二、工作內(nèi)容和工作地點 ii.jobdescriptionsandworkingplace 1、乙方同意按甲方工作需要，從事崗位(工種)工作，乙方應(yīng)保質(zhì)保量完成該崗位所承擔(dān)的各項工作內(nèi)容。乙方的工作地點在海鹽縣境內(nèi)， 2、甲方可以根據(jù)生產(chǎn)和工作需要及乙方的身體狀況、工作能力和表現(xiàn)升、降乙方的職務(wù)，調(diào)整乙方的工作崗位或地點，乙方愿意服從甲方的安排。 6、甲方以貨幣形式按月支付乙方工資。 partyashallpaythesalaryofpartybbymonthincurrency. 五、勞動紀(jì)律 vlabordiscipline 1、乙方對甲方依法制定的規(guī)章制度已經(jīng)熟知，并嚴(yán)格遵照執(zhí)行。 2、乙方應(yīng)遵守職業(yè)道德，不得損害甲方利益。partybshallabidebytheprofessionalethicswhichshallnotinjuretheinterestsofpartya. 六、社會保險和福利待遇 visocialinsuranceandwelfare 1、甲方按國家和地方政策規(guī)定為乙方辦理社會保險有關(guān)手續(xù)，并承擔(dān)相應(yīng)的義務(wù)。 partyashalldealwiththerelevantformalitiesofsocialsecurityforpartybaordingtothecountryandlocalpoliciesandtakeuptherelevantliabilities. 2、乙方的福利待遇按國家及甲方的規(guī)定執(zhí)行。thewelfareofpartybshallbesubjecttotherulesofthecountryandpartya. 七、勞動保護(hù)、勞動條件和職業(yè)危害防治 viilaborprotection,laborconditionandoupationalharmpreventionandcure 1、甲方根據(jù)生產(chǎn)崗位的需要，按照國家有關(guān)勞動安全、衛(wèi)生的規(guī)定為乙方配備必要的安全防護(hù)措施，發(fā)放必要的勞保用品。 partyashallequippartybwiththenecessarysafetyprotectionmeasuresandissuethenecessarylaborprotectionarticlesaordingtotheneedsofthepostandtherulesofthelaborsafetyandhygiene. 2、乙方在勞動過程中應(yīng)當(dāng)嚴(yán)格遵守安全操作規(guī)程，嚴(yán)禁違章作業(yè)，防止勞動過程中的事故，減少職業(yè)危害，并應(yīng)自覺愛護(hù)甲方的工具等財產(chǎn)。 duringthelaborprocess,partybshallabidebythesafetyoperationproceduretopreventtheaidentsduringthelaborprocess,decreasetheoupationalharmandconsciouslyprotecttheassetssuchasthetoolsofthepartya.itisstrictlyforbiddentomaketheoperationbyviolatingtherules. 3、甲方應(yīng)當(dāng)建立、健全職業(yè)病防治責(zé)任制度，加強對職業(yè)病防治的管理，提高職業(yè)病防治水平。partyashallsetupandoptimizetheoupationaldiseasecureresponsibilitysystem,enforcethemanagementovertheoupationaldiseaseandpromotethecureleveloftheoupationaldisease. 八、教育與培訓(xùn) cationandtraining 甲方應(yīng)當(dāng)依據(jù)國家有關(guān)職業(yè)教育與就業(yè)準(zhǔn)入的有關(guān)規(guī)定以及本單位的實際情況，為乙方提供職業(yè)教育和技能培訓(xùn)。乙方參加培訓(xùn)應(yīng)按規(guī)定與甲方另行簽訂培訓(xùn)協(xié)議。 partyashallprovidepartybwiththeoupationaleducationandskilltrainingaordingtotheactualconditionofthepanyandrelevantrulesofthecountryontheoupationaleducationandpostpermit.partybshallenterintothetrainingagreementwithpartyaadditionallyforthetrainingtaken. 九、勞動合同的解除、變更、終止 ix.revocation,modificationandterminationofthelaborcontract 1、甲乙雙方解除、變更、終止、續(xù)訂勞動合同應(yīng)當(dāng)依照勞動合同法和國家及省、市等有關(guān)規(guī)定執(zhí)行。 ifthepartiesrevoke,modify,terminateandextentthelaborcontract,theyshallperformthemaordingtotherelevantrulesofthelaborcontractlawandthecountry,provinceandcityetc. 3、經(jīng)甲乙雙方協(xié)商一致，可變更合同相關(guān)內(nèi)容，變更勞動合同，應(yīng)當(dāng)采用書面形式。 afterthemutualconsultationsoftheparties,thecontractmaybemodifiedinwriting. 4、乙方符合勞動合同法第三十九條情形之一者，甲方有權(quán)解除勞動合同。 ifpartybhasoneofthecircumstancesunderarticle39ofthelaborcontract,partyaisentitledtorevokethelaborcontract. 5、乙方要求解除勞動合同，應(yīng)當(dāng)提前三十日(試用期內(nèi)提前三日、專業(yè)人員提前六個月)以書面形式通知甲方，可以解除勞動合同。 ifpartybrequirestorevokethelaborcontract,theyshallinformpartyainwritingwiththirty(30)daypre-notice(thepersonunderprobationneedsapre-noticeofthree(3)daysandtheprofessionalpeoplewiththepre-noticeofsixmonths). 6、甲方應(yīng)在解除或者終止勞動合同時，為乙方出具解除或者終止勞動合同的證明，并在15日內(nèi)為勞動者辦理相關(guān)手續(xù)。乙方應(yīng)在甲方出具解除或者終止勞動合同的證明后10日內(nèi)辦理工作移交，如涉及經(jīng)濟(jì)補償?shù)陌磭矣嘘P(guān)規(guī)定在辦結(jié)工作交接時支付。 upontherevocationorterminationofthelaborcontract,partyashallissuethecertificationforrevocationorterminationofthelaborcontracttopartybanddealwiththerelevantformalitiesforthelaborerwithinfifteen(15)days.partybshallmaketheworkhandoverwithinten(10)daysafterissuancebypartyaofthecertificateofrevocationorterminationofthelaborcontract.regardinganyeconomicpensation,theyshallbepaiduponthehandoveroftheworkaordingtotherulesofthecountry. 十、違反勞動合同的責(zé)任 x.responsibilitiesforviolatingthelaborcontract 1、本合同一經(jīng)簽訂，甲乙雙方應(yīng)嚴(yán)格執(zhí)行。任何一方違反規(guī)定解除勞動合同的，應(yīng)當(dāng)向?qū)Ψ劫r償因違約造成的經(jīng)濟(jì)損失。oncethecontractisenteredinto,thepartiesshallstrictlyperformit.regardinganypartywhoviolatethelaborcontractandraisetherevocation,theyshallpensatetheotherpartyfortheeconomiclossesarisen. 6、乙方違約解除合同，在合同期間（含轉(zhuǎn)崗）由甲方出資進(jìn)行職業(yè)技術(shù)或提升培訓(xùn)的，按培訓(xùn)協(xié)議約定向甲方支付違約金；若無培訓(xùn)協(xié)議，按國家有關(guān)規(guī)定執(zhí)行。 regardingpartybwhoviolatesthecontracttorevokesthecontract,duringthecontractterm(includingtheposttransfer),ifpartyainvestsinpartybsoupationaltechnologyordevelopmenttraining,partybshallpaythepartybwiththepenaltyaordingtotheagreement.ifthereisnotrainingagreement,itshallbesubjecttotherelevantrulesofthecountry. 3、乙方因違章作業(yè)或失職行為給甲方造成損失的，甲方有權(quán)追究乙方賠償責(zé)任，并按違紀(jì)行為給予處理。ifpartybcauseslossestopartyaduetotheoperationviolatingtheruleornegligencebehavior,partyaisentitledtorecoursepartybwiththepensationresponsibilitiesandpunishtheviolatingbehaviors. 十一、勞動爭議處理及其它 xi.labordisputessettlementandmiscellaneous 1、甲乙雙方在本合同履行中發(fā)生勞動爭議，應(yīng)協(xié)商解決或由本單位工會組織調(diào)解解決； 也可以向所在鎮(zhèn)勞動爭議協(xié)調(diào)委員會申請調(diào)解，調(diào)解不成或不愿調(diào)解的，可向海鹽縣勞動爭議仲裁委員會申請仲裁，對仲裁裁決不服的，可以向海鹽縣人民法院起訴。 regardingthelabordisputesarisenofthepartiesduringtheperformanceofthecontract,theyshallbesolvedthroughconsultationsorintervenedbythetradeunionoftheunitorappliedforthemedicationfromthelabordisputecoordinationmitteeinthetown.regardingthosewhofailtoreachtheagreementorarenotwillingtobeintermediated,theymayfilethearbitrationfromthelabordisputearbitrationmitteefromhanyancountry.regardingthosewhodontagreewiththearbitration,theymayfilethelawsuitefromthepeoplescourt. 7、乙方不得泄露甲方的商業(yè)和技術(shù)秘密，不得利用甲方的技術(shù)或財物與他人研制產(chǎn)品。 partybshallnotdisclosethemercialandtechnologysecretsofpartybandshallnottakeadvantageofpartyastechnologyorassetstodevelop
