車庫價值為借款增信合同編號：__________GarageValueasCollateralforBorrowingEnhancementBETWEEN:[ContractingPartyAName][ContractingPartyAAddress]AND[ContractingPartyBName][ContractingPartyBAddress]EffectiveDate:[DateofEffectiveAgreement]1.RECITALSWHEREAS,[ContractingPartyA],hereinafterreferredtoas"Borrower",possessesagaragelocatedat[GarageAddress],whichisappraisedandvaluedat[GarageAppraisedValue]("Garage");WHEREAS,[ContractingPartyB],hereinafterreferredtoas"Lender",iswillingtoprovidealoantotheBorrowerintheamountof[LoanAmount];WHEREAS,theBorrowerdesirestousetheGarageascollateraltosecuretheLoanfromtheLender,inaccordancewiththetermsandconditionssetforthherein.NOW,THEREFORE,inconsiderationofthemutualcovenantsandagreementscontainedherein,thepartiesheretoagreeasfollows:2.AGREEMENT2.1.LoanTermsTheBorroweragreestoborrowfromtheLenderthesumof[LoanAmount],hereinafterreferredtoasthe"Loan".TheLoanshallbeevidencedapromissorynoteexecutedtheBorrowerinfavoroftheLender("Note").2.2.CollateralAssecurityforthepaymentoftheLoan,theBorrowerheregrantstotheLenderalienandsecurityinterestinandtotheGarage,includingallrights,,andinterestthereinandthereto,subjecttothetermsandconditionsofthisAgreement.TheBorrowerrepresentsandwarrantsthatithasgoodandmarketabletotheGarage,freeandclearofanyliens,claims,orencumbrances.2.3.ValuationofGarageTheBorroweracknowledgesandagreesthattheGaragehasbeenappraisedandvaluedat[GarageAppraisedValue]aqualifiedappraiser.TheBorrowerfurtheragreesthattheGarageshallbeappraisedatleastonceevery[AppraisalFrequency]toensurethatthevalueofthecollateralremainssufficienttosecuretheLoan.2.4.UseofGarageTheBorrowershallcontinuetoown,use,andmaintaintheGarageinaccordancewithallapplicablelaws,regulations,andordinances.TheBorrowershallnotsell,transfer,lease,orencumbertheGaragewithoutthepriorwrittenconsentoftheLender.2.5.InspectionandAccessTheBorrowershallallowtheLenderoritsauthorizedrepresentativestoinspecttheGarageandanyrelateddocumentsatreasonabletimesanduponreasonablenotice.TheLendermayalsorequireaccesstotheGaragetoexerciseitsrightsandremediesunderthisAgreement.3.REPRESENTATIONSANDWARRANTIESTheBorrowerrepresentsandwarrantstotheLenderthat:3.1.IthasthelegalcapacitytoenterintothisAgreementandtoperformitsobligationshereunder;3.2.IthasgoodandmarketabletotheGarage,freeandclearofanyliens,claims,orencumbrances;3.3.TheGarageiscurrentlyingoodconditionandrepair,andissuitableforthepurposescontemplatedhere;3.4.ItwillusetheLoanproceedsforthepurposesmutuallyagreedupontheparties;4.INDEMNIFICATIONTheBorroweragreestoindemnifyandholdtheLenderharmlessfromanyandalllosses,damages,claims,suits,actions,liabilities,costs,andexpenses(includingreasonableattorney'sfees)arisingoutoforinconnectionwiththeGarageorthisAgreement,excepttotheextentcausedtheLender'sgrossnegligenceorwillfulmisconduct.5.TERMINATIONThisAgreementshallterminateupontheearlierof:5.1.ThefullandfinalrepaymentoftheLoan,interest,andallotherobligationsunderthisAgreement;or5.2.Thesale,transfer,orotherdispositionoftheGarageinaccordancewiththetermsandconditionsofthisAgreement.6.MISCELLANEOUS6.1.GoverningLawThisAgreementshallbegovernedandconstruedinaccordancewiththelawsof[GoverningJurisdiction],withoutregardtoitsconflictoflawsprinciples.6一、附件列表：1.借款申請書2.借款合同3.車庫所有權(quán)證明4.車庫評估報告5.借款人財務(wù)報表6.貸款用途說明7.借款人信用證明8.抵押物清單9.借款人身份證明10.其他與借款和抵押有關(guān)的文件和證明。二、違約行為及認(rèn)定：1.借款人未能按時還款或未還清貸款本息。2.借款人未能履行合同約定的其他義務(wù)。3.借款人未按約定使用貸款用途。4.借款人未能保持車庫的價值，導(dǎo)致抵押物價值下降。5.借款人未經(jīng)許可，出售、轉(zhuǎn)讓或抵押車庫。6.借款人未配合貸款人行使權(quán)利和執(zhí)行合同。三、法律名詞及解釋：1.借款人：指與貸款人簽訂借款合同，并承擔(dān)還款義務(wù)的一方。2.貸款人：指提供貸款，并有權(quán)收回貸款本金和利息的一方。3.車庫：指借款人擁有的，作為借款抵押的房產(chǎn)。4.貸款：指貸款人向借款人提供的貨幣資金。5.違約：指借款人未履行合同約定的義務(wù)。6.抵押：指借款人將其擁有的財產(chǎn)權(quán)利作為借款的擔(dān)保。四、執(zhí)行中遇到的問題及解決辦法：1.車庫價值下降：定期進(jìn)行車庫價值評估，確保其價值足以覆蓋貸款金額。如有必要，借款人需補(bǔ)充擔(dān)保。2.借款人未能按時還款：與借款人協(xié)商，制定還款計劃。如協(xié)商無果，貸款人可依法采取措施，如扣押抵押物等。3.借款人未按約定使用貸款用途：要求借款人立即糾正，并承擔(dān)違約責(zé)任。4.借款人未經(jīng)許可，出售、轉(zhuǎn)讓或抵押車庫
