1、中英文:Employment Agreement      中央院 所(處)、研究中心聘(雇)用契約書(shū)Employment Agreement (with contribution benefit )  中央研究院 所(處)(以下簡(jiǎn)稱甲方)為應(yīng)業(yè)務(wù)需要,聘(雇)用 先生(女士)(以下簡(jiǎn)稱乙方)為約聘(雇)人員,雙方訂立契約條款如左:This Agreement is made and entered into on the _ day of _ , _ by and between _ ( Institute or Prep

2、aratory Office ), Academia Sinica ( hereinafter referred to as “A” ) and _ ( hereinafter “B” ).Whereas, A is willing to offer B employment, and B is willing to accept such employment subject to the following terms and conditions:  一、聘(雇)用期間:自年月日起至中華民國(guó)年月日止。1. Term of Employment parties agre

3、e that the term of this agreement shall be commencing from this _ day of _ , _ to the _ day of _ , _ .  二、聘(雇)用報(bào)酬:甲方按月支給乙方報(bào)酬 薪點(diǎn)(折合新臺(tái)幣 元)。2. RemunerationA shall pay B a salary of N.T._ per month.  三、工作(具體敘明):3. Bs duties ( in specific description )Bs duties shall include _ ?四、受聘(雇

4、)責(zé)任:4. Bs Obligations and Termination乙方受聘(雇)后須確保甲方公務(wù)機(jī)密,有保密期限者從其規(guī)定,無(wú)保密期限者自離職日起三年為限(解聘(雇)者亦同)。乙方不得有不法行為或違背約定義務(wù),如有違背者,除涉及民、刑事責(zé)任,由甲方依法追究外,并得隨時(shí)解聘(雇)。4.1 B shall handle in a confidential manner all matters relating to As business. This confidentiality obligation shall remain effective during the period sp

5、ecified in the regulations or working rules concerned. In case that no time period is specified, it remains effective for successive three (3) years terms after Bs termination of this employment. In the event that B violates any law or regulation, or breaches this Agreement or working rules concerne

6、d, A may in its discretion reprimand B or terminate this Agreement. A also reserves the right to institute suit against B for civil compensation or to impose criminal liability. 在聘(雇)用期間,乙方愿接受與甲方約定之工作上的指派調(diào)遣,并遵守此工作上之相關(guān)規(guī)定。若乙方違背上述相關(guān)規(guī)定確屬情節(jié)重大,甲方得隨時(shí)終止契約;甲、乙雙方如因特別事故須提前終止契約時(shí),應(yīng)于一個(gè)月前提出預(yù)告,經(jīng)甲、乙雙方協(xié)議后乙方始得離職。乙方離職時(shí)

7、,應(yīng)先依照規(guī)定辦妥離職手續(xù)。如有損害公物,或侵權(quán)情事(或違反甲方智能財(cái)產(chǎn)權(quán)規(guī)定),應(yīng)負(fù)責(zé)賠償。4.2 During the term of this Agreement, B shall comply with the directions and instructions of his/her supervisors, perform his/her duties in accordance with all regulations and relevant working rules. Where B violates any obligation specified in this pa

8、ragraph and the case is considered to be serious in nature, A may in its discretion terminate this Agreement. If at any time the parties intend to terminate this Agreement due to causes beyond the reasonable control of such party, either shall give thirty (30) days notice of cancellation to the othe

9、r party prior to the intended termination date. B shall vacate his/her office under and pursuant to the stipulations agreed upon by both parties. B shall submit to the proceedings in prescribed manner as to be vacated of his/her office.In case of any one of the following conditions is due to Bs faul

10、t,B shall be responsible for compensation:(1) Where B inflicts damage to or excessively abuses machinery, equipment, tools, raw materials, products or other article belonging to Academia Sinica;(2) Where B commits torts;(3) Where B violates As ownership of intellectual property rights.  &#

11、160;五、乙方在受聘(雇)用期間,除應(yīng)遵守甲方一切行政法規(guī)之規(guī)定外,其假期、離職儲(chǔ)金給與、勞工保險(xiǎn)及全民健保等,依左列約定:5. B shall comply with any administrative regulations and rules provided by A. In regard to the matters of absence on leave, “pay-as-you-go” contribution benefit, labor insurance and national health insurance, the following terms and con

12、ditions shall be applicable. 假期核給:依行政院暨所屬各機(jī)關(guān)聘雇人員給假辦法辦理。5.1 “Absence on leave ” shall be operated pursuant to “Regulation of Absence on leave for Personnel served in all Executive Yuan organizations under Civil Contractual Relationship”.離職儲(chǔ)金之扣繳及給與依各機(jī)關(guān)學(xué)校聘雇人員離職儲(chǔ)金給與辦法規(guī)定辦理,按月扣繳儲(chǔ)存生息,并于離職時(shí)依規(guī)定發(fā)給。5.2 deducti

13、on and grant of “pay-as-you-go” contribution benefit shall be operated pursuant to “Regulation of pay-as-you-go contribution benefit for Personnel served in all organizations and schools under Civil Contractual Relationship”. Certain amount of salary shall be deducted per month and accrue on the fin

14、ancial institute over the term of this employment.按乙方每月支報(bào)酬之百分之七提存儲(chǔ)金,其中百分之五十由乙方于每月報(bào)酬中扣繳作為自提儲(chǔ)金,另百分之五十由甲方提撥作為公提儲(chǔ)金,并由甲方在機(jī)構(gòu)開(kāi)立專戶儲(chǔ)存孳息,列帳管理。5.2-1 An amount equal to seven percent ( 7) of the monthly salary shall be contributed. Fifty percent ( 50) of the contribution shall be drawn from Bs monthly salary. (

15、 hereinafter called “personal contribution benefit”) A shall provide the other fifty percent ( 50) of the contribution ( hereinafter called “public contribution benefit”), and shall open a special account on financial institute as to accumulate and manage this contribution (personal plus public) . 乙

16、方因契約期滿離職、或經(jīng)甲方同意于契約期限屆滿前離職、或在職因公、因病或意外死亡者,發(fā)給公、自提儲(chǔ)金本息。5.2-2 total amount of the contribution benefits (personal plus public) shall be granted toB, if at any time (a) B leaves the office on the expiry of this Agreement, (b) B vacates the office prior to the expiration date with the consent of A, and (c

17、) B deceases due to undertaking of duty, illness or accident. 乙方因違反契約所定義務(wù)而經(jīng)甲方予以解聘,或未經(jīng)甲方同意而于契約期限屆滿前離職者,僅發(fā)給自提儲(chǔ)金之本息。5.2-3 The amount of personal contribution benefits accumulated shall be granted to B, if at any time (a) A terminates this Agreement inasmuch as B breaches any obligation, and (b) B resig

18、ns from the office prior to the expiration date without the consent of A. 其余未盡事宜請(qǐng)各機(jī)關(guān)學(xué)校聘雇人員離職儲(chǔ)金給與辦法有關(guān)規(guī)定。5.2-4 Any matter or event not provided in the context of this Article shall be operated pursuant to “Regulation of pay-as-you-go contribution benefit for Personnel served in all organizations and s

19、chools under Civil Contractual Relationship” and relevant regulations.?乙方受聘(雇)用期間,甲方應(yīng)善盡投保勞工保險(xiǎn)及全民健康保險(xiǎn)之義務(wù)。5.3 During the term of this Agreement, A shall insure B subject to the terms and conditions pursuant to labor insurance regulations and national health insurance regulations.   六、乙方于受聘(雇

20、)期間之著作或工作成果,如系于甲方企劃下,或法定工作期間完成者,其所有權(quán)歸屬中央院。因前開(kāi)著作或工作成果所生之智能財(cái)產(chǎn)權(quán),應(yīng)依本院之相關(guān)規(guī)定辦理。6. Both parties agree that A shall own proprietary right pertaining to the literary works or achievements completed by B under the projects initiated or coordinated by A during the term of this Agreement. ownership of intellect

21、ual property rights ( including but not limited to certain patents, trademarks, copyrights, technical information and know-how ) accrued from the literary works or achievements herein contained is subject to the relevant regulations and rules provided by A.   七、本契約期間屆滿當(dāng)然失效,如因業(yè)務(wù)需要須續(xù)聘時(shí),另行簽訂新

22、契約。7. Expiration At the expiration of the term of this agreement, the employment relationship shall automatically terminate without any condition. A new employment agreement shall be signed for the renewal and continuance of such relationship, if agreed to any by both parties.  八、本契約未訂定事項(xiàng),

23、悉依聘用人員聘用條例及行政院暨所屬機(jī)關(guān)約雇人員雇用辦法相關(guān)規(guī)定辦理。8. Any matter or event not provided in the context of this Agreement shall be governed by and interpreted in accordance with “Employment Regulation for Personnel under Civil Contractual Relationship” (stipulated by Academia Sinica ) & “Employment Regulation for

24、Personnel served in all Executive Yuan organizations under Civil Contractual Relationship”.九、本契約以中文本為準(zhǔn)。如中、二本互相歧異或抵觸時(shí),以中文本為準(zhǔn)。9. Governing LanguageThe Chinese text of this Agreement shall be deemed the original. In the event of any dispute or misunderstanding as to the interpretation of the language or terms of this Agreement, the Chinese language version shall control.   十、本契約糾紛以士林地院為第一審管轄法院。10. Governing LawAny dispute or controversy between the parties with resp
