下午13:30—17:30Afternoon下午13:30—17:30Afternoon13:30—17:30晚上19:30—23:30night19:30—23:30直接生產(chǎn)人員(早班):上午8:00—12:00Morning8:00—12:00(中班):下午13:30—17:30Afternoon13:30—17:30非直接生產(chǎn)人員:上午8:30-12:00下午13:00—17:30Morning8:30-12:00Afternoon13:00—17:30特殊情況下根據(jù)實(shí)際需要,公司會作出特殊安排 ,具體則按公司發(fā)布的時間執(zhí)行Incaseofspecialcircumstances,thecompanywillmakespecialarrangementbasedonactualdemand,andthedetailsofwhichshallbeimplementedaccordingtothetimetableissuedbythecompany.公司對某些特定崗位實(shí)行不定時工作制,經(jīng)勞動部門批準(zhǔn)且受限于中華人民共和國適用法律法規(guī)的規(guī)定,該等員工的工作時間安排可不同于上述標(biāo)準(zhǔn)工作時間。Thecompanywillimplementflexibleworkinghoursystemoncertainspecialpositions,asapprovedbythelabordepartmentandtheapplicablelawandregulationofthePeople'RepublicofChina,theworkinghoursarrangementofsuchemployeesmaydifferfromtheforesaidstandardworkinghours.合同期及試用期Contractperiodandprobationperiod員工在上班的第一天辦妥一切報到手續(xù)后, 由人力資源部門代表公司與其簽訂勞動合同。 除非法律另有規(guī)定,所有的合同均為固定期限合同。 合同期限一般為3年,也可以由公司和員工自行約定其他期限。Afteremployeessettleallthereport-to-dutyproceduresonthefirstdayofworking,thehumanresourcedepartmentwillsignlaborcontractwiththemonbehalfofthecompany.Unlessotherwiseregulatedbylaw,allthecontractsshallbefixed-termcontracts.Theperiodofcontractisnormally3years,orotherperiodsagreedbetweenthecompanyandtheemployees.勞動合同到期時,經(jīng)公司和員工協(xié)商一致,可續(xù)簽合同。Whenlaborcontractsexpires,itmayberenewedafterthecompanyandemployeesreachanagreementthroughnegotiation.任何首次受雇于公司的員工都應(yīng)在其勞動合同期限開始之日起的不超過 3個月期間為試用期(直接工人試用期可為2個月)。試用期結(jié)束后,除非公司認(rèn)為員工不符合錄用條件, 員工將繼續(xù)為公司工作。Anyemployeeemployedbythecompanyshallhaveaprobationperiodnomorethan3monthsafterthebeginningdateofhis/herlaborcontract.(Directlaborprobationperiodcanbe2months),Aftertheprobationperiodexpires,unlessthecompanybelievesthattheemployeedoesn'tmeettheructmentcondition,theemployeewillcontinuetoworkforthecompany.公司在試用期內(nèi)或結(jié)束之時可對員工的工作表現(xiàn)進(jìn)行評估。員工不符合錄用條件的情況包括但不限于:Duringoraftertheprobationperiod,thecompanymayevaluatetheworkperformanceofemployees.Thecircumstancesthatemployeesdonmeetrectuitmentconditionsincludebutnotlimitedto:員工提供或要求第三方為其提供虛假的個人信息或文件或與雇傭有關(guān)其他信息或文件。Employeesprovideorrequireanythirdpartytoprovidefalsepersonalinformationordocumentor

otherinformationordocumentrelatingtoemployment.員工未能通過公司所指定的醫(yī)院的健康體檢。Employeesfailtopassthehealthexaminationatthehospitaldesignatedbythecompany.員工對其前雇主負(fù)有未了結(jié)的債務(wù),且公司認(rèn)為該等債務(wù)可能會對員工在公司的工作帶來不利的影響。Employeeshaveunsettleddebtwithformeremployer,andthecompanybelievesthatsuchdebtwillbringnegativeinfluencetotheemployees 'workinthecompany.員工對其前雇主負(fù)有競業(yè)限制義務(wù)。Employeeshavecompetitiverestrictionobligationtotheirformeremployers.員工不能勝任公司的工作任務(wù)。Employeesarenotcapableofworktasksinthecompany.員工未能通過公司的工作表現(xiàn)評估。Employeesfailtopasstheworkperformanceassessmentinthecompany.員工的身體條件不符合其工作崗位的崗位要求(例如特殊崗位的要求) 。Employees'physicalconditionsdon'tmeetthepositionrequirementsoftheirworkpositions(suchasrequirementsforspecialpositions).4.4培訓(xùn)、升職和調(diào)動Training,promotionandtransfer4.4根據(jù)員工的能力和工作表現(xiàn), 公司將自行決定向適合的員工提供平等的培訓(xùn)及升職機(jī)會。 公司有權(quán)要求接受公司出資的專項(xiàng)或?qū)I(yè)技術(shù)培訓(xùn)的員工與公司簽訂一份服務(wù)期協(xié)議。Basedontheabilityandworkperformanceofemployees,thecompanywilldecideatitsdiscretiontoprovideproperemployeeswiththeequaltrainingandpromotingopportunities.Thecompanywillbeentitledtosigningaserviceperiodagreementwiththeemployeesacceptingthespecificorprofessionaltrainingpaidbythecompany.根據(jù)業(yè)務(wù)需要,公司可將員工調(diào)往 XX的其他崗位或其他關(guān)聯(lián)公司工作。Basedonbusinessdemand,thecompanymaytransferemployeestootherpositionsorotheraffiliatedcompaniesofLightning.如果員工希望調(diào)動工作,應(yīng)向其直接主管提出書面申請,直接主管將協(xié)同人力資源部共同考慮員工的申請。如果公司認(rèn)為員工所申請的調(diào)動不具有可行性, 則該等申請將不會被批準(zhǔn), 其直接主管或人力資源部應(yīng)盡量在合理的時間內(nèi)將此結(jié)果告知員工。tbeIfemployeeswishtotransferwork,theyshallsubmitwrittenapplicationtotheirdirectdirector,whowillassistthehumanresourcedepartmentinconsideringtheemployees'applications.Ifthecompanybelievesthatthetransferappliedbyemployeesareisnotfeasible,thensuchapplicationswon oved,theirtbedirectdirectorsorhumanresourcedepartmentshallinformsuchemployeesabouttheresultinreasonablyshortperiod.4.5勞云亦關(guān)系的終41□詢基除 Terminationandcancellationoflaborrelation有下列情形之一的,在中國法律允許的情況下,公司可立即單方解除勞動合同:Foranyofthefollowingcircumstances,thecompanymayunilaterallycancelthelaborcontractallowedbyChineselaw:員工在試用期內(nèi)被證明不符合錄用條件(包括但不限于本手冊第 4.3部分所列的條件) ;Employeesareproventobenotmeetingtherecruitmentconditionsduringprobationperiod(includingbutnotlimitedtotheconditionslistedinarticle4.3ofthismanual);員工嚴(yán)重違反了公司的規(guī)章制度(包括但不限于本手冊) 。該等行為的實(shí)例如下所列,但下述實(shí)例并非意在窮盡所有的可能:Employeeshaveseriouslyviolatedthecompany’sregulationsandsystems(inbcluutdninogtlimitedtothismanual).Suchbehaviorshaveexamplesarelistedasfollowed,butwhichexamplesarenotexhaustingallthepossibilities:偷竊公司或其他員工的產(chǎn)品、財物(如金錢、產(chǎn)品、原材料、工具等) ;Steelproduct,property(suchasmoney,product,rawmaterial,tool,etc)ofthecompanyorotheremployees;欺詐行為,包括但不限于:Fraudulentconduct,includingbutnotlimitedto:欺騙公司和 /或同事, 偽造文件或記錄 (如申請病假的醫(yī)院證明, 身份證、 學(xué)歷及專TOC\o"1-5"\h\z業(yè)資格證明及其他個人信息) ;Cheatonthecompanyand/orcolleaguesbyforgingdocumentsorrecords(suchashospitalcertificateforapplyingsickleave,IDcertificate,diploma,professionalqualificationcertificateandotherindividualinformation);貪污公司財物(如利用假發(fā)票) ;Embezzlingofcompanyproperty(suchasusingfakeinvoice);偽造數(shù)據(jù)、報表或材料(如假銷售紀(jì)錄、假簽名等) ;或Forgedata,statementormaterial(suchasfalsesalesrecord,falsesignature);or未經(jīng)允許私取公司財產(chǎn)、禮品及禮券等。Takecompanyproperty,giftorgiftcertificatewithoutpermission.在非吸煙區(qū)吸煙,可能或已經(jīng)導(dǎo)致危險后果或污染產(chǎn)品 /材料;Smokeinnon-smokingarea,whichmayoralreadycausedangerousconsequenceorcontaminateproducts/materials;故意破壞公司或其他員工財產(chǎn);Purposefullydamagethepropertiesofthecompanyorotheremployees;在公司內(nèi)外無理取鬧、聚眾鬧事、打架斗毆,影響辦公室秩序、工作秩序和社會秩序;Maketroubleoutofnothing,gatheracrowdandmakedisturbances,havegroupfighting,affectofficeorder,workorderandsocialorderinsideoroutsidethecompany;口頭或書面、直接或間接威脅、騷擾、辱罵其他同事或?qū)ζ渌逻M(jìn)行人身攻擊,或以任何形式干擾他人工作;Directlyorindirectlythreat,harassorinsultothercolleaguesinoralorwrittenform,ormakepersonalattackonothercolleagues,ordisturbtheothers ’workinanyform;向非意圖接收信息的第三人泄漏公司的業(yè)務(wù)、策略、銷售量等機(jī)密信息;Disclosethecompany'soperation,strategy,salesvolumeandotherconfidentialinformationtoanythirdpartywithoutintentiontoreceiveinformation;發(fā)表有損公司、產(chǎn)品或雇員形象的言論,或做出有損公司形象的其他行為;Expressanyspeechthatdamagetheimageofthecompany,productsoremployees,ormakeotherconductthatdamagethecompany'simage;違反公司相關(guān)規(guī)定,接受任何與公司有業(yè)務(wù)關(guān)系的機(jī)構(gòu)(含潛在客戶)或人士之禮品或金錢及其它任何形式的個人資助;Violatetheconcernedregulationbyacceptinggift,moneyandanyotherformofpersonalgainfromanyinstitution(includingpotentialcustomer)orindividualshavingbusinessrelationwiththecompany;違反公司的相關(guān)規(guī)定(定義及鏈接見本手冊第 4.8部分),包括但不限于:Violatetheconcernedregulation(fordefinitionandlinks,pleaserefertoarticle4.8ofthismanual),includingbutnotlimitedto:單獨(dú)或與其他公司或個人一起從事賄賂或其他腐敗的行為;或Independentlyorcollidewithothercompanyorindividualtoengageinbriberyorothercorruptionactivities;or未經(jīng)公司事先批準(zhǔn),為其他實(shí)體或個人工作。Workforotherentityorindividualwithoutpermissionfromthecompanyinadvance.違反公司制度和程序(定義及鏈接見本手冊第 4.9部分)(包括但不限于紀(jì)律規(guī)范)的任何規(guī)定;Violatetheconcernedsystemandprocedureinthecompany(fordefinitionandlinks,pleaserefertoarticle4.9ofthismanual),includingbutnotlimitedtoanyregulationinthedisciplinecode;受到公司顧客或客戶的投訴,且使得公司遭受經(jīng)濟(jì)上和聲譽(yù)上的損失;Receivecomplaintfromcompanycustomerorclient,andcausethecompanytosubjecttoeconomicorreputationalloss;違反公司相關(guān)《保密協(xié)議》 (如適用) ’personalinterestandthecompanyhaveconflict,ormayhaveconflict,orcanbeinterpretedashavingconflict:與其他實(shí)體或個人建立雇傭關(guān)系或事實(shí)雇傭關(guān)系;Establishemploymentrelationorsubstantialemploymentrelationwithotherentityorindividual;向公司的競爭對手(由公司認(rèn)定)提供服務(wù)或以其他方式提供協(xié)助;Providecompetitorofthecompany(determinedbythecompany)withserviceorprovideassistanceinotherform;違反公司經(jīng)營原則,未向公司申報并獲批準(zhǔn),向任何實(shí)體(包括公司的潛在客戶)或個人贈送或收受該等實(shí)體或個人贈送的禮品、現(xiàn)金或任何其他的有價物品或好處;Violatethegeneraloperationprinciplebygivingoracceptinganygift,cashoranyothervaluableitemorgaintoorfromanyentity(includingpotentialcustomerofthecompany)orindividual;or直接或間接從與公司進(jìn)行交易的實(shí)體或個人處享有個人利益。Directlyorindirectlyhavepersonalinterestfromanyentityorindividualthathavingtransactionwiththecompany.違反任何法律法規(guī)并因此而承擔(dān)刑事、行政或民事責(zé)任;Violateanylawandregulation,andassumecriminal,administrativeorcivilresponsibilityasaconsequence;任何其他經(jīng)公司認(rèn)定損害公司利益的的行為。Anyotherbehaviorrecognizedbythecompanyasharmingthecompany ’sinterest.員工嚴(yán)重失職,營私舞弊,給公司造成重大損失的;Employeeshaveseverenegligenceormalpracticeandcauseseriouslosstothecompany;“重大損失 ”不僅包括超過人民幣 5,000元的經(jīng)濟(jì)損失, 也包括其他無法以經(jīng)濟(jì)價值衡量的損失,如對公司形象或聲譽(yù)的損害?!癝eriousloss”includesnotonlytheeconomiclossoverRMB5,000,butalsootherlossthatcanmeasuredbyeconomicvalue,suchasdamagetocompanyimageorreputation.相關(guān)法律法規(guī)所規(guī)定的公司可立即單方解除勞動合同的其他情形。Othercircumstancesregulatedbytheconcernedlawandregulationthatthecompanymayunilaterallycancelthelaborcontract.有下列情形之一的, 公司提前三十日以書面形式通知員工或者額外支付員工一個月工資后, 可單方解除勞動合同:Foranyofthefollowingcircumstances,thecompanymayunilaterallycancelthelaborcontractbynoticingtheemployeesinwritingformthirtydaysinadvance,orpaytheemployeesonemothofpay:員工患病或者非因工負(fù)傷,在規(guī)定的醫(yī)療期滿后不能從事原工作,也不能從事由公司另行安排的工作的;Duetosicknessornon-work-relatedinjury,aftertheregulatedmedicaltreatmentperiodexpires,ifemployeeisunabletoengageintheoriginalworkandunabletoengageotherworkarrangedbythecompany;員工不能勝任工作,經(jīng)過培訓(xùn)或者調(diào)整工作崗位,仍不能勝任工作的(是否不能勝任可根據(jù)工作績效評估的結(jié)論或其他結(jié)果加以決定) ;Employeesarenotcapableofworktasks,andstillunabletoworkaftertrainingoradjustmentofworkposition(whethercapableofworkingshallbedeterminedbasedontheworkperformanceassessmentconclusionorotherresults);勞動合同訂立時所依據(jù)的客觀情況發(fā)生重大變化, 致使勞動合同無法履行, 經(jīng)公司與員工協(xié)商,未能就變更勞動合同內(nèi)容達(dá)成協(xié)議的(如發(fā)生并購、撤資或公司遷址) 。Theobjectiverealitybasedonwhichthelaborcontractisformedhasmaterialchange,whichmakestheoriginallaborcontractunabletobefulfilled,andthecompanyandemployeesfailtoreachanagreementthroughnegotiationregardingchangeoflaborcontract(suchasacquisition,investmentwithdrawalorcompanyrelocation).員工在試用期內(nèi)可提前三日書面通知公司以解除勞動合同, 或在試用期滿后提前三十日書面通知公司以解除勞動合同。Duringprobationperiod,employeesmaycancellaborcontractbysendingwrittennoticetothecompanythreedaysinadvance,orafterprobationperiod,theymaycancelthelaborcontractbysendingwrittennoticetothecompanythirtydaysinadvance.公司和員工經(jīng)協(xié)商一致可解除勞動合同。Thecompanyandemployeesmaycancelthelaborcontractthroughnegotiation.如果員工達(dá)到法定退休年齡,勞動合同將自動終止。Ifemployeesreachmandatoryageforretirement,thelaborcontractshallbeautomaticallyterminated.勞動合同終止(無論因何原因終止)時,員工應(yīng)根據(jù)公司的要求完成工作交接手續(xù),包括:Whenlaborcontractisterminated(nomatterduetowhatreason),employeesshallcompletetheworkhandoverprocedureaccordingtocompanyrequirements,including:立即歸還其在公司工作期間從公司獲得的所有公司財產(chǎn)(包括但不限于文件、記錄、門禁卡、員工胸卡、鑰匙、移動電話、電腦、文檔、設(shè)備和其他財產(chǎn)或物品) 。如果員工未能歸還任何上述財產(chǎn),公司可在應(yīng)向其支付的有關(guān)款項(xiàng)中作出相應(yīng)的抵扣。Immediatereturnallthecompanypropertiesobtainedduringworkingperiod(includingbutnotlimitedtodocuments,records,accesscard,employeenametag,keys,mobilephone,computer,files,equipmentsandotherpropertiesorarticles).Ifemployeesfailtoreturnanyoftheforesaidproperties,thecompanymaymaketheconcerneddeductionfromtheconcernedpayments.參加離崗體檢(適用于特殊工作崗位) ;Participateleavingphysicalexamination(applicabletospecialworkingpositions);簽署文件,以放棄其因與公司的勞動關(guān)系而對公司可能享有的任何權(quán)利主張;及Signdocumentstogiveupanypossiblerightorclaimtothecompanyduetothelaborrelation;and公司所不時規(guī)定且可適用的任何其他程序。Otherproceduresregulatedandapplicableinthecompanyfromtimetotime.工作績效評估Workpeformanceassessment工作績效評估是鑒定、評估和提升員工工作表現(xiàn)的過程。除正常的年度工作績效評估(每年年底及年中,年底績效評估側(cè)重當(dāng)年員工工作績效的總結(jié),年中的評估側(cè)重員工發(fā)展計劃)之外,公司也可在其認(rèn)為必要和/或適當(dāng)?shù)臅r候進(jìn)行任何臨時性的工作績效評估。公司將向員工提供認(rèn)證、反饋和指導(dǎo),以幫助其有效達(dá)成公司的目標(biāo)。Workperformanceassessmentmeanstheprocesstoevaluate,assessandimproveemployeesworkperformance.Besidesnormalannualworkperformanceassessment(usuallyintheendofeachyearandmiddleyear,endyearPPMfocusonoverallwholeyearperformanceassessment,mid-yearPPMfocusondevelopment),thecompanymayalsoundertakeanytemporaryworkperformanceassessmentatanytimeitmaythinknecessaryand/orproper.Thecompanywillprovideemployeeswithcertification,feedbackandinstructiontohelpthemeffectivelyreachthecompany'starget.通過評估者和被評估員工之間的雙向溝通來進(jìn)行工作績效評估。Thebilateralcommunicationbetweenassessorandassessedemployeeswillbemadetoundertakeworkperformanceassessment.評估者應(yīng)就公司、部門或小組目標(biāo)和被評估員工進(jìn)行交流,幫助員工設(shè)定個人績效目標(biāo),明確其對目標(biāo)及標(biāo)準(zhǔn)的理解,提供反饋與指導(dǎo),激勵被評估者努力工作、探索職業(yè)發(fā)展前景和并確定培訓(xùn)需求等。被評估員工應(yīng)理解公司目標(biāo),明確自身工作目標(biāo)和要求,努力完成其日常工作,領(lǐng)會評估的過程、目標(biāo)及評估者/直接主管的期望和反饋,并借此及時改進(jìn)工作表現(xiàn)。Theassessorshallcommunicatewiththeassessedemploymentregardingthetargetsofthecompany,departmentandteam,helpemployeestosetindividualperformancetarget,definetheirinterpretationontargetsandstandards,providefeedbackandinstruction,encouragetheassessedtoworkhard,explorecareerdevelopmentprospect,determinetrainingdemand,etc.Theassessedemployeesshallunderstandthecompany'stats,cleartheirworktargetsandrequirements,makeeffortstocompletetheirordinarywork,understandtheprocessandtargetofassessmentaswellastheexpectationandfeedbackfromtheassessor/directsupervisor,andtaketheopportunitytoimproveworkperformance.如果員工的工作績效評估表明其不勝任當(dāng)前的工作,公司將對其進(jìn)行培訓(xùn)或調(diào)崗。如果該員工在培訓(xùn)或調(diào)崗后經(jīng)評估仍然不勝任工作,則公司可根據(jù)第 4.5.2部分的規(guī)定解除其勞動合同。Ifemployeesworkperformanceassessmentshowsthattheyareunabletodothecurrentwork,thecompanywillgivethemtrainingortransfer.Ifsuchemployeesarestillunabletodotheworkaftertrainingortransfer,thenthecompanymaycanceltheirlaborcontractaccordingtoarticle4.5.2.降職Demotion經(jīng)過工作績效評估,如果員工的工作表現(xiàn)無法達(dá)到公司要求,公司可要求員工予以改進(jìn),如果員工未能根據(jù)公司的要求在規(guī)定的期限內(nèi)對其工作表現(xiàn)進(jìn)行改進(jìn),則公司可以對員工進(jìn)行降職(例如將其調(diào)至另一崗位或降低其在公司的級別) ,經(jīng)協(xié)商可適當(dāng)調(diào)整員工的工資和福利待遇。Afterworkperformanceassessment,ifemployees'workperformancefailtomeetthecompanyrequirements,thecompanymayrequiretheemployeestoimprove,iftheemployeesfailtoimprovetheirworkperformanceinregulatedperiodaccordingtocompanyrequirements,thenthecompanymaygivedemotiontotheemployees(suchastransferthemtootherpositionorreducetheirgradeinthecompany),andtheemployees'salaryandwelfaretreatmentmaybeproperlyadjustedafnegotiation.公司制I度和程序
