14、ste and linters, etc.· 棉花廢料:加工或使用棉花過程中產(chǎn)生的下腳回收廢料等。Cotton Waste: leftover and/or recycling waste left during the processing or use of the cotton.· 欺詐棉包：單個(gè)棉包中：含有與棉花完全無關(guān)的非棉物質(zhì)；里面含有污染棉花，但從棉包外部或可看出或看不出來；好棉花在外面，次棉花包在里面，以免在常規(guī)檢查中被發(fā)現(xiàn)；有一定數(shù)量的無紡用價(jià)值棉花。False Packed Bale: cotton in a single bale: containin

15、g substances entirely foreign to cotton; containing damaged cotton in the interior with or without any indication of such damage upon the exterior; composed of good cotton upon the exterior and decidedly inferior cotton in the interior, in such a manner as not to be detected by customary examination

16、; or containing a certain amount of no spinning value cotton.· 混雜棉包：單個(gè)棉包中含有一定數(shù)量不同品級、不同長度或不同顏色類型的棉花。Mixed Packed Bale: a bale containing a certain amount of different grades, staples or colors of cotton.· 溢短裝率：到岸重量超出或少于合同規(guī)定重量的部分占合同總重量的百分率。Weight Tolerance Ratio: the percentage of the part o

17、f the CIQ landed weight exceeding or shorter than the weight provided by the Contract against the total contract weight.· 棉包密度：采用通用棉包密度，是指根據(jù)國際標(biāo)準(zhǔn)化組織ISO第8115-1986（E）的規(guī)定，一個(gè)貨包長度在1060-1400毫米，寬度540毫米，高度700-950毫米。Bale Density: Universal Bale Density as determined by the International Standards Organiz

18、ation ISO Reference No. 8115-1986 (E) is a bale with the nominal dimensions of 1060 to 1400 mm in length by 540 mm in width and 700-950 mm in height.2包裝2 Packing適合于海運(yùn)的緊縮機(jī)出口包裝，外裹棉布或其他不能產(chǎn)生異性纖維的包裝，捆扎牢固，包裝完整。如果使用容易產(chǎn)生異性纖維的包裝材料包裝棉花，則賣方須承擔(dān)全部清理異性纖維的費(fèi)用。棉花須以通用密度壓縮貨包的形式供貨。Compressed export packing suitable for

19、 voyage, outside wrapped by cotton cloth or other packing materials that do not contain foreign matters, tightly and completely packed. If any packing materials that may easily produce foreign matters are used to pack the cotton, the Seller shall bear all the expenses for the cleaning of foreign mat

Contract Number若嘜頭不清，由此而產(chǎn)生的混嘜理貨費(fèi)由賣方承擔(dān)。If the marks are not clear, all the expenses arising from sorting the mixed mark bales shall be borne by the Seller.4裝船通知4 Shipment Notice4.1 如為FOB成交:賣方應(yīng)在收到船公司的裝運(yùn)通知后48小時(shí)，通知買方合同號、品級、長度級或小樣型

22、號、包裝、凈重、金額；裝船日期、裝船口岸、目的港和預(yù)計(jì)到港日期，并航寄、 或電子的形式將裝船單據(jù)副本一式三份給買方。4.1 Under FOB terms: the Seller shall notify the Buyer by telegraph, fax or of the contract number, grade, staple or type, packing, net weight, and price; as well as shipment date, shipment port, destination port and estimated arrival date wi

23、thin 48 hours after notification from the shipping line and mail, fax or three copies of the duplications of the loading documents to the Buyer.4.2 如為CFR/CIF成交:賣方應(yīng)在收到船公司的裝運(yùn)通知后48小時(shí)，通知買方船名、船齡(老船賣方要付超齡加保費(fèi))、船旗、裝船日期、裝船口岸、目的港、合同號、提單號、總金額、毛重、凈重。4.2 Under CFR/CIF terms: the Seller shall notify the Buyer of

24、the ship name, ship age (for aged ship the Seller shall pay the over-age extra premium), ship flag, shipment date, shipment port, destination port, contract number, number of the bill of lading, total price, gross weight and net weight within 48 hours after the shipment notification from the shippin

25、g line.4.3 如賣方未按上述4.1、4.2款規(guī)定通知買方，以致買方未能與時(shí)購買保險(xiǎn)，由此而產(chǎn)生的損失由賣方負(fù)擔(dān)。4.3 If the Seller fails to notify the Buyer by telegraph, fax or as provided in above Article 4.1 and Article 4.2 and thus the Buyer is unable to purchase the insurance in time, all the losses arising therefrom shall be borne by the Seller.

26、5單據(jù)5 Documents在開證時(shí)，賣方需向議付行，不開證時(shí)需向買方指定的銀行提供下列單據(jù)：The Seller shall provide the following documents for the negotiating bank in the event of issuing a letter of credit or the bank designated by the Buyer when not issuing a letter of credit:5.1 商業(yè)發(fā)票、裝箱單正本和副本各三份,詳細(xì)注明信用證號、合同號。5.1 Three originals and three

27、copies of the original commercial invoice and packing list, specifying the letter of credit number and contract number in details;5.2 逐包或逐集裝箱過重的重量碼單一式二份。5.2 Two copies of weight memo by weighing the bales or containers one by one;5.3 全套可轉(zhuǎn)讓的清潔海運(yùn)提單正本和副本各三份。5.3 Three originals and three copies of the f

28、ull set of the clean bill of lading;5.4 賣方給買方的裝船通知副本一份。5.4 One copy of the shipment notification from the Seller to the Buyer;5.5 在CIF條款下,保險(xiǎn)單正本和副本各一份。5.5 One original and one copy of the certificate of insurance under CIF terms;5.6 產(chǎn)地證明、植物檢疫證明和非木質(zhì)包裝證明正本和副本各一份。5.6 One original and one copy of the cer

29、tificate of origin, phytosanitary certificate, and non-wooden packing certificate.6 付款方式6 Payment Method6.1 在雙方約定以信用證為付款方式時(shí)，在合同規(guī)定的最晚裝運(yùn)日前30天，由買方通知開戶銀行開出以賣方為受益人的不可撤銷的信用證，憑第5項(xiàng)單據(jù)條款規(guī)定的單據(jù)電匯付款。信用證的容應(yīng)與合同規(guī)定相符。信用證的到期日為最晚裝運(yùn)日后的第21天。6.1 In the event that the parties hereto agree to make payment by letter of cred

30、it, the Buyer shall cause the opening bank to issue an irrevocable letter of credit in favor of the Seller within 30 days prior to the latest shipment date provided by the Contract, and the payment shall be made by wire on the basis of the documents provided in Article 5-Documents. The content of th

31、e letter of credit shall be consistent with the terms and conditions of the Contract. And the expiry date of the letter of credit shall be the 21st day after the latest shipment date.6.2 在雙方約定以憑單托收為付款方式時(shí)，買方憑第5項(xiàng)單據(jù)條款規(guī)定的全套單據(jù)，由買方指定的銀行按發(fā)票金額付款。6.2 In the event that the parties hereto agree on documents ag

32、ainst payment, the bank designated by the Buyer shall make the payment at the invoice amount on the basis of whole set of documents that are provided in Article 5-Documents.7 到貨檢驗(yàn)7 Inspection Upon Delivery7.1 檢驗(yàn)機(jī)構(gòu)7.1 Inspection Institution貨物到目的地后由CIQ檢驗(yàn)，其出具的重量檢驗(yàn)證書（包括對欺詐棉包和混雜棉包的認(rèn)定）和質(zhì)量檢驗(yàn)證書（如有殘破還應(yīng)出具殘損證書

33、），作為買賣雙方結(jié)算和索賠的依據(jù)。CIQ will conduct inspections after the goods arrive at the destination and issue the weight inspection certificate (including the confirmation of false packed bale and mixed packed bale) and the quality inspection certificate (such as the damage certificate if the cotton is damaged)

34、, which shall be the basis for the settlement and claims between the Seller and the Buyer.7.2 重量檢驗(yàn)7.2 Weight Inspection根據(jù)實(shí)際到貨情況，CIQ將采用逐包過重或用地衡以一個(gè)集裝箱為單位過重，出具重量檢驗(yàn)證書，按實(shí)際凈重結(jié)算。In accordance with the actual delivery circumstance, CIQ will scale the weight of each bale or weigh by container with land scale

35、, issue the weight inspection certificate and make the settlement by actual net weight.皮重：根據(jù)數(shù)量的多少、包裝類型的差異，CIQ將從每批貨中隨機(jī)抽取(1-5)%的包數(shù)，以加權(quán)平均確定平均皮重。按實(shí)際平均皮重計(jì)算到岸凈重。Tare Weight: in accordance with the quantity and package type, CIQ will sample(1-5)% bales from each lot of cotton and compute the average tare w

36、eight by weighted average. And calibrate the net weight upon arrival at the port based on the actual average tare weight.買賣雙方均可派代表（須憑授權(quán)委托書）到現(xiàn)場察看稱重、扦樣過程，賣方應(yīng)在貨物到達(dá)目的地前通知買方，買方應(yīng)予必要協(xié)助。Both the Seller and the Buyer may assign representatives (with a power of attorney) to the site for the purposes of observ

37、ing the weighing and sampling process, and the Seller shall notify the Buyer of the same prior to the goods arriving at the destination, and the Buyer shall provide necessary assistance.7.3質(zhì)量檢驗(yàn)7.3 Quality Inspection抽樣：品級、長度：從每批棉包中隨機(jī)抽樣10；馬克隆值和強(qiáng)度：從品級、長度抽取的樣品中隨機(jī)抽取其樣品總量的一半，作為馬克隆值和強(qiáng)力的檢驗(yàn)樣品。Sampling: grade

39、utcome of sensory evaluation shall prevail.7.4復(fù)驗(yàn)7.4 Re-inspection重量不復(fù)驗(yàn)。報(bào)驗(yàn)人對CIQ質(zhì)量檢驗(yàn)結(jié)果有異議的，可在收到檢驗(yàn)結(jié)果之日起15日，向做出檢驗(yàn)結(jié)果的CIQ或者國家質(zhì)量監(jiān)督檢驗(yàn)檢疫總局申請復(fù)驗(yàn)。復(fù)驗(yàn)只對抽取留存的樣品，復(fù)驗(yàn)結(jié)果為最終依據(jù)。No weight re-inspections.
