(14) 裝運(yùn)條件：(CIF / CFR) 1. 載運(yùn)船只由賣方安排，允許分批裝運(yùn)，允部轉(zhuǎn)船，允許集裝箱運(yùn)輸。 2. 賣方于貨物裝船后，應(yīng)將合同號(hào)碼、品名、數(shù)量、船名、裝船日期以傳真通知買方。 Terms of Shipment :( CIF / CFR) 1. The carrying ve

7、ssel shall be provided by the Seller，partial shipments，transshipment and container transportation are allowed. 2. After loading is completed，the Seller shall notify the Buyer by fax of the contract number，description of commodity， quantity，name of the carrying vessel and date of shipment. (15) 品質(zhì)與數(shù)量

8、、重量的異議與索賠：貨到目的口岸后，買方如發(fā)現(xiàn)貨物品質(zhì)及/或數(shù)量/重量與合同規(guī)定不符，除 屬于保險(xiǎn)公司及/或船公司的責(zé)任外，買方可以憑雙方同意的檢驗(yàn)機(jī)構(gòu)出具的檢驗(yàn)證明向賣方提出異議，品質(zhì)議 異須于貨到目口岸之日起30天內(nèi)提出，數(shù)量/重量異議須于貨到目的口岸之日起 15天內(nèi)提出。賣方應(yīng)于收到異議后30 天內(nèi)答復(fù)買方。 Qudity/Quantity/Weight Discrepancy and Claim: In case the quality and/or quantity/Weight are found by the Buyer to be not in conformity with

9、the Contract after Arrival of the goods at the port of destination the Buyer may lodge claim with the seller supported by survey report issued by inspection organization agreed upon by both parties with the exception，however，of those claims for which the insurance company and/or the shipping company

10、 are to be held responsible. Claim for quality discrepancy should be filed by the Buyer within 30 days after arrival of the goods at the port of destination while for quantity/weight discrepancy claim should be filed by the Buyer with in 15 days after arrival of the goods at the port of destination.

11、 The Seller shall， within 30 days after receipt of the notification of the claim，send reply to the Buyer. (16) 人力不可抗拒：由于人力不可抗拒事故，使賣方不能在本合同規(guī)定期限內(nèi)交貨或者不能交貨，賣方不負(fù)貫 任。但賣方必須立即以傳真通知對方。如對方提出要求，賣方應(yīng)以掛號(hào)函向?qū)Ψ教峁┯芍袊鴩H易易促進(jìn)委員 會(huì)或有關(guān)機(jī)構(gòu)出具的發(fā)生事故的證明文件。 Force Majeuer : In case of Force Majeure the Seller shall not be held res

12、p on sible for the late delivery or non-delivery of the goods but shall no tify the Buyer by fax. The Seller shall deliver to the Buyer by registered mail，if so requestedby the Buyer，a certificate issued by the China Council for Promoti on of Intern ati onal Trade or any compete nt authorities. 13、 仲裁：凡因執(zhí)行本合同或與本合同有關(guān)事項(xiàng)所發(fā)生的一切爭執(zhí)，應(yīng)由雙方通過友好方式協(xié)商解決。如果不能 取得協(xié)議時(shí)，則在被告國家根據(jù)被告國仲裁機(jī)構(gòu)的仲裁程序規(guī)則進(jìn)行仲裁。仲裁決定是終局的，對雙方具有同 等約束力。仲裁費(fèi)用除非載機(jī)構(gòu)另有決定外，均由敗訴一方負(fù)擔(dān)。 Arbitrati ons: All disputes in connection with this Con tract or the executi on thereof shell be settled through friendly negotiatons between two parties.
