3、r,mainlyincludes:datacenterdecorationandelectricalsystems,air-conditioningsystems,CCTVsystems,accesscontrolsystems,firefightingsystemreform,serverracksystems.1.4動工條件：合同見效后，甲方預付款到位和現(xiàn)場具備動工條件。Startconditions:Afterthecommencementofthecontract,PartyAhasstartedadvanceandon-siteconditionsinplace.1.5工程造價：合同

7、artyB55%ofthecontractprice.2.4工程竣工后3個月內(nèi)，甲方支付給乙方節(jié)余的合同款，即￥Afterthecompletionoftheprojectwithin3months,PartyAshallpaytoPartyBtheremainingcontractprice.元；雙方職責Responsibilitiesoftheparties3.1甲方職責：ResponsibilitiesofpartyA:a.及時以書面形式通知乙方本工程具備動工條件的時間;TimelywrittennoticetoPartyBtheconditionsofthisprojecthaveth

8、etimetostart;輔助乙方辦理進駐施工現(xiàn)場所需人員證件、批件等相關(guān)手續(xù)；ToassistPartyBtoentertheconstructionsitepersonnelrequireddocuments,approvaldocumentsandotherrelevantprocedures;為乙方供應現(xiàn)場工程辦公室和足夠的現(xiàn)場庫房；Toprovideon-siteengineeringofficeandsufficientfieldwarehouse;積極輔助乙方施工，協(xié)調(diào)施工時與各部門的配合，并負責供應工程所需的現(xiàn)場平面圖及建筑構(gòu)造圖。ActivelyassistPartyBcon

9、struction,coordinationwithvariousdepartments,andresponsibleforprovidingtheneededfortheprojectsiteplansandarchitecturaldrawings.及時按合同規(guī)定之付款進度向乙方支付工程款項。TimelyaccordingtothetermsofthecontractpaymentscheduletopayPartyBprojectfunds.3.2乙方職責：ResponsibilitiesofpartyB:乙方在工程開始前應組織相關(guān)人員研究和熟悉圖紙，參加設(shè)計交底，安排施工總進度計劃并提

10、交給甲方；PartyBbeforetheprojectbeginsshallorganizerelevantpersonneltostudyandbefamiliarwithdrawings,involvedinthedesignwork,arrangementofconstructiongeneralscheduleplanandsubmittoPartyA;向甲方或項目監(jiān)理供應所購各樣產(chǎn)品、設(shè)施的技術(shù)資料，接受進場檢驗；TothepartyAorprojectsupervisiontoprovidethepurchaseavarietyofproducts,equipment,techni

11、calinformation,acceptentryinspection;恪守甲方或監(jiān)理方對施工現(xiàn)場的相關(guān)規(guī)定；Abidebythepartyorthesupervisiononconstructionsiteoftherelevantprovisions;準時達成乙方所肩負的施工任務，保證工程施工質(zhì)量。TimelycompletionofconstructiontasksundertakenbyPartyB,toensureconstructionquality.施工與工程設(shè)計改正Constructionandengineeringdesignchange4.1乙方在施工中要依照國家頒發(fā)的施

12、工查收規(guī)范和質(zhì)量檢驗標準，以及設(shè)計要求進行，要求所有工程達到合格標準。OntheconstructionofPartyBaccordingtothecountryissuedconstructionacceptancenormsandqualityinspectionstandards,aswellasthedesignrequirements,allprojectachievethequalifiedstandard.4.2在施工中，要堅持依照設(shè)計文件和施工圖紙施工，任何一方不得任意改正設(shè)計，如出現(xiàn)窩工、返工和資料損失，以及增加勞動力成本等，由于甲方的原因造成的，損失由甲方肩負，由于乙方的原

14、byPartyB.4.3在施工中，若甲方A有改正設(shè)計文件的要求，應書面通知乙方；若乙方發(fā)現(xiàn)設(shè)計文件有錯誤或嚴重不合理的地方，也應書面通知甲方，雙方約定并改正設(shè)計文件和圖紙后方可連續(xù)施工。Duringtheconstruction,ifthepartyAtochangethedesigndocument,shallgiveawrittennoticetoPartyB;ifPartyBisfoundthedesigndocumentsarewrongorseriousunreasonableplace,shouldalsobewrittennoticetoPartyA,bothsidesagree

15、dandmodifydesigndrawingsanddocumentsbeforeitcancontinuetoconstruction.4.4在施工過程中，如遇以下情況，需順延工期，雙方應及時進行磋商，并經(jīng)過書面形式確定順緩限時：Intheprocessofconstruction,incaseofthefollowingcircumstances,beextendedperiod,bothpartiesshalltimelyconsultations,andthroughthewrittenformtodeterminetheextensionofthetimelimit:因天災或人力不

16、可以抗拒的原因被迫歇工的；Becauseofnaturaldisasterorthemanpowerirresistiblereasonsforcedshutdown;因甲方提出改正計劃或改正施工圖而不可以連續(xù)施工的；BecausepartyAproposedchangestotheplanorchangetheconstructiongraphthereforecannotcontinueconstruction;乙方不可以如期供設(shè)施或所供資料或許設(shè)施不合規(guī)格要求，被迫歇工或不可以順利施工的；PartyBfailstosupplyequipmentorforthematerialsorequ

17、ipmentofdifferentspecifications,wasforcedtoshutdownornotsmoothconstruction;竣工查收與售后服務Finalacceptanceandafter-salesservice5.1乙方必定嚴格履行隱蔽工程查收制度，凡隱蔽工程達成后，必定經(jīng)過查收并作好記錄(隱蔽工程指墻內(nèi)、吊頂內(nèi)的管線施工等）。PartyBmuststrictlyenforcethehiddenworksystem,wherethehiddenworkhasbeencompleted,mustpassinspectionandmakerecords(hiddenw

18、orksreferstothewall,theceilinginsidethepipelineconstruction,etc.).5.2整體工程竣工后，乙方向甲方提交竣工文檔并提交書面查收申請。甲方接到申請后7日內(nèi)組織相關(guān)人員依照合同內(nèi)容和早先約定的查收條款進行項目查收，并出具雙方署名的驗收報告。如甲方不可以如期組織查收，須提早通知乙方，并與乙方另行約定查收日期，但甲方必定認同乙方的竣工時間。甲方推遲查收，此間所發(fā)生的管理費和各項損失均由甲方負擔。假如提交查收申請后一個月仍未能達成查收，則以竣工之日作為系統(tǒng)的保修開始日期。Whenthewholeprojectiscompleted,Part

20、izeacceptance,shallinformPartyBinadvance,andPartyBtobeagreeddateofacceptance,butpartyAmustacknowledgepartyBcompletiontime.partyAdelayedacceptance,duringwhichoccurredinthemanagementfeesandalllossesshallbebornebyPartyA.Ifthesubmissionofacceptanceapplicationonemonthafterfailedtocompleteacceptance,theco

21、mpletiondateasthesystemwarrantystartdate.5.3工程查收合格后進入質(zhì)保期。質(zhì)保期為查收合格之日起12個月。在質(zhì)保期內(nèi)，乙方應對系統(tǒng)除人為因素外的所有故障負責免費維修或改換。Projectafteracceptanceintothewarrantyperiod.Warrantyperiodfromthedateofacceptanceof12months.Duringthewarrantyperiod,PartyBshallsysteminadditiontohumanfactorsallfaultisresponsibleforfreerepairorr

22、eplacement.5.4在質(zhì)保期內(nèi)，乙方做到對甲方求援電話2小時內(nèi)響應，8小時內(nèi)到達現(xiàn)場并著手解決問題。質(zhì)保期結(jié)束后，乙方對系統(tǒng)進行有償保護。有償保護的花銷由雙方磋商。Duringthewarrantyperiod,PartyBshalldotohelptelephoneresponsewithin2hours,8hourstoarriveatthesceneandsetaboutsolvingtheproblem.Aftertheendofthewarrantyperiod,PartyBonthesystempaidmaintenance.Paidmaintenancecoststhro

23、ughconsultationbythetwoparties.技術(shù)服務和培訓Technicalserviceandtraining6.1由乙方按技術(shù)培訓綱領(lǐng)負責對甲方的相關(guān)操作人員和維修人員進履行用級培訓。經(jīng)過培訓，使甲方的受訓人員能掌握系統(tǒng)設(shè)施的配置，能進行正確操作和平常保護及一般常有故障排查。接受培訓的人員由甲方確定，日期由甲乙雙方共同約定。PartyBaccordingtothetechnicaltrainingprogramforPartyAsoperatorsandrepairpersonneltouseclasstraining.Throughtraining,thetrainee

24、scangraspthepartysystemequipmentconfiguration,cancorrectoperationandroutinemaintenanceandcommontroubleshooting.TrainedpersonnelwereidentifiedbythepartyA,thedatemutuallyagreedbybothparties.6.2在保修期內(nèi)，乙方供應兩次上門巡檢服務，包括各系統(tǒng)運行情況的查察、記錄，以及必要的設(shè)施保護。Duringthewarrantyperiod,PartyBshallprovidetwoon-siteinspectionse

25、rvices,includingthestatusofsystemview,recording,andthenecessaryequipmentmaintenance.6.3乙方為甲方免費供應網(wǎng)絡(luò)綜合布線系統(tǒng)和數(shù)據(jù)中心的技術(shù)咨詢服務。PartyBshallprovidefreenetworkcablingsystemanddatacentertechnicaladvisoryservices.違約責任Theliabilityforbreachofcontract7.1乙方供應貨物的質(zhì)量或規(guī)格不符合合同約定，行業(yè)規(guī)格或政府的法律法例的要求的，甲方可以依照貨物的性質(zhì)以及損失大小，要求乙方肩負維修，

26、改換，退貨，減少價款等責任。PartyBshallprovidethequalityorspecificationsofthegoodsdoesnotconformtothecontractspecifications,industryorgovernmentregulatoryrequirements,PartyAmayaccordingtothenatureofthegoodsandthelossofsize,Bshouldbeartherepair,replacement,return,reducecost.7.2乙方除因受中華人民共和國合同法規(guī)定的不可以抗力因素影響外，假如未能按計劃施

27、工，則乙方在竣工之日前，每天應按甲方所支付合同款的1（大寫：千分之一）賠償甲方損失。PartyBexceptduetoP.R.CContractLawprovisionsofforcemajeurefactors,iftheconstructionnotonschedule,thenPartyBinthecompletiondate,dailyshouldbepaidbyPartyAcontractto1(inwords:1/1000)compensationforthelossofPartyA.7.3在履行合同過程中，假如乙方提早獲知有不可以準時交貨或供應服務的情況，應及時以書面形式將不可以

28、準時交貨的原因、預期延緩時間通知甲方。甲方收到乙方通知后，認為其理由正當?shù)?，可酌情延伸交貨時間。Duringperformanceofthecontract,ifPartyBknowaheadoftimehasnotdeliveredontimeortoprovideservice,shouldbepromptlyinwritingofthereasonsfornotdeliveredontime,anticipateddelaytimenotifyparty.PartyAreceivednotification,thinkitsreason,couldbeappropriatetoexten

29、dthetimeofdelivery.7.4若由于甲方改正設(shè)計需求、未確認資料或設(shè)施型號、未確認施工方案而以致設(shè)施訂貨周期推遲，所以致使的延緩交貨，乙方不負擔當何責任。IfduetoPartyAtochangethedesigndemand,didnotconfirmmaterialmodels,unrecognisedconstructionschemecausedbyequipmentordercyclethuscausingthedelayofdelivery,PartyBdoesnotbearanyresponsibility.orequipmenttimedelay,7.5甲方在合同

30、規(guī)定的付款限時內(nèi)未能及時付款，視為甲方違約。甲方每天按合同款項的千分之一賠償乙方損失。PartyAinthecontractpaymentperiodfailedtotimelypayment,regardedofcontract.PartyAaccordingtothecontractsum1/1000dailycompensationforanylossofPartyB.asabreach7.6甲乙任意方因第三者的原因造成違約的，應向?qū)Ψ郊缲撨`約責任。Anypartyforthethirdpartyreasonsfordefault,shallbeliabletotheotherparty

31、forbreach.合同的改正ThemodificationofContract合同需在甲乙雙方公正磋商，達成一致的條件下進行改正，改正的內(nèi)容需以文字正本形式經(jīng)雙方授權(quán)人署名并蓋印后見效。所有改正內(nèi)容作為附件存在與合同正本擁有相同的法律效力。Anymodificationmustonthebasisoffairnegotiationandbeacceptedbybothsides.Theformalfileofmodifiedcontractshouldbevalidatingaftersignedandstampedbyauthorizedpersonofbothsides.Allchangetothecontentasanattachmentwiththeoriginal
