1、原文：歐委會(huì)對(duì)華反傾銷措施磋商致辭 下午好！首先，我謹(jǐn)代表中國(guó)政府，對(duì)歐方同意與中方舉行今天的磋商表示感謝。據(jù)我的同事介紹，中歐雙方在確定此次磋商時(shí)間和進(jìn)行磋商前的準(zhǔn)備工作方面進(jìn)行了良好的溝通，歐方充分體現(xiàn)了靈活和務(wù)實(shí)的精神。我相信，這為我們此次磋商奠定了非常好的基礎(chǔ)。我對(duì)此表示感謝。 2009年7月31日，中國(guó)政府通過常駐WTO 代表團(tuán)致函歐方，就歐方對(duì)源自中國(guó)的鋼鐵緊固件采取的反傾銷措施提起WTO爭(zhēng)端解決機(jī)制下的磋商請(qǐng)求。對(duì)于中方的這一法律行動(dòng)，我想表明以下兩點(diǎn)：首先，正如歐方所知，此案是中國(guó)加入世貿(mào)組織以來，對(duì)歐 盟第一次啟動(dòng)WTO爭(zhēng)端解決程序。中國(guó)政府一貫重視中歐經(jīng)貿(mào)關(guān)系，主張通過雙邊

2、對(duì)話解決爭(zhēng)議和分歧。但是，歐方頻繁對(duì)華輸歐產(chǎn)品發(fā)起反傾銷調(diào)查，更裁定對(duì)來自中國(guó)的緊固件產(chǎn)品征收高額反傾銷稅。中方認(rèn)為，歐方在該案的立案、調(diào)查和裁決過程中存在諸多與WTO規(guī)則不符之處，違反了歐盟在WTO項(xiàng)下應(yīng)承擔(dān)的義務(wù)；裁決結(jié)果缺乏公正性和透明度，損害了1700余家中國(guó)緊固件企業(yè)的正當(dāng)貿(mào)易利益。中國(guó)政府和業(yè)界對(duì)此強(qiáng)烈不滿，多次在不同場(chǎng)合闡明中方立場(chǎng)和關(guān)注，但是，雙邊對(duì)話始終沒有解決中方的關(guān)注。中方認(rèn)為，中方就緊固件案提起WTO爭(zhēng)端解決項(xiàng)下的磋商請(qǐng)求，是中方的正當(dāng)權(quán)利，也是成熟的貿(mào)易伙伴之間常常選擇的解決爭(zhēng)議的一種方式。其次，自1979年歐方對(duì)華發(fā)起第一起反傾銷調(diào)查至今30年時(shí)間里，歐方共對(duì)華發(fā)起

3、140余起反傾銷調(diào)查，是對(duì)華發(fā)起反傾銷調(diào)查最多的WTO成員之一。尤其是近兩年，全球都面臨金融危機(jī)的艱難時(shí)期，中歐本應(yīng)攜手應(yīng)對(duì)金融危機(jī)，共同反對(duì)貿(mào)易保護(hù)主義，但是，歐方卻頻頻對(duì)華發(fā)起反傾銷調(diào)查。中方堅(jiān)決反對(duì)任何濫用反傾銷規(guī)則、助長(zhǎng)貿(mào)易保護(hù)主義的做法。我們希望歐方能夠重視中方的強(qiáng)烈關(guān)注，并在WTO爭(zhēng)端解決下妥善解決問題。我建議此次磋商圍繞中方向歐方提交的問題單逐項(xiàng)進(jìn)行。中方希望通過協(xié)商，歐方能夠盡可能澄清有關(guān)措施的一些細(xì)節(jié)。同時(shí)，中方希望雙方通過此次磋商，解決中方關(guān)注。謝謝！譯文：Speech about Consultations on European Commissions Anti-dum

According to my collegues introduction, Europe and China communnicate with each other very well on setting the negotiating time and the preparation bef

5、ore the negotiation,which fully reflects your pragmaticism and flexibility. I believe that this negotiation establishes a solid foundation. Thanks for your effort.On July 31th,2009, Chinese government wrote to Europe to request for consultations on the anti-dumping measures taken by Europe against t

6、he iron or steel fasteners made in China under WTO dispute settlement mechanism. For this legal action,I want to state clearly the following two points:Firstly ,as Europe knows,the case is the first time for china to start WTO dispute settlement procedure against the European Union since China enter

7、ed WTO. Chinese government always attaches great importance to trade relationship between Europe and China, and advocates to solve and overcome the dispute and difference between us through bilateral dialogues. However, Europe frequently initiates anti-dumping investigation into products exported fr

8、om China to Europe, even ruled that Europe would impose a heavy anti-dumping tax on products of iron or steel fasteners from China. The Chinese holds that there are many discrepancies with the WTO Rules in the case on file, investigation and adjudication process in European activities, violating the

9、 obligation Europe should undertake under WTO. The result of arbitrament was lack of impartiality and pellucidity, which damaged the commercial interests of more than 1700 Chinese enterprises trading in iron or steel fasteners. The Chinese gvernment and industry expressed strong discontent and state

10、d Chinese standpoint on different occasions, instead, bilateral dialogue never solved the focus of China. China holds that the request for consultations on the the case of the iron or steel fasteners under WTO dispute settlement mechanism is Chinas legal right and a solution to the dispute,which is

11、often adopted by mature trade partners.Secondly, it has been 30 years since Europe initiated the first anti-dumping investigation against China in 1979, during which,Europe, one of the WTO members who initiated anti-dumping investigations against China the most. Especially in the recent two years,wi

12、th the financial crisis facing the whole world, Europe and China should have joined hands in response to the economic crisis and objected to trade protectionism together. However, Europe repeatedly launched anti-dumping investigations against China. We stand firmly against any action which abuses an

13、ti-dumping rules to encourage trade protectionism. We hope that Europe will attach great importance to Chinese intense concern and properly solve issues under WTO dispute settlement .I propose that the consultation should revolve around the list of issues submitted by China to Europe term by term.
