The Sellers shall bear all the charges and risks until the goods are effectively loaded on board the carrying vessel.b) 賣方必須在合同規(guī)定的交貨期限三十天前,將合同號(hào)、貨物名稱、數(shù)量、裝運(yùn)口岸及預(yù)計(jì)貨物運(yùn)達(dá)裝運(yùn)口岸日期,以電報(bào)通知買方以便買方安排艙位.并同時(shí)通知買方在裝港的船代理.倘在規(guī)定期內(nèi)買方未接到前述通知,即作為賣方同意在合同規(guī)定期內(nèi)任何日期交貨,并由買方主動(dòng)租訂艙位.T

12、he Sellers shall advise the Buyers by cable, and simultaneously advise theBuyers' shipping agent at the loading port , 30 days before the contracted time of shipment , of the contractnumber, name of commodity, quantity , loadingport and expected date of arrival of the goods at the loading port,

13、enablingthe Buyers to arrange for shipping space. Absence of such advice within the time specified above shall be considered as Sellers ' readiness to deliver the goods during the time of shipment contracted and the Buyers shall arrange for shipping space accordingly.c買方應(yīng)在船只受載期12天前將船名、預(yù)計(jì)受載日期、裝載數(shù)

14、量、合同號(hào)、船舶代 理人,以電報(bào)通知賣方.賣方應(yīng)聯(lián)系船舶代理人配合船期備貨裝船.如買方因故需要變 更船只或更改船期時(shí),買方或船舶代理人應(yīng)及時(shí)通知賣方.The Buyers shall advise the Sellers by cable , 12 days before the expected loading date , of the estimated laydays , contractnumber, name of vessel , quantity,to be loaded and shipping agent. The Sellers shall then arrange wi

15、th the shipping agent for loading accordingly. In case of necessity for substitution of vessel or alteration of shipping schedule , the Buyers or the shipping agent shall duly advise the Sellers to the same effect.d買方所租船只按期到達(dá)裝運(yùn)口岸后,如賣方不能按時(shí)備貨裝船,買方因而遭受的一切損失包括空艙費(fèi)、延期費(fèi)及/或罰款等由賣方負(fù)擔(dān).如船只不能于船舶代理人所確定的受載期內(nèi)到達(dá),在港口

16、免費(fèi)堆存期滿后第16天起發(fā)生的倉(cāng)庫(kù)租費(fèi),保險(xiǎn)費(fèi)由買方負(fù)擔(dān),但賣方仍負(fù)有載貨船只到達(dá)裝運(yùn)口岸后立即將貨物裝船之義務(wù)并負(fù)擔(dān)費(fèi)用及風(fēng)險(xiǎn).前述各種損失均憑原始單據(jù)核實(shí)支付.In the event of the Sellers ' failure in effecting shipment upon arrival of the vessel at the loading port , all losses , including dead freight , demurrage fines etc. thus incurred shall be for Sellers' accoun

If the vessel failsto arrive at the loading port within the laydays. previously declared by the shipping agent , the storage charges and insurance premium from the 16th day after expiration of the free storage time at the port shall be borne by the Buyers. However, the Sellers shall be still unde

18、r the obligation to load the goods onboard the carrying vessel immediately after her arrival at the loading port,at their own expenses and risks. The expenses and losses mentioned above shall be reimbursed against original receipts or invoices.B.本錢加運(yùn)費(fèi)價(jià)條款：Terms of CFR Delivery :賣方負(fù)責(zé)將本合同所列貨物由裝運(yùn)口岸裝直達(dá)班輪

19、到目的口岸,中途不得轉(zhuǎn)船.貨物不得用懸掛買方不能接受的國(guó)家的旗幟的船只裝運(yùn).The Sellers undertake to ship the contracted goods from the port of loading to the port of destination on adirect liner, with no transhipment allowed. 20、ccept.(11) 裝運(yùn)通知：賣方在貨物裝船后,立即將合同號(hào)、品名、件數(shù)、毛重、凈重、發(fā)票 金額、載貨船名及裝船日期以電報(bào)通知買方.Advice of Shipment : The Sellers shall upon competition of loading, adviseimmediately the Buyers by cable of the contract number, name of commodity ,number of packages , gross and net weights , invoice value , name of vessel and load

21、ing date.(12) 保險(xiǎn)：自裝船起由買方自理,但賣方應(yīng)按本合同第(11)條通知買方.如賣方未 能按此辦理,買方因而遭受的一切損失全由賣方負(fù)擔(dān).Insurance : To be covered by the Buyers from shipment , for this purpose theSellers shall advise the Buyers by cable of the particulars as called for inClause(11) of this Contract , In the event of the Buyers being unable to

22、arrange for insurance in consequence of the Sellers ' failure to send the above advice , the Sellers shall be held responsible for all the losses thus sustained by the Buyers.(13) 檢驗(yàn)和索賠：貨卸目的口岸,買方有權(quán)申請(qǐng)中華人民共和國(guó)國(guó)家質(zhì)量監(jiān)督檢驗(yàn)檢 疫總局進(jìn)行檢驗(yàn).如發(fā)現(xiàn)貨物的品質(zhì)及/或數(shù)量/重量與合同或發(fā)票不符：除屬于保險(xiǎn)公司及/或船公司的責(zé)任外,買方有權(quán)在貨卸目的口岸后90天內(nèi),根據(jù)中華人民共和國(guó)國(guó)家質(zhì)

23、量監(jiān)督檢驗(yàn)檢疫總局出具的證實(shí)書向賣方提出索賠,因索賠所發(fā)生的一切費(fèi)用(包括檢驗(yàn)費(fèi)用)均有賣方負(fù)擔(dān).FOB介格條件時(shí),如重量短缺,買方有權(quán)同時(shí)索賠短重部分的運(yùn)費(fèi).Inspection and Claim : The Buyers shall have the right to apply to the General Administration of Quanlity Supervision, Inspection and Quarantine of thePeople ' s Republic of China (AQSIQ) for inspection after dischar

24、ge of the goods at the port of destination. Should the qualityand/or quantity/weight befoundnot in conformity with the contract or invoice the Buyers shall be entitled to lodge claims with the Sellers on the basis of AQSIQ 's Survey Report , within 90 days after discharge of the goods at the por

25、t of destination, with theexception , however , of those claims for which the shipping company and/or the insurance company are to be held responsible. All expenses incurred on the claim including the inspection fee as per the AQSIQ inspection certificate are to be borne by the Sellers. In case of F

26、OB terms , the buyers shall also be entitled to claim freight for short weight if any.(14) 不可抗力：由于人力不可抗拒事故,使賣方不能在合同規(guī)定期限內(nèi)交貨或者不能 交貨,賣方不負(fù)責(zé)任.但賣方必須立即通知買方,并以掛號(hào)函向買方提出有關(guān)政府機(jī)關(guān)或者商會(huì)所出具的證實(shí),以證實(shí)事故的存在.由于人力不可抗拒事故致使交貨期限延期 一個(gè)月以上時(shí),買方有權(quán)撤銷合同.賣方不能取得出口許可證不得作為不可抗力.Force Majeure : In case of Force Majeure the Sellers shall n
