RegulationonBDAenterprisemajorresponsiblepersonimplementingworksafetymanagementresponsibility(Temporary)(Discussiondraft)Chapter1GeneralruleClause1Inordertoenhancethesafetyawarenessofenterprise’smajorresponsiblepersonandfulfillthelegalresponsibilityandobligation,improvetheBDAsafetymanagement,thisregulationismadeinaccordancewith<WorksafetylawofPRC>,<Beijingworksafetyregulation>andotherrelatedlaw/regulationandtheactualconditionofBDA.Clause2Alltheenterprise’smajorresponsiblepersonshouldobeythisregulation.Clause3Theenterprisemajorresponsiblepersonrefertothepersonwhotakestheoverallresponsibilityonproduction/businessandhasthebusinessdecision-makingright.Generallyhe/sheshouldbetheboardchairman,generalmanageroflimitedliabilitycompany,ortheplantmanager,investororlegalrepresentativeofothermanufactureandbusinessunite.Clause4BDAworksafetysupervisiondepartmentsupervisesandmanagestheenterprisemajorresponsibleperson’simplementationonhis/herresponsibilityinaccordancewithrelatedlaw/regulation.Chapter2WorksafetyresponsibilityofenterprisemajorresponsiblepersonClause5Manufactureandbusinessuniteistheresponsibilityentityofworksafetyinproductionandbusinessactivities,unitmajorresponsiblepersonisthefirstresponsiblepersonofworksafety,he/shemustimplementthemajorresponsibility.Thefirstresponsiblepersontakestheoverallresponsibilityforworksafetyandundertakestheresponsibilityofproductionaccident,occupationalhazardpreventionandtheconsequencesocaused.Clause6Theworksafetyresponsibilitiesofenterprisemajorresponsiblepersonare:1)Organize,approveandsignandissuetheworksafetyresponsibilitydocument,worksafetyrulesandinstructions;2)Establishworksafetymanagementdepartmentanddisposepersonnellawfully;3)Organizetodraftandapproveworksafetyinputplantoensurethesafetyinvestmentonsafety.Andundertaketheconsequencewhichiscausedbyinadequateworksafetyfundinput;4)Studyworksafetyproblemsperiodically;5)Superviseandinspectthesafetywork,organizetoestablish/improveproceduresofpotentialhazardinspection&follow-up,documentationsystem.Findandeliminatethepotentialhazardstimely;6)Organizetodraftandimplementemergencyplan,establishemergencyrespond/rescueteam,improveemergencyrescuecondition,carryoutemergencydrills,andreporttoBDAworksafetysupervisiondepartmentforrecordinaccordancewithrelatedregulations;7)Reportaccidentintimeandfaithfully,handlethefollowingactionsonaccident;8)Organizeandsupervisethelegalapprovalandacceptanceprocedureonnew/reconstructed/extensionprojects;9)Worksafetyresponsibilityonrelatedlaws/regulations.Chap3Detailedcontentofenterprisemajorresponsibleperson’ssafetyresponsibilityClause7Theworksafetyresponsibilitysystemdocumentsthatshouldbeapproved,signedandissuedbyenterprisemajorresponsiblepersonshouldincludethefollowinglevels:1)Enterprisemajorresponsibleperson’sworksafetyresponsibility;2)Othermember’sworksafetyresponsibilityinmanagementteam;3)Middle-leveldepartment(department,workshop,branch-company)’sworksafetyresponsibilitiesanddepartmentmanagers’worksafetyresponsibilities.4)Shiftandshiftleader’sworksafetyresponsibility;5)Workstations’andemployees’worksafetyresponsibility;Clause8Enterprisemajorresponsiblepersonshouldestablishsafetymanagementdepartmentanddisposesafetymanagementpersonnelinaccordancewiththefollowingrequirements:1)Constructioncompany,urbanrailtrafficcompany,hazardouschemicalmanufacture/purchasingandselling/storagecompanyshouldsetupworksafetydepartmentanddisposefull-timesafetymanagementpersonnel;2)Companiesotherthandefinedbythefirstitemshouldsetupworksafetydepartmentanddisposefull-timesafetymanagementpersonneliftheemployeenumberismorethan300.Thenumberoffull-timesafetypersonnelshouldnolessthan0.5%ofthetotalnumberofemployees;3)Companiesotherthandefinedbythefirstandtheseconditemsshoulddisposeatleastonefull-timeorpart-timesafetymanagementperson,orconsigntocertificatedqualifiedprofessionalpersontosupplythesafetymanagementservice;4)Full-timeandpart-timesafetymanagementpersonnelmustattendrelatedtrainingrequiredbyrelatedregulationandmusthavecorrespondingsafetymanagementknowledge.Part-timesafetymanagementpersonmustbefamiliarwiththeproductionprocess.Clause9Enterprisemajorresponsiblepersonshouldapprovetheannualsafetyfundinputandsupervisetheeffectiveimplementation.Clause10Enterprisemajorresponsiblepersonshouldorganizesafetyroutinemeetingatleastquarterlyandkeepmeetingminutes.Safetyroutinemeetingshouldinclude:1)Recentstatusanalysis;2)Recentaccident,majoraccidentpotentialhazardsnotification;3)Safetyfindingstatusfollowing-up;4)Actionplanforthenextstep;5)Decisionmakingonimportantissuesonsafety.Clause11Enterprisemajorresponsiblepersonshouldsupervisethesafetyinspection,shouldfollowthebelow4levels:1)Enterprisemajorresponsiblepersonshouldorganizesafetyinspectionmonthly(includinginspectionsbeforeholidays);2)Safetymanagementpersonshoulddosafetyinspectionatleastweekly;3)Workshopresponsiblepersonshoulddosafetyinspectionatleastweekly;4)Shiftleadershoulddosafetyinspectioneveryday.Clarifythe“four-confirmation”forfindings-------Confirmcorrectiveactionsandrequirement,confirmresponsibleperson,confirmthedeadline,confirmtheverifierandkeeptherecord.Safetymanagementpersonshouldsummarizethefindingandreporttoenterpriseresponsiblepersonatleastmonthly.Enhancetheoverduefinding’sfollow-up.Clause12EnterprisemajorresponsiblepersonshouldattendsafetytraininginaccordancewithBDAworksafetysupervisiondepartments.Trainingforthefirsttimeshouldnolessthan32hours,yearlyrefreshsafetytrainingshouldnolessthan12hours.Trainingforhazardouschemicalproductionandbusinesscompanymajorresponsiblepersonshouldnolessthan48hours;yearlyrefreshtrainingshouldnotlessthan16hours;Clause13Enterprisemajorresponsiblepersonshouldorganizeemergencyplanandimplementinaccordancewiththefollowingrequirement:1)Emergencyplanshouldcomposedof3-levelplanofgeneralplan,specialplanandsite-handlingplan;(二)Practicabilityandmaneuverabilityshouldbeputtohighprioritywhendraftingemergencyplan;(三)Organizeatleast2drillstoensurepeoplewhoareinvolvedinemergencyplantobefamiliarwithhis/herresponsibilityandtotakeappropriateactions.Revisetheemergencyplanintimeinaccordancewiththeproblemsappearedindrill;Clause14Afteraccidenthappened,therelatedpersononsitemustreporttoenterprisemajorresponsiblepersonimmediately.Onceenterprisemajorresponsiblepersonreceivetheaccidentreport,he/sheshouldstartupemergencyplantorescueinjuredpersonandtopreventfurthermoreaccident,reducepersonnelinjuryandpropertyloss.EnterprisemajorresponsiblepersonmustassignaspecialpersontoreportaccidenttoBDAworksafetymanagementdepartmentandrelateddepartmentin1hourafterreceivingtheaccidentreport.Themaincontentofccidentreportshouldinclude:1)Generalsituationofcompany;2)Accidenttime,venueandthesceneofaccident;3)Accidentbriefdescription;4)Injuredpersons’numberorpossibleinjuredperson’snumber(includingpersonsnotfound)andthedirecteconomylossbypreliminaryestimate;(五)Actionshavingbeentaken;(六)Otherinformationwhichshouldbereported.Chapter4SupervisionandmanagementactionsClause15BDAworksafetysupervisiondepartmentshouldevaluatetheperformanceofimplementationofenterprisemajorresponsiblepersonyearlyinaccordancewithrelatedevaluationstandardatyearend;Year-endevaluationiscomposedofpreliminaryevaluationandfinalevaluation.Evaluationresultsare:excellent,eligible,ineligible.EnterprisemajorresponsiblepersonhasrighttopleadtoBDAsafetysupervisiondepartmentin7workingdaysafterreceivingpreliminaryevaluationnotification,oritwillberegardedasagreeingthepreliminaryresult.Clause16Afterpleadingperiod,BDAsafetysupervisiondepartmentshouldnotifythepreliminaryresultintheBDAscopepublicly,shouldfollowupthedenouncedsafetyproblems,shouldholdre-evaluationmeetingforcaseswithseriousproblems;Clause17Fortheenterprisemajorresponsiblepersonandsafetymanagementpersonwhoisevaluatedas“excellent”,BDAsafetysupervisiondepartmentshouldgivethemhonor.Thiscompanycangivethembonusof2monthsalary.Fortheenterprisemajorresponsiblepersonandsafetymanagementpersonwhoisevaluatedas“eligible”,BDAsafetysupervisiondepartmentshouldgivethemhonor.Thiscompanycangivethembonusof1monthsalary.Fortheenterprisemajorresponsiblepersonandsafetymanagementpersonwhoisevaluatedas“ineligible”,BDAsafetysupervisiondepartmentshouldgivethemanoticeofcriticism,meantime,requirethiscompanytosubmitwrittencorrectiveactionplantoBDAsafetysupervisiondepartment.Clause18Ifenterprisemajorresponsiblepersondoesn’timplementhis/herworksafetyresponsibility,BDAsafetysupervisiondepartmentshouldgivethemadministrativepenaltiesinaccordancewith<WorksafetylawofPRC>,<Beijingworksafetyregulation>,<Worksafetyaccidentreportandinvestigationregulation>,<Worksafetyviolationpunishregulation>,etc.Clause19Fortheenterprisemajorresponsiblepersonwhodidn’timplementhis/hersafetyresponsibilityandthereforeseriousinjuryhappened,itshouldbepunishedinaccordancewithapprovedaccidentinvestigationresult對因未履行安全生產職責、造成重傷以上責任事故的單位主要負責人,將依據經批復的事故調查報告的處理意見進行處理,觸犯刑法的應依法移送司法機關追究其刑事責任。第二十條本《規(guī)定》由開發(fā)區(qū)管理委員會負責解釋。第二十一條本《規(guī)定》自2010年月日起實施。北京經濟技術開發(fā)區(qū)生產經營單位主要負責人履行安全生產管理職責規(guī)定(暫行)(討論稿)第一章總則第一條為強化北京經濟技術開發(fā)區(qū)(以下簡稱開發(fā)區(qū))的生產經營單位主要負責人(以下簡稱單位主要負責人)安全生產管理意識,切實落實法定職責與義務,加強開發(fā)區(qū)區(qū)域范圍內生產經營單位的安全生產管理工作,依據《中華人民共和國安全生產法》、《北京市安全生產條例》等法律法規(guī),結合開發(fā)區(qū)實際情況,制定本規(guī)定。第二條凡開發(fā)區(qū)區(qū)域范圍內從事生產經營活動的單位主要負責人均應遵守本規(guī)定。第三條本規(guī)定單位主要負責人,指對本單位生產經營活動負全面責任,有生產經營決策權的人員,具體指有限責任公司或股份有限公司的董事長、總經理,其他生產經營單位的廠長、投資人或法定代表人。第四條開發(fā)區(qū)安全生產監(jiān)督管理部門依法對單位主要負責人依法履職行為進行監(jiān)督管理。第二章單位主要負責人應履行的安全生產職責第五條生產經營單位是生產經營活動過程中安全生產的責任主體,單位主要負責人是本單位安全生產的第一責任人,必須依法履行安全生產責任主體職責。第一責任人對本單位安全生產工作全面負責,并對本單位生產事故、職業(yè)危害的預防和產生的后果承擔責任。第六條單位主要負責人對本單位安全生產工作負有下列職責:(一)組織制定本單位安全生產責任制、安全生產規(guī)章制度和操作規(guī)程,并負責審批、簽發(fā);(二)依法建立適應本單位安全生產工作需要的安全生產管理機構,配備安全生產管理人員;(三)組織制定、審批安全生產投入計劃,保證本單位安全生產資金投入的有效實施,并對由于安全生產所必需的資金投入不足導致的后果承擔責任;(四)定期研究安全生產問題;(五)督促、檢查本單位的安全生產工作,組織建立健全事故隱患排查治理和建檔監(jiān)控制度,及時發(fā)現、消除生產事故隱患;(六)組織制定并實施本單位的生產事故應急救援預案,建立應急救援組織,完善應急救援條件,開展應急救援演練,并按有關規(guī)定報送開發(fā)區(qū)安全生產監(jiān)督管理部門及有關部門備案;(七)及時、如實按規(guī)定報告生產安全事故,落實生產安全事故處理的有關工作;(八)組織、督促本單位新建、改建、擴建工程項目依法辦理安全生產審驗手續(xù);(九)有關法律、法規(guī)規(guī)定的安全生產職責。第三章單位主要負責人應履行職責的具體內容第七條單位主要負責人審批簽發(fā)的安全生產責任制度應包括以下五個層面內容:(一)主要負責人的安全生產責任;(二)生產經營管理層其他負責人的安全生產責任;(三)中層部門(各管理科室、車間、分公司)和部門負責人的安全生產責任;(四)班組和班組長安全生產責任;(五)具體崗位和從業(yè)人員的安全生產責任。第八條單位主要負責人應按以下要求配置本單位安全生產管理機構并配備安全生產管理人員:(一)建筑施工單位、城市軌道交通運營單位、危險物品的生產、經營、儲存單位應當設置安全生產管理機構,按照國家或者本市有關規(guī)定,配備專職安全生產管理人員;(二)第一款規(guī)定以外的其他生產經營單位,從業(yè)人員超過300人的,應當設置安全生產管理機構或者配備專職安全生產管理人員,專職安全生產管理人員配備人數不低于企業(yè)從業(yè)人員總數的0.5%;(三)第一、二款規(guī)定以外的生產經營單位,應當至少配備一名專職或兼職安全生產管理人員,或者委托具有國家規(guī)定的相關專業(yè)技術資格的工程技術人員提供安全生產管理服務;(四)專職、兼職企業(yè)安全生產管理人員均須按照有關要求參加相關培訓并具備相應的安全管理專業(yè)知識。兼職安全生產管理人員必須由熟悉主要生產工藝的工程技術管理人員擔任。第九條單位主要負責人應對本單位安全生產資金投入年度計劃進行審批,并監(jiān)督該計劃的有效實施。第十條單位主要負責人應至少每季度組織召開一次安全生產例會,并留存會議記錄。安全生產例會內容應包括以下事項:(一)近期企業(yè)安全生產形勢分析;(二)近期發(fā)生事故、重大事故隱患的情況通報;(三)安全生產檢查及隱患整改情況的追溯;(四)下一階段安全生產工作部署;(五)單位重大安全生產事宜的審定。第十一條單位主要負責人應督促企業(yè)內部進行安全生產檢查,分為四級檢查:(一)單位主要負責人每月至少組織檢查一次(包含節(jié)假日前檢查);(二)單位安全生產管理人員每周至少檢查一次;(三)車間負責人每周至少檢查一次;(四)班組長每日檢查一次。對于發(fā)現的隱患應明確“四定”——定整改內容和要求、定整改責任人
