ArbitrationRules(RevisedandadoptedbytheChinaCouncilforthePromotionofInternationalTrade/ChinaChamberofInternationalCommerceonNovember4,2023.EffectiveasofJanuary1,2023.)ChapterIGeneralProvisionsArticle1TheArbitrationCommission

1.TheChinaInternationalEconomicandTradeArbitrationCommission(“CIETAC”),originallynamedtheForeignTradeArbitrationCommissionoftheChinaCouncilforthePromotionofInternationalTradeandlaterrenamedtheForeignEconomicandTradeArbitrationCommissionoftheChinaCouncilforthePromotionofInternationalTrade,concurrentlyusesasitsnamethe“ArbitrationInstituteoftheChinaChamberofInternationalCommerce”.

2.WhereanarbitrationagreementprovidesforarbitrationbytheChinaCouncilforthePromotionofInternationalTrade/ChinaChamberofInternationalCommerce,orbytheArbitrationCommissionortheArbitrationInstituteoftheChinaCouncilforthePromotionofInternationalTrade/ChinaChamberofInternationalCommerce,orreferstoCIETAC’spreviousnames,itshallbedeemedthatthepartieshaveagreedtoarbitrationbyCIETAC.Article2StructureandDuties1.TheChairmanofCIETACshallperformthefunctionsanddutiesvestedinhim/herbytheseRuleswhileaViceChairmanmayperformtheChairman’sfunctionsanddutieswiththeChairman’sauthorization.

2.CIETAChasanArbitrationCourt(the“ArbitrationCourt”),whichperformsitsfunctionsinaccordancewiththeseRulesunderthedirectionoftheauthorizedViceChairmanandthePresidentoftheArbitrationCourt.

3.CIETACisbasedinBeijing.Ithassub-commissionsorarbitrationcenters(AppendixI).Thesub-commissions/arbitrationcentersareCIETAC’sbranches,whichacceptarbitrationapplicationsandadministerarbitrationcaseswithCIETAC’sauthorization.

4.Asub-commission/arbitrationcenterhasanarbitrationcourt,whichperformsthefunctionsoftheArbitrationCourtinaccordancewiththeseRulesunderthedirectionofthepresidentofthearbitrationcourtofthesub-commission/arbitrationcenter.

5.Whereacaseisadministeredbyasub-commission/arbitrationcenter,thefunctionsanddutiesvestedinthePresidentoftheArbitrationCourtundertheseRulesmay,byhis/herauthorization,beperformedbythepresidentofthearbitrationcourtoftherelevantsub-commission/arbitrationcenter.

6.ThepartiesmayagreetosubmittheirdisputestoCIETACorasub-commission/arbitrationcenterofCIETACforarbitration.WherethepartieshaveagreedtoarbitrationbyCIETAC,theArbitrationCourtshallacceptthearbitrationapplicationandadministerthecase.Wherethepartieshaveagreedtoarbitrationbyasub-commission/arbitrationcenter,thearbitrationcourtofthesub-commission/arbitrationcenteragreeduponbythepartiesshallacceptthearbitrationapplicationandadministerthecase.Wherethesub-commission/arbitrationcenteragreeduponbythepartiesdoesnotexistoritsauthorizationhasbeenterminated,orwheretheagreementisambiguous,theArbitrationCourtshallacceptthearbitrationapplicationandadministerthecase.Intheeventofanydispute,adecisionshallbemadebyCIETAC.Article3Jurisdiction

1.CIETACacceptscasesinvolvingeconomic,tradeandotherdisputesofacontractualornon-contractualnature,basedonanagreementoftheparties.

2.Thecasesreferredtointheprecedingparagraphinclude:

(a)internationalorforeign-relateddisputes;

(b)disputesrelatedtotheHongKongSpecialAdministrativeRegion,theMacaoSpecialAdministrativeRegionandtheTaiwanregion;and

(c)domesticdisputes.Article4ScopeofApplication

1.TheseRulesuniformlyapplytoCIETACanditssub-commissions/arbitrationcenters.

2.WherethepartieshaveagreedtorefertheirdisputetoCIETACforarbitration,theyshallbedeemedtohaveagreedtoarbitrationinaccordancewiththeseRules.

3.WherethepartiesagreetorefertheirdisputetoCIETACforarbitrationbuthaveagreedonamodificationoftheseRulesorhaveagreedontheapplicationofotherarbitrationrules,theparties’agreementshallprevailunlesssuchagreementisinoperativeorinconflictwithamandatoryprovisionofthelawapplicabletothearbitralproceedings.Wherethepartieshaveagreedontheapplicationofotherarbitrationrules,CIETACshallperformtherelevantadministrativeduties.

4.WherethepartiesagreetorefertheirdisputetoarbitrationundertheseRuleswithoutprovidingthenameofthearbitrationinstitution,theyshallbedeemedtohaveagreedtoreferthedisputetoarbitrationbyCIETAC.

5.WherethepartiesagreetorefertheirdisputetoarbitrationunderCIETAC’scustomizedarbitrationrulesforaspecifictradeorprofession,theparties’agreementshallprevail.However,ifthedisputefallsoutsidethescopeofthespecificrules,theseRulesshallapply.Article5ArbitrationAgreement

1.Anarbitrationagreementmeansanarbitrationclauseinacontractoranyotherformofawrittenagreementconcludedbetweenthepartiesprovidingforthesettlementofdisputesbyarbitration.

2.Thearbitrationagreementshallbeinwriting.Anarbitrationagreementisinwritingifitiscontainedinthetangibleformofadocumentsuchasacontract,letter,telegram,telex,fax,electronicdatainterchange,oremail.AnarbitrationagreementshallbedeemedtoexistwhereitsexistenceisassertedbyonepartyandnotdeniedbytheotherduringtheexchangeoftheRequestforArbitrationandtheStatementofDefense.

3.Wherethelawapplicabletoanarbitrationagreementhasdifferentprovisionsastotheformandvalidityofthearbitrationagreement,thoseprovisionsshallprevail.

4.Anarbitrationclausecontainedinacontractshallbetreatedasaclauseindependentandseparatefromallotherclausesofthecontract,andanarbitrationagreementattachedtoacontractshallalsobetreatedasindependentandseparatefromallotherclausesofthecontract.Thevalidityofanarbitrationclauseoranarbitrationagreementshallnotbeaffectedbyanymodification,cancellation,termination,transfer,expiry,invalidity,ineffectiveness,rescissionornon-existenceofthecontract.Article6ObjectiontoArbitrationAgreementand/orJurisdiction

1.CIETAChasthepowertodeterminetheexistenceandvalidityofanarbitrationagreementanditsjurisdictionoveranarbitrationcase.CIETACmay,wherenecessary,delegatesuchpowertothearbitraltribunal.

2.WhereCIETACissatisfiedbyprimafacieevidencethatavalidarbitrationagreementexists,itmaymakeadecisionbasedonsuchevidencethatithasjurisdictionoverthearbitrationcase,andthearbitrationshallproceed.SuchadecisionshallnotpreventCIETACfrommakinganewdecisiononjurisdictionbasedonfactsand/orevidencefoundbythearbitraltribunalduringthearbitralproceedingsthatareinconsistentwiththeprimafacieevidence.

3.WhereCIETAChasdelegatedthepowertodeterminejurisdictiontothearbitraltribunal,thearbitraltribunalmayeithermakeaseparatedecisiononjurisdictionduringthearbitralproceedingsorincorporatethedecisioninthefinalarbitralaward.

4.Anyobjectiontoanarbitrationagreementand/orthejurisdictionoveranarbitrationcaseshallberaisedinwritingbeforethefirstoralhearingheldbythearbitraltribunal.Whereacaseistobedecidedonthebasisofdocumentsonly,suchanobjectionshallberaisedbeforethesubmissionofthefirstsubstantivedefense.

5.Thearbitrationshallproceednotwithstandinganobjectiontothearbitrationagreementand/orjurisdictionoverthearbitrationcase.

6.Theaforesaidobjectionstoand/ordecisionsonjurisdictionbyCIETACshallincludeobjectionstoand/ordecisionsonaparty’sstandingtoparticipateinthearbitration.

7.CIETACoritsauthorizedarbitraltribunalshalldecidetodismissthecaseuponfindingthatCIETAChasnojurisdictionoveranarbitrationcase.Whereacaseistobedismissedbeforetheformationofthearbitraltribunal,thedecisionshallbemadebythePresidentoftheArbitrationCourt.Wherethecaseistobedismissedaftertheformationofthearbitraltribunal,thedecisionshallbemadebythearbitraltribunal.Article7PlaceofArbitration

1.Wherethepartieshaveagreedontheplaceofarbitration,theparties’agreementshallprevail.

2.Wherethepartieshavenotagreedontheplaceofarbitrationortheiragreementisambiguous,theplaceofarbitrationshallbethedomicileofCIETACoritssub-commission/arbitrationcenteradministeringthecase.CIETACmayalsodeterminetheplaceofarbitrationtobeanotherlocationhavingregardtothecircumstancesofthecase.

3.Thearbitralawardshallbedeemedashavingbeenmadeattheplaceofarbitration.Article8ServiceofDocumentsandPeriodsofTime

1.Alldocuments,noticesandwrittenmaterialsinrelationtothearbitrationmaybedeliveredinpersonorsentbyregisteredmailorexpressmail,fax,orbyanyothermeansconsideredproperbytheArbitrationCourtorthearbitraltribunal.

2.ThearbitrationdocumentsreferredtointheprecedingParagraph1shallbesenttotheaddressprovidedbythepartyitselforbyitsrepresentative(s),ortoanaddressagreedbytheparties.Whereapartyoritsrepresentative(s)hasnotprovidedanaddressorthepartieshavenotagreedonanaddress,thearbitrationdocumentsshallbesenttosuchparty’saddressasprovidedbytheotherpartyoritsrepresentative(s).

3.Anyarbitrationcorrespondencetoapartyoritsrepresentative(s)shallbedeemedtohavebeenproperlyservedonthepartyifdeliveredtotheaddresseeorsenttotheaddressee’splaceofbusiness,placeofregistration,domicile,habitualresidenceormailingaddress,orwhere,afterreasonableinquiriesbytheotherparty,noneoftheaforesaidaddressescanbefound,thearbitrationcorrespondenceissentbytheArbitrationCourttotheaddressee’slastknownplaceofbusiness,placeofregistration,domicile,habitualresidenceormailingaddressbyregisteredorexpressmail,orbyanyothermeansthatcanprovidearecordoftheattemptatdelivery,includingbutnotlimitedtoservicebypublicnotary,entrustmentorretention.

4.TheperiodsoftimespecifiedintheseRulesshallbeginonthedayfollowingthedaywhenthepartyreceivesorshouldhavereceivedthearbitrationcorrespondence,noticesorwrittenmaterialssentbytheArbitrationCourt.Article9GoodFaith

Arbitrationparticipantsshallproceedwiththearbitrationingoodfaith.Article10WaiverofRighttoObject

Apartyshallbedeemedtohavewaiveditsrighttoobjectwhereitknowsorshouldhaveknownthatanyprovisionof,orrequirementunder,theseRuleshasnotbeencompliedwithandyetparticipatesinorproceedswiththearbitralproceedingswithoutpromptlyandexplicitlysubmittingitsobjectioninwritingtosuchnon-compliance.ChapterIIArbitralProceedingsSection1RequestforArbitration,DefenseandCounterclaimArticle11CommencementofArbitration

ThearbitralproceedingsshallcommenceonthedayonwhichtheArbitrationCourtreceivesaRequestforArbitration.Article12ApplicationforArbitration

ApartyapplyingforarbitrationundertheseRulesshall:

1.SubmitaRequestforArbitrationinwritingsignedand/orsealedbytheClaimantoritsauthorizedrepresentative(s),whichshall,interalia,include:

(a)thenamesandaddressesoftheClaimantandtheRespondent,includingthezipcode,telephone,fax,email,oranyothermeansofelectronictelecommunications;

(b)areferencetothearbitrationagreementthatisinvoked;

(c)astatementofthefactsofthecaseandthemainissuesindispute;

(d)theclaimoftheClaimant;and

(e)thefactsandgroundsonwhichtheclaimisbased.

2.AttachtotheRequestforArbitrationtherelevantdocumentaryandotherevidenceonwhichtheClaimant’sclaimisbased.

3.PaythearbitrationfeeinadvancetoCIETACinaccordancewithitsArbitrationFeeSchedule.Article13AcceptanceofaCase

1.Uponthewrittenapplicationofaparty,CIETACshallacceptacaseinaccordancewithanarbitrationagreementconcludedbetweenthepartieseitherbeforeoraftertheoccurrenceofthedispute,inwhichitisprovidedthatdisputesaretobereferredtoarbitrationbyCIETAC.

2.UponreceiptofaRequestforArbitrationanditsattachments,whereafterexaminationtheArbitrationCourtfindstheformalitiesrequiredforarbitrationapplicationtobecomplete,itshallsendaNoticeofArbitrationtobothpartiestogetherwithonecopyeachoftheseRulesandCIETAC’sPanelofArbitrators.TheRequestforArbitrationanditsattachmentssubmittedbytheClaimantshallbesenttotheRespondentunderthesamecover.

3.WhereafterexaminationtheArbitrationCourtfindstheformalitiesrequiredforthearbitrationapplicationtobeincomplete,itmayrequesttheClaimanttocompletethemwithinaspecifiedtimeperiod.TheClaimantshallbedeemednottohavesubmittedaRequestforArbitrationifitfailstocompletetherequiredformalitieswithinthespecifiedtimeperiod.Insuchacase,theClaimant’sRequestforArbitrationanditsattachmentsshallnotbekeptonfilebytheArbitrationCourt.

4.AfterCIETACacceptsacase,theArbitrationCourtshalldesignateacasemanagertoassistwiththeproceduraladministrationofthecase.Article14MultipleContracts

TheClaimantmayinitiateasinglearbitrationconcerningdisputesarisingoutoforinconnectionwithmultiplecontracts,providedthat:

(a)suchcontractsconsistofaprincipalcontractanditsancillarycontract(s),orsuchcontractsinvolvethesamepartiesaswellaslegalrelationshipsofthesamenature;

(b)thedisputesariseoutofthesametransactionorthesameseriesoftransactions;and

(c)thearbitrationagreementsinsuchcontractsareidenticalorcompatible.Article15StatementofDefense

1.TheRespondentshallfileaStatementofDefenseinwritingwithinforty-five(45)daysfromthedateofitsreceiptoftheNoticeofArbitration.IftheRespondenthasjustifiedreasonstorequestanextensionofthetimeperiod,thearbitraltribunalshalldecidewhethertograntanextension.Wherethearbitraltribunalhasnotyetbeenformed,thedecisiononwhethertogranttheextensionofthetimeperiodshallbemadebytheArbitrationCourt.

2.TheStatementofDefenseshallbesignedand/orsealedbytheRespondentoritsauthorizedrepresentative(s),andshall,interalia,includethefollowingcontentsandattachments:

(a)thenameandaddressoftheRespondent,includingthezipcode,telephone,fax,email,oranyothermeansofelectronictelecommunications;

(b)thedefensetotheRequestforArbitrationsettingforththefactsandgroundsonwhichthedefenseisbased;and

(c)therelevantdocumentaryandotherevidenceonwhichthedefenseisbased.

3.ThearbitraltribunalhasthepowertodecidewhethertoacceptaStatementofDefensesubmittedaftertheexpirationoftheabovetimeperiod.

4.FailurebytheRespondenttofileaStatementofDefenseshallnotaffecttheconductofthearbitralproceedings.Article16Counterclaim

1.TheRespondentshallfileacounterclaim,ifany,inwritingwithinforty-five(45)daysfromthedateofitsreceiptoftheNoticeofArbitration.IftheRespondenthasjustifiedreasonstorequestanextensionofthetimeperiod,thearbitraltribunalshalldecidewhethertograntanextension.Wherethearbitraltribunalhasnotyetbeenformed,thedecisiononwhethertogranttheextensionofthetimeperiodshallbemadebytheArbitrationCourt.

2.Whenfilingthecounterclaim,theRespondentshallspecifythecounterclaiminitsStatementofCounterclaimandstatethefactsandgroundsonwhichthecounterclaimisbasedwiththerelevantdocumentaryandotherevidenceattachedthereto.

3.Whenfilingthecounterclaim,theRespondentshallpayanarbitrationfeeinadvanceinaccordancewiththeArbitrationFeeScheduleofCIETACwithinaspecifiedtimeperiod,failingwhichtheRespondentshallbedeemednottohavefiledanycounterclaim.

4.Wheretheformalitiesrequiredforfilingacounterclaimarefoundtobecomplete,theArbitrationCourtshallsendaNoticeofAcceptanceofCounterclaimtotheparties.TheClaimantshallsubmititsStatementofDefenseinwritingwithinthirty(30)daysfromthedateofitsreceiptoftheNotice.IftheClaimanthasjustifiedreasonstorequestanextensionofthetimeperiod,thearbitraltribunalshalldecidewhethertograntsuchanextension.Wherethearbitraltribunalhasnotyetbeenformed,thedecisiononwhethertogranttheextensionofthetimeperiodshallbemadebytheArbitrationCourt.

5.ThearbitraltribunalhasthepowertodecidewhethertoacceptacounterclaimoraStatementofDefensesubmittedaftertheexpirationoftheabovetimeperiod.

6.FailureoftheClaimanttofileaStatementofDefensetotheRespondent’scounterclaimshallnotaffecttheconductofthearbitralproceedings.Article17AmendmenttoClaimorCounterclaim

TheClaimantmayapplytoamenditsclaimandtheRespondentmayapplytoamenditscounterclaim.However,thearbitraltribunalmayrefuseanysuchamendmentifitconsidersthattheamendmentistoolateandmaydelaythearbitralproceedings.Article18JoinderofAdditionalParties

1.Duringthearbitralproceedings,apartywishingtojoinanadditionalpartytothearbitrationmayfiletheRequestforJoinderwithCIETAC,basedonthearbitrationagreementinvokedinthearbitrationthatprimafaciebindstheadditionalparty.WheretheRequestforJoinderisfiledaftertheformationofthearbitraltribunal,adecisionshallbemadebyCIETACafterthearbitraltribunalhearsfromallpartiesincludingtheadditionalpartyifthearbitraltribunalconsidersthejoindernecessary.

ThedateonwhichtheArbitrationCourtreceivestheRequestforJoindershallbedeemedtobethedateofthecommencementofarbitrationagainsttheadditionalparty.

2.TheRequestforJoindershallcontainthecasenumberoftheexistingarbitration;thename,addressandothermeansofcommunicationofeachoftheparties,includingtheadditionalparty;thearbitrationagreementinvokedtojointheadditionalpartyaswellasthefactsandgroundstherequestreliesupon;andthe

claim.

TherelevantdocumentaryandotherevidenceonwhichtherequestisbasedshallbeattachedtotheRequestforJoinder.

3.Whereanypartyobjectstothearbitrationagreementand/orjurisdictionoverthearbitrationwithrespecttothejoinderproceedings,CIETAChasthepowertodecideonitsjurisdictionbasedonthearbitrationagreementandrelevantevidence.

4.Afterthejoinderproceedingscommence,theconductofthearbitralproceedingsshallbedecidedbytheArbitrationCourtifthearbitraltribunalisnotformed,orshallbedecidedbythearbitraltribunalifithasbeenformed.

5.Wherethejoindertakesplacepriortotheformationofthearbitraltribunal,therelevantprovisionsonparty’snominatingorentrustingoftheChairmanofCIETACtoappointarbitratorundertheseRulesshallapplytotheadditionalparty.ThearbitraltribunalshallbeformedinaccordancewithArticle29oftheseRules.

Wherethejoindertakesplaceaftertheformationofthearbitraltribunal,thearbitraltribunalshallhearfromtheadditionalpartyofitscommentsonthepastarbitralproceedingsincludingtheformationofthearbitraltribunal.IftheadditionalpartyrequeststonominateorentrusttheChairmanofCIETACtoappointanarbitrator,bothpartiesshallnominateorentrusttheChairmanofCIETACtoappointarbitratorsagain.ThearbitraltribunalshallbeformedinaccordancewithArticle29oftheseRules.

6.TherelevantprovisionsonthesubmissionoftheStatementofDefenseandtheStatementofCounterclaimundertheseRulesshallapplytotheadditionalparty.ThetimeperiodfortheadditionalpartytosubmititsStatementofDefenseandStatementofCounterclaimshallstartcountingfromthedateofitsreceiptoftheNoticeofJoinder.

7.CIETACshallhavethepowertodecidenottojoinanadditionalpartywheretheadditionalpartyisprimafacienotboundbythearbitrationagreementinvokedinthearbitration,orwhereanyothercircumstanceexiststhatmakesthejoinderinappropriate.Article19ConsolidationofArbitrations

1.Attherequestofaparty,CIETACmayconsolidatetwoormorearbitrationspendingundertheseRulesintoasinglearbitrationif:

(a)alloftheclaimsinthearbitrationsaremadeunderthesamearbitrationagreement;

(b)theclaimsinthearbitrationsaremadeundermultiplearbitrationagreementsthatareidenticalorcompatibleandthearbitrationsinvolvethesamepartiesaswellaslegalrelationshipsofthesamenature;

(c)theclaimsinthearbitrationsaremadeundermultiplearbitrationagreementsthatareidenticalorcompatibleandthemultiplecontractsinvolvedconsistofaprinciplecontractanditsancillarycontract(s);or

(d)allthepartiestothearbitrationshaveagreedtoconsolidation.

2.IndecidingwhethertoconsolidatethearbitrationsinaccordancewiththeprecedingParagraph1,CIETACshalltakeintoaccounttheopinionsofallpartiesandotherrelevantfactorssuchasthecorrelationbetweenthearbitrationsconcerned,includingthenominationandappointmentofarbitratorsintheseparatearbitrations.

3.Unlessotherwiseagreedbyalltheparties,thearbitrationsshallbeconsolidatedintothearbitrationthatwasfirstcommenced.

4.Aftertheconsolidationofarbitrations,theconductofthearbitralproceedingsshallbedecidedbytheArbitrationCourtifthearbitraltribunalisnotformed,orshallbedecidedbythearbitraltribunalifithasbeenformed.Article20SubmissionandExchangeofArbitrationDocuments

1.AllarbitrationdocumentsfromthepartiesshallbesubmittedtotheArbitrationCourt.

2.AllarbitrationdocumentstobeexchangedduringthearbitralproceedingsshallbeexchangedamongthearbitraltribunalandthepartiesbytheArbitrationCourtunlessotherwiseagreedbythepartiesandwiththeconsentofthearbitraltribunalorotherwisedecidedbythearbitraltribunal.Article21CopiesofArbitrationDocuments

WhensubmittingtheRequestforArbitration,theStatementofDefense,theStatementofCounterclaim,evidence,andotherarbitrationdocuments,thepartiesshallmaketheirsubmissionsinquintuplicate.Wheretherearemultipleparties,additionalcopiesshallbeprovidedaccordingly.Wherethepartyappliesforpreservationofpropertyorprotectionofevidence,itshallalsoprovideadditionalcopiesaccordingly.Wherethearbitraltribunaliscomposedofasolearbitrator,thenumberofcopiessubmittedmaybereducedbytwo.Article22Representation

ApartymayberepresentedbyitsauthorizedChineseand/orforeignrepresentative(s)inhandlingmattersrelatingtothearbitration.Insuchacase,aPowerofAttorneyshallbeforwardedtotheArbitrationCourtbythepartyoritsauthorizedrepresentative(s).Article23ConservatoryandInterimMeasures

1.WhereapartyappliesforconservatorymeasurespursuanttothelawsofthePeople’sRepublicofChina,CIETACshallforwardtheparty’sapplicationtothecompetentcourtdesignatedbythatpartyinaccordancewiththelaw.

2.Inaccordancewiththeapplicablelawortheagreementoftheparties,apartymayapplytotheArbitrationCourtforemergencyreliefpursuanttotheCIETACEmergencyArbitratorProcedures(AppendixIII).Theemergencyarbitratormaydecidetoorderorawardnecessaryorappropriateemergencymeasures.Thedecisionoftheemergencyarbitratorshallbebindinguponbothparties.

3.Attherequestofaparty,thearbitraltribunalmaydecidetoorderorawardanyinterimmeasureitdeemsnecessaryorproperinaccordancewiththeapplicablelawortheagreementofthepartiesandmayrequiretherequestingpartytoprovideappropriatesecurityinconnectionwiththemeasure.Section2ArbitratorsandtheArbitralTribunalArticle24DutiesofArbitrator

Anarbitratorshallnotrepresenteitherparty,andshallbeandremainindependentofthepartiesandtreatthemequally.Article25NumberofArbitrators

1.Thearbitraltribunalshallbecomposedofoneorthreearbitrators.

2.UnlessotherwiseagreedbythepartiesorprovidedbytheseRules,thearbitraltribunalshallbecomposedofthreearbitrators.Article26NominationorAppointmentofArbitrator

1.CIETACmaintainsaPanelofArbitratorswhichuniformlyappliestoitselfandallitssub-commissions/arbitrationcenters.ThepartiesshallnominatearbitratorsfromthePanelofArbitratorsprovidedbyCIETAC.

2.WherethepartieshaveagreedtonominatearbitratorsfromoutsideCIETAC’sPanelofArbitrators,anarbitratorsonominatedbythepartiesornominatedaccordingtotheagreementofthepartiesmayactasarbitratorsubjecttotheconfirmationbytheChairmanofCIETAC.Article27Three-ArbitratorTribunal

1.Withinfifteen(15)daysfromthedateofreceiptoftheNoticeofArbitration,theClaimantandtheRespondentshalleachnominate,orentrusttheChairmanofCIETACtoappoint,anarbitrator,failingwhichthearbitratorshallbeappointedbytheChairmanofCIETAC.

2.Withinfifteen(15)daysfromthedateoftheRespondent’sreceiptoftheNoticeofArbitration,thepartiesshalljointlynominate,orentrusttheChairmanofCIETACtoappoint,thethirdarbitrator,whoshallactasthepresidingarbitrator.

3.ThepartiesmayeachrecommendonetofivearbitratorsascandidatesforthepresidingarbitratorandshalleachsubmitalistofrecommendedcandidateswithinthetimeperiodspecifiedintheprecedingParagraph2.Wherethereisonlyonecommoncandidateonthelists,suchcandidateshallbethepresidingarbitratorjointlynominatedbytheparties.Wherethereismorethanonecommoncandidateonthelists,theChairmanofCIETACshallchoosethepresidingarbitratorfromamongthecommoncandidateshavingregardtothecircumstancesofthecase,andhe/sheshallactasthepresidingarbitratorjointlynominatedbytheparties.Wherethereisnocommoncandidateonthelists,thepresidingarbitratorshallbeappointedbytheChairmanofCIETAC.

4.Wherethepartieshavefailedtojointlynominatethepresidingarbitratoraccordingtotheaboveprovisions,thepresidingarbitratorshallbeappointedbytheChairmanofCIETAC.Artic
