1、房屋租賃合同 出租方(甲方): Lessor (Party A): 承租方(乙方): Lessee (Party B): 居間方(丙方):上海德佑房地產(chǎn)經(jīng)紀(jì)有限公司Intermediary party (Party C): Shanghai Deovolente Realty Co., Ltd.根據(jù)中華人民共和國(guó)合同法、上海市房屋租賃條例等相關(guān)法律法規(guī)的規(guī)定,甲、乙雙方經(jīng)丙方居間介紹,在平等、自愿、公平和誠(chéng)信的基礎(chǔ)上,經(jīng)協(xié)商一致,就乙方承租甲方的房屋事宜,簽訂本合同,以資共同遵守:This Contract is made by Party C and between both parties

2、 after negotiation on an equal, voluntary, fair and good-faith basis in accordance with “Contract Law of the Peoples Republic of China”, “Shanghai Municipality Regulations on the Leasing of Building Premises” and other relevant laws and regulations, with regard to the issue that Party B will rent th

3、e house of Party A:一、出租房屋基本情況:(下稱“該房屋”,實(shí)際情況以權(quán)屬證明或相關(guān)法律文書的記載內(nèi)容為準(zhǔn))I. Usage of the rented premises 乙方向甲方承諾,租賃該房屋作為 (居住 辦公 生產(chǎn) 倉(cāng)儲(chǔ) 其他 )使用,并遵守國(guó)家和本市有關(guān)于房地產(chǎn)使用和物業(yè)管理的規(guī)定。Party B shall make commitment to Party A that the premises shall be used as ( Resi

13、 rent ( includes excludes) the fees on the leasing invoices issued by Party A.五、保證金(押金)和其他費(fèi)用V. Guarantee deposit (security deposit) and other fees5.1 甲乙雙方約定,在(交房 簽訂本合同)時(shí),乙方應(yīng)向甲方支付房屋租賃保證金(押金),保證金(押金)為 個(gè)月的租金,即(人民幣美元 ) 元(大寫 萬(wàn) 仟 佰 拾 元整)。甲方收取該保證金(押金)后應(yīng)向乙方出具收款憑證。租賃關(guān)系終止時(shí),甲方收取的房屋租賃保證金(押金)除用于抵充本合同約定由乙方承擔(dān)的費(fèi)用外,

14、剩余部分無(wú)息歸還乙方。5.1 Both parties have agreed that at the time of ( handover of the premises signing this Contract), Party B shall pay Party A the guarantee deposit (security deposit) of the premises, which is equivalent to the rent of month(s), that is, ( RMB USD ) (Say Only). Upon receiving the guarante

15、e deposit (security deposit), Party A shall issue the receipt voucher to Party B. At the time of the termination of leasing relation, the guarantee deposit (security deposit) collected by Party A shall be used to offset the fees undertaken by Party B as agreed in this Contract and the remaining port

16、ion shall be returned to Party B without interest. 5.2 租賃期間內(nèi)發(fā)生的水費(fèi)、電費(fèi)、煤氣費(fèi)、電話(通訊)費(fèi)、電視收視費(fèi)等房屋使用費(fèi)用由乙方承擔(dān);物業(yè)管理費(fèi)由(甲方 乙方)承擔(dān)。 5.2 The cost arising from water, electricity, gas, telephone call (communication) and TV and so on(或 etc.) during the leasing period shall be undertaken by Party B; property management

17、 fee shall be undertaken by (Party A Party B).六、房屋使用要求和維修責(zé)任VI. House use requirements and maintenance responsibility6.1 租賃期間,乙方發(fā)現(xiàn)該房屋及其附屬設(shè)施有損壞或故障時(shí),應(yīng)及時(shí)通知甲方修復(fù);甲方應(yīng)在接到乙方通知后的 日內(nèi)進(jìn)行維修。逾期不維修的,乙方可代為維修,費(fèi)用由甲方承擔(dān)。6.1 During the leasing period, if Party B discovers any damage or trouble with the premises and the a

18、ccessory facilities, Party B shall timely notify Party A for repair; Party A shall carry out the repair within day(s) after receiving the notification. In case of delay of repair, Party B may make the repair in place of Party A at the cost of Party A.6.2 租賃期間,乙方應(yīng)合理使用并愛(ài)護(hù)該房屋及其附屬設(shè)施。因乙方使用不當(dāng)或不合理使用,致使該房屋及

19、其附屬設(shè)施損壞或發(fā)生故障的,乙方應(yīng)負(fù)責(zé)維修。乙方拒不維修的,甲方可代為維修,費(fèi)用由乙方承擔(dān)。6.2 During the leasing period, Party B shall make reasonable use of the premises and the accessory facilities. Any damage or trouble arising from improper use or unreasonable use of the premises and accessory facilities shall be repaired by Party B. In t

20、he event that Party B refuses the repair, Party A may carry out the repair in place of Party B at the cost of Party B.6.3 租賃期間,甲方應(yīng)保證該房屋及其附屬設(shè)施處于正常的可使用和安全的狀態(tài)。甲方對(duì)該房屋進(jìn)行檢查、養(yǎng)護(hù),應(yīng)提前 日通知乙方。檢查養(yǎng)護(hù)時(shí),乙方應(yīng)予以配合。甲方應(yīng)減少對(duì)乙方使用該房屋的影響。6.3 During the leasing period, Party A shall ensure normal availability and safe status o

21、f the premises and accessory facilities. If Party A intends to carry out inspection and maintenance on the premises, Party A shall notify Party B days in advance. During the inspection and maintenance, Party B shall provide coordination. Party A shall minimize the influence on the use of the premise

22、s. 6.4 乙方需裝修或者增設(shè)附屬設(shè)施和設(shè)備的,應(yīng)事先征得甲方的書面同意,按規(guī)定須向有關(guān)部門報(bào)批的,則應(yīng)由(甲方 甲方委托乙方)報(bào)請(qǐng)有關(guān)部門批準(zhǔn)后,方可進(jìn)行。乙方增設(shè)的附屬設(shè)施和設(shè)備的歸屬及其維修責(zé)任由甲、乙雙方另行書面約定。6.4 In case that Party B intends to decorate the premises or add accessory facilities and equipments, Party B shall obtain written permission from Party A in advance; if it is required s

23、o, ( Party A Party B entrusted by Party A) shall submit such behavior to the competent department for approval before the implementation. The ownership and maintenance of the accessory facilities and equipments added by Party B shall be additionally agreed by both parties in written form. 七、房屋返還與續(xù)租V

House return and renting renewal7.1 乙方應(yīng)在本合同的租賃期限屆滿之后的 日內(nèi)返還該房屋,未經(jīng)甲方同意逾期返還該房屋的,每逾期一日,乙方應(yīng)以日租金的 %向甲方支付該房屋占用期間的使用費(fèi)。7.1 Party B shall return the premises within days after the termination of the leasing period, and in case of any delay for the return of the premises without permission of Party A, Part

25、y B shall pay Party A the use fee of the premises at the daily rate equivalent to % of daily rent during the occupation of the premises.7.2 乙方如果需要續(xù)租的,應(yīng)在租賃期限屆滿兩個(gè)月之前向甲方提出,甲方同意的,雙方另行簽訂相關(guān)續(xù)租文書。乙方在同等條件下享有優(yōu)先承租權(quán)。7.2In case that Party B wants to renew the Contract, Party B shall raise the renewal intention t

26、o Party A two months before the termination of the leasing period, and with the approval of Party A, the renewal contract will be additionally signed between both parties. Under the equivalent condition, Party B shall have the priority for obtaining the lease.7.3 租賃期限屆滿,甲乙雙方未續(xù)簽租賃合同,乙方繼續(xù)支付租金,甲方未表示拒絕的

27、,則按法律相關(guān)規(guī)定,雙方之間成立不定期租賃關(guān)系。在不定期租賃關(guān)系中,甲方有權(quán)提前一個(gè)月通知乙方租賃關(guān)系終止。7.3After the termination of the leasing period, if no renewal contract is signed by both parties and Party B continues paying the rent, which is not refused by Party A, the non-fixed-term leasing relations are established between both parties acc

28、ording to relevant laws and regulations. During such non- fixed-term leasing relations, Party A shall have the right to terminate the leasing relations by notifying Party B one (1) month in advance.7.4 乙方返還該房屋應(yīng)符合正常使用后的狀態(tài)。返還時(shí),應(yīng)經(jīng)甲方驗(yàn)收認(rèn)可,并相互結(jié)清各自應(yīng)當(dāng)承擔(dān)的費(fèi)用。7.4The premises returned by Party B shall be consis

29、tent with the status after normal use of the premises. Upon return of the premises, Party B shall inspect the premises before its acceptance and the relevant fees for respective parties shall be settled. 八、轉(zhuǎn)租與轉(zhuǎn)讓VIII. Sublease and transfer8.1 除甲方已經(jīng)在本合同中同意乙方轉(zhuǎn)租外,乙方在租賃期限內(nèi),需事先征得甲方的書面同意,方可將該房屋部分或全部轉(zhuǎn)租給他人。但

30、原始戶型同一間居住房屋,不得分割轉(zhuǎn)租。8.1Except that Party A agrees in this Contract that the premises may be subleased by Party B, Party B shall not sublease part or all of the premises to any other person within the leasing period, without written permission of Party A. Anyhow one living room in the original househo

31、ld type shall not be separated for subleasing.8.2 在租賃期限內(nèi),甲方如需出售該房屋,應(yīng)提前兩個(gè)月通知乙方。乙方在簽署本合同之時(shí),已確認(rèn)放棄優(yōu)先購(gòu)買權(quán)。8.2 During the leasing period, if Party A wants to sell the premises, Party A shall notify Party B two (2) months in advance. Party B confirmed the waiver of the preemption of the premises at the time

32、 of signing this Contract.九、解除合同的條件IX. Conditions for contract cancelation9.1 甲乙雙方同意在租賃期限內(nèi),有下列情形之一的,本合同終止,雙方互不承擔(dān)責(zé)任:9.1 Both parties agree that during the leasing period, this Contract shall be terminated neither party needing to assuming any responsibility in case of any of the following situations;

33、(一)該房地產(chǎn)占用范圍內(nèi)的土地使用權(quán)依法提前收回的;(1) The use right of the land occupied by the real estate has been legally retrieved;(二)該房地產(chǎn)因社會(huì)公共利益被依法征用的;(2) The premises are occupied by means of legal requisition due to social and public interests;(三)該房地產(chǎn)因城市建設(shè)需要被依法列入房屋拆遷許可范圍內(nèi)的;(3) This real estate has to be legally put

34、into the dismantling range due to urban construction;(四)該房屋毀損、滅失或者被鑒定為危險(xiǎn)房屋的;(4) The premises are damaged, destroyed or verified as dangerous house;(五)甲方已告知乙方該房屋出租前已設(shè)定抵押,現(xiàn)被處分的;(5) Party A has notified Party B that the premises have been pledged before leasing and now has been disposed;(六) 。(6) .9.2 甲

35、乙雙方同意,有下列情形之一的,一方可書面通知另一方解除本合同。違反合同的一方,應(yīng)向另一方按月租金的 倍支付違約金,給對(duì)方造成損失的,支付的違約金不足以抵付損失的,還應(yīng)賠償造成的損失與違約金的差額部分:9.2Both parties agree that either party may notify the other party to cancel this Contract in written form in case of any of the following situation, and the party that breaches this Contract shall pa

36、y the other party the liquidated damages equivalent to time(s) of the monthly rent, and in case that the losses incurred to both parties cannot be offset by the liquidated damages paid by the breaching party, the breaching party shall pay the difference between the incurred losses and the liquidated

37、 damages;(一)甲方未按時(shí)交付該房屋,經(jīng)乙方催告后 日仍未交付的;(I) Party A fails to hand over the premises on time, and even days after exigent notice of Party B;(二)甲方交付的該房屋不符合本合同的約定,致使不能實(shí)現(xiàn)租賃目的的;或甲方交付的房屋存在缺陷,危及乙方安全的;(II) The premises handed over by Party A do not comply with the agreement in this Contract, which therefore ma

38、kes it impossible to realize the leasing purpose; or the premises handed over by Party A have the defects endangering the safety of Party B;(三)乙方在甲方按時(shí)交付該房屋的情形下,未能配合辦理交房手續(xù),經(jīng)甲方催告后 日仍未配合辦理交房手續(xù)的;(III) In spite of the timely handover of the premises by Party A, Party B fails to cooperate to go through th

39、e procedures for the handover of the premises days after the exigent notice of Party A;(四)乙方未征得甲方書面同意改變?cè)摲课萦猛?,致使該房屋損壞的;(IV) Party B changed the use of the premises without written permission of Party A and therefore incurred the damage of the premises;(五)因乙方原因造成該房屋主體結(jié)構(gòu)損壞的;(V) The main structure of th

40、e premises is damaged due to the reasons of Party B;(六)乙方擅自轉(zhuǎn)租該房屋或轉(zhuǎn)讓該房屋承租權(quán)的;(VI) Party B subleases the premises or transfers the leasing right of the premises without permission of Party A;(七)乙方逾期不支付租金累計(jì)超過(guò) 月的;(VII) Party fails to pay the rent up to more than months; (八) 。 (VIII) .十、違約責(zé)任X. Breaching l

41、iability10.1 該房屋交付時(shí)存在缺陷的,甲方應(yīng)自交付日起 日內(nèi)進(jìn)行修復(fù),逾期不修復(fù)的,甲方同意減少租金并變更有關(guān)租金條款。10.1 In case of any defect with the premises at the time of handover, Party A shall make the repair within days after the handover, and if no repair is made even after the stipulated period, Party A agrees to reduce the rent and chang

42、e the clause related to the rent. 10.2 因甲方未告知乙方,該房地產(chǎn)出租前已抵押或產(chǎn)權(quán)轉(zhuǎn)移已受到限制,造成乙方損失的,甲方應(yīng)當(dāng)負(fù)責(zé)賠償。10.2In case that Party A fails to notify Party B that the premises have been pledged or the ownership transfer of the premises has been restricted, any loss incurred to Party B therefrom shall be paid by Party A.10

43、.3 租賃期間,甲方不及時(shí)履行本合同約定的維修與養(yǎng)護(hù)責(zé)任,致使該房屋損壞,造成乙方財(cái)產(chǎn)損失或人身傷害的,甲方應(yīng)承擔(dān)賠償責(zé)任。10.3 During the leasing period, Party A fails to timely perform the maintenance responsibility of the premises as agreed in the Contract, which therefore has incurred the damage of the premises, then any property loss or personal injury i

44、ncurred upon Party B shall be compensated by Party A. 10.4 租賃期間,非本合同規(guī)定的情況,甲方擅自解除本合同,提前收回該房屋的,甲方應(yīng)按月租金的 倍向乙方支付違約金。若違約金不足以抵付乙方損失的,甲方還應(yīng)負(fù)責(zé)賠償。10.4During the leasing period, Party A unilaterally cancelled this Contract and took back the premises in advance in case of the situations other than those stipula

45、ted in the Contract, Party A shall pay Party B the liquidated damages equivalent to times of monthly rent. If the liquidated damages cannot compensate for the loss incurred upon Party B, Party A shall provide further compensation. 10.5 乙方未征得甲方書面同意或者超出甲方書面同意的范圍和要求裝修房屋或者增設(shè)附屬設(shè)施和設(shè)備的,甲方可以要求乙方 恢復(fù)房屋原狀 賠償損失

46、。10.5If Party B decorates the premises or adds the accessory facilities or equipments without written permission of Party A or beyond the scope and requirements agreed in written permission of Party A, Party A may require Party B to recover the premises to the original state, compensate for the loss

47、. 10.6 租賃期間,非本合同規(guī)定的情況,乙方中途擅自退租的,乙方應(yīng)按月 租金的 倍向甲方支付違約金。若違約金不足以抵付甲方損失的,乙方還應(yīng)負(fù)責(zé)賠償。 10.6 During the leasing period, in case of the situation other than those stipulated in the Contract, Party B stops the renting, Party B shall pay Party A the liquidated damages equivalent to time(s) of monthly rent. If the

48、 rent is not enough to offset the loss incurred upon Party A, Party B shall provide further compensation. 十一、居間條款XI. Intermediary clause三方一致確認(rèn),甲、乙雙方是在丙方的居間介紹之下達(dá)成本交易的,甲、乙、丙三方簽署本合同,即為丙方居間成功,甲、乙雙方愿意按照約定向丙方支付傭金。具體約定詳見(jiàn)甲方與丙方,以及乙方與丙方各自簽署的傭金確認(rèn)書。Three parties unanimously confirm that Party A and B reach this

49、 Contract under the intermediary introduction of Party C, and the signature of this Contract by three parties means the success of intermediary service of Party C, for which Party A and B are willing to pay Party C the commission as agreed. For more details, refer to the commission confirmation lett

50、er signed between Party A and C, and between Party B and Party C.十二、定金條款XII. Down payment甲乙雙方約定,在簽訂本合同時(shí),乙方支付(人民幣美元 ) 元(大寫 萬(wàn) 仟 佰 拾 元整)作為定金,由乙方直接或通過(guò)丙方支付給甲方,或者由丙方根據(jù)甲方的授權(quán)予以保管。 Party A and B agree that at the time of signing this Contract, Party B shall pay (RMB USD ) (Say Only) as the down payment, whic

51、h shall be paid to Party A directly or via Party C, or Party C may keep the down payment with the authorization of Party A.若到本合同約定的交房日期甲方未能按時(shí)交房的,經(jīng)乙方催告后 日仍未交付的,甲方需雙倍返還定金給乙方;若到本合同約定的交房日期乙方未能配合交房的,經(jīng)甲方催告后 日仍未配合辦理交房手續(xù)的,則甲方有權(quán)沒(méi)收乙方支付的定金;發(fā)生本條款所述情形時(shí),守約方有權(quán)選擇適用本條款或第9.2款的相關(guān)約定。若甲乙雙方履行完畢交房手續(xù),則該定金作為租金或者租賃保證金(押金)的一部

52、分進(jìn)行抵充。In the event that Party A fails to handover the premises at the date of handover as agreed in this Contract, and even days after exigent notice of Party B, then Party A shall pay double the return of the deposit to Party B; in case that Party B fails to cooperate with Party A for the handling proceduresof the handover by the date of handover agreed in this Contract, and even days after exigent notice of Party A, Party A shall have the right to confiscate the down payment paid by Party B; in case of any situation in this Article, the observant party shall hav
