ThisPlanappliestoallemployeesandoperatingunitlocationsworldwide,includingallmanufacturingfacilities,distributioncenters,warehouses,fieldservicecenters,retail,SG&Alocationsandmobileunits(“facilities”)ofStanleyBlack&Deckeranditssubsidiariesandjointventures(inwhichStanleyBlack&Deckerexercisesdecisionmakingcontroloveroperations).LegalrequirementsmayvaryindifferentcountriesinwhichStanleyBlack&Deckerfacilitiesarelocated.Thisplanmustbeappliedineachcountryinamannerthatcomplieswiththerespectivelegalrequirements.Responsibility

EachSeniorManager’sEHSperformancewillbeassessedaspartofhisorheroverallperformancereview.KeyconsiderationswillincludeEHScompliance,injuryrates,RoadMapscore,resultsofEHScomplianceaudits,degreeofimplementationofthePlan,energyandwaterconservation,wasteminimization,andmeasurableimprovementwithrespecttoEHSperformance.

ManagersandsupervisorsofalldepartmentsmustbeheldresponsibleandaccountablefortheEHSmanagementpracticesimplementedintheirareaofresponsibility.Thisincludesperformingsuchfunctionsasareainspectionsandaudits,andemployeetraining.ThirdPartyComplianceAudits

RoutinefacilityinspectionswillbesupplementedbyperiodicformalcomplianceauditsbyoutsideconsultantsorlawyerspursuanttoStanleyBlack&Decker’sComplianceAssuranceProgram(“CAP”).InaccordancewiththeCAP,PlantManagerswillsubmitannualEHSComplianceAssuranceLetterstotheGeneralCounselcertifyingthatfacilitiesareincompliancewithEHSlawsandregulationsandStanleyBlack&Decker’spoliciesandprocedures,orthattheactivitiestoachievecompliancewillbeconducted.
