4、日期和工作期限，為本項(xiàng)目派出其授權(quán)代表、各類技術(shù)人員、工人、管理和服務(wù)人員( 以下簡稱“人員”) 。Party B shall offer number of the people,dispatch date and working termandshalldispatchtheauthorizedrepresentative,technicians,workers,managementandservicepeople(hereafter refer as employee)(1) 人員離境之前如需變更時(shí)，甲方應(yīng)將變更內(nèi)容提前一個(gè)月書面通知乙方，如甲方變更計(jì)劃未能及時(shí)通知乙方公司，而乙方公司已

5、按計(jì)劃集中人員和訂購機(jī)票，甲方應(yīng)負(fù)擔(dān)因此造成的損失。(1)Party A shall notify Party B one month earlier for the changes on employee before they leave china.If Party A fail to inform Party B and Party B bookflight tickets according to plan for the employee.Party A shall compensate the lost for it.(2) 人員工作期限期滿之前，如需終止雇傭，甲方應(yīng)在終止雇傭之

6、日前_1_ 個(gè)月書面通知乙方。(2)If Party A requires to terminate employment before labor contract expiration.They shall inform Party B one month earlier in written notice.第三條 簽證和其他證件(3) Visa and other certificate1. 乙方應(yīng)按中國政府的有關(guān)規(guī)定辦理人員出入中國國境的一切必要手續(xù)，并承擔(dān) 其費(fèi)用。Party B shall handle all necessary procedures of Exit-Entry

7、for employee in accordance with law and regulations of Chinese Government and bear the charges.2. 甲方應(yīng)按項(xiàng)目所在國政府的有關(guān)規(guī)定辦理人員出入項(xiàng)目所在國及居留、工作許可證、等相關(guān)手續(xù)，并承擔(dān)費(fèi)用。Party A shall handle residence permit,work permit and other relevant procedures for employee in accordance with Party A country s regulations and bear th

8、e charges.3. 如果甲方未能為人員獲得在項(xiàng)目所在國的居留、工作許可證和相關(guān)手續(xù)，而使人員無法進(jìn)行工作，應(yīng)付給人員在此期間的合同工資。如人員因此被迫返國時(shí)，甲方應(yīng)負(fù)擔(dān)人員的回程旅費(fèi)，并支付每人_1_個(gè)月合同工資的賠償費(fèi)。3.1 f party A did not obtain the residence permit,work permit and relevant procedures to result the employee can not work.Party A will pay employee salary during this period.If the emplo

9、yee was forced to return China for it.Party A will bear the returning expenses and pay each employee one month salary as compensation.第四條 乙方公司的義務(wù)4. Party B s obligation s1. 符合雙方商定的技術(shù)條件；Employeeis qualified for technical requirements agreed upon by two parties2. 遵守項(xiàng)目所在國的法律和法令，尊重當(dāng)?shù)仫L(fēng)俗習(xí)慣；Employee should

10、 abide by worksite country laws and regulations and respect local customs and habits.3. 尊重甲方人員的技術(shù)指導(dǎo)；Employee should respect technical guidance of Party A4. 不參與項(xiàng)目所在國的任何政治活動(dòng)；Employee shall not to take part in any political activities.5. 遵守公司的規(guī)章制度；Employee shall abide by company rules and regulations6.

11、 與甲方為實(shí)施本項(xiàng)目而雇傭的其他國籍的人員合作共事。6.Employee can work together with other foreigners employed by Party A for the mentioned project.第五條 甲方的義務(wù)Party A s obligation s1. 對(duì)人員給予正確的技術(shù)指導(dǎo)；Party A shall provide correct technical guidance to employee2. 尊重人員的人格、風(fēng)俗和習(xí)慣；Party A shall respect employee personality, customs a

12、nd habits.3. 不干涉人員在非工作時(shí)間的活動(dòng)自由；Party A shall not intervene employee activities during non working time.4. 保障人員的安全；Party A shall guarantee employee safety.5. 對(duì)人員的解雇和更換，應(yīng)由雙方的授權(quán)代表商定。Any dismissal and replacement on employee shall be consulted by both party s representatives.第六條；每天工作時(shí)間安排可由甲、乙方公司授權(quán)代表商定6.

14、的月工資(包括伙食費(fèi))在本合同有效內(nèi)按以下標(biāo)準(zhǔn)支付(美元 )：后付工資標(biāo)準(zhǔn)表。Employee monthly salary (including food expenses) shall be paid by USD according to the following standards during the validity of the labor contract.Attachment hereto the wages schedule sheet.(1) 服務(wù)人員Service person(2) 熟練技工，廚師Skillful mechanic ,chef(3) 技術(shù)員，翻譯，T

15、echnician and interpreter(4) 工程師， Engineer(5) 授權(quán)代表Authorized representative第八條 夜班及加班8.Night shift and overtime1. 根據(jù)項(xiàng)目的需要，甲方要求人員在夜間工作或加班，應(yīng)取得乙方授權(quán)代表同意，(1)If necessary for work, Party A may, on the basis of negotiation with Party B representative, request employee work night shift or overtime.2. 夜間時(shí)間系指從

16、當(dāng)日晚上9 時(shí)至次日晨5 時(shí)。人員夜間工作( 指正常夜班工作)甲方應(yīng)按合同工資150%支付工資；人員夜間加班，甲方應(yīng)按合同工資200%支付加班費(fèi)。(2)Night shift times from 9:00PM to the second morning 5:00AM.Night shift(Social work hours at night). Party A shall pay wages 150% accordingto the contract salary. For overtime at night,Party A shall pay wages 200% according t

17、o the contract salary.第九條 工資支付9 Remuneration乙方公司的授權(quán)代表應(yīng)按甲方提供的表格填寫工作時(shí)間和加班時(shí)間，編制工資單，在每月工資結(jié)算日即28 日提前 2 天內(nèi)提交甲方的授權(quán)代表審核批準(zhǔn)。Party B representative shall fill in the form offered by Party A withemployee s working time and overtime and submit to Party A s representative for approval within 2 days earlier the se

18、ttlement date on each 28th.3. 工資單審批后，甲方應(yīng)在每月工資結(jié)算日即：28 日、后 3 天內(nèi)將工資和加班費(fèi)以美元支付給乙方公司帳號(hào)；After approval of the wages sheet,Party A shall pay salary by transferring the dollar to Party B company s account through bank within 3 days since the settlement date on 28th.第十四條保 險(xiǎn)14.Insurance1. 乙方為人員自其離開中國之日起至返抵中國之日

19、止。在中國投保人身意外險(xiǎn)，保險(xiǎn)費(fèi)由雇主承擔(dān)。甲方應(yīng)隨同人員的月合同工資以美元一并向中國公司支付每人每月_保險(xiǎn)費(fèi)。1 .Party B shall participate in accident insurance for employee start f rom the date of leaving china and end to the date of the return. Party A shall pay insurance premiums together with employee salary to Party B China company in USD monthly.

20、2. 人員在中國投保人身意外險(xiǎn)后，如經(jīng)甲方要求，乙方可向甲方提供必要的證明文件，以避免甲方為人員在項(xiàng)目所在國重復(fù)投保。After employee participate in personal accident insurance in China.PartyB shall offer the relevant insurance certificates to Party A if they require, in order to avoid Party A buy multiple insurance 第十五條醫(yī)療和病假15. Medical treatment and sicknes

21、s leaves1. 甲方應(yīng)為人員在整個(gè)合同期間因病或因工傷提供免費(fèi)醫(yī)療、藥品和住院治療。2. 人員在合同期間如因病或因工傷死亡，甲方負(fù)責(zé)其遺體處理并承擔(dān)死者遺物運(yùn) 回中國的費(fèi)用。1.Party A should provide employee free medical service,medicine and Hospital treatment among the contract period.2.If the employee is dead for illness and work injury.Party A is responsible to dispose body and

22、bear all suspense to ship back the remains to china.第十七條生活和膳食設(shè)施1. 甲方應(yīng)為人員免費(fèi)提供適宜的住房，；水、電、臥具、空調(diào)、沐浴、衛(wèi)生、洗衣設(shè)備和用品。2. 甲方應(yīng)向人員免費(fèi)提供廚房、餐廳、炊具、餐具、制冰機(jī)、電冰箱等用品。17 Living and dining facilitiesParty A should supply employee living house,water,electricity,bed,air conditioner,shower, sanitation, washing machine and othe

23、r ordinary facilities.Party A should supply employee the kithen,dining-room,cooker, tableware, ice machine, refrigerator etc.第十八條勞保用品及小工具Labor protection articles and tools1. 甲方應(yīng)為人員免費(fèi)提供一般勞保用品、以及辦公用品。2. 甲方應(yīng)免費(fèi)向人員提供各工作所需工具。(1) .Party A should provide employee ordinary Labor protection and office suppli

Party A should provide employee all required work tools in free第十九條保密1. 乙方及其人員在執(zhí)行本合同期間對(duì)于本項(xiàng)目的一切資料及情況應(yīng)對(duì)第三者保守秘密。19.ConfidentialityDuring the validity period of the contract,Party B and the employee should keep the materials and information strictly confidential and shall not disclose to

25、 any third party.第二十一條不可抗力由于不可抗力事件，如天災(zāi)、戰(zhàn)爭、內(nèi)亂、封鎖、暴動(dòng)、傳染病、政變等，使本項(xiàng)目無法繼續(xù)進(jìn)行，經(jīng)雙方協(xié)商本合同可以暫停。在這種情況下，甲方應(yīng)負(fù)擔(dān)人員的回國旅費(fèi)。21 .Force MajeureDue to events of Force Majeure,such as natural disaters,war,civil strife,blockade,riots,infectiousdiseases,coup which may preventeither party from performing any of its obligations

26、 under contract,theaffected party shall notify the other party of under such circumstance,Party A shall bear the return charges of the employee 第二十二條仲 裁凡因執(zhí)行本合同所發(fā)生的或與本合同有關(guān)的一切爭議，雙方應(yīng)通過友好協(xié)商解決；如果協(xié)商不能解決，可向中國國際經(jīng)濟(jì)貿(mào)易仲裁委員會(huì)進(jìn)行仲裁。22 .ArbitrationAny disputes in connection with this Contract or the execution thereof shall be amicably settled through negotiations In case no settlement can be reached between the two Parties, it shall be submitted to C
