前言網(wǎng)絡(luò)商場包羅萬象,商品種類繁多,購買方便快捷,向消費(fèi)市場散發(fā)著難以抵擋的誘惑。據(jù)艾瑞咨詢數(shù)據(jù)顯示,從2001年到2006年,我國網(wǎng)絡(luò)購物的用戶規(guī)模從375萬人增加到4310萬人,與此同時網(wǎng)絡(luò)購物交易額也由6億元增長至312億元。艾瑞咨詢2012Q3電子商務(wù)交易規(guī)模199萬億隨著水果蔬菜、襯衫、電器、建材甚至鉆石都已經(jīng)搬到網(wǎng)上來賣,會有更多的細(xì)分垂直行業(yè)掀起新的網(wǎng)絡(luò)銷售,電子商務(wù)也開始由第一波的互聯(lián)網(wǎng)概念真正走向了關(guān)乎人們衣食住行的商務(wù)行為。調(diào)查在我們的調(diào)查中,不少被訪者認(rèn)為網(wǎng)上購物既方便又齊全,但也有被訪者反映了網(wǎng)上購物的商品信息不齊全,很多商品都是拿官方雜志的圖片混淆消費(fèi)者等問題。個案一小方,女,28歲,江門臺山人,自由職業(yè)者“我覺得網(wǎng)上購物弊大于利。大部分網(wǎng)店都是標(biāo)榜韓國等海外的官方圖片,以漂亮的效果圖混淆消費(fèi)者,而商品卻是仿制品,這就讓我們消費(fèi)者買得不安心,很多理性消費(fèi)者都會選擇小額消費(fèi)?!眰€案二黃先生,男,40歲,江門人,某服裝店老板“網(wǎng)上購物不能看到實(shí)物,衣物等物品也不能試穿,黑心賣家還會以次充好,把瑕疵品賣給買家。一方面,交易不安全,在實(shí)體店買賣都是現(xiàn)金交易,而在網(wǎng)上購物卻要款到發(fā)貨,根本不確定賣方是否能誠信交易;另一方面,維修困難。當(dāng)你在網(wǎng)上購買了數(shù)碼產(chǎn)品,使用出現(xiàn)故障了,你是否能得到聯(lián)保的保修服務(wù)?!眰€案三小陳,男,22歲,江門人,五邑大學(xué)學(xué)生“我曾在網(wǎng)上購買50元充值卡,買回來后發(fā)現(xiàn)卻是30元充值卡,一直也聯(lián)系不上賣家,所以在網(wǎng)上購物存在很大風(fēng)險(xiǎn),經(jīng)營者多用虛擬網(wǎng)名注冊,經(jīng)營者的真實(shí)身份、住所等信息無法予以確認(rèn),很多網(wǎng)上交易又是跨省市的異地交易,給受理和查處帶來困難,使消費(fèi)者的損失難以被追回?!本W(wǎng)絡(luò)購物的弊端分析我們在看到網(wǎng)上購物優(yōu)點(diǎn)的同時更要認(rèn)清它在現(xiàn)階段存在的問題,以便盡早地找到解決方案以促進(jìn)網(wǎng)上購物的良性發(fā)展??梢哉f,現(xiàn)階段我國消費(fèi)者對網(wǎng)上購物狀況的評價(jià)是“痛并快樂著”,而這其中痛的指數(shù)要高于快樂指數(shù)。第一、交易對象認(rèn)定的模糊性。明確交易對象對于消費(fèi)者來說是非常重要的事情,這關(guān)系到法律責(zé)任的承擔(dān)問題。在傳統(tǒng)購物環(huán)境下交易對象非常明確,商店里掛的營業(yè)執(zhí)照就表明了經(jīng)營者的身份。一旦出了問題可以直接到原購物地點(diǎn)追討責(zé)任。但是在網(wǎng)絡(luò)環(huán)境下,消費(fèi)者只有通過經(jīng)營者網(wǎng)站中提供的信息了解對方,但是至于信息是否真實(shí)、對方到底是誰根本不清楚。第二、知情權(quán)難以保證。知情權(quán)是消費(fèi)者享有的一項(xiàng)基本權(quán)利也是一項(xiàng)重要權(quán)利。然而上網(wǎng)購物時,消費(fèi)者獲取信息的范圍是有限的,它并不像傳統(tǒng)購物時能看到、摸到真實(shí)立體的商品,并向售貨員詳細(xì)打聽有關(guān)商品的基本情況。此時的消費(fèi)者只能從網(wǎng)上提供的內(nèi)容中獲取有關(guān)商品的部分信息,看到的充其量也就是一張或幾張關(guān)于商品的平面照片。因此,網(wǎng)上購物的消費(fèi)者一般對商品信息的了解都是缺失的。第三、格式合同的制約。由于網(wǎng)上購物的特殊性,格式合同不可避免地成了消費(fèi)者和經(jīng)營者達(dá)成合意的必要環(huán)節(jié)。現(xiàn)在的問題是經(jīng)營者往往利用特權(quán)制定一些又長又復(fù)雜甚至危害消費(fèi)者權(quán)利的條款,有時為逃避責(zé)任還會使用一些模棱兩可的語言,一旦出了問題會以此為自己辯解。消費(fèi)者有時為了圖省事不會仔細(xì)閱讀每一條款,有時就算讀了也很有可能領(lǐng)會不到其中的微妙之處,有時即便發(fā)現(xiàn)有什么可疑的地方但為了及時買到所需商品也無所顧忌,因此,有時一個“我同意”的點(diǎn)擊會給消費(fèi)者帶來了購物后一系列的麻煩。第四、交貨延遲。付款后不能按期收到貨物的事屢見不鮮,有時付款后收不到貨物的情況也會出現(xiàn)。第五、退貨困難。網(wǎng)上購得的貨物想要退掉并不是件容易的事,經(jīng)營者往往找種種理由拒絕退貨。有時甚至直接在格式合同中明文規(guī)定某些商品不得退貨。對于在退貨范圍內(nèi)的商品,通過經(jīng)營者的規(guī)定看也根本無法退換。第六、網(wǎng)上欺詐與虛假廣告?;ヂ?lián)網(wǎng)技術(shù)使得某些商家可通過匿名的方式躲避調(diào)查,利用監(jiān)管難度大、隱蔽性強(qiáng)、傳播快的特點(diǎn)大行虛假廣告和欺詐之道,它們往往打著“跳樓價(jià)”“超值大獎等你拿”一類的旗號吸引消費(fèi)者的眼球,借機(jī)侵犯消費(fèi)者的權(quán)益而為自己牟利。第七、無人問津的售后服務(wù)。許多網(wǎng)民表示,網(wǎng)上購物的售后服務(wù)較差,有時商品出了問題經(jīng)營者能推則推,就算有售后服務(wù)也只是表面應(yīng)付一下,許多問題根本得不到實(shí)質(zhì)解決。第八、處于危機(jī)中的隱私權(quán)。這個問題是現(xiàn)在大家廣泛關(guān)注的問題,也是挑戰(zhàn)網(wǎng)絡(luò)安全的主要大敵。一些商家為了擴(kuò)大銷售額,不惜將以前消費(fèi)者的信息建立數(shù)據(jù)庫,根據(jù)其經(jīng)濟(jì)狀況、上網(wǎng)習(xí)慣等不停轟炸消費(fèi)者的郵箱以推銷自己的產(chǎn)品;更有甚者,為了眼前的經(jīng)濟(jì)利益將消費(fèi)者的信息賣給他人。此外,消費(fèi)者的信用卡賬號、密碼被篡改、被盜也是常有的事。所有這些問題如果不能及時有效地解決,肯定會制約未來網(wǎng)上購物的進(jìn)一步發(fā)展。當(dāng)今信息產(chǎn)業(yè)高速發(fā)展,商品借助網(wǎng)絡(luò)產(chǎn)生了一種新的交易方式網(wǎng)絡(luò)購物,今天很高興和對方辯友共同探討網(wǎng)絡(luò)購物利弊的問題,我方觀點(diǎn)是網(wǎng)絡(luò)購物弊大于利,首先,我們明確這樣的概念網(wǎng)絡(luò)購物指的是通過互聯(lián)網(wǎng)檢索信息,并通過訂購者發(fā)出請求,通過第三方支付工具或銀行付款,通過郵寄方式或快遞公司配送的購物方式。今天我們研究利弊的對象,是看網(wǎng)絡(luò)購物對個人,對社會,乃至對國家是利是弊。下面我方從從以下三方面進(jìn)行闡述。第一、從個人的角度出發(fā),網(wǎng)絡(luò)購物使個人權(quán)益受到威脅。我們知道網(wǎng)絡(luò)購物需要大量的個人信息,而現(xiàn)在的網(wǎng)絡(luò)上個人信息外泄的現(xiàn)象越來越嚴(yán)重,甚至有人倒賣個人信息。再者,通過網(wǎng)絡(luò)進(jìn)行購物,消費(fèi)者難以知悉其商品和接受的服務(wù)的真實(shí)情況,由于網(wǎng)絡(luò)具有虛擬性,看得見卻摸不著,網(wǎng)絡(luò)消費(fèi)者僅能憑著自己的感官或經(jīng)驗(yàn)去判定產(chǎn)品質(zhì)量和性能。眾多消費(fèi)者對網(wǎng)絡(luò)產(chǎn)品質(zhì)量,性能了解是局部的,片面的。因此,包括因產(chǎn)品存在的瑕疵等質(zhì)量問題而引發(fā)的糾紛時常發(fā)生。由于網(wǎng)絡(luò)購物無確定的發(fā)生地,交易地而導(dǎo)致消費(fèi)者難以享有應(yīng)有的售后服務(wù),甚至國家三包政策都難以實(shí)現(xiàn)。當(dāng)消費(fèi)者的權(quán)益受到侵害時,由于網(wǎng)絡(luò)身份信息核實(shí)難,證據(jù)真?zhèn)伪鎰e難,權(quán)利義務(wù)認(rèn)定難的三大特點(diǎn)而導(dǎo)致消費(fèi)者權(quán)益無法得到正當(dāng)?shù)木S護(hù)。無論是網(wǎng)購的過程還是網(wǎng)購的結(jié)果無一不在告訴我們,網(wǎng)絡(luò)購物弊大于利。第二、從社會層面上看,網(wǎng)絡(luò)購物引發(fā)了信譽(yù),道德危機(jī)。我們看到教我們開網(wǎng)店的書籍,毫不避諱地告訴我們?nèi)绾螌a(chǎn)品圖片修飾到美觀甚至夸張的程度;如何編寫能夠吸引甚至忽悠消費(fèi)者的文字;如何將商家的信譽(yù)刷到一定的高度;如何刪除對商家不良的評論。當(dāng)這些東西成了開網(wǎng)店的必修課時,我們的擔(dān)心還是多余的嗎我們還看到,在網(wǎng)絡(luò)這一平臺上,走私水貨,販賣盜版等行為更加猖獗,他們瘋狂地?cái)D占正牌商家的市場,使消費(fèi)者想買真貨卻不敢買,當(dāng)正牌商家想賣真貨卻賣不出,使合法商家的利益受到了沖擊。水貨,盜版等不良風(fēng)氣的盛行,擾亂了市場的同時也必將對社會道德,社會秩序產(chǎn)生很大的不利影響。第三、從國家的角度上看,對于網(wǎng)絡(luò)購物國家監(jiān)管難度很大。中國B2B研究中心調(diào)查顯示,淘寶網(wǎng)上80以上的店主并沒有繳納任何稅金,這就證明至少有30億元的巨額稅金就這樣點(diǎn)點(diǎn)鼠標(biāo),敲敲鍵盤之間無聲無息蒸發(fā)了。而正是因?yàn)榫W(wǎng)絡(luò)商店沒有固定的場所,導(dǎo)致了國家征稅的困難。出臺了法律條文,也因?yàn)閷?shí)施難度大,也無法減少網(wǎng)絡(luò)商店偷稅漏稅的現(xiàn)象。更驚人的是,不法分子利用網(wǎng)絡(luò)開設(shè)違規(guī)的秘密商店進(jìn)行網(wǎng)絡(luò)非法交易,甚至于管制品買賣。而對于這種現(xiàn)象,相關(guān)部門也因難找到證據(jù)而出現(xiàn)了法律想管卻管不到的局面。電子商務(wù)糾紛案件通常標(biāo)額小,數(shù)量多,目前司法資源有限又效率較低,成本高昂,無法適應(yīng)電子商務(wù)的快速發(fā)展。我們看到,對于網(wǎng)絡(luò)購物國家監(jiān)管難度很大,而這必將對于國家的利益和安全造成巨大的威脅。如今,我們看到了網(wǎng)絡(luò)購物不單單使消費(fèi)者個人安全受到了威脅,還使社會出現(xiàn)危機(jī
