5、政機關(guān)公務(wù)員處分條例、森林防火條例、河南省 森林防火條例 實施辦法等法律法規(guī)和國務(wù)院關(guān)于特大安全事故行政責任追究的 規(guī)定及河南省森林火災(zāi)應(yīng)急預(yù)案等有關(guān)規(guī)定，結(jié)合我省實際， 制定本辦法。第二條 本辦法適用于全省各級行政機關(guān)和法律、法規(guī)授權(quán)的具有 管理公共事務(wù)職能的組織以及國家行政機關(guān)依法委托的組織中工勤人 員以外的工作人員，企業(yè)、事業(yè)單位、社會團體中由國家行政機關(guān)以 委任、派遣等形式任命的人員。第三條對違反本辦法的個人和單位，有關(guān)單位可以按照下列規(guī)定追究其責任：（一）誡勉談話；（二）責令作由書面檢查；（三）通報批評；（四）組織處理；（五）行政問責；（六）依法給予行政紀律處分；（七）依法給予行政處

6、罰；（八）依法追究刑事責任。前款規(guī)定可以單獨或者合并使用。受到責任追究的，取消年度評優(yōu)評先資格。第四條 森林防火工作實行各級人民政府行政首長負責制。各級人 民政府及其有關(guān)行政部門、單位的法定代表人或主要負責人是本行政 區(qū)、本部門或本單位森林防火工作的第一責任人，對森林防火工作負 主要領(lǐng)導(dǎo)責任；各級人民政府及其行政部門和單位分管森林防火工作 的負責人，對森林防火工作負直接領(lǐng)導(dǎo)責任；各單位明確的森林防火 責任人，對本單位的森林防火安全負直接責任。第五條縣級以上各級人民政府負責本行政區(qū)域內(nèi)的森林防火工作，履行下列森林防火職責：（一）宣傳和貫徹實施森林防火法律、法規(guī)、規(guī)章，增強公民的森林防火安全意識；

7、（二）建立健全森林防火機構(gòu)，核定并編制配備專職人員負責日常工作；（三）將森林防火基礎(chǔ)設(shè)施建設(shè)列入當?shù)貒窠?jīng)濟和社會發(fā)展規(guī)劃， 納入當?shù)亓謽I(yè)發(fā)展總體規(guī)劃，使森林防火工作與維護生態(tài)安全和社會 經(jīng)濟發(fā)展相適應(yīng)；（四）將森林火災(zāi)預(yù)防和撲救經(jīng)費列入當?shù)毓藏斦A(yù)算，保障森林防火工作的經(jīng)費投入；（五）凡國家一級、二級和省重點火險縣， 必須建立專業(yè)森林消防隊；（六）凡有森林防火任務(wù)的縣（市、區(qū)） ，必須儲備滿足森林防火任務(wù)需要的森林防火物資；（七）將森林防火工作納入議事日程，及時分析森林防火工作情況，研究解決森林防火工作中存在的重大問題；（八）重大節(jié)假日以及森林火災(zāi)多發(fā)季節(jié)，應(yīng)當組織進行森林防火檢查，采取有

17、、 （八）、 （九）、（十）、 （十一） 、 （十二）等項職責。第六條縣級以上人民政府護林防火指揮部及其辦公室對本行政區(qū)域內(nèi)的森林防火工作實施監(jiān)督管理，履行下列森林防火職責： （一）檢查和監(jiān)督國家森林防火工作的方針、政策、法規(guī)和重大行政 措施的執(zhí)行情況，森林防火責任制的落實情況；制定本轄區(qū)森林防火工作總體規(guī)劃，指導(dǎo)本轄區(qū)的森林防火工作； （二）對執(zhí)行森林防火責任制不力的地方政府和部門，提出責任追究的建議； （三）加強森林防火產(chǎn)品監(jiān)督，按照法定時限對森林防火基礎(chǔ)設(shè)施建設(shè)工程進行驗收； （四）組織監(jiān)督和管理森林防火工作經(jīng)費和各類防火物資的儲備調(diào)配使用； （五）依法開展森林防火檢查，督促本轄區(qū)各部門

30、省人民政府各行政部門，應(yīng)當按照各自的職責分工，做好森林防火工作。（一）省政府辦公廳負責組織召開火災(zāi)撲救中的緊急會議，向國務(wù)院報送有關(guān)材料和文件。（二）省林業(yè)廳負責指導(dǎo)包括自然保護區(qū)、森林公園、國有林場等所有林地的森林火災(zāi)預(yù)防和撲救工作，監(jiān)督檢查各省轄市、縣（市、區(qū)）和林區(qū)各單位森林防火和森林火災(zāi)撲救工作，組織實施省森林火災(zāi)應(yīng) 急預(yù)案演練，并履行省人民政府護林防火指揮部辦公室職責。（三）省公安廳負責組織公安機關(guān)協(xié)助搞好災(zāi)區(qū)治安管理和安全保衛(wèi) 工作，維持火場治安秩序，及時查處森林火災(zāi)肇事者。必要時協(xié)調(diào)公 安消防部隊參與滅火。（四）省發(fā)展改革委員會負責涉及省級森林防火和森林火災(zāi)撲救的基 礎(chǔ)建設(shè)項目審

31、批，并將其納入基本建設(shè)計劃；協(xié)調(diào)應(yīng)急物資的儲存、 調(diào)撥和緊急供應(yīng)工作。（五）省財政廳負責籌措解決森林火災(zāi)撲救工作經(jīng)費。要將森林防火 基礎(chǔ)設(shè)施、撲火隊伍裝備、撲火物資儲備（供應(yīng)）以及災(zāi)后重建等所 需資金列入同級財政預(yù)算。（六）省人力資源和社會保障廳參與對各部門、各單位和人員在火災(zāi) 撲救中職責履行情況的監(jiān)督檢查，負責獎勵火災(zāi)撲救有功人員。（七）省住房和城鄉(xiāng)建設(shè)廳負責指導(dǎo)風景名勝區(qū)森林防火基礎(chǔ)設(shè)施建設(shè)、森林防火安全管理及發(fā)生森林火災(zāi)時的人員疏散等工作。（八）省旅游局負責組織指導(dǎo)旅游區(qū)和旅行社森林防火安全知識教育， 將森林防火安全知識納入導(dǎo)游提示游客內(nèi)容；發(fā)生森林火災(zāi)時督促旅 游區(qū)組織人員疏散。（九）

45、益廣告等形式開展森林防火安全教育；遇到三級以上火險天氣時，在省電視臺、廣播電臺播報火險等級預(yù)報。（十四）省通信管理局負責組織通信聯(lián)絡(luò)，確保火災(zāi)現(xiàn)場的通信網(wǎng)絡(luò)暢通。（十五）省監(jiān)察廳負責對不落實政府行政首長負責制、省人民政府護林防火指揮部成員單位責任制和火災(zāi)撲救中失職瀆職行為的單位和個人實施責任追究。（十六）省衛(wèi)生廳負責組織醫(yī)務(wù)人員趕赴火場實施現(xiàn)場醫(yī)療救護，做好災(zāi)區(qū)衛(wèi)生防疫。遇有大批重危傷員時，組織、協(xié)調(diào)現(xiàn)場急救和轉(zhuǎn)診救治工作。（十七）省科技廳負責組織協(xié)調(diào)撲火高新技術(shù)及手段的研究和推廣應(yīng)用，提高撲救效率。（十八）省商務(wù)廳負責組織火災(zāi)撲救生活必需品的應(yīng)急供應(yīng)。（十九）省教育廳負責做好林區(qū)學(xué)校師生預(yù)防
