2、me: project工程地點(diǎn)：Project locati on:工程開工日期：Project Comme nceme nt Date:工程竣工日期：Project Ccompleti on Date:2. 合同內(nèi)容：該項(xiàng)目安裝設(shè)備包括：3臺(tái)高壓柜，1臺(tái)1600kVA變壓器，8臺(tái)低壓開關(guān) 柜，計(jì)量用互感器和計(jì)量裝置。乙方負(fù)責(zé)該項(xiàng)目所有設(shè)備、電纜、橋架和計(jì)量裝置 等的電力部分的安裝施工和檢驗(yàn)工作。施工完成后，乙方負(fù)責(zé)本項(xiàng)目所有電力公司 的相關(guān)報(bào)驗(yàn)、通電申請(qǐng)、安裝驗(yàn)收、試驗(yàn)和最后通電工作。本項(xiàng)目為全套的交鑰匙 工程。本合同價(jià)格含以上全部費(fèi)用(除電力部門指定由業(yè)主自己交費(fèi)項(xiàng)目外)The conte

Party B is responsible for all inspection electricity application、installation accepta nee test and the fin ally electricity work related to electric power compa ny about this project.this project is full set of tur nkey

This con tract price and above all charges.(In addition to the electric power department designated by the owner their own to pay.)3. 合同款：美元Project Funds: USD ( Sayonly)4. 承包方式：合同簽訂后，預(yù)付款收到后 50天完成全部安裝工作，55天時(shí)辦理完項(xiàng)目 驗(yàn)收工作。預(yù)付款收到后60-65天時(shí)保證正常通電。Contracting type： After the contract signed， after the

6、 advance payment is received Party B will finish all the installed work in 50 days and have acceptance work of project transacted in 55 days. Party B make sure that all the equipment will be normally electrified in 60-65 days when the advance payment is received.5. 付款條件 ( Conditions of Payment ) :1.

7、 合同簽訂后，預(yù)付 50%即元人民幣 。After the con tract sig ned, prepay 50% of Project Funds which is ¥( RMB).2. 項(xiàng)目通電驗(yàn)收后預(yù)付 40%即元人民幣 。After electrified acceptance work of project finished prepay 40% of Project Funds which is ¥( RMB ) .3. 通電驗(yàn)收后 6個(gè)月時(shí)付清剩余 10%即元人民幣 。Pay off the surplus 10% ofProject Funds when

8、 electrified acceptance have finished 6 months which is ¥( RMB ).6. 甲方責(zé)任( Responsibility of TheBuyer )：1. 甲方全面負(fù)責(zé)安裝施工現(xiàn)場(chǎng)的管理工作。Party A is broadly responsible for the management of the installed construction site.2. 開工前 3天，甲方應(yīng)為乙方入場(chǎng)施工創(chuàng)造條件，騰空?qǐng)龅亍⒔油ㄊ┕に?；水電免費(fèi) 提供給乙方。In the three days before Project Comme

9、ncement Da、teParty A should Creat the conditions for Party B to entrance for construction、empty space、get water and electricity through which are Party A free offer.3. 開工前 10天，甲方應(yīng)為乙方提供已確定的設(shè)計(jì)方案圖及安裝施工清單，審查乙方的分 項(xiàng)工程施工方案，確定工程范圍。In the ten days before Project Commencement Da，te Party A should provide the

10、identified design diagram and installed construction listing.4. 甲方中途終止工程，應(yīng)向乙方償付合同款的50%的違約金。Party A shall pay 50% of Project Total Value for Party B If Party A terminate the project midway.5. 按合同規(guī)定支付乙方工程款項(xiàng)。Party A pay project funds for Party B in accordance with the provisions of this contract.7. 乙方責(zé)

11、任 ：Responsibility of Party B1. 所供產(chǎn)品安裝工程完全符合國家和天津電力公司相關(guān)規(guī)定，所有工作都以符合相關(guān)標(biāo) 準(zhǔn)為原則，不符合項(xiàng)，主管部門提出后乙方得免費(fèi)改造，直至驗(yàn)收合格為止。The installed project of production,which is Party B provide，entirely conform to the provisions of the relative stipulation of the country and tianjin electric power company.2. 乙方保證進(jìn)場(chǎng)相關(guān)施工人員的安全，并負(fù)責(zé)提

12、供必要安全教育和安全保護(hù)措施，并對(duì) 危險(xiǎn)工作和作業(yè)人員提供必要的保險(xiǎn)措施和有償補(bǔ)償保障。所有乙方人員如果有安全事 故或人員傷害甚至傷亡事故，由乙方負(fù)全責(zé)，與甲方無關(guān)。Party B guarantees safety of entry relative construction worker，s and is responsible for providing necessary safety education and safety protection measures. And provide necessary security measures and paid compe nsat

13、i ng in sura nc eParty B will take en tirely resp on sibility If any security accidents or personal injuries even injuries and deaths happen to Party'sB workers ，and has nothing to do with Party A.3. 乙方保證所有使用材料、電纜、橋架、型材等都是滿足國家標(biāo)準(zhǔn)規(guī)定的合格達(dá)標(biāo)產(chǎn)品， 不合格的，甲方有權(quán)要求乙方無條件更換。Party B make sure that all used materi

14、als are qualified products which meet the national standard stipulation .if production not qualified, Party A shall be entitled to request Party B offer unconditional replacement.4. 乙方保證做到文明施工，所有進(jìn)場(chǎng)人員需經(jīng)過安全施工教育，服從甲方和乙方相關(guān)領(lǐng) 導(dǎo)管理，不做違規(guī)違紀(jì)事情。Party B make sure that working must civilized and all entry workers

15、 need to be safety construction educated ，workers must obey Party A and Party B's relative management.8. 工期延誤 (project delay) ： 對(duì)以下的原因造成竣工日期的延誤，經(jīng)甲方代表確認(rèn)，工期相應(yīng)順延。Completion date corresponding prolong for the following reasons makes completion date delayed，confirmed by Tarty A.1. 增加工作內(nèi)容Add project c

16、ontent2. 不可抗力Force Majeure3. 甲方未按合同約定時(shí)間提供符合要求的圖紙，或修改范圍不能及時(shí)提供。Party A do not provide satisfactory drawing according to the contract time.4. 合同中約定或甲方代表同意給予順延的其他情況。Promise in contract or other conditions which Party A agree to prolong completion date.9. 不可抗力( Force Majeure )： 由于發(fā)生人力不可抗拒的原因，致使本合約不能履行，甲方

17、概不負(fù)責(zé)。不可抗力是指本 協(xié)議的不可抗力系指不可干預(yù)、不能避免且不能克服的客觀情況。Party B shall be exempted from any liability for failure of executing this Agreement or a portion of the goods under this Agreement in consequence of any Force Majeure incidents which might occur. Force Majeure as referred to in this Agreement means unforese

18、eable, unavoidable and insurmountable objective conditions.10. 仲裁 (Arbitration )： 凡因本合同引起的或與本合同有關(guān)的任何爭議，均應(yīng)提交中國國際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì) 天津分會(huì)，按照申請(qǐng)仲裁時(shí)該會(huì)現(xiàn)行有效的仲裁規(guī)則進(jìn)行仲裁。仲裁裁決是終局的，對(duì) 雙方均有約束力。仲裁不成功時(shí)， 可向甲方所在地的人民法院提出訴訟， 進(jìn)行司法解決。Any dispute arising from or in connection with this Agreement shall be submitted to Tianjin Branch

19、of China International Economic and Trade Arbitration Commission for arbitration , and shall be conducted in accordance with the Commission's arbitration rules in effect at ttime of applying for arbitration. 20、l,can file a suit with the location of Party A people's court, judicial soluti on.11. 通知(Notification ):所有通知用中英文寫成，并按照合同中地址用傳真或快件或電子郵件方式送達(dá)給對(duì)方。如果地址有變更，一方應(yīng)在變更后2日內(nèi)書面通知另一方。All notification and other information in China and English Ianguages, shall be sent by fax or express mail or e-mail to each other in accorda nee with the address specified in this con tract. If any cha nges of the addresses occupied, a party shall, with in 2 days, in formed other party.12. 適用法律(Governing Law):本合同的所有方面將受中華人民共和國法律和蒙古國法律的約束，并按其進(jìn)行解釋。All
