2、y A” refers:1.The real estate developer or its assigned property management enterprise.“Party B” refers:The house purchaser (owner).“Property Management for Prior Period” refers:The property management during the period between the day when the house is sold and the day when the Property Management

3、Contract signed between Owners mittee and the Property Management Enterprise takes effect.Name of This Property:Huashi Zaoyuan GardenNumber of Sales (Presale) Contract for the House Purchased by Party B:Basic Status of the House Purchased by Party B:Type: Location:Floorage: square metersAording to a

4、pplicable laws and basing on the principle of voluntariness, equality and consensus, by Party Bs signing the House Purchase and Sales (Presale) Contract, both Party A and Party B hereby e to the following agreement upon service of property management for the prior period:Article OneRights and Liabil

5、ities of Both PartiesRights and Liabilities of Party AParty A shall provide maintenance, repair, service and management of mon sections of house, mon facilities and equipment, planting, environmental sanitation, security and traffic control, etc.Aording to relevant regulations and policies and basin

6、g on factual conditions, Party A shall work out the Property Management Regulations, the Building Management Regulations and the Owners Manual for this property, and shall notify Party B in writing of same.Party A shall set up and plete necessary management files system for this property.Party A sha

7、ll restrain acts violating the Property Management Regulations and the Building Management Regulations for this property.The Property Management Enterprise may assign specific items of management and services to certain professional panies, but shall not transfer the overall management of this prope

8、rty to any third party.Aording to this Agreement, Party A shall collect property management fees from Party B.Party A shall work out annual plans upon property management services and financial budget.In the last month of each year, Party A shall announce to Party B balance aount of management expen

9、ses.Party A shall notify Party B in writing and in advance of precautions and restrictions for decoration and fitment, and shall sign with Party B the House Decoration and Fitment Management Agreement.Party A shall provide Party B with paid services such as maintenance and repair of private sections

10、, facilities and equipment.Within one month after termination of this Agreement, Party A shall hand over the property management of this property to the property management enterprise selected by Owners mittee. Such handover shall be confirmed by Owners mittee.Rights and Liabilities of Party BParty

11、B shall attend Owners Conference or Owners Congress, with the rights to vote, to be elected and to supervise.Party B shall supervise Party As behavior in property management services by the aid of the developer, and shall present Party A ments and proposals concerning the property management.Party B

12、 shall abide by the Property Management Regulations for this property and the Building Management Regulations.Aording to this Agreement and the Management Convention for this property, Party B shall pay the fees in time for the property management.During house decoration and fitment, Party B shall a

13、bide by the Agreement of House Decoration and Fitment Management and the Fitment Regulations.Party B shall not oupy or damage, or change any functions of, any mon sections or mon facilities or equipment. Should any reasonable use of mon sections or mon facilities or equipment be needed for purposes

14、of moving in or decoration or fitment, Party B shall notify Party A in advance of same and restore the used object to its original state in a limited period of time as mutually agreed. Party B shall be liable for all damages therein caused.In the case of house transfer, Party B shall notify Party A

15、in advance and advice the transferee to sign this Agreement with Party A.Party B shall bear civil liability for all losses and damages caused by breach of the Property Management Regulations for this property and the Building Management Regulations which is mitted by any tenant or user of, or any vi

16、sitor to, the house of Party B.Aording to principles of safety, fairness and reasonableness, Party B shall reasonably deal with neighbors in aspects such as water supply, venting, daylighting, repair, passaging, sanitation and environment protection associated with this property, and shall not infri

17、nge upon others lawful interests.Party B shall bear all the owners liabilities stipulated by the Management Convention for this property, and shall have all the owners rights therein.Article TwoDetails of Property Management ServicesMaintenance and Management for mon Sections of House“mon sections”

18、refers to the parts of main load-bearing structure of a building (including the base, internal and external load-bearing walls, pillars, girders, floor slabs and the roof, etc.), exposed wall surfaces, the lobby, staircases, corridors and passages, etc.mon Facilities and Equipment and Their Maintena

19、nce and Repair“mon facilities and equipment” refers to the mon utilities that includes water pipelines, drain ducting, rainspouts, water tanks, pressure pumps, elevators, antennas, power lines, munication lines, lighting, boilers, heating lines, gas lines, fire-fighting facilities, greenbelts, roads

20、, street lamps, ditches, wells, non-mercial parking lots or carports, public entertainment and sport facilities, and the houses or floors containing such mon facilities and equipment.Environmental SanitationSanitation of mon (public) places;Maintenance of greenbelts;Temporary depositing, clearing an

21、d removing refuses.Security GuardDetailsTo assist Public Security Bureau to maintain the public order in the area of this property.To work out the stipulations and supervision regulations concerning using passes to enter this property.To assist in implementing relevant rules set by the Property Mana

22、gement pany.To assist in and support setting up and carrying out fire-control measures and regulations for this property.ResponsibilitiesTo maintain the public order in the area of this property.To maintain the public order of parking lots in the area of this property.To supervise and implement the

23、fire-control arrangement, fire prevention and fire salvage of this property.Traffic Control and Vehicle ParkingDetailsTo control the traffic order at the public places, bicycle parking lots and vehicle parking lots of this property.To maintain the conditions for vehicle parking and cargo loading/unl

24、oading at designated places, bicycle parking lots, vehicle parking lots and unloading platform of this property.To arrange vehicle parking and to collect parking charges.ResponsibilitiesTo prepare traffic signs for the public places and to monitor traffic safety and vehicle flow status.To sign agree

25、ment of vehicle parking in this property, to set and assist to implement regulations for vehicle parking and cargo loading/unloading, to restrain all acts violating regulations.Management of House Decoration and FitmentArticle ThreeQuality of Property Management ServicesBuilding AppearanceWithout un

26、approved building, addition, modification or removal;To mend/repair, renew and white-wash the worn-out areas;To unify doorplate, doorknobs and keep them of nice appearance.Equipment OperationTo ensure safe running of equipment to relevant domestic specifications.To maintain economic operations of eq

27、uipment under normal functionality.Maintenance and Management of mon Sections and mon Facilities/EquipmentWithout defective, deformative or unsafe operation;To ensure constant availability without unapproved oupation or blocking.Environmental SanitationClean places and equipment, without hidden risk

28、 of pollution of infection. All household refuses removed.Without insects or mice; drainage clear; to implement the practice of “three responsibilities in front of the door”.PlantingTo cultivate and maintain greenbelts and green decorations;To propagate knowledge on and obligations of growing and pr

29、otecting plants;Traffic Control and Vehicle ParkingTo designate places for cargo loading/unloading and vehicle parking;To restrain overloading and overtime parking.SecurityTo supervise and control information of all households, people moving in and out, elevator utilities and warehouse material flow

30、ing in and out;To carefully inspect the valid IDs of fitting workers, and to protect finished items.Fire ControlTo prepare fire-fighting tools and to set up fire-control measures for work sites, and to implement fire-control education;Without construction materials violating safety regulations, oper

31、ations of construction, decorations, installations/arrangements.Routine Repair and Emergency Repair of mon Sections and mon Facilities/Equipment of BuildingCivil works:including decoration, painting, cleaning and renewal of roofs, facade eave awnings, stairs, door or window surrounding walls, chimne

32、ys, slop ways and patio, etc.;Electricals and Mechanicals:including ponent replacing, testing, restoration, enhancement and upgrading of the systems of fire control, water supply, draining, power supply, light current devices, security monitoring, building automatic control and parking charge collec

33、ting, etc.;Emergency of civil works includes hidden hazards such as decoration shattering, falling or loosing;Emergency aids of electricals and Mechanicals includes equipment halts, elevator enclosures, supply intermits of water/power/gas, waterlogging and drain blockings, etc.Article FourFees for P

34、roperty Management Services (excluding expenses for major repairs, renewals and reforms of mon sections and mon facilities/equipment and expenses for power consumption for normal operations of mon equipment)Initial Date of Payment of Party B:The date when the property is delivered for use, or the da

35、te when the official notice of building aeptance is issued, or the initial date of payment set and notified by Party A, whichever es the latest.The rate is 2.48 yuan RMB per month for each square meter of floorage.Should the room be left unused for reason of Party B, the rate shall be 2.48 yuan RMB

36、per month for each square meter of floorage.If the property is leased out, Party B shall pay for the property management services.If Party B transfers the property to any third party, Party B shall pay for the property management services prior to the transfer.The rate for property management servic

37、es is subject to adjustment depending on changes of governmental stipulations and cost of the services.The day of payment for each month is the fifth day of that month.Power cost for operations of mon sections and mon equipment depends on factual expenses and is prorated monthly to the floorage shar

38、e of Party Bs room.Article FiveFees for Other Paid ServicesCharges for Parking Lots and OthersMotor Bicycles:15 yuan each per monthMotor Tricycles for the Handicapped:12 yuan each per monthBicycles:3 yuan each per monthCable TVTo charge to the rate standard for cable TV utility in Beijing.Fees for F

39、itment Management ServicesThe fee for fitment management (drawing review, on-site supervision, routine watch and inspection, etc):300 yuan per unit.The fee for fitment waste removal:20 yuan per natural room (bedroom, sitting room, kitchen, bath room, balcony, store room, etc.); no charge for removal

40、 by the owner himself.Fitment deposit:20 yuan per square meter of floorage.Article SixCollection of Payments for External ServicesEntrusted by relevant departments or units, Party A provides payment collection services for general consumptions, cable utility, gas supply, heat supply and house rent,

41、etc., as are set by government. (These are not parts of property management fees.)Article SevenControl and Use of Maintenance FoundationAording to stipulations of Method of Foundation Management for Maintenance and Repair of mon Sections and Facilities of Residence Buildings issued by Ministry of Co

42、nstruction, a maintenance foundation is set up for this property to cover major repair, periodic repair, renewal and reform of mon sections and mon facilities after the warranty period expires. While purchasing the house, Party B shall pay to relevant governmental department for the maintenance foun

43、dation at a rate of about 2% of the house price.Use of Maintenance Foundation:The maintenance foundation will be under administration of the munity Office before the Owners mittee is established and, after the Owners mittee is established and at consent of Owners mittee, will be passed to Party A. P

44、arty A shall propose annual plans of using the maintenance foundation, which shall be carried out at the approval of Owners mittee.In the event that the maintenance foundation bees inadequate, at the review and approval by local governing department of property administration, supplemental fund shal

45、l be raised basing on the floorage oupied by Party B.Should Party B transfer property right of the house to any others, the balance of maintenance foundation shall be transferred together with the property right, without refunding to Party B.Article EightInsuranceParty A shall handle insurance for m

46、on sections and mon facilities of the building, of which the premium shall be shared by all owners pro rata basing on the floorages they are oupying.Party B may handle insurances for his household property and family members.Party B shall follow relevant rules of property management and provisions o

47、f the Property Management Convention, and shall neither violate regulations to wantonly misuse nor carelessly use either indoor or mon facilities, or otherwise Party B shall be liable for any insurance premium addition thus caused on mon property or facilities or any damages thus caused to same.Arti

48、cle NineBillboards and Rights and InterestsParty B shall not wantonly apply any billboards or banners, or distribute any leaflets, or conduct any other advertising activities, at any mon places or reserved places.Party B shall not post or stand or set any other advertising stuff at any exposed windo

49、ws lest the general appearance and style of the property should be distained.Party B may place doorplates or signs or stand billboards outdoor at the locations designated by Party A.Article TenOther Agreed ItemsTo ensure normal operation of the Property Management pany, Party B hereby agrees, at aep

50、tance of the building, to make full payment to Party A for management services of the first year.In this Agreement, the wording “Rules of Building Management” refers to the Management Convention and all other specifications, notices, regulations or memos, etc.Beside Party B himself, Party B shall be

51、ar the responsibility to instruct all users of his house, including but not limited to lessees, temporary users, borrowers, tenants or authorized house keepers or workers, to abide by and follow this Agreement.Article Eleven liabilities for DefaultIn the event that Party A has violated this Agreemen

52、t and failed to reach the quality target of management services as herein agreed, Party B shall be entitled to require Party A to correct within a limited time. Party A shall bear legal liability for all losses for Party B caused by Party As failure of such correction in the limited time.In the even

53、t that Party B has violated this Agreement and made Party A to fail in reaching the quality target of management services as herein agreed, Party A shall be entitled to require Party B to correct within a limited time. Party B shall bear legal liability for all losses for Party A caused by Party Bs failure of such correction in the limited time.In the event that Party A has violated this Agreement and willfully raised any rates and applied any unreasonable charges, Party B shall be entitled to require Party A to return the amount o
