1、一、海員船上投訴Seafarers ' on-board Complaints1、海員可以對(duì)不符合 2006海事勞工公約和其他相關(guān)國際公約、船旗國法規(guī)、適用的集體協(xié)議、海員上船聘用協(xié)議等規(guī)定的行為進(jìn)行投訴。Seafarer may lodge complaints related to any matter that is alleged to constitutea breach of requirements of <Maritime Labor Convention,2006> ,applicable collective bargaining agreement ,
2、 Seafarers ' employment agreement, and other relative international conventions and flag state laws or regulations.2、海員可以向本部門負(fù)責(zé)人(水手長、機(jī)工長)或其上級(jí)高級(jí)海員進(jìn)行口頭投訴。部門長接 到海員投訴應(yīng)盡快給予答復(fù),如海員對(duì)投訴的答復(fù)不滿意,該海員進(jìn)而向船長投訴,船長應(yīng) 親自處理并在接到海員投訴 24 小時(shí)內(nèi)給予答復(fù)。The seafarer shall firstly explain his grievance to high ranking officers,
3、 such as boatswain, chief motorman, or to the head of the department of the seafarer. The head of department should then attempt to resolve the matter as soon as possible. If the seafarer is not satisfied with the way his grievance has been handled, he may refer it to the master, who should handle t
4、he matter personally and give reply within 24 hours after receiving complaint.3、如果投訴不能在船上得到協(xié)商解決,可以向公司船員部投訴,船員部應(yīng)在三個(gè)工作日內(nèi)給 予書面答復(fù),適宜時(shí),與有關(guān)海員或可能被他們指定為代表的人協(xié)商。If a complaint can 't be resolved on board, the matter should be referred ashore to Crew Manning Department. The Crew Manning Department should g
5、ive a written reply within 3 work days, where appropriate, in consultation with the concerned seafarers or any representatives they designated.4、投訴事項(xiàng)可能與船上接受投訴的人或甚至與船長具體相關(guān)。在任何情況下,海員均有權(quán)直 接向船長或在其認(rèn)為必要時(shí)向適當(dāng)?shù)耐獠慨?dāng)局投訴。這些當(dāng)局可以是船東、船旗國、海員居 住國或港口國的主管當(dāng)局。The complaint may relate specifically to those individuals to
6、whom the complaint is to be made or even to the master of the ship. In all cases seafarers should have a right to complain directly to the master and, if necessary, tocompetent alienauthorities, understanding as these, the ship owner, the flag state, Seafarer 's country of residence, or the port
7、 state control authority.5、船員可以向經(jīng)授權(quán)的認(rèn)可組織登輪檢查員提出投訴,但投訴必須采取書面形式。The seafarer can complain to on-boardsurveyors of the authorized organization,but the complaint must be in written form.6、海員有權(quán)選擇同船的另一名海員陪同或代表其投訴, 該指定人員應(yīng)能參與該投訴事項(xiàng)的任 何會(huì)議或聽證。Seafarers have the right to be accompanied or represented by another
8、 seafarer of their choice on board the ship concerned for filing complaints. Such persons are able to attend any meetings or hearings into the matter.7、所有投訴和對(duì)于投訴所做的結(jié)論應(yīng)予記錄,記錄的一份副本應(yīng)提供給有關(guān)海員。All complaints and the decisions on them should be recorded and a copy is providedto the seafarer concerned.8、公司將
9、確保提出投訴海員不受迫害,并明示船長確保海員不會(huì)因投訴而受到迫害,同時(shí)不 妨礙海員通過其認(rèn)為適當(dāng)?shù)娜魏畏墒侄螌で蠹m正的權(quán)利。The company shall safeguard against the victimization of seafarers for filing complaints, and the captain shall definitely ensure that the seafarers could not be persecuted for the complaints. At the same time nobody could prevent seafar
10、ers from the right of redressing an error through any legal means they considered suitable.9、指定船舶電機(jī)員為船上海員投訴顧問, 在保密的基礎(chǔ)上向海員提供公正的建議并幫助他們 遵循船上投訴程序。The Electrician officer is nominated as the complaint adviser on board. He should supply the fair advice to the seafarers and help them to follow the complai
11、nt-handling procedure, based on keeping it secret.二、公司處理投訴程序Seafarer Complaint-handling Procedures of the Company1、船員公司根據(jù)海員投訴的內(nèi)容進(jìn)行處理,必要時(shí)由相關(guān)部門的人員組成海員投訴調(diào)查組。The Compan'y s Crew Department shall handle the seafarers 'complaint, and if necessary ,establish an investigation team which is made up o
12、f persons from related Sections.2、與船方建立聯(lián)系,進(jìn)一步收集海員投訴的具體證據(jù),就海員的投訴向其提供公正的建議, 并采取適當(dāng)?shù)拇胧樘岢鐾对V的海員保密。The Company's Crew Department shall contact with the ship to collect the reliable evidence, and give fair advices about the seafarers' complaints, take appropriatesteps to safeguard the confidentiali
13、ty of complaints made by seafarers.3、如公司對(duì)投訴的處置結(jié)果無法達(dá)到投訴海員的滿意,雙方可向主管機(jī)關(guān)申請(qǐng)仲裁。If the companycannot resolve the complaint to the satisfaction of the seafarer, both sides may ask for arbitration to the competent authorities.4、如果收到主管當(dāng)局的有關(guān)本公司海員投訴通知,公司應(yīng)立即指派相關(guān)部門實(shí)施調(diào)查,與船 方聯(lián)系收集證據(jù),查明海員投訴的理由及原因,并與主管機(jī)關(guān)積極配合,依據(jù)國家和國際法
14、規(guī)妥善解決海員投訴。If received from thecompetent authorities a notice about the seafarer 's complaintof the company, the company should immediately instructthe relativedepartments tocontact with the ship, to do investigation, collect evidence and find out the reason about the complaint. Also the company
15、should well co-operate with the competent authorities to resolve seafarers' complaints in accordance with the national andinternational laws and regulations.5、將所有解決投訴問題的證據(jù)予以保留, 同時(shí)確保投訴海員和船方持有一份處置結(jié)果復(fù)印件。 The company would keep all the evidence about handling the complaint, at the same time, ensure
16、that the complaint seafarer and the ship respectively keep a copy of result of the complaint handling.6、投訴處理完畢后,船員公司應(yīng)整理有關(guān)記錄存檔。公司承諾海員投訴將得到公平、有效和迅速處理。After handling the complaint, the Crew Department should file the relative records and keep in the archives. The Companypromises that the seafarers '
