10、lnamed in Box 5, of the GT/NT indicated in Box 6 and carrying about the number ofmetric tons of deadweight capacity all told on summer loadline stated in Box 7, nowin position as stated in Box 8 and expected ready to load under this Charter Partyabout the date indicated in Box 9, and the party menti
11、oned as the Charterers in Box4 that: The said Vessel shall, as soon as her prior commitments have been completed, proceed to the loading port(s) or place(s) stated in Box 10 or so near thereto as she may safely get and lie always afloat, and there load a full and complete cargo (if shipment of deck
12、cargo agreed same to be at the Charterers' riskand responsibility) as stated in Box 12, which the Charterers bind themselves to ship, and being so loaded the Vessel shall proceed to the discharging port(s) or place(s) stated in Box 11 as ordered on signing Bills of Lading, or so near thereto as

Owners' Responsibility Clause 15The Owners are to be responsible for loss of or damage to the goods or for delay in delivery of the goods only in case the loss, damage or delay has been caused by personal want of due diligence on the part of
15、the Owners or their Manager to make the Vessel in all respects seaworthy and to secure that she is properly manned, equipped and supplied, or by the personal act or default of the Owners or their Manager.And the Owners are not responsible for loss, damage or delay arising from any other cause whatso
16、ever, even from the neglect or default of the Master or crew or some other person employed by the Owners on board or ashore for whose acts they would, but for this Clause, be responsible, or from unseaworthiness of the Vessel on loading or commencement of the voyageor at any time whatsoever.2.所有人責任條

Deviation ClauseThe Vessel has liberty to call at any port or ports in a
18、ny order, for any purpose, to sail without pilots, to tow and/or assist Vessels in all situations, and also to deviate for the purpose of saving life and/or property.3.繞航條款船舶有權(quán)為任目的以任順序掛靠任港口,沒有引航員在船也可航行,在 任情況下拖帶和/或幫助他船,亦可為拯救人命和/或財產(chǎn)而繞航.4. Payment of Freight運費支付(a) The freight at the rate stated in Box
19、 13 shall be paid in cash calculated on the intaken quantity of cargo.(a)運費應(yīng)按第13欄所列費率,根據(jù)裝船貨物的數(shù)量計算,以現(xiàn)金支付.(b) Prepaid. If according to Box 13 freight is to be paid on shipment, it shall bedeemed earned and non-returnable, Vessel and/or cargo lost or not lost. Neitherthe Owners nor their agents shall b
20、e required to sign or endorse bills of lading showing freight prepaid unless the freight due to the Owners has actually been paid.(b)預(yù)付.如按第13欄,運費是在裝船時支付,則應(yīng)視為運費已經(jīng)收取并且是不可退還的,而無論船舶和/或貨物是否發(fā)生滅失.如果應(yīng)支付給所有人的運費尚未實際支付則不能要求所 有人或其代理人簽發(fā)或背書表明運費已經(jīng)預(yù)付的提單(c) On delivery. If according to Box 13 freight, or part thereo
21、f, is payable at destination it shall not be deemed earned until the cargo is thus delivered. Notwithstanding the provisions under (a), if freight or part thereof is payable on delivery of the cargo the Charterers shall have the option of paying the freight on delivered weight/quantity provided such
22、 option is declared before breaking bulkand the weight/quantity can be ascertained by official weighing machine, joint draft survey or tally.Cash for Vessel's ordinary disbursements at the port of loading to be advanced bythe Charterers, if required, at highest current rate of exchange, subject
23、to two (2)per cent to cover insurance and other expenses.(c)到付.如按第13欄,運費或部分運費在目的地支付,則在貨物按按這種式交付之前,不應(yīng)認為運費已經(jīng)收取.盡管有(a)款規(guī)定,如果運費或部分運費在交付貨物時支付,承租人應(yīng)有選擇按交付貨物的重量/數(shù)量支付運費的權(quán)利只 要這種選擇是在散貨分解之前宣布的,并且該重量/數(shù)量可由公認白衡重儀器,共同查驗單據(jù)或理貨加以確定.如經(jīng)要求,承租人應(yīng)現(xiàn)金墊付船舶在裝貨港的經(jīng)常費用,而按最高兌換率折合并附加2%抵償保險費和其他費用。5. Loading/Discharging(a) Costs/Risks
24、The cargo shall be brought into the holds, loaded, stowed and/or trimmed, tallied,lashed and/or secured and taken from the holds and discharged by the Charterers,free of any risk, liability and expense whatsoever to the Owners.The Charterers shall provide and lay all dunnage material as required for
25、 the properstowage and protection of the cargo on board, the Owners allowing the use of all dunnage available on board. The Charterers shall be responsible for and pay thecost of removing their dunnage after discharge of the cargo under this Charter Party and time to count until dunnage has been rem
26、oved.(a)費用/風險貨物應(yīng)由承租人負責送至艙,裝船,積載和/或平艙,理貨,綁扎和/或固定,并 從艙取出和卸船,所有人不承擔任風險,責任和費用.承租人應(yīng)提供并鋪設(shè)為適當積載和保護船上貨物所需要的墊月物料,但所有人有權(quán)決定是否允所有這些墊艙物料在船上的使用.根據(jù)本租船合同當貨物卸船后,承租人應(yīng)負責將其墊料移走并支付移走墊料所需的費用,花費的時間計入裝卸時間,直到墊料已經(jīng)移走.(b) Cargo Handling GearUnless the Vessel is gearless or unless it has been agreed between the parties thatthe
27、Vessel's gear shall not be used and stated as such in Box 15, the Owners shallthroughout the duration of loading/discharging give free use of the Vessel's cargo handling gear and of sufficient motive power to operate all such cargo handling gear. All such equipment to be in good working orde
28、r. Unless caused by negligence of the stevedores, time lost by breakdown of the Vessel's cargo handling gear or motive power - pro rata the total number of cranes/winches required at that time for the loading/discharging of cargo under this Charter Party - shall not count as laytime or time on d
29、emurrage.On request the Owners shall provide free of charge cranemen/winchmen from the crew to operate the Vessel's cargo handling gear, unless local regulations prohibitthis, in which latter event shore labourers shall be for the account of the Charterers.Cranemen/winchmen shall be under the Ch
30、arterers' risk and responsibility and asstevedores to be deemed as their servants but shall always work under the supervision of the Master.(b)貨物裝卸設(shè)備除非船上無裝卸設(shè)備或經(jīng)當事協(xié)議不使用船上的裝卸設(shè)備,并在第15欄中載明,所有人在整個裝卸過程中可以自由使用船上的貨物裝卸設(shè)備并使用充足動力操縱所有這些設(shè)備.所有這些設(shè)備應(yīng)處于良好工作狀態(tài).如果不是由于裝卸 人員的疏忽所造成,船上的貨物裝卸設(shè)備或動力故障引起的時間損失,應(yīng)按發(fā)生故障的設(shè)備占本!據(jù)
31、本租船合同裝/卸貨物時所要求的起重機/起貨機總數(shù)的比例予以扣減,不計入裝卸時間或滯期時間.如果當?shù)匾?guī)定不加禁止.經(jīng)承租人要求,所有人應(yīng) 提供由船員充當?shù)钠鹭洐C司機/起重機司機來縱船上的貨物裝卸設(shè)備,但所有人對這些司機并不承擔責任.如果當?shù)匾?guī)定不允,岸上的勞動力應(yīng)由承租人負責雇傭.起貨機司機/起重機 司機應(yīng)由承租人承擔風險和責任,并且作為裝卸人員應(yīng)視為承租人的受雇人,當應(yīng)始終工作在船長的監(jiān)督之下.(c) Stevedore DamageThe Charterers shall be responsible for damage (beyond ordinary wear and tear) to
32、 any part of the Vessel caused by Stevedores. Such damage shall be notified as soon as reasonably possible by the Master to the Charterers or their agents and to their Stevedores, failing which the Charterers shall not be held responsible. The Master shall endeavour to obtain the Stevedores' wri
33、tten acknowledgement of liability.The Charterers are obliged to repair any stevedore damage prior to completion ofthe voyage, but must repair stevedore damage affecting the Vessel's seaworthiness or class before the Vessel sails from the port where such damage was caused or found. All additional
34、 expenses incurred shall be for the account of the Charterers and any time lost shall be for the account of and shall be paid to the Owners by the Charterers at the demurrage rate.(c)裝卸人員造成的損害承租人應(yīng)對由于裝卸人員造成的船舶任部分的損害(超出正常損耗)負責.這種損害應(yīng)由船長盡快通知承租人或其代理人和其裝卸人員.如果未能如此,承租人將不承擔責任.船長應(yīng)當盡量取得裝卸人員對其責任的書面承認.承租人在航次完成前

Notice of readiness at loading port to be given to the Shippers named in Box 17 or if not named, to the Charterers or their agents named in Box 18. Notice of readiness at the discharging port to be given

41、 Vessel's arrival at or off theport of loading/discharging, the Vessel shall be entitled to give notice of readinesswithin ordinary office hours on arrival there, whether in free pratiqueor not,whether customs cleared or not. Laytime or time on demurrage shall then count as if she were in berth
42、and in all respects ready for loading/discharging provided thatthe Master warrants that she is in fact ready in all respects. Time used in movingfrom the place of waiting to the loading/ discharging berth shall not count as laytime. If, after inspection, the Vessel is found not to be ready in all re
43、spects to load/ discharge time lost after the discovery thereof until the Vessel is again ready to load/discharge shall not count as laytime.Time used before commencement of laytime shall count.* Indicate alternative (a) or (b) as agreed, in Box 16.如船舶到達裝/卸港而無泊位,則船舶有權(quán)在到達后在辦公時間遞交通知書,無論檢疫與否,無論清關(guān)與否,且如船

DemurrageDemurrage at the loading and discharging port is payable by the Charterers at the rate stated in Box 20 in the manner stated in Box 20 p
45、er day or pro rata for any part of a day. Demurrage shall fall due day by day and shall be payable upon receipt of the Owners' invoice.In the event the demurrage is not paid in accordance with the above, the Ownersshall give the Charterers 96 running hours written notice to rectify the failure.
46、If the demurrage is not paid at the expiration of this time limit and if the vessel is in or at the loading port, the Owners are entitled at any time to terminate the Charter Party and claim damages for any losses caused thereby.7.滯期費滯期費用由承租人按第20欄中規(guī)定的每日費率,不足一日者按比例計算,按日支付,并在收到船東的發(fā)票后支付.如未按上述規(guī)定支付,船東應(yīng)給承租人書面通知其在 96小時支付,如仍未在此期限付清,且如船舶在裝港,則船東有權(quán)在任時候中止本租約并向其索賠由此引起的任損失。8.
