PMIMEMBERETHICALSTANDARDS

MEMBERCODEOFETHICS

TheProjectManagementInstitute(PMI)isaprofessionalorganizationdedicatedtothedevelopmentandpromotionofthefieldofprojectmanagement.ThepurposeofthePMIMemberCodeofEthics/ConductistodefineandclarifytheethicalresponsibilitiesforpresentandfuturePMImembers.

Preamble:

Inthepursuitoftheprojectmanagementprofession,itisvitalthatPMImembersconducttheirworkinanethicalmannerinordertoearnandmaintaintheconfidenceofteammembers,colleagues,employees,employers,customers/clients,thepublic,andtheglobalcommunity.

MemberCodeofEthics:

Asaprofessionalinthefieldofprojectmanagement,PMImemberspledgetoupholdandabidebythefollowing:

? Iwillmaintainhighstandardsofintegrityandprofessionalconduct

? Iwillacceptresponsibilityformyactions

? Iwillcontinuallyseektoenhancemyprofessionalcapabilities

? Iwillpracticewithfairnessandhonesty

? Iwillencourageothersintheprofessiontoactinanethicalandprofessionalmanner.

PMIMEMBERETHICALSTANDARDS

MEMBERSTANDARDSOFCONDUCT

ThefollowingisadescriptionoftheobligationsandexpectationscontainedinthePMIMemberStandardsofConductdescribestheobligationsandexpectationsandassociatedwithacceptanceofmembershipintheProjectManagementInstitute.AllPMIMembersmustconducttheiractivitiesconsistentwiththeMemberStandardsofConduct.

I. ProfessionalObligations.

A. ProfessionalBehavior.

1. PMIMemberswillfullyandaccuratelydiscloseanyprofessionalorbbusiness-relatedconflictsor

potentialconflictsofinterestinatimelymanner.

2. PMIMemberswillrefrainfromofferingoracceptingpayments,orotherformsofcompensationor

tangiblebenefits,which:(a)donotconformwithapplicablelaws;,and(b)mayprovideunfairadvantage

forthemselves,theirbusinessorotherstheymayrepresent.

3. PMIMemberswhoconductresearchorsimilarprofessionalactivitieswilldosoinamannerthatisfair,honest,accurate,unbiased,and

otherwiseappropriate,andwillmaintainappropriate,accurate,andcompleterecordswithrespecttosuch

researchfindingsandrelatedprofessionalactivities.

4. PMIMemberswillrespectandprotecttheintellectualpropertyrightsofothers,andwillproperly

discloseandrecognizetheprofessional,intellectual,andresearchcontributionsofothers.

5. PMIMemberswillstrivetoenhancetheirprofessionalcapabilities,skillsandknowledge;andwillaccuratelyandtruthfullyrepresentandadvertisetheirprofessionalservicesandqualifications..

B. RelationshipWithCustomers,Clients,andEmployers.

1. PMIMemberswillprovidecustomers,clients,andemployerswithfair,honest,completeand

accurateinformationconcerning:(a)theirqualifications;,(b)theirprofessionalservices;and(cb)thepreparationofestimates

concerningcosts,services,andexpectedresults.

2. PMIMemberswillhonorandmaintaintheconfidentialityandprivacyofcustomers,/clients,

employer,andsimilarworkinformation,includingapplicabletheconfidentialityofcustomeror/clientidentities,

assignmentsundertaken,andotherinformationobtainedthroughoutthecourseoftheaprofessional

relationship,unless:(a)grantedpermissionbythecustomer,/client,oremployer;or(b)themaintenanceofthe

confidentialityisotherwiseunethicalorunlawful.

3. PMIMemberswillnottakepersonal,business,orfinancialadvantageofconfidentialorprivateinformation

acquiredduringthecourseoftheirprofessionalrelationships,norwilltheyprovidesuch

informationtoothers.

C. RelationshipWiththePublicandtheGlobalCommunity.

1. PMIMemberswillhonorandmeetallapplicablelegalandethicalobligations,includingthelaws,

rules,andcustomsofthecommunityandnationinwhichtheyfunction,work,orconductprofessionalactivities.

2. PMIMemberswillperformtheirworkconsistentandinconformancewithtoprofessionalstandardstoensurethatthepublicisprotected

fromharm.

II. ObligationstoPMI.

A. ResponsibilitiesofPMIMembership.

1. PMIMemberswillabidebythebylaws,policies,rules,requirements,andproceduresoftheProjectManagement

Institute,andwillnotknowinglyengageorassistinanyactivitiesintendedtocompromisethe

integrity,reputation,property,and/orlegalrightsoftheInstitute.

2. PMIMemberswillabidebythelaws,regulations,andotherrequirementsoftheirrespectivecommunitiesandnations,andwillnot

knowinglyengagein,orassistin,anyactivitiesintendedtohavenegativeimplications,including

criminalconduct,professionalmisconduct,ormalfeasance.

PMIMemberswillcooperatewiththeInstituteconcerningthereviewofpossibleethicsviolations,andotherPMImatters,completely,consistentwithapplicablepoliciesandrequirements.

PMIMemberswillaccurately,completely,andtruthfullyrepresentinformationtoPMI.

PMIMEMBERETHICALSTANDARDS

MEMBERETHICSCASEPROCEDURES

Thefollowingethicscaseproceduresaretheonlyrulesforprocessingpossibleviolationsoftheseethicalstandards.,andTheseproceduresareapplicabletomembersoftheProjectManagementInstitute(hereinafterreferredtoasPMIortheInstitute),andthosewhoareseekingInstitutemembership.PMImembersandindividualsseekingPMImembershipunderstandandagreethattheseproceduresareafairprocessforresolvingallethicsmattersdulyadoptedbyPMI;andtheywillbeboundbydecisionsmade,andrequirementsissued,pursuanttotheseprocedures.;and,theseproceduresdonotconstituteacontractbetweentheInstituteandthePMImemberorapplicantformembership.

A. GeneralProvisions

1. NatureoftheProcess.PMIhastheonlyauthoritytoresolveandendanyethicsmatter,regardlessofcircumstances.By

applyingformembershipintheInstitute,PMImembersandapplicantsagreethattheywillacceptthenotchallengethe

authorityoftheInstitutetoapplytheMemberCodeofEthics/Conduct,MemberStandardsofConduct,andtheMemberEthicsCaseProcedures,

orandotherrelevantpoliciestoresolveethicsmatters.

Theseethicsproceduresarenotaformallegalprocessproceedings;therefore,manylegalrulesandpractices

arenotobserved,andtheproceduresaredesignedtooperatewithouttheassistanceofattorneys.

Anyparty,ofcourse,mayberepresentedbyanattorneywithrespecttoanethicsmatter.Ifaparty

hasretainedanattorney,thatattorneymaybedirectedtocommunicatewiththeInstitutethrough

thePMILegalCounsel.ThepartiesareencouragedtocommunicatedirectlywiththeInstitute.

TheInstitutemayusetheservicesofPMILegalCounselwithoutlimitation.

2. Participants.EthicscasesmaybedecidedbythePMIEthicsReviewCommittee,(EthicsReviewCommittee),

thePMIEthicsAppealsCommittee,(EthicsAppealsCommittee),and/oranyauthorizeddesignee.A

PMImemberorapplicantwhoisthesubjectofanethicscomplaintorinvestigationwillbeidentifiedastheRespondent.

Theperson(s)initiatinganethicscomplaintwillbeidentifiedastheComplainant(s).

3. TimeRequirements.TheInstitutewillmakeeveryreasonableefforttofollowthetimerequirementsnotedintheseisprocedures

document.However,theInstitute’sfailuretomeetatimerequirementwillnotprohibitthefinalresolutionof

anyethicsmatter,orotherwisepreventPMIfromactingundertheseprocedures.ComplainantsandRespondentsarerequiredtocomplywithalltimerequirementsspecified

intheseprocedures.TimeextensionsorpostponementsmaybegrantedbytheInstituteifatimelywritten

requestexplainsareasonablecause.

4. RelaxationofRequirements/GlobalAccommodations.Inlightoftheglobalnatureoftheinternationalproject

managementcommunity,includingdifferencesrelatedtothelanguage,custom,geographiclocation,and

othercharacteristicsofPMImembersandapplicants,theInstituterecognizesthatPMImembersand

applicantsmayhavedifficultymeetingcertaintimeorotherrequirementsintheseprocedures.Accordingly,a

PMImemberorapplicantmaysubmittotheExecutiveDirectorawrittenrequestforanextensionofoneor

moreofthetimerequirements;or,areasonableaccommodationrelatedtomattersoflanguage,custom,

geographiclocation,orthelike.TheExecutiveDirectorwillforwardsuchrequeststotheChairoftheEthicsReviewCommitteeortheChairoftheEthicsAppealCommittee,asapplicable.Generally,requestsforsuchtimeextensionsthatseektoincreaseadeadline

andotherreasonableaccommodationswillbegranted.

5. Litigation/OtherProceedings.TheInstitutemayacceptandresolveethicscomplaintswhencivilorcriminal

litigation,orotherproceedingsrelatedtothecomplaint,arealsobeforeacourt,regulatoryagencyor

professionalbody.TheInstitutemayalsocontinueordelaytheresolutionofanyethicscomplaintsinsuch

cases.

6. ImproperDisclosure.TheInstitutemayissueanyappropriatedirective(s)andrequirement(s)whereaPMImemberorapplicant

providesamisleadingdisclosure,orfailstodiscloserequestedinformationrelatedto:PMImembership;

anethicscomplaint;anethicscase;orsimilarmatter.Whereadiscipline,order,orotherdirective,orotherrequirementis

issuedbytheInstituteunderthisSection,thememberorapplicantinvolvedmayseekreviewandappeal

pursuanttotheseprocedures.

7. Confidentiality.Inordertoprotecttheprivacyofthepartiesinvolvedinanethicscase,allmaterialprepared

by,orsubmittedto,theInstitutewillbeconfidential,unlessotherwiseauthorizedbytheseprocedures.

Amongotherinformation,theInstitutewillnotconsiderthefollowingmaterialstobeconfidential:materials

whicharedisclosedastheresultofalegalrequirement;materialswhicharediscloseduponthewrittenrequestofthememberorapplicant

whoisthesubjectofanethicscomplaintorinvestigation,anyinformationrelatingtothememberor

applicantwhichhe/shewouldlikereleasedtootherprofessionalorganizationsorthirdparties,and

whichisnototherwiseconfidential;and,allfinalpublishedrulings,decisions,requirements,orders,and/orreportsofthe

EthicsReviewCommitteeortheEthicsAppealsCommittee.

8. FailuretoCooperate.IfanypartyrefusestofullycooperatewiththeInstituteconcerningmattersarising

undertheseprocedureswithoutgoodcause,theInstitutemay:terminatetheethicscomplaintofan

uncooperativeComplainant;or,imposeanysanctionorrequirementincludedwithintheserulesifaRespondentis

uncooperative.Whereadiscipline,order,requirement,orotherdirectiveisissuedbytheInstituteunderthisSection,the

memberorapplicantinvolvedmayseekreviewandappealpursuanttotheseprocedures.

9. ResignationfromtheInstitute.ShouldaRespondentattempttorelinquishPMImembershiporwithdrawan

applicationduringthecourseofanyethicscase,theInstitutereservestherighttocontinuethemattertoa

finalandbindingresolutionaccordingtotheseprocedures.

B. SubmissionofEthicsComplaints/AcceptanceorRejection.

1. ExecutiveDirector.Anyperson,group,organization,or,inappropriatecases,theInstitute(Complainant)mayinitiateanethicscomplaint.EachComplainantmustsubmittotheExecutiveDirectoradetailedwrittendescriptionofthefactualallegationssupportingtheethicscomplaint,includingthespecificprovisionsoftheMemberCodeofEthicsorMemberStandardsofConductrelevanttotheallegationssetforthinthecomplaint.TheExecutiveDirectorwillforwardthecomplainttotheEthicsReviewCommitteeChairforreview,consideration,andassignment.

2. EthicsReviewCommittee.TheEthicsReviewCommitteewillberesponsiblefortheinvestigationandresolutionofeachethicscomplaint.Uponreceiptofacomplaint,theReviewCcommitteewilldeterminewhether

sufficientddetailispresentedtoconstituteaformalethicscomplaint,baseduponthespecificMemberCodeofrEthicsorMemberStandardsofConductprovisionsprovidedidentifiedbythecomplaint,andtopermittheReviewCcommitteetoconductanappropriatereview.

3. ComplaintAcceptance/RejectionCriteria.Inordertodetermineifanethicscomplaintisacceptedorrejected,theEthicsReviewCommitteewillconsiderwhether:aprovencomplaintwouldconstituteaviolationofthespecificMemberCodeofEthicsorMemberStandardsofConductprovisionsidentifiedbytheComplainantintheoriginalsubmission;thepassageoftimesincetheallegedviolationrequiresthatthecomplaintberejected;relevant,reliableinformationorproofconcerningthechargeisavailable;theComplainantiswillingtoprovidetestimonyorotherevidenceconcerningthecomplaint;and,thereisreasonablecausetobelievethatthechargeappearstobejustified,consideringtheproofavailable.

3.a. ComplaintAcceptance.Uponadeterminationthatanethicscomplaintisappropriate,theEthicsReviewCommitteewillissueaformalEthicsComplaintNoticeidentifyingeachMemberCodeofEthicsandMemberStandardsofConductviolationalleged,andthesupportingfactualbasisforeachcomplaint.ThisNoticewillbedeliveredtotheRespondent,andwillbemarkedConfidential.TheReviewCommitteemayrequestadditionalinformationtosupplementorexplainanallegation.

3.b. ComplaintRejection.IftheEthicsReviewCommitteedeterminesthatanallegationorcomplaintchangeshouldnotbeaformalethicscomplaint,theReviewCommitteewillreturnallinformationsubmittedandnotifyComplainantoftherejectionanditsbasisbycorrespondence.

3.b.1. AppealofComplaintRejectionDetermination.Withinforty-five(45)daysofthemailingdateofcomplaintrejectioncorrespondence,theComplainantmayappealtotheEthicsAppealsCommitteebystatinginwritingtheproceduralerrorshe/shebelievesweremadebytheEthicsReviewCommitteewithrespecttothechargerejection,ifany;thespecificprovisionsoftheMemberCodeofEthicsandMemberStandardsofConductbelievedviolated;and,thespecificinformationhe/shebelievessupportstheacceptanceofacomplaint.TheEthicsAppealsCommitteewillreviewtheComplainant’sappealandissueadecisionbasedupontherecord.TheAppealsCommitteemayaccepttheReviewCommitteedecisionandrejectthecomplaint,oranypartthereof;or,reversetheReviewCommitteedecisionanddirectthatacomplaintbeissuedandthecaseresolvedundertheseprocedures.

4. EthicsComplaintResponse.Withinforty-five(45)daysofthemailingdateofanEthicsComplaintNotice,theRespondentmustsubmitaresponsetotheEthicsReviewCommittee.TheEthicsComplaintResponsemustincludeafullresponsetoeachcomplaint,andacopyofeachdocumentrelevanttotheresolutionoftheethicscomplaint.TheReviewCommitteemayrequestadditionalinformationtosupplementaresponse.

5. ComplaintReferral.IftheEthicsReviewCommitteedeterminesthatthefactualallegationspresentedbyaComplainant,ortheinformationrevealedbyaninvestigation,mayconstituteaviolationofMemberCodeofEthicsorMemberStandardsofConductprovisionsnotdirectlyrelatedtothosepresentedbytheComplainant,theReviewCommitteemaytakeanyofthefollowingactions:notifytheRespondentofpossible,unrelatedCodeorStandardsviolations,andanyrecommendedcorrectiveactions;referthemattertotheComplainantforreviewandpossiblere-submissionofarevisedornewcomplaint;referthemattertootherInstitute,government,orprofessionalbodiesforreview;or,otherappropriateactions/referrals.

C. PreliminaryActionsandOrders.

PreliminaryandTemporaryOrders.TheEthicsReviewCommittee,ortheEthicsAppealsCommittee,mayrequiretheRespondenttodo,ortorefrainfromdoing,certainactsbyPreliminaryandTemporaryOrderreasonablyrelatedtothecomplaintunderconsiderationpendingthefinalresolutionofthecaseorinvestigation.Suchordersmayinclude,butarenotlimitedto,arequirementthattheRespondentvoluntarilyandimmediatelyceasefromrepresentinghimselforherselfasaPMImemberorapplicant,orasotherwiseassociatedwiththeInstituteuntilfurthernotice;or,arestrictionthattheRespondentmaynotpursueaPMIpositionorofficependingthefinalresolutionoftheethicsmatterunderreview.TheEthicsReviewCommitteeortheEthicsAppealsCommitteemaydisciplineaRespondentwhofailstocomplywithaTemporaryorPreliminaryOrder.PreliminaryandTemporaryOrdersarenotsubjecttoappeal,butmaybereconsideredbytheCommitteesuponwrittenrequestoftheRespondentpresentingsubstantialreasonsthattheorderisnolongernecessary.

D. EthicsReviewCommitteeHearings.

1. EthicsReviewCommittee.ThePMIBoardofDirectorswillappointatleastseven(7)PMImemberstoserveastheEthicsReviewCommitteetoinvestigateandresolveethicscomplaintmatters.ThePMIChair,withBoardofDirectorsapproval,willappointaCommitteeChairfromthesevenmembers,whowillsupervisetheworkoftheCommittee.TheChairmayappointoneormoreVice-Chairstoassisthim/her,andtoalsopresideovereachEthicsHearing.AsdirectedbytheCommitteeChair,three(3)disinterestedmembersoftheEthicsReviewCommitteewillbeassignedtoeachcase,andwillconductaninformalEthicsHearingdesignedtocollectandweighalloftheavailableinformationandproof,andwillhavefullauthoritytoconvene,presideover,continue,decide,andconcludeanEthicsHearing.

2. HearingSchedule,Notice,andAttendance.Thehearingdate,time,andlocationforeachethicscasewillbescheduledbytheEthicsReviewCommitteeinconsultationwiththeparties,andbothpartieswillbenotifiedinwriting.Eachpartymayattendthehearinginpersonorviatelephoneconference,whereallparticipantswillbeabletocommunicatewitheachother.

3. ParticipationofLegalRepresentatives/ConductoftheHearing.UponrequestbytheEthicsReviewCommittee,thePMIChair,orthePMIBoardofDirectors,thePMILegalCounselshallbeavailabletoassisttheCommitteeShouldthePMIGeneralCounselbepresentatanEthics

Hearing,theGeneralCounselwithhavetheprivilegeofthefloor,andmayconductthehearinginconsultationwiththe

EthicsReviewCommittee.Legalorotherrepresentativesofthepartiesdonothavesuchprivilegeandare

boundbythedeterminationsandrulingsoftheEthicsReviewCommitteeandPMILegalCounsel.No

formallegalrulesofevidence,cross-examination,oath,andotherprocedureswillapplytohearings.ThePMI

memberorapplicant,oralegalrepresentative,willbepermittedtoaskquestionsofwitnessesatthe

discretionoftheEthicsReviewCommittee.Objectionsrelatingtorelevanceofinformationandother

proceduralissueswillbedecidedbytheEthicsReviewCommitteeandthesedecisionsarenotsubjectto

appeal.

4. HearingRecord.Ataped,written,orotherrecordoftheEthicsHearingwillbemadebytheEthicsReviewCommittee,anotherPMIrepresentative,orastenographer/recorder,asdeterminedbytheReviewCommittee.

5. HearingExpenses.Partieswillberesponsiblefortheirexpensesassociatedwithanethicsinvestigationorcase,includingthecostsassociatedwithanywitnessesorlegalcounsel.TheInstitutewillbearothergeneralcostsofconductingtheEthicsHearing,includingcostsassociatedwiththeactivitiesofPMIrepresentatives.

6. ClosingoftheHearingRecord.AnyEthicsHearingmayproceedtoaconclusionanddecision,whetherornotthepartiesarepresent,basedontheappropriatewrittenrecord,asdeterminedbytheEthicsReviewCommittee.TheReviewCommitteewillreviewthehearingrecord,aswellasanysubmissionspresentedbythepartiesandotherrelevantinformation,andthereafter,willdeterminetheoutcomeoftheethicscasebymajorityvoteinaclosedsession.Thehearingrecordwillbeclosedfollowingtheconclusionofthehearing,unlessotherwisedirectedbytheEthicsReviewCommitteeChairoraVice-Chair.

7. EthicsReviewCommitteeDecisionandOrder.ADecisionandOrderwillbepreparedbytheEthicsReviewCommitteeaftertheclosingoftherecord,whichwillincludeasummaryofthecase,includingthepositionsoftheparties;asummaryofrelevantfactualfindingsbasedontherecordofthehearing;afinalrulingontheMemberCodeofEthicsandMemberStandardsofConductviolationscharged;and,astatementofanycorrectiveordisciplinaryaction(s),andotherdirectivesissuedbytheReviewCommittee.CopiesoftheEthicsReviewCommitteeDecisionandOrdershallbesenttotheparties.Thepartieswillalsobenotifiedthatthefinaldecisionmaybepublishedconsistentwiththerequirementsoftheseprocedures.

8. DisciplinaryActionsAvailable.WhenaRespondentisfoundtohaveviolatedoneormoreprovisionsoftheMemberCodeofEthicsorMemberStandardsofConduct,theInstitutemayissueandorderoneormoreofthefollowingdisciplinaryorremedialactions:

8.a. ThedenialandrejectionofanyPMImembershipapplication;

8.b Privatereprimandandcensure,includinganyappropriateconditionsordirectives;

8.c. Publicreprimandandcensure,includinganyappropriateconditionsordirectives;

8.d. Membershipprobationforanyperioduptothree(3)years,includinganyappropriaterestrictionsorconditionsconcerningmembershiprightsandanyotherconditionsordirectives;

8.e. Suspensionofmembershipstatusforaperiodofnolessthansix(6)monthsandnomorethanthree(3)years,includinganyappropriateconditionsordirectives;

8.f. TerminationofmembershipandexpulsionfromtheInstitute.

E. EthicsAppealsCommittee/Appeals.

1. TimePeriodforSubmittingAppeal.Withinforty-five(45)daysofthemailingdateofanadverseEthicsReviewCommitteeDecisionandOrder,theRespondentortheComplainantmaysubmittothePMIExecutiveDirectorawrittenappealofalloraportionoftheDecisionandOrderconsistentwiththerequirementsoftheseprocedures.TheExecutiveDirectorwillforwardtheappealtotheEthicsAppealsCommitteeChairforreview,consideration,andassignment.

2. GroundsforAppeal.AnadverseEthicsReviewCommitteeDecisionandOrdermaybereversedorotherwisemodifiedbytheEthicsAppealsCommittee.However,thegroundsforappealofanadversedecisionarestrictlylimitedtothefollowing:

2.a. ProceduralError.TheEthicsReviewCommitteemisappliedaprocedurecontainedintheserules,andthemisapplicationprejudicedtheappealingparty.

2.b. NeworPreviouslyUndiscoveredInformation.FollowingtheclosingoftheHearingRecord,theappealingpartyhaslocatedrelevantproofthatwasnotpreviouslyinhis/herpossession;wasnotreasonablyavailablepriortoclosureoftherecord;and,couldhaveaffectedtheEthicsReviewCommitteedecision.

2.c. MisapplicationoftheCodeofEthicsorStandardsofConduct.TheEthicsReviewCommitteemisappliedtheprovisionsoftheMemberCodeofEthicsorMemberStandardsofConduct,andthemisapplicationprejudicedtheappealingparty.

2.d. ContrarytotheInformationPresented.TheEthicsReviewCommitteedecisioniscontrarytothemostsubstantialinformationprovidedintherecord.

2.e WithrespecttoSubsections2.a.and2.c.above,theEthicsAppealsCommitteewillconsideronlyargumentsthatwerepresentedtotheEthicsReviewCommitteepriortotheclosingoftheHearingRecord.

3. ContentsofAppealLetter.TheappealingpartymustsubmittothePMIExecutiveDirectoraletterorotherwrittendocumentdirectedtotheEthicsAppealsCommitteeandtotheotherparty,whichcontainsthefollowinginformationandmaterial:theethicscasename;thedocketnumberanddateoftheEthicsReviewCommitteeDecision;astatementandcompleteexplanationofthereasonsfortheappealunderSectionE.2,includinganexplanationandbasisforanyrequestconcerningareductioninthedisciplineissuedbytheEthicsReviewCommittee;and,copiesofanymaterialsupportingtheappeal.

F. EthicsAppealsCommittee/AppealHearings.

1. EthicsAppealsCommittee.ThePMIBoardofDirectorswillappointatleastseven(7)PMImemberstoserveastheEthicsAppealsCommitteetoresolveethicsappeals.ThePMIChair,withBoardofDirectorsapproval,willappointaCommitteeChairfromthesevenmembers,whowillsupervisetheworkoftheAppealsCommittee.TheChairmayappointoneormoreVice-Chairstoassisthim/her,andtoalsopresideovereachAppealHearing.AsdirectedbytheCommitteeChair,three(3)disinterestedmembersoftheAppealsCommitteewillbeassignedtoeachcase,andwillhavefullauthoritytoconvene,presideover,continue,decide,andconcludeanethicsappeal.

2. AppealHearings.Followingreceiptofacompleteandproperwrittenappeal,theEthicsAppealsCommitteewillscheduleadateonwhichtoconductanAppealHearing,andthepartieswillbenotifiedinwritingatleastforty-five(45)daysinadvanceofthescheduleddate.TheAppealsCommitteewillreviewthehearingrecord,aswellasanyappealsubmissionspresentedbythepartiesandotherrelevantinformation,andthereafterwilldetermineandresolvetheappealbymajorityvoteinaclosedsession.

3. RequesttoAppearBeforeEthicsAppealsCommittee.EitherpartymayrequesttheopportunitytoappearbeforetheEthicsAppealsCommitteeinwritingatleastforty-five(45)dayspriortothedatescheduledfortheAppealHearing.IntheeventthatarequesttoappearbeforetheEthicsAppealsCommitteeisapproved,theAppealsCommitteemaylimittheappearanceinanymanner.DenialsofrequeststoappearbeforetheAppealsCommitteearenotsubjecttoappeal.

4. EthicsAppealsCommitteeDecisionandOrder.FollowingtheconclusionofanAppealHearing,theEthicsAppealsCommitteewillissueanAppealDecisionandOrderstating:theoutcomeandresolutionoftheappeal,includingasummaryofrelevantportionsoftheEthicsReviewCommitteeDecisionandOrder;asummaryofanyrelevantproceduralorfactualfindingsmadebytheAppealsCommittee;theEthicsAppealsCommittee’sruling(s)anddecision(s)withrespecttothemattersunderappeal;and,theAppealsCommittee’sfinalDec
