新加坡建筑工勞工合約(中英文)CONTRACTFORFOEMPLOYMENTREIGNCONSTRUCTIONWORKERSINTHEREPUBLICOFSINGAPORE(雇傭外籍建筑工人合同)ThisEmploymentContract(雇傭合同)ismadebetween茲由(1)havingitsregisteredaddressat:(hereinafterreferredtoasthe“Employer”)ononepartand(以下簡(jiǎn)稱(chēng)雇主,為一方,與):Name(姓名)Nationality(國(guó)籍)DateofBirth(出生日期)IdentificationNo.(身份證號(hào)碼)Address(家庭住址)(hereinafterreferredtoasthe“Employee”)ontheotherpartwhovoluntarilybindthemselvestothetermsandconditionsinthisemploymentcontract(以下簡(jiǎn)稱(chēng)為雇員,作為另一方,自愿達(dá)成以下雇傭條款):ITISHEREBYAGREEDTHATthisemploymentcontract,whichincludesthetermsandconditionsstatedinAnnexAandanydocumentsreferredtointhemandanyalterations,modifications,amendmentsorrevisionstothesamenotifiedbytheEmployertotheEmployeeformthecontractofemploymentbetweentheEmployerandtheEmployee:同時(shí),本雇傭合同也包括附件A及其提及的文件內(nèi)容以及在執(zhí)行過(guò)程中根據(jù)情況對(duì)這些內(nèi)容進(jìn)行的補(bǔ)充、修改和完善,并相應(yīng)通知雇員。GeneralPrinciple(總則)TheEmploymentContractistobesignedbytheEmployeeunderhisnotionandcommonunderstanding.Andithasbeenstudiedbyhimselfandconsideredcarefullyunderhisownsanityandhisfamily’spermission.本雇傭合同書(shū)是雇員在充分理解的基礎(chǔ)上簽訂的。雇員在簽署時(shí),神智清醒,無(wú)任何壓力或引誘,并已取得家屬支持后,經(jīng)多次閱讀和反復(fù)思考,完全自愿簽署的。AfterthisContractissigned,theemploymentrelationshipwillbeestablished.Anditshouldbethebehaviorstandardoftheemployee’s.Anybreachforit,theEmployeewillaccepttherelativepenaltyforhisowndeeds.本合同簽署后,雇員的一切言行必須以本合同為準(zhǔn)則,若有違反,雇員自愿受罰。Task(工作安排)TheEmployermayattheirabsolutediscretionassigntheEmployeeinadifferenttrade/taskfromtimetotime.TheEmployerreservestheirrighttoadjusttheEmployee’spayaccordinglyiftheEmployeeisunableand/orisincompetenttocarryouttheassignedtrade/task.雇主有權(quán)根據(jù)需要將雇員安排在另一個(gè)職位工作。同時(shí),雇主保留因雇員不能勝任工作而對(duì)其工資進(jìn)行調(diào)整的權(quán)利。TheEmployeeshouldbephysicallyhealthyandpassallthemedicalcheckbyauthorizeddoctorsinSingapore.Andtheemployeeshouldbeaqualifiedconstructionworkerthatcanworkatheights,bearheat,andanyothertoughworkingenvironmentonsite.雇員必須身體健康,能通過(guò)新加坡醫(yī)院和診所組織的體檢。雇員必須是合格的建筑工人,工作時(shí)做到能吃苦,不怕曬,不怕熱、適應(yīng)在高空、基坑或海上工作,能夠從事各項(xiàng)建筑施工。DutiesofEmployee(雇員職責(zé))Location(工作地點(diǎn))AnyoftheworksitesdesignatedbytheEmployerwithintheRepublicofSingapore.新加坡共和國(guó)內(nèi)任何一個(gè)雇主指定的工地。WorkingTime(工作時(shí)間)TheworkingtimeshouldbedecidedbytheemployeeaccordingthelawofSingapore.雇員的工作時(shí)間按照新加坡的雇傭法由雇主決定。TheemployeeshouldfollowtheregulationsandinstructionbytheEmployer.Anyabsenceforworkwithoutavalidreason,theEmployercouldgivethefineofS$50.00.Iftheabsenceaccumulatedto3days,theEmployercouldperformtherightandrepatriatetheEmployee.雇員必須服從雇主的領(lǐng)導(dǎo)與管理。對(duì)于曠工的雇員,雇主可處以每天50.00新幣的曠工罰款。連續(xù)曠工3天者,雇主可以取消其準(zhǔn)證并遣送回國(guó)。Contractperiod(■■■)Thecontractperiodisfortwo(2)years.Alltheemployeesshallstrictlyfollowthis2years’contractperiod.Otherwise,theEmployeeshallcompensatetotheEmployeraccordingtotherelativeclauseofthisEmploymentContract.本合同雇傭期為兩年,雇員務(wù)必嚴(yán)格遵守。否則,根據(jù)本雇傭合同相應(yīng)條款,給予雇主補(bǔ)償。Uponcompletionofthefirstyear’semployment,theEmployermayattheirabsolutediscretiondecidenottorenewtheworkpermitforthesecondaryyearwithoutgivinganyreasonandwithoutbeingliableforanycompensationtotheEmployee.在第一年雇傭期滿(mǎn)后,雇主根據(jù)工作需要及雇員的工作表現(xiàn),為雇傭辦理工作準(zhǔn)證延期。雇主有權(quán)辭退不合格的雇員,而不需給予原因和補(bǔ)償。IftheEmployeerefusestocomplywiththistwo(2)years’contractperiod,theEmployeeshallberesponsibleforhisownrepatriationcoststohisdomicilecountryandallthecompensationtotheEmployerwhichmaybepaidfromtheEmployee’ssalary.如果雇員在雇傭期內(nèi)拒絕履行為期兩年的雇傭合同,雇員必須自己承擔(dān)相關(guān)遣返費(fèi)用和對(duì)雇主的賠償。該費(fèi)用由雇員從其工資中直接支付給雇主。Uponcompletionofthistwoyear’semployment,itcouldbeextendundertheconsensusbetweentheEmployerandtheEmployee.兩年雇傭期滿(mǎn),如果雇主與雇員雙方同意,可以延長(zhǎng)合同期限。WorkPermit(工作準(zhǔn)證)TheEmployeeshallhandoverhistravel/passportdocumentsandWorkPermittotheEmployerduringtheemploymentintheRepublicofSingaporeforprocessing.雇員在到達(dá)新加坡的雇傭之日起,應(yīng)將其護(hù)照及工作準(zhǔn)證等有關(guān)證件交給雇主保管。Salary(工資)TheEmployee’ssalaryshallbecalculatedstrictlybasedonpieceworksystem.Pieceworksystemshalladoptthefollowingquotarate(S$)whichmayberevisedoradjustedbytheEmployerattheirabsolutediscretionfromtimetotime.AnyrevisionoradjustmentofthepieceworkratesperunitstatedbelowwillbenotifiedtotheEmployeeasandwhenmadeonthegeneralnoticeboardofeachworksiteandavailablefromthesupervisors:Timberformwork4.00-8.00/m2Metalformwork4.00-8.00/m2Rebar50.00-120.00/tonBricklaying2.00—3.50/m2Plastering1.50—3.00/m2Tiling5.00—8.00/m2Concrete3.00—9.00/m2Basedontheabovepieceworksystem,theEmployee’saverageincomeunderfullattendanceduringthisemploymentperiodshallbeS$1350permonthorevenhigher,providedthattheEmployeecanperformhisdutiescompetentlyandefficientlyandcandeliverthequalifiedproductsaccordingtotheEmployer’srequirementsandassignments.雇員在新加坡的工資收入嚴(yán)格按計(jì)件工資制計(jì)算。計(jì)件工資按以下定額單價(jià)(新元為單位)執(zhí)行:木模4.00-8.00/平方米鐵模4.00-8.00/平方米鋼筋50.00-120.00/噸砌磚2.00—3.50/平方米抹灰1.50—3.00/平方米瓷磚5.00—8.00/平方米砼3.00—9.00/平方米雇主將根據(jù)實(shí)際情況對(duì)以上定額單價(jià)進(jìn)行調(diào)整和修改并相應(yīng)通知雇員。在以上定額計(jì)價(jià)體制下,雇員在確保施工質(zhì)量并按時(shí)完成所分配的工作量的情況下,在雇傭合同期內(nèi),全勤雇員的平均每月工資總收入將達(dá)到或超過(guò)1350新元。Health,Safety&GoodFaith(健康、安全與忠誠(chéng))ItshallbethedutyoftheEmployeetotakereasonablecareforhisownhealthandsafetyandthatofotherpersonswhomaybeaffectedbyhisactsoromissionsatworkandtoco-operatewiththeEmployersofarasisnecessarytoperformanydutyortocomplywithanyrequirementonworkplacehealthandsafetyimposedbytheSingaporelawfromtimetotime.雇員有責(zé)任在工作時(shí)采取一切合理的方法照管好自己和可能受到自己行為影響的周?chē)渌藛T的健康與安全,并配合雇主一切必要的健康與安全的措施和/或遵守新加坡法律針對(duì)工作場(chǎng)所而經(jīng)常制定的健康安全要求。TheEmployeemustcomplyfullywithallhealth,safetyorworkregulationsfromtimetotimeintroducedbytheEmployerandnotifiedtotheEmployee.雇員必須完全遵守雇主制定的關(guān)于健康、安全或工作要求等方面的規(guī)定。TheEmployeeshalldevotethewholeofhistime,attentionandskillinhisworkinghourstothecompletehisassignedworkortaskinacompetentandefficientmanner.雇員在工作期間必須全力付出,毫無(wú)保留地用自己的工作技能來(lái)有效地完成雇主所分配的工作內(nèi)容或任務(wù)。TheEmployeeshallnotdirectlyorindirectlycarryonorassistincarryingonorbeemployed,involvedorengagedinanyotherworkorbusinessforanyotherpersoninSingaporeotherthantheEmployerirrespectiveofwhethertheEmployeeispaidorreceivedaremunerationforsuchotherworkorbusiness.雇員不能直接或間接地為除雇主以外的其他任何人從事或涉及任何性質(zhì)的工作或業(yè)務(wù),不管是否從中獲得收益。SicknessorInjury(病假醫(yī)療)EveryEmployeeshallnotifyorarrangesomeonetonotifytheEmployeronthefirstdayofeachabsencefromworkorassoonafterasitispracticableandshallstatethereasonforandexpecteddurationoftheabsence.任何雇員如果不能上班,必須在沒(méi)有上班的第一天或盡可能最早的時(shí)間親自或委托他人通知雇主,并說(shuō)明不能上班的原因及不能上班的預(yù)計(jì)天數(shù)。Wheretheabsenceisduetoillnessorinjury,theEmployeeshallberequiredtoproduce,withoutdemandbytheEmployer,theoriginalmedicalleavecertificatefromanapprovedhospital,polyclinicormedicalclinicattheendofseven(7)days(orsuchotherperiodasisappropriate)fromthestartoftheabsence.如果雇員因生病或受傷不能上班,必須在從沒(méi)有上班的第一天起,7天之內(nèi)(或其他客觀(guān)合理的期限)主動(dòng)向雇主出示經(jīng)新加坡批準(zhǔn)的醫(yī)院或診所等所出具的病假證明,而不需要雇主要求后才出示。TheEmployershallneitherberesponsiblenorliabletopayforanymedicalcharges,feesorexpensesoftheEmployeeinrespecttreatmentforanynonwork-relatedillness,injuryordisabilityoriftheinjury,illnessordisabilityariseoutsidethecourseofemploymentwiththeEmployer,exceptforS$20.00compensationpermonthduringtheemployment.雇員在雇傭期間因非工作性質(zhì)的疾病或受傷而發(fā)生的任何醫(yī)藥費(fèi)或診斷費(fèi)或治療費(fèi)等,雇員都應(yīng)負(fù)責(zé)支付,雇主在其雇傭期內(nèi)可以每月給予20新元的醫(yī)藥費(fèi)報(bào)銷(xiāo)。雇員不是在本雇傭期內(nèi)發(fā)生的疾病或受傷,所涉及的任何醫(yī)藥費(fèi)或診斷費(fèi)或治療費(fèi)等,雇主也不予負(fù)責(zé)承擔(dān)。TheEmployerwillrendersuchreasonableassistancetotheEmployeetomakeaclaimunderthemedicalinsurancecoverageprovidedthattheEmployershallnotbeliabletopayortocompensatetheEmployeeifhisclaimexceedsthelimitoftheinsurancecoverageoriftheclaimisrejectedbytheinsurerforanyreasonwhatsoever.雇主也將為雇員提供合理的協(xié)助,以幫助他們?cè)谝?guī)定的保險(xiǎn)范圍內(nèi)向保險(xiǎn)公司進(jìn)行醫(yī)療索賠。但是,如果該醫(yī)療索賠超過(guò)強(qiáng)制保險(xiǎn)規(guī)定的范圍或保險(xiǎn)公司無(wú)論以任何理由拒絕該索賠,雇主不為此承擔(dān)任何支付或賠償?shù)呢?zé)任。GroupPersonalAccidentInsurance■■■■■■ItshallbemandatoryforeveryEmployeetoparticipateinagrouppersonalaccidentinsuranceprogramprovidedbyaninsurancecompanydesignatedbytheEmployerforanydeath,injuryorincapacitysufferedbytheEmployee,whetherwork-relatedorotherwise,forsolongasheremainsanEmployeeoftheEmployerinSingapore.為保障雇員在雇傭期內(nèi),無(wú)論是否與工作有關(guān)而發(fā)生意外事故致死或受傷或致殘后能夠有所賠償,雇員須參與雇主在新加坡指定保險(xiǎn)公司為雇員投保的一份“人身安全保險(xiǎn)計(jì)劃”。TheEmployeeherebyauthorizetheEmployertoretainS$100-150(orsuchinsurancepremiumfromtimetotimeasdeterminedbytheEmployer)fromtheEmployee’ssalaryeveryyeartopayfortheinsurancepremiumonbehalfoftheEmployeetothedesignatedinsurancecompany.雇員由此授權(quán)雇主每年從工資里保留100-150新元作為保費(fèi)并由雇主代為支付給指定的保險(xiǎn)公司。IndustrialAccident(工傷處理)IftherewasanindustrialaccidenthappenedintheEmployer’sconstructionsiteanditisreportabletoMinistryofManpower,theEmployeeshouldinformtherepresentativesoftheEmployerandtheSafetyOfficer(WorkplaceSafety&HealthOfficer-WSHOfficer)oftheMaincontractorduring24hoursoftheaccidenthappened.ThentheEmployercouldassisttheEmployeetomakeaclaimunderworkmencompensationpolicytocoverhisinjuryanddisability.如果雇員確實(shí)在雇主的工地發(fā)生工傷并需通報(bào)人力部,應(yīng)在24小時(shí)內(nèi)通知雇主的代表和主包的安全官,雇主根據(jù)相關(guān)程序協(xié)助雇員進(jìn)行工傷索賠,以保護(hù)雇員因工作而導(dǎo)致的受傷或傷殘等。TheEmployeeagreesandundertakesto:(雇員同意并承諾:)givewrittennoticeofanyinjuryorillnesssufferedbytheEmployeeinanyindustrialaccidentduringthecourseofhisemploymentonthedayoftheindustrialaccidentitselforassoonafterasitispracticable(notmorethanthreedays)totheEmployer;在工傷或工作疾病發(fā)生的當(dāng)天或盡可能最早的時(shí)間內(nèi)(不超過(guò)三天),■■通知雇主;fullyco-operatewithanyinvestigationintotheindustrialaccidentcarriedoutorconductedbytheEmployer;全力配合雇主為此工傷所進(jìn)行的調(diào)查;givefullandfrankdisclosuretotheEmployerofallinformationandcircumstancesconcerningtheindustrialaccidentandtoidentifyanddisclosethenameofalleyewitnesses,ifany.全面而真實(shí)地告訴雇主所有與該工傷有關(guān)的信息和當(dāng)時(shí)的工作環(huán)境。如果有目擊證人,必須全部列出;TheEmployeemuststrictlycomplywithalltheEmployer’srulesandregulationsinrespectofindustrialaccidentstatedinAnnexAfailingwhichtheEmployermayattheirabsolutediscretiontakeappropriatedisciplinaryaction.雇員發(fā)生工傷后,必須嚴(yán)格遵守雇主為工傷管理制定的相關(guān)規(guī)章制度(詳見(jiàn)附件A)。如果違犯,雇主將采取一切合適的紀(jì)律處罰措施。Employee’sSavingsScheme(雇員托存款)TheEmployeeherebyirrevocablyandunconditionallyauthorizestheEmployertoretainasumofmoneyfromhissalaryeverymonthascompulsorysavingfortheEmployeeinthefollowingmanner:雇員特此授權(quán)雇主按照以下方式每月從其工資中留存部分?jǐn)?shù)額作為必需的托存款。本授權(quán)不可撤回和無(wú)條件執(zhí)行。TheEmployeeherebyirrevocablyauthorizesandempowerstheEmployertodealwiththecompulsorysavingoftheEmployeeinthefollowingorderofpriority:雇員特此授權(quán)雇主按照以下優(yōu)先順序處理以上必需的托存款。本授權(quán)不可撤回和無(wú)條件執(zhí)行。topayincometax,ifany,imposedontheEmployeebytheSingaporetaxauthority;支付新加坡政府要求的個(gè)人所得稅(如果有);topayanyindebtednesshowsoeverarisingduefromtheEmployeetotheEmployerwhichmayincludebutnotlimitedtoaccommodationand/orutilitiesservicesprovided,medicalfees/chargespaidbytheEmployeronbehalfoftheEmployee(ifany),advancesorloansoradjustmentofover-paymentofsalary(ifany),repatriationcostsoranylossanddamagesufferedbytheEmployerarisingfromanybreachoftheemploymentcontractbytheEmployee支付雇主以下費(fèi)用(但不限于):住宿水電費(fèi);雇主代雇員墊付的本應(yīng)由雇員自己承擔(dān)的醫(yī)療費(fèi)(如果有);雇員借款或雇主預(yù)發(fā)或多發(fā)的工資(如果有);雇員違犯雇傭合同相關(guān)條款而給雇主造成的損失(如果有)等。Repatriation(送返)Uponthesuccessfulcompletionofthistwo(2)years’employmentcontractbytheEmployeewithoutcommittinganybreachoftheemploymentcontract,theEmployerundertakestobeartheair-ticketcostsoftheEmployeetohisdomicilecountryprovided.Andthearrivalplaceshouldbedecidedbytheemployer.Thetransportfeefromairportinhisdomicilecountrytotheoriginalresidentialplaceshallbebornbytheemployeehimself.雇員完整履行兩年的雇傭合同后,雇主將負(fù)責(zé)安排機(jī)票,將雇員送回國(guó)。但降落機(jī)場(chǎng)由雇主根據(jù)當(dāng)時(shí)的實(shí)際情況決定,從國(guó)內(nèi)機(jī)場(chǎng)至國(guó)內(nèi)居住地的交通費(fèi)由雇員承擔(dān)。TerminationGenerally(終止合同)IftheEmployeeterminatestheemploymentcontractatanytimebeforetheexpiryofthistwo-yearcontractduetohisownvolition,orhisneglect,defaultormisconductoriftheEmployeeisdeportedbytheSingaporeauthorityduetohisowndefaultorneglectoriftheworkpermitoftheEmployeeiscancelledorcannotberenewedduetothedefaultorneglectoftheEmployee,theEmployeeshallbeliableforthelossoftheemployer’s.ThedetailspleaserefertoAnnexA.如果雇員在兩年合同期滿(mǎn)之前任何時(shí)候主動(dòng)終止合同,或由于雇員不能勝任工作或違規(guī)犯錯(cuò)或不正當(dāng)行為而導(dǎo)致被雇主解雇或被新加坡政府驅(qū)逐出境或準(zhǔn)證不能延長(zhǎng)等,在此情況下,雇員必須賠償雇主。具體細(xì)節(jié)參照附件A.ReturnoftheEmployer'sbelongings(歸還雇主財(cái)物)OncethisContractwasterminated,theEmployeemustreturnallthebelongingsoftheEmployer’s.在雇傭關(guān)系終止的同時(shí),雇員必須歸還產(chǎn)權(quán)屬于雇主或由雇主提供的一切財(cái)物。Terminationformedicalreasons(IfthehealthoftheEmployee,ascertifiedbythemedicalpractitioner,issoimpairedand/orisunfittocarryonwithhisassignedtrade/taskundertheemploymentcontractwithoutanydefaultorneglectonthepartoftheEmployee,theEmployerreservestherighttoterminatethisemploymentagreementwithoutbeingliableforanycompensationtotheEmployee.經(jīng)醫(yī)生證明,雇員因病不能適合正常工作,雇主有權(quán)終止合同。DisciplinaryRules(紀(jì)律處分)TheEmployeemustatalltimesstrictlyobserveallthetermsandconditionsoftheemploymentcontract,includingbutnotlimitedtoalltherulesandregulationsoftheEmployersetoutinAnnexAwhichmaybeamended,revisedormodifiedbytheEmployerfromtimetotimeandanysuchamendments,revisionsormodificationsshallcontinuetobindtheEmployeeaccordinglyuponnotificationtotheEmployeefromhissupervisorand/orpostedonthenoticeboardatthegeneralofficeoftheworksite.雇員必須嚴(yán)格遵守本合同條款,包括附件A中雇主制定的各項(xiàng)規(guī)章制度等。雇主將根據(jù)實(shí)際情況對(duì)附件A中的內(nèi)容進(jìn)行修改、完善和增補(bǔ)等并將相關(guān)內(nèi)容通知雇員,而這些修改和增補(bǔ)的內(nèi)容及通知和或/張貼在工地上的通知內(nèi)容等也同樣對(duì)雇員具有約束力。Incasesofseriousmisconductorincompetence,theEmployeemaybedismissedwithoutanyperiodofpriornoticeorwarning.Inothercases,theEmployeewillbegivenanoralwarninginthecaseoffirstoffenceandawrittenwarninginthecaseofasubsequentoffencebeforebeingdismissed.如果雇員有嚴(yán)重不當(dāng)行為或嚴(yán)重不能勝任工作,雇主將即刻解雇雇員而不需要提前警告或通知。但在一般違規(guī)情況下,雇主將第一次口頭警告和第二次書(shū)面警告,在此之后雇員如果繼續(xù)再犯,將被解雇。TheEmployeemaybesuspendedfromemploymentwithoutpayasanalternativetodismissalorduringtheinvestigationofanyallegedmisconductorincompetence.作為雇主終止合同的替代辦法,雇主可對(duì)雇員處以停工,或在調(diào)查雇員不當(dāng)行為或不能勝任工作的具體情況期間要求雇員停工。在停工期間雇員沒(méi)有工資。TheEmployermaytakesomedisciplinaryactionotherthandismissalsuchassuspensionwithoutpay,demotion,withdrawalorsuspensionofsubsidizedaccommodation,foodandutilitiesservices,transfertosomeotherplaceortypeofworkorlossofallowances,privileges,etc.雇主對(duì)違規(guī)雇員除采取解雇的處罰方式以外,還可以對(duì)其處以紀(jì)律處分,譬如無(wú)薪停工,降級(jí),取消住宿、水電及設(shè)施津貼,調(diào)換工地或工作性質(zhì),取消各項(xiàng)津貼或待遇等。Withoutprejudicetothegeneralityoftheaboveandwithoutsettingoutacomprehensivedefinitionoftheexpression,seriousmisconductbytheEmployeemayinclude:一般情況下,雇員嚴(yán)重不當(dāng)行為主要包括:theftorreasonablesuspicionoftheftorothercriminaloffence偷竊或任何違法行為-breachesofworkplacesafetyandhealthrulesandregulations違反工地健康及安全條規(guī)breachesoffireandsafetyregulations違反消防及安全條規(guī)smokinginanareanotdesignatedforsmoking在禁煙區(qū)域吸煙assault,fighting,strike,rioting,disorderlybehaviour,gambling,immoralactivityorprostitutionnearoronthepremi
