17、廳、國務(wù)院辦公廳印發(fā)的關(guān)于實行黨政領(lǐng)導干部問責的暫行規(guī)定和 中共云南省委關(guān)于在全省實行領(lǐng)導干部問責制的決定精神,結(jié)合云南省人民政府關(guān)于省政府部門及州市行政負責人問責辦法的實施情況,制定本辦法。第二條本辦法適用于各級黨委、政府及其工作部門(含其內(nèi)設(shè)機構(gòu) )的領(lǐng)導干部,各級黨委、政府及其組織人事部門任命和管理的企事業(yè)單位的領(lǐng)導干部。第三條對黨政領(lǐng)導干部實行問責,按照干部管理權(quán)限進行。各級黨委、 政府及其工作部門黨委(黨組)對所管理的干部實行問責,紀檢監(jiān)察機關(guān)、組織人事部門履行本辦法中的有關(guān)職責。第四條實施黨政領(lǐng)導干部問責,堅持依法有序、公開公正、權(quán)責統(tǒng)一、責罰適當、依靠群眾、實事求是、懲教結(jié)合、促

29、第六條有下列獨斷專行、決策失誤情形之一的,應(yīng)當問責:(一)涉及本地區(qū)、本部門經(jīng)濟社會發(fā)展,或者人民群眾的切身利益, 或者專業(yè)性較強的重大決策事項,不按照規(guī)定程序進行可行性評估和論證、聽證、公示、專家咨詢、集體決策和報批;(二)個人擅自決定涉及經(jīng)濟社會發(fā)展全局的重大事項、干部任免、項目安排和大額資金使用;(三)違規(guī)決定采取行政措施,導致群體性事件發(fā)生,或者引發(fā)其他嚴重社會矛盾;(四)因決策失誤,造成重復建設(shè)、資源浪費、重大人員傷亡、生態(tài)環(huán)境破壞、環(huán)境嚴重污染等重大損失。第七條有下列濫用職權(quán)、違法行政情形之一的,應(yīng)當問責:(一)制定、發(fā)布、實施與法律、法規(guī)、規(guī)章或上級政策規(guī)定相抵觸的規(guī)范性文件、行

30、政決定、命令和行為;(二)違法授權(quán)或委托其他組織或個人行使相關(guān)行政職權(quán),或不依法對受委托者行使行政職權(quán)的行為進行監(jiān)督;(三)在法定的條件和標準外附加條件或變更標準,要求或授意下屬要求行政相對人提交與申請辦理事項無關(guān)材料;(四)截留、滯留、擠占扶貧和救災(zāi)、救濟等款物,以及其他ectificationand strengtheningthemanageme ntofdailye ducation,the spiritofreformshortofthecomplete system,paycloseattentiontosystem implementation, rea lly makethe

35、的事項不兌現(xiàn);(四)在招商引資等活動中,故意拖延,久拖不結(jié),影響招商引資等工作進程;(五)對應(yīng)當由多個部門或跨地區(qū)共同辦理的事項,主辦部門(地區(qū) )不主動牽頭協(xié)調(diào),協(xié)辦部門(地區(qū) ) 不積極支持配合,致使工作延誤。第九條有下列不求進取、平庸無為情形之一的,應(yīng)當問責:(一)對上級的重大決策、重要部署,消極對待,執(zhí)行不力,影響整體工作推進;(二)對本地區(qū)、本部門存在的突出問題,不調(diào)查研究,不認真解決;ectificationand strengtheningthemanageme ntofdailye ducation,the spiritofreformshortofthecomplete sy

39、es a nd im proved livel ihood,construction morehigh ecolomain economi cand social development.Atpresent,the overallsmooth(三)工作實績差、干部群眾意見較大。第十條有下列欺上瞞下、弄虛作假情形之一的,應(yīng)當問責:(一)對職責范圍內(nèi)的事項和群眾反映的問題在處置中隱瞞真相,歪曲事實;(二)編報虛假數(shù)據(jù)、虛假成績,欺騙上級機關(guān)和社會公眾;(三)瞞報、謊報、遲報公共突發(fā)事件、重大公共安全和生產(chǎn)安全責任事故、重大疫情或其他重要情況;(四)隱瞞案件真相,歪曲案件事實,瞞案不報,壓案不查。第

40、十一條有下列態(tài)度冷漠、作風粗暴情形之一的,應(yīng)當問責:(一)在人民群眾生命財產(chǎn)安全受到威脅時,不實施或不組織救助,或組織實施救助不力;(二 ) 對下屬請示匯報或反映要求解決的問題置之不理或者刁難;(三)對群眾檢舉、控告、申訴、投訴等,未按規(guī)定接待和受理。第十二條有下列鋪張浪費、攀比享受情形之一的,應(yīng)當問責:(一)不從實際出發(fā),不顧財政承受力,違背群眾意愿,搞 “政績工程”、 “形象工程”;(二)違反規(guī)定建蓋樓堂館所、購買商品房和集資建房,購建和裝修辦公用房,或購買、更換公務(wù)用車;(三)借招商、考察、學習、培訓等名義,變相公款旅游;(四)用公款進行高消費娛樂活動。ectificationand s

45、、產(chǎn)權(quán)交易、礦業(yè)權(quán)審批、城鄉(xiāng)規(guī)劃、國有土地使用權(quán)出讓等活動中,不按有關(guān)規(guī)定公開公平公正辦理:(三)不接受黨組織、人大、 政協(xié)、 新聞輿論和人民群眾監(jiān)督;(四)不配合紀檢監(jiān)察、審計等監(jiān)督部門履行職責。第十四條在所管轄范圍內(nèi),有下列監(jiān)管不力、處置不當情形之一的,應(yīng)當問責:(一)領(lǐng)導班子成員發(fā)生重大違法違紀案件;(二)發(fā)生濫用職權(quán)、徇私舞弊、失職瀆職等嚴重違法違紀行為,或?qū)乐剡`法違紀行為不管不問,甚至包庇、袒護、縱容;(三)發(fā)生重特大安全生產(chǎn)責任事故,或重大建設(shè)項目出現(xiàn)嚴重質(zhì)量問題;(四 )組織大型群眾性活動,未采取有效安全防范措施和補救措施,致使發(fā)生重大安全事故,以及事故發(fā)生后處置不當;(五)對

50、ent,the overallsmooth第十六條本地區(qū)、 本部門、 本系統(tǒng)或者本單位在貫徹落實黨風廉政建設(shè)責任制方面出現(xiàn)問題的,按照 關(guān)于實行黨風廉政建設(shè)責任制的規(guī)定,追究黨政領(lǐng)導干部的責任。第三章問責方式及適用第十七條對黨政領(lǐng)導干部實行問責的方式分為:(一)誡勉談話;(二)取消當年評優(yōu)評先資格;(三)責令作出書面檢查;(四)通報批評;(五)責令公開道歉;(六)調(diào)整工作崗位;(七)停職檢查;(八)引咎辭職;(九)責令辭職;(十)免職。以上問責方式可以單獨使用或并用。第十八條被問責的黨政領(lǐng)導干部應(yīng)當追究紀律責任的,依照有關(guān)規(guī)定給予黨紀政紀處分。涉嫌犯罪的,移送司法機關(guān)依法處理。第十九條根據(jù)被問

55、情節(jié)嚴重,損害和影響較大的,采用通報批評、責令公開道歉、調(diào)整工作崗位、停職檢查的方式問責;(三 )情節(jié)特別嚴重,損害和影響重大的,采用引咎辭職、責令辭職、免職的方式問責。第二十條責任劃分。(一)領(lǐng)導干部在其職責范圍內(nèi),不履行或不正確履行自己的職責,對造成的損失或后果起決定性作用的,承擔直接責任;(二)領(lǐng)導干部在其職責范圍內(nèi),對直接主管的工作不履行或不正確履行職責,對造成的損失或后果負直接領(lǐng)導責任的,承擔主要領(lǐng)導責任;(三)領(lǐng)導干部在其職責范圍內(nèi),對應(yīng)管的工作或參與決定的工作不履行或不正確履行職責,對造成的損失或后果負次要領(lǐng)導責任的,承擔重要領(lǐng)導責任;(四)2 人以上不履行或不正確履行職責,造成
