工程合同中有關(guān)開工的條款中英文對(duì)照全套工程合同中有關(guān)開工的條款COMMENCEMENTOFWORK開工CommencementofWork開工準(zhǔn)備CommencementPreparation開工通知CommencementNotice開工日期CommencementDate開工時(shí)間TimeforCommencement開工及延期開工Commencementandpostponementofcommencement開工日期：指雙方在協(xié)議書中約定，乙方開始施工的絕對(duì)或相對(duì)的日期。Commencingdate:thedate,absoluteorrelative,onwhichPartyBstartsthestipulatedconstructionagreedbybothpartiesintheagreement.TheCommencementDate:ThedateonwhichtheContractorcommencestheconstructionhereunderasspecifiedintheagreement.開工日期：指發(fā)包人承包人在協(xié)議書中約定的承包人開始施工的日期。除專用合同條款另有約定外，承包人應(yīng)按照第7.1款〔施工組織設(shè)計(jì)〕約定的期限，向監(jiān)理人提交工程開工報(bào)審表，經(jīng)監(jiān)理人報(bào)發(fā)包人批準(zhǔn)后執(zhí)行。開工報(bào)審表應(yīng)詳細(xì)說(shuō)明按施工進(jìn)度計(jì)劃正常施工所需的施工道路、臨時(shí)設(shè)施、材料、工程設(shè)備、施工設(shè)備、施工人員等落實(shí)情況以及工程的進(jìn)度安排。Unlessotherwisespecifiedinthetermsoftheparticularcontract,thecontractorshallsubmittothesupervisorthereportformofconstructioncommencementinaccordancewiththetermstipulatedinsubclause7.1[ConstructionOrganizationDesign].Thereportformshallbeexecutedsubsequenttotheemployer?sapproval.Thereportformofcommencementshouldmakeillustrationsoftheimplementationontheworkroad,temporaryfacilities,materials,engineeringequipment,constructionequipment,constructionpersonnel,etc.,whicharenecessaryforconstructionprogressplan,andthescheduleoftheworksprogress.除專用合同條款另有約定外，合同當(dāng)事人應(yīng)按約定完成開工準(zhǔn)備工作。Exceptotherwiseagreementofcontract,partiesheretoshouldpursuanttotheagreementaccomplishthepreparationofcommencement.發(fā)包人應(yīng)按照法律規(guī)定獲得工程施工所需的許可。經(jīng)發(fā)包人同意后，監(jiān)理人發(fā)出的開工通知應(yīng)符合法律規(guī)定。監(jiān)理人應(yīng)在計(jì)劃開工日期7天前向承包人發(fā)出開工通知，工期自開工通知中載明的開工日期起算。Theemployershall,inaccordancewiththestipulationsoflaw,obtainthenecessarypermissionandapprovalfortheconstructionoftheworks.TheCommencementNoticeissuedbythesupervisorshall,subjecttotheemployer’sapprovalandcomplywiththestipulationsoflaw.Thesupervisorshall,7dayspriortothescheduledcommencementdateandtheworktermwillbecalculatedfromthecommencementdatewhichisstatedinCommencementNotice.除專用合同條款另有約定外，因發(fā)包人原因造成監(jiān)理人未能在計(jì)劃開工日期之日起90天內(nèi)發(fā)出開工通知的，承包人有權(quán)提出價(jià)格調(diào)整要求，或者解除合同。發(fā)包人應(yīng)當(dāng)承擔(dān)由此增加的費(fèi)用和（或）延誤的工期，并向承包人支付合理利潤(rùn)。Unlessotherwisespecifiedintheparticularcondition,wherethesupervisorfailstoissueCommencementNoticeduetotheemployer’reason,within90daysfromthescheduledcommencementdate,thecontractorreservetherighttoraisetherequirementofpriceadjugementorterminationofcontract.Employershouldbeartheincreasedcostand/ordelayedtermarisingtherefrominadditiontomakepaymentofreasonableprofitstothecontractor.除非合同協(xié)議書另有說(shuō)明，雇主應(yīng)在不少于7天前向承包商發(fā)出開工日期的通知;UnlessotherwisestatedintheContractAgreement,theEmployershallgivetheContractornotlessthan7days’noticeoftheCommencementDate;and開工日期應(yīng)在第1.6款[合同協(xié)議書]規(guī)定的合同全面實(shí)施和生效日期后42天內(nèi)。theCommencementDateshallbewithin42daysafterthedateonwhichtheContractcomesintofullforceandeffectunderSub-Clause1.6[ContractAgreement].承包商應(yīng)在開工日期后，在合理可能情況下盡早開始工程的設(shè)計(jì)和施工,隨后應(yīng)以正當(dāng)速度拖延地進(jìn)行工程。TheContractorshallcommencethedesignandexecutionoftheWorksassoonasisreasonablypracticableaftertheCommencementDate,andshallthenproceedwiththeWorkswithdueexpeditionandwithoutdelay.“開工日期”指的是鉆機(jī)到達(dá)公司的第一口井井場(chǎng)或指定的其它井場(chǎng)，承包商各個(gè)崗位人員齊備，從各方面都已具備開鉆水平，并在以下規(guī)定的合同期間內(nèi)，以鉆機(jī)制造商標(biāo)定的技術(shù)規(guī)范，達(dá)到能夠進(jìn)行持續(xù)施工狀態(tài)的時(shí)刻。鉆機(jī)一旦到達(dá)井場(chǎng)，承包商應(yīng)立即以書面形式通知公司。"CommencementDate"meansthedateandtimeofarrivaloftheRigatthefirstwellorotherlocationspecifiedbyCOMPANY,providedCONTRACTOR’Sfullcrewisinallrespectsreadytospudandsustaincontinueddrillingoperationsatmanufacturer'sratedspecificationduringtheContractPeriodasdefinedbelow.CONTRACTORshallnotifyCOMPANYinwritingimmediatelyupontheRig'sarrival.發(fā)包人必須按合同規(guī)定支付定金，收到定金作為設(shè)計(jì)人設(shè)計(jì)開工的標(biāo)志。未收到定金，設(shè)計(jì)人有權(quán)推遲設(shè)計(jì)工作的開工時(shí)間，且交付文件的時(shí)間順延。TheemployershallpaythedownpaymentinaccordancewithstipulationsoftheContract.Receptionofthedownpaymentisthemarkofcommencementofdesignworkforthedesigner.Ifthedownpaymentisnotreceived,thedesignerisentitledtoputoffthetimeofcommencementofdesignwork,andpostponeaccordinglythetimeofdeliveryofdocuments.乙方應(yīng)當(dāng)按照協(xié)議書約定的開工日期開工。乙方不能按時(shí)開工，應(yīng)當(dāng)不遲于協(xié)議書約定的開工日期前7天，以書面形式向甲方代表提出延期開工的理由和要求。甲方代表應(yīng)當(dāng)在接到延期開工申請(qǐng)后48小時(shí)內(nèi)以書面形式答復(fù)乙方。PartyBshallcommencetheconstructionaspertheagreement.Incasethecommencementcannotbeontime,thecommencementshallnotbelaterthan7daysthantheagreeddateandthepostponementshallbeexplainedtoPartyA?srepresentativeandrequestedinwriting,whoshallgiveawrittenreplytoPartyBwithin48hoursuponreceipt.Incasenoreplyismadewithin48hours,itshallberegardedPartyA?srepresentativehasagreedonthepostponementandtheprogressscheduleshallbepostponedaccordingly.IfPartyA?srepresentativedoesnotagreeonthepostponementorPartyBfailstosubmitarequestforpostponementwithinthestipulatedperiod,theconstructionperiodshallnotbepostponed.承包人應(yīng)當(dāng)按照協(xié)議書約定的開工日期開工。承包人不能按時(shí)開工，應(yīng)當(dāng)不遲于協(xié)議書約定的開工日期前4天，以書面形式向工程師和發(fā)包人代表提出延期開工的理由和要求；只有在接到工程師和發(fā)包人代表明確的書面答復(fù)后，工期才能相應(yīng)順延。工程師和發(fā)包人代表不同意延期要求或承包人未在規(guī)定時(shí)間內(nèi)提出延期開工要求，工期不予順延。TheContractorshallcommenceconstructionontheCommencementDateasagreedintheAgreement.IftheContractorcannotcommenceontime,theContractorshallsubmittotheEngineersandtheEmployer?sRepresentativerequirementinwritingfordeferringthecommencementwiththenecessaryreasonsnotlaterthan4daysbeforetheCommencementDateassetoutintheAgreement.TheProjectPeriodcanbeextendedaccordinglyonlyafterthewrittenexplicitapprovalisobtainedfromtheEngineersandtheEmployer?sRepresentative.IftheEngineersandtheEmployer?sRepresentativedisagreeontherequirementondeferringthecommencementortheContractorfailstosubmittherequirementwithintheprescribedtimelimit,theProjectPeriodcannotbeextended.Underspecialcircumstances,theEmployermaynotifytheContractorinwritingtodefertheCommencementDateandtheProjectPeriodshallbeextendedaccordingly.However,theContractorwillnotmakeanyrequirementsforExpensesagainsttheEmployer.?在特殊情況下，發(fā)包人可書面通知承包人推遲開工日期，工期相應(yīng)順延，但承包人不會(huì)向發(fā)包人提出任何費(fèi)用要求。發(fā)包人應(yīng)在開工日期前7天用書面形式向承包人發(fā)出進(jìn)場(chǎng)通知。承包人應(yīng)在合同規(guī)定的開工日期的3天前接收工地。TheEmployershallissueawrittenmove-innoticetotheContractor7daysbeforetheCommencementDate.TheContractorshalltakeovertheSite3daysbeforetheCommencementDateasstipulatedintheContract.開工日應(yīng)為本協(xié)議生效日____個(gè)月之后的第___天，但C可在開工日之前開始修建進(jìn)廠通道、勘探、測(cè)量和現(xiàn)場(chǎng)清理等。如果C按照第9.1款的規(guī)定開始土建工作，開工日應(yīng)為C實(shí)際開始土建工作的日期，C應(yīng)通知B。Thecommencementdateshallbethe____dayafter____monthsromtheEffectiveDateofthisAgreementprovidedthatCcanstartworkoraccessroad，survey，investigation，clean-upworkaroundthesite，tc.beforethecommencementdate.However，ifCcommencesconstructionorkinaccordancewiththeprovisionofClause9.1，thecommencementdatehallbethedatewhereCmateriallystartstheconstructionwork，whichhallbenotifiedtoBbyC.承包商在接到工程師有關(guān)開工的通知后，應(yīng)在合理可能的情況下盡快開工，開工通知應(yīng)在中標(biāo)函頒發(fā)日期之后，在投標(biāo)書附件中規(guī)定的期限內(nèi)發(fā)出。此后，承包商應(yīng)迅速且毫不遲延開始工程的施工。TheContractorshallcommencetheWorksassoonasisreasonablyafterthereceiptbyhimofanoticetothiseffectfromtheEngineer,whichnoticeshallbeissuedwithinthetimestatedintheAppendixtoTenderafterthedateoftheLetterofAcceptance.Thereafter,theContractorshallproceedwiththeWorkswithdueexpeditionandwithoutdelay.Thisprojectcontracttimelimitforaprojectis60days(calendardaybeginsfromtheoperation,itdoesnotcontaindesigntimelimitforaproject).本工程合同工期為60天（日歷天從開工之日起算起，不含設(shè)計(jì)工期）2、Theoperationdate____;completiondate___.本工程開工日期____年__月__日，竣工日期____年__月___日。ThecontractordoesnotstartworkontheSiteuntilthefirstpossessiondateanddoestheworksothatCompletionisonorbeforetheCompletionDate.承包商從第一個(gè)現(xiàn)場(chǎng)占有日起開始施工作業(yè)，并應(yīng)在竣工日或竣工日前竣工。開工日期是指合同資料表B中所列最遲發(fā)生的條件的事發(fā)日。如合同資料表B中未列出任何條件，則開工日為合同簽訂日。TheCommencementDateshallbethedateonwhichthelatestoftheeventslistedinContractScheduleBhasoccurred.IfnoeventhasbeenlistedinContractScheduleB,theCommencementDateshallbethedateofsignatureofthisContract.未滿足開工條件。如項(xiàng)目未能根據(jù)3.2款開工，則在簽訂日后6個(gè)月內(nèi)（或其他雙方商定的時(shí)限，見合同資料表C），任何一方都可以書面通知對(duì)方終止合同。Non-occurrenceoftheCommencementDate.IftheCommencementDatehasnotoccurred,accordingtoArticle3.2,withinsix(6)monthsfromthedateofsignature(orwithinsuchothertermasmaybeagreedbetweentheParties:seeContractScheduleC),eitherPartymayterminatetheContractbywrittencommunicationtotheotherParty.TheContractorshallcommencetheWorksrightaftertheEffectiveDateaccordingtothetimescheduleasdescribedinAppendix4oftheContract.承包商須在合同生效日后，立即按照合同附件4的時(shí)間進(jìn)度要求開始工作。以上各井的開工日期以經(jīng)批準(zhǔn)的開工報(bào)告日期為準(zhǔn)，日歷工期不含附屬工程及堵水注漿的工期，其工期另行約定。Theapprovedstartdatei
