1、 篇一：車輛租賃合同(中英文版)車輛接送客合作經(jīng)營合同 甲方:party a:乙方:party b：甲乙雙方因合作經(jīng)營甲方酒店客人用車事宜,特達成如下合作合同,供雙方共同遵守: this contract is made by and between party a and party b, whereby both parties agree to the terms and conditions as stipulated hereinafter:一、 合作基本方式scope of work雙方共同經(jīng)營xxxx（以下簡稱xx）車輛接送客人業(yè)務(wù)。乙方提供車輛及駕駛員，甲方負(fù)責(zé)轎車接送客業(yè)務(wù)安

2、排及駕駛員管理。雙方按約獲得利潤分成，承擔(dān)責(zé)任按經(jīng)營分工，各負(fù)責(zé)任。乙方應(yīng)提供明細(xì)的收費項目表給甲方，甲方有權(quán)就收費情況給予意見。二、 甲方權(quán)利義務(wù)rights and responsibilities of party a1、甲方負(fù)責(zé)安排、提供酒店轎車接送客人業(yè)務(wù)，且該業(yè)務(wù)甲方只能按本合同約定安排由乙方車輛接送，不能安排其他非乙方車輛接送。party a is responsible for arranging and providing hotel cars for guest. partya can only use party bs car according to the contr

3、act.2、甲方應(yīng)做好轎車接送客人的業(yè)務(wù)管理工作，每日予以記錄業(yè)務(wù)清單與應(yīng)收報酬，每周甲乙雙方核對客人用車經(jīng)營收入。三、 乙方權(quán)利義務(wù)rights and obligations of party b1、乙方需提供蒙迪歐、奧迪a6、別克gl8、豐田考斯特等車型為甲方客人提供接送服務(wù)。party b shall provide 2 mendeo, , audia6, buickgl8，toyota coaster including other models of car as per guest(s) request.2、乙方提供相應(yīng)駕駛員，經(jīng)營甲方接送客業(yè)務(wù)，駕駛員必須服從酒店管理。part

4、y b shall provide professional licensed drivers who must follow the rules and regulations of the hotel.3、駕駛員服裝按甲方要求由乙方自備，乙方應(yīng)保證所提供之車輛車況及駕駛員之服務(wù)，著裝符合甲方酒店服務(wù)標(biāo)準(zhǔn)，如有違反甲方將給予乙方書面警告并建議乙方更換駕駛員，上述書面警告累計達三次以上如乙方仍無改進，甲方有權(quán)考慮終止合同。party b shall responsible for the drivers uniform based on the glooming standard and re

5、quirement by the hotel. violation of this regulation will result in warning letter and driver change. party a can terminate this contract if warning letter amounted to more than three times4、乙方提供的上述車輛來源以乙方有權(quán)合法使用為原則，不以車輛所有權(quán)歸屬為限。 party b shall guarantee the legal use rights of the cars, it will not be

6、 limited by the ownership of the cars.5、乙方應(yīng)負(fù)責(zé)辦理好車輛的保險，保險費全部由乙方承擔(dān)。party b shall be full in charge of car insurance and totally bear the insurance fee.6、乙方應(yīng)負(fù)責(zé)其提供的轎車的日常維修工作。party b should be responsible for daily car maintenance.7、乙方有權(quán)利按本合同約定獲得利潤及有義務(wù)承擔(dān)相應(yīng)責(zé)任。party b has the right to obtain the stipulated

7、 share of profit and is obliged to related responsibilities四、 甲方客人用車費用的收取guest transportation charge本合作事項所產(chǎn)生的收益，即甲方客人的用車費用，由甲方先行收取。party a can charge for guest first on behalf of party b according to the profits made by the co-operation business.五、 經(jīng)營成本負(fù)擔(dān)management costmanagement cost hereinafter is

8、 to be borne by party b:a、乙方所提供的轎車購置成本費用由乙方自行承擔(dān)，車輛所有權(quán)屬于乙方。甲方對乙方提供的車輛不享有所有權(quán)。car purchasing expense is to be borne by party b. party b has the ownership of the cars. party a does not have the ownership of the cars.b、駕駛員工資收入。driver salaryc、車輛及駕駛員的保險費用。car and driver insurance d、車輛的維修、保養(yǎng)費用，油費，過路、過橋、養(yǎng)路費用

9、等。car maintenance fee / petrol fee /road toll fee.六、 收入分配revenue distributiona can obtain 30% of the revenue, party b can obtain 70% of the rest revenue.2、以上收入是指乙方每月接、送客人后，由甲方客人支付的全部用車費用。所有收入均由甲方代為收取，乙方不可向客人收取用車費用。甲方有償使用乙方車輛所產(chǎn)生的用車費用不包含在此，需另行結(jié)算。3、本條所指收入，雙方按月予以結(jié)算。即在每月1-5號內(nèi)結(jié)算上月收入，并在結(jié)算后2日內(nèi)予以分配。revenue s

11、will own 30% of the rest profits; party b will own 70% of the rest profits.七、 經(jīng)營相關(guān)責(zé)任承擔(dān)distribution of the related responsibilities1、因本合作事項產(chǎn)生損害結(jié)果，包括但不限于車輛損失、駕乘人員損傷、第三方損失均由乙方自行承擔(dān)與解決。party b shall be borne damages which includes, without limitation, car damage, driver and passenger injury and all third

12、 party loss.2、若以上損害系第三方原因造成的，需以甲方名義予以解決的，則甲方應(yīng)予以解決。屆時，甲方可自行或委托乙方處理，但甲方因此產(chǎn)生的各項費用由乙方承擔(dān)。同時，甲方向第三方獲得的各項賠償應(yīng)返還給乙方。if the above damages are caused by a third party and need party a to solve, party八、 特別約定special agreement客人所需要消費發(fā)票由甲方提供，扣除甲方獲得利潤，余下部分乙方每月結(jié)帳時全額開據(jù)發(fā)票結(jié)帳。party a shall provide invoice as required, p

29、西亞法律，乘客不得在車內(nèi)吸煙與飲食。6. 發(fā)生任何情況導(dǎo)致車輛不能使用時，甲方應(yīng)立即進行更換同等級車輛頂替，保障乙方正常使用要求。upon car breakdown due to any reasons, party a shall immediately replace with the same standard cars to ensure the normal use as required.7. 任何交通事故的費用及后果由甲方承擔(dān)。party a shall undertake the costs and consequences incurred from accident.8. 付款：從簽訂合同后，乙方每滿一個日歷月對甲方進行一次結(jié)算，并按結(jié)算額進行支付。payment term: party b shall make the monthly payment to party a as agreed in the mutually settled monthly statement after the agreement signed.9. 甲方司機應(yīng)能夠流利使用英語、漢語與馬來語，并熟悉新加坡及馬來西亞道路。在乙方租車期間，甲方司機應(yīng)聽從乙 方的安排，甲方的任何延誤對乙方造成的損失，乙方將從租車費中進行扣減，
