7、U1963年3月13日，被告米蘭達在自己家中被捕，被警察帶到警 察局，事后警方承認，訊問前未告知其有獲得律師幫助的權(quán)利。二小 時后，米蘭達在警察“為什么要干”的訊問下供認了犯罪事實，在訊問筆錄上也簽了字，據(jù)此他被以強奸罪和綁架罪提起訴訟，經(jīng)法院幾育人猶如春風化雨，授業(yè)不惜蠟炬成灰精品教學教案設(shè)計| Excellent teaching plan次審理都被判有罪，判處監(jiān)禁 50年。米蘭達不服，最后上訴到聯(lián)邦 最高法院。當時的首席大法官沃倫經(jīng)審理認為：警察的訊問違背了美 國憲法第五修正案，即任何人不得被迫在刑事案件中自證其罪。 所以 由此獲得的被告承認有罪的供述不能作為定罪的證據(jù)，故撤銷原判 決，
