeallowedintoPartyA‘splacewithoutPartyA’sspecialpermissioninwriting:〔1〕危險物,包括但不限于武器、、刀、劍、彈藥、易燃物、放射物或其他危險物品。Dangerousarticlesincludingbutnotlimitedtoanyweapon,gun,knife,sword,cartridge,explosiveflammablearticles,radioactivearticlesorotherdangerousarticles.〔2〕未經海關同意的進口物品。ImportedgoodswithouttheCustoms‘permission.〔3〕任何影響甲方正常運作或被有關部門制止的物品。AnyarticleaffectingnormaloperationofPartyAorforbiddenbyrelevantauthorities.第七條甲方權利義務Article7RightsandObligationsofPartyA1.甲方有權監(jiān)視乙方在租賃期限內遵守本合同約定及甲方的有關規(guī)章制度,并對乙方違背有關約定的行為予以制止。PartyAshallbeentitledtomonitorPartyB‘sacttoconformwithstipulationscontainedhereinandrelevantrulesandregulationsofPartyAwithinthetermoflease,andprohibitanyPartyB’sactagainstrelevantstipulations.2.甲方應按約定為乙方提供場地及相關配套設施和經營條件,保障乙方正常的會展活動。PartyAshallprovidetheplaceandrelevantsupportingfacilitiesandoperationconditionsasstipulatedtoensurethenormaloperationofexhibitionbyPartyB.3.除有明確約定外,甲方不得不干預乙方正常的會展活動。Exceptasotherwiseclearlystipulated,PartyAshallnotinterferewithPartyB‘snormalexhibitionactivities.4.甲方應對市場進展物業(yè)管理,并負責場內的平安防范和經營設施的建立及維護、包括:建筑物〔包括公共區(qū)域及租賃場地〕的管理及維修保養(yǎng);對乙方裝修的審查和監(jiān)視;水、電、氣、空調、電梯、扶梯等設備、管道、線路、設施及系統(tǒng)的管理、維修及保養(yǎng);清潔管理;保安管理并負責市場的公共平安;消防管理;內外各種通道、道路、停車場的管理。PartyAshallconductpropertymanagementtothemarket,andtakechargeofsecurityinsidetheplaceandconstructionandmaintenanceofoperationfacilities,includingmanagement,repairandmaintenanceofbuildings〔includingthoseinpublicareaandleasearea〕,inspectingandmonitoringPartyB‘sdecoration,management,repairandmaintenanceofequipment,pipelines,lines,facilitiesandsystemsuchaswater,power,gas,airconditioning,escalators,andetc.,cleaningmanagement,securitymanagementandpublicsecurityofthemarket,fireprotectionmanagement,andmanagementofallpassageways,roadsandparkinglotsinsideandoutside.第八條乙方權利義務Article8RightsandObligationsofPartyB1.乙方應按照約定用處使用甲方場地,自覺遵守甲方依法制訂的各項規(guī)章制度,服從甲方的監(jiān)視。PartyBshallusePartyB‘splaceforthepurposeasstipulatedandobservePartyA’srulesandregulationsestablishedinaccordancewithlawsandacceptPartyA‘ssupervision.2.乙方應按合同約定及時支付甲方租金。PartyBshallpaytherentaltoPartyAintimeasstipulatedherein.3.乙方有責任維護租賃區(qū)域和公共區(qū)域的整潔。租賃期限屆滿,乙方應按時把自己及參展商的所有物品〔展臺、展架、遺棄物以及垃圾〕移出租賃區(qū)域。有關物品未能按時移出的,甲方將視為遺棄物進展處理。乙方也可以委托甲方對上述物品進展清理,所需費用由乙方承當。PartyBshallhavetheliabilitytomaintaintheleaseareaandpublicareainacleanstatus.Uponexpirationofthetermoflease,PartyBshallremoveallitsortheparticipatingexhibitors‘articlesforexhibition〔booth,display,derelictsandgarbage〕outoftheleasearea.Anyarticlethathasnotbeenremovedoutintimeshallbetreatedasderelicts.PartyBmayalsoentrustPartyAtotreattheabovearticlesatPartyB’scost.4.乙方應合理使用場內的各項設施,如需安裝設備、擺放展品、設置宣傳廣告等,應先征得甲方同意,造成損壞的應承當修復或賠償責任。PartyBshallusefacilitiesinsidetheareainareasonableway,andshallobtainPartyA‘spriorpermissionincaseofneedforequipmentinstallation,exhibitsdisplayandpublicizingadvertisementsetup,andshallundertaketheliabilityforrepairorpensationtoanydamage.5.乙方保證自己和自己的客戶不會對甲方或甲方場所進展的其他展覽會有任何攻擊、損害或干擾的不正當競爭行為。PartyBshallpledgethatitoritscustomerswillnothaveanyunfairpetitionactssuchasattack,damageorinterferenceagainstPartyAorotherexhibitionsatPartyA‘splace.6.乙方負責對自己財產進展妥善保管,并保證其展品或其他物品,將不占用或堆放在非租賃區(qū)域〔包括室外場地〕;否那么甲方有權予以處理,所需費用由乙方承當。PartyBshallproperlykeepitsownproperties,andensureitsexhibitsorotherarticleswouldnotoccupyorpileupatthenon-leasearea〔includingoutdoorfield〕;otherwisePartyAshallbeentitledtohandlesuchexhibitsandarticlesatPartyB‘scost.7.乙方如為宣傳會展活動而需使用甲方名稱、商標和標識,應事先獲得甲方書面同意,否那么乙方應承當由此產生的法律責任。PartyBshallobtainPartyA‘spriorapprovalincaseofneedsofusingPartyA’sname,trademarkandlogoforpublicizingtheexhibition;otherwisePartyBshallundertakethelegalliabilitiesincurredhereby.第九條違約責任Article9DefaultLiabilities1.甲方未按約定提供場地或用水、用電等市場內的經營設施或條件致使乙方不能正常經營的,應減收相應租金,乙方有權要求甲方繼續(xù)履行合同或解除合同,并要求甲方賠償相應的損失。IncasePartyAfailstoprovidetheplaceorwater,powerandotheroperationfacilitiesorconditionsinthemarket,whichcausesPartyBafailureinnormaloperation,PartyAshallreducetheamountofrental,andPartyBshallbeentitledtorequestPartyAtocontinuetoperformtheContractorterminatetheContract,andtopensateforrelevantloss.2.乙方未按照約定支付租金及其他費用的,應每日向甲方支付遲延金額的%的違約金。IncasePartyBfailstopaytherentalandotherexpensesasstipulated,itshallpayPartyAtheliquidateddamagesasper%oftheamountnotdulypaidforeachdayoverdue.第十條爭議解決Article10SettlementofDisputes本合同項下發(fā)生的爭議,由雙方當事人協商解決,或向有關部門申請調解解決;協商或調解解決不成的,按以下第種方式解決。AnydisputearisingfromorinconnectionwiththeContractshallbesettledbythePartiesthroughconsultation,ormaybesubmittedtorelevantdepartmentformediation;failingthesame,ofthefollowingwaysshallbeadopted.〔一〕依法向人民法院起訴;FilealawsuittoPeople‘sCourtinaccordancewithlaws;〔二〕提交仲裁委員會仲裁。SubmitthedisputetoArbitrationmitteeforarbitration.第十一條不可抗力Article11ForceMajeure因發(fā)生自然災害、重大疫情等不可抗力或突發(fā)事件的,經核實可全部或局部免除責任,但應及時通知對方,并在合理期限內提供有效證明。Incaseofanyforcemajeureoremergencysuchasnaturaldisastersandkeyepidemicsituations,liabilitiesmay,uponverification,beexemptedwhollyorpartly;however,itshallbenotifyedtotheotherpartyintimeandeffectivecertifyshallbeprovidedwithinareasonabletime.第十二條其他約定Article12Miscellaneous1.本合同經雙方簽字蓋章后生效。TheContractshallbeeeffectiveuponsigningandsealingoftheParties.2.本合同正本一式二份,甲、乙方各執(zhí)一份。TheContractshallbeservedintwooriginals,PartyAholdingoneoriginalsandPartyBholdingone.3.本合同用中文英文書寫。兩種文本具有同等法律效力。如兩種文本有分歧,以中文文本為準。任何修改須以書面形式并由雙方簽字同意。TheContractshallbemadeinbothChineseandEnglish,andtwoversionsshallhavethesamelegalforce.Incaseofanydiscrepancybetweenthetwoversions,theChineseversionshallprevail.AnymodificationtheretoshallbemadeinwritingandsignedbythePartiesforpermission.4.未盡事宜,雙方可另行以附件形式補充。附件由雙方簽字確認,與本合同具有同等效力。甲方〔簽章〕:PartyA〔Seal〕:乙方〔簽章〕:PartyA〔Seal〕:簽訂日期:Date:簽訂日期:Date:土地租賃合同英文出租方〔甲方〕Lessor〔hereinafterreferredtoasPartyA〕:承租方〔乙方〕Lessee〔hereinafterreferredtoasPartyB〕:根據國家有關法律、法規(guī)和有關規(guī)定,甲、乙雙方在平等自愿的根底上,經友好協商一致,就甲方將其合法擁有的房屋出租給乙方使用,乙方承租使用甲方房屋事宜,訂立本合同。一、物業(yè)地址Locationofthepremises甲方將其所有的位于上海市_________區(qū)____________________________________的房屋及其附屬設施在良好狀態(tài)下出租給乙方___________使用。PartyAwillleasetoPartyBthepremisesandattachedfacilitiesallownedbyPartyAitself,whichislocatedat_________________________________________________________________andingoodconditionfor_____________.二、房屋面積Sizeofthepremises出租房屋的登記面積為_________平方米〔建筑面積〕。Theregisteredsizeoftheleasedpremisesis_________squaremeters〔Grosssize〕。三、租賃期限Leaseterm租賃期限自_______年___月___日起至_______年___月___日止,為期___年,甲方應于_______年___月___日將房屋騰空并交付乙方使用。Theleasetermwillbefrom_____〔month〕_____〔day〕_______〔year〕to________〔month〕_____〔day〕_______〔year〕。PartyAwillclearthepremisesandprovideittoPartyBforusebefore_____〔month〕_____〔day〕_______〔year〕。四、租金Rental1.數額:雙方商定租金為每月人民幣_____________元整,乙方以___________形式支付給甲方.Amount:therentalwillbe____________permonth.PartyBwillpaytherentaltoPartyAintheformof____________in________________.2.租金按_____月為壹期支付;第一期租金于_______年_____月_____日以前付清;以后每期租金于每月的______日以前繳納,先付后住〔假設乙方以匯款形式支付租金,那么以匯出日為支付日,匯費由匯出方承當〕。甲方收到租金后予書面簽收。Paymentofrentalwillbeoneinstallmenteverymonth〔s〕。Thefirstinstallmentwillbepaidbefore_______〔month〕______〔day〕__________〔year〕。Eachsuccessiveinstallmentwillbepaid_____________eachmonth.PartyBwillpaytherentalbeforeusingthepremisesandattachedfacilities〔IncasePartyBpaystherentalintheformofremittance,thedateofremittingwillbethedayofpaymentandtheremittancefeewillbebornebytheremitter.〕PartyAwillissueawrittenreceiptafterreceivingthepayment.3.如乙方逾期支付租金超過十天,那么每天以月租金的0.5%支付滯納金;如乙方逾期支付租金超過十五天,那么視為乙方自動退租,構成違約,甲方有權收回房屋,并追究乙方違約責任。Incasetherentalismorethantenworkingdaysoverdue,PartyBwillpay0.5percentofmonthlyrentalasoverduefineeveryday,iftherentalbepaid15daysoverdue,PartyBwillbedeemedtohavewithdrawnfromthepremisesandbreachthecontract.Inthissituation,PartyAhastherighttotakebackthepremisesandtakeactionsagainstpartyB'sbreach.五、保證金Deposit1.為確保房屋及其附屬設施之平安與完好,及租賃期內相關費用之如期結算,乙方同意于______年_____月_____日前支付給甲方保證金人民幣_________元整,甲方在收到保證金后予以書面簽收。Guarantyingthesafetyandgoodconditionsofthepremisesandattachedfacilitiesandaccountofrelevantfeesaresettledonscheduleduringtheleaseterm,partyBwillpay_________topartyAasadepositbefore_____〔month〕_____〔day〕_______〔year〕。PartyAwillissueawrittenreceiptafterreceivingthedeposit.2.除合同另有約定外,甲方應于租賃關系消除且乙方遷空、點清并付清所有應付費用后的當天將保證金全額無息退還乙方。Unlessotherwiseprovidedforbythiscontract,PartyAwillreturnfullamountofthedepositwithoutinterestonthedaywhenthiscontractexpiresandpartyBclearsthepremisesandhaspaidallduerentalandotherexpenses.3.因乙方違背本合同的規(guī)定而產生的違約金、損壞賠償金和其它相關費用,甲方可在保證金中抵扣,缺乏局部乙方必須在接到甲方付款通知后十日內補足。IncasepartyBbreachesthiscontract,partyAhasrighttodeductthedefaultfine,pensationfordamageoranyotherexpensesfromthedeposit.Incasethedepositisnotsufficienttocoversuchitems,PartyBshouldpaytheinsufficiencywithintendaysafterreceivingthewrittennoticeofpaymentfromPartyA.六、甲方義務ObligationsofPartyA1.甲方須按時將房屋及附屬設施〔詳見附件〕交付乙方使用。2.房屋設施如因質量原因、自然損耗或災害而受到損壞,甲方有修繕并承當相關費用的責任。Incasethepremiseandattachedfacilitiesaredamagedbyqualityproblems,naturaldamagesordisasters,PartyAwillberesponsibletorepairandpaytherelevantexpenses.3.甲方應確保出租的房屋享有出租的權利,反之如乙方權益因此遭受損害,甲方應負賠償責任。PartyAwillguaranteetheleaserightofthepremises.Otherwise,PartyAwillberesponsibletopensatePartyB'slosses.七、乙方義務ObligationsofPartyB1.乙方應按合同的規(guī)定按時支付定金、租金及保證金。PartyBwillpaytherental,thedepositandotherexpensesontime.2.乙方經甲方同意,可在房屋內添置設備。租賃期滿后,乙方將添置的設備搬走,并保證不影響房屋的完好及正常使用。PartyBmaydecoratethepremisesandaddnewfacilitieswithPartyA'sapproval.Whenthiscontractexpires,PartyBmaytakeawaytheaddedfacilitieswhichareremovablewithoutchangingthegoodconditionsofthepremisesfornormaluse.3.未經甲方同意,乙方不得將承租的房屋轉租或分租,并保護使用該房屋如因乙方過失或過錯致使房屋及設施受損,乙方應承當賠償責任。PartyBwillnottransfertheleaseofthepremisesorsubletitwithoutPartyA'sapprovalandshouldtakegoodcareofthepremises.Otherwise,PartyBwillberesponsibletopensateanydamagesofthepremisesandattachedfacilitiescausedbyitsfaultandnegligence.4.乙方應按本合同規(guī)定合法使用該房屋,不得擅自改變使用性質。乙方不得在該房屋內存放危險物品。否那么,如該房屋及附屬設施因此受損,乙方應承當全部責任。PartyBwillusethepremiseslawfullyaccordingtothiscontractwithoutchangingthenatureofthepremisesandstoringhazardousmaterialsinit.Otherwise,PartyBwillberesponsibleforthedamagescausedbyit5.乙方應承當租賃期內的水、電、煤氣、電訊、收視費、等一切因實際使用而產生的費用,并按單如期繳納。PartyBwillbearthecostofutilitiessuchasmunications,water,electricity,gas,managementfeeetc.ontimeduringtheleaseterm.八、合同終止及解除的規(guī)定Terminationanddissolutionofthecontract1.乙方在租賃期滿后如需退租或續(xù)租,應提早兩個月通知甲方,由雙方另行協商退租或續(xù)租事宜。在同等條件下乙方享有優(yōu)先續(xù)租權。2.租賃期滿后,乙方應在當天將房屋交還甲方;任何滯留物,如未獲得甲方諒解,均視為放棄,聽憑甲方處置,乙方決無異議。Whentheleasetermexpires,PartyBwillreturnthepremisesandattachedfacilitiestoPartyAwithindays.
