Improvement of farmers排污管道工程承包協(xié)議發(fā)包方（甲方）：承包方（乙方）：王永峰鋒頂管施工隊(duì)（身份證號： ）依據(jù)中華人民共和國合同法及建筑安裝工程承包合同條例及有關(guān)規(guī)定，就高陵縣開發(fā)區(qū)涇渭五路污水管道工程，經(jīng)甲乙雙方協(xié)商一致，達(dá)成如下分包協(xié)議：第一條 工程概況一、工程名稱：高陵縣開發(fā)區(qū)涇渭五路污水管道工程二、工程地點(diǎn)：高陵縣開發(fā)區(qū)涇渭五路三、工程主要內(nèi)容： DN1000頂管施工分包.（包含安全文明施工、工作井、接收井的開挖支護(hù)、管道頂進(jìn)及管口處理、閉水試驗(yàn)等工作內(nèi)容）。四、工程包干價： 1、DN1000鋼筋砼管包干單價： 1040元/延米； 2、本合同暫定工程量為612.7米，按實(shí)際發(fā)生量結(jié)算。五、工程工期：本工程自 年 月 日開工，至 年 月 日竣工驗(yàn)收。工期延誤造成的費(fèi)用由乙方承擔(dān)。第二條 承包方式本工程的承包方式為：包工包料（含管材附材）。1、乙方的工作內(nèi)容：工作井、接收井按甲方要求施工，頂管設(shè)備進(jìn)場及安裝和頂進(jìn)、設(shè)備轉(zhuǎn)場、管道內(nèi)抹帶、等與頂管工作有關(guān)的工作內(nèi)容。2、乙方負(fù)責(zé)施工現(xiàn)場的安全圍護(hù)、文明施工。第三條 價款支付與結(jié)算甲方應(yīng)按照乙方當(dāng)月完成工程的工程款60%支付給乙方。工程結(jié)束，經(jīng)相關(guān)單位組織驗(yàn)收，驗(yàn)收合格后，甲方付至乙方工程款的90%，余款自驗(yàn)收合格后一年內(nèi)付清。第四條 工程變更本工程在施工中，任何一方不得隨意變更原設(shè)計(jì)，承包方應(yīng)無條件服從發(fā)包方的統(tǒng)一管理，無權(quán)對設(shè)計(jì)變更加以干涉，但有權(quán)商討變更價款的確定。第五條 工程質(zhì)量與安全1、承包方必須保證本工程的質(zhì)量，發(fā)包方以國家頒發(fā)的給水排水管道工程施工及驗(yàn)收規(guī)范GB50268-2008、建筑安裝工程質(zhì)量檢驗(yàn)評定標(biāo)準(zhǔn)、施工圖紙及說明書，施工技術(shù)文件作為依據(jù)對本工程進(jìn)行驗(yàn)收，如驗(yàn)收不合格，發(fā)包方有權(quán)扣除承包方總價款的20 作為保修費(fèi)，直至承包方返工至合格為止，其返工所耗的工、料、機(jī)均由承包方自負(fù)。2、乙方必須確保本工程的安全，應(yīng)本著“預(yù)防為主、安全第一”的方針施工，嚴(yán)格施工作業(yè)制度，無條件服從甲方安全人員統(tǒng)一指揮，凡因乙方原因，造成任何安全事故，一切損失與后果均由乙方自負(fù)，和甲方無關(guān)。3、施工期間職工患病，因工負(fù)傷致殘、傷亡所需費(fèi)用全部由乙方自理。第六條 雙方責(zé)任一、甲方權(quán)利與義務(wù)1、開工前甲方向乙方提供施工圖紙和相關(guān)資料，進(jìn)行施工技術(shù)交底、安全文明施工交底。2、甲方隨時抽查乙方工程質(zhì)量，對不符合施工要求的部分，乙方應(yīng)在甲方規(guī)定期限內(nèi)整改，如需返工，乙方無條件返工并承擔(dān)由此給甲方造成的損失。施工過程中乙方造成關(guān)于該工程進(jìn)度質(zhì)量和國家規(guī)范的錯誤甲方有權(quán)處罰。3、施工用水、電，由甲方負(fù)責(zé)提供，保證施工用水、電供應(yīng)端口接入施工段及土方外運(yùn)。4、將水準(zhǔn)點(diǎn)及坐標(biāo)控制點(diǎn)以局面的形式交給乙方，并進(jìn)行現(xiàn)場交驗(yàn)，乙方正式放線后，由甲方負(fù)責(zé)及時請本工程業(yè)主和監(jiān)理部門進(jìn)行驗(yàn)收。5、組織乙方進(jìn)行圖紙會審、安全交底、技術(shù)交底。6、甲方負(fù)責(zé)頂管施工的資料整理，乙方協(xié)助甲方提供所需的相關(guān)原始數(shù)據(jù)、材料的合格證、檢驗(yàn)報(bào)告等及頂進(jìn)記錄，但不負(fù)責(zé)工程資料。7、甲方負(fù)責(zé)指派專職測量人員，對乙方的頂進(jìn)質(zhì)量進(jìn)行跟蹤測量，發(fā)現(xiàn)質(zhì)量問題及時通知乙方進(jìn)行處理。8、按合同約定向乙方支付工程款。二、乙方權(quán)利與義務(wù)1、乙方必須嚴(yán)格按照國家規(guī)范、設(shè)計(jì)圖紙及甲方要求施工，保證工程順利驗(yàn)收，否則所有返工費(fèi)用由乙方承擔(dān)。乙方服從甲方管理人員、技術(shù)人員對工程質(zhì)量、安全文明施工等方面的要求。2、乙方應(yīng)根據(jù)當(dāng)?shù)厥姓ㄔO(shè)安全文明施工要求及甲方制定具體安全文明施工措施做好施工段內(nèi)的安全、文明施工，保證工程能夠保質(zhì)保量保安全的順利完成，安全文明施工所需的材料由乙方負(fù)責(zé)。3、乙方必須采取切實(shí)、有效、嚴(yán)格的安全防護(hù)措施，嚴(yán)格執(zhí)行甲方制定的安全文明施工相關(guān)條例，保證所有施工人員和設(shè)備的安全，并承擔(dān)施工中由于自身原因而造成事故的責(zé)任和因此發(fā)生的費(fèi)用。4、乙方應(yīng)充分考慮土質(zhì)情況制定合理施工方案，確保管道頂進(jìn)順利頂至設(shè)計(jì)井位，否則此段管不計(jì)費(fèi)，并承擔(dān)返工費(fèi)用。5、乙方必須保證施工質(zhì)量，確保在地質(zhì)報(bào)告顯示的土層中正常施工不會造成對所穿越的道路、地下管線和施工區(qū)域內(nèi)的地面出現(xiàn)塌陷、沉降等損壞，否則自行承擔(dān)所造成的經(jīng)濟(jì)損失。6、乙方確保進(jìn)場設(shè)備，儀器完好，有合格證并有權(quán)威機(jī)構(gòu)檢測報(bào)告。7、乙方自行采購水泥、管材等其它材料，所有進(jìn)場材料必須合格經(jīng)甲方材料員批準(zhǔn)后方可使用，并提供材料合格證。8、開工前向甲方提供施工方案及其它相關(guān)資質(zhì)、資料。第七條 附則一、甲方指定 為工地代表，乙方指定 為工地代表。二、本合同發(fā)生糾紛時，甲乙雙方應(yīng)及時協(xié)商解決，協(xié)商不成時：1、向經(jīng)濟(jì)合同仲裁機(jī)關(guān)申請仲裁；2、向人民法院起訴。三、違約責(zé)任： 1、甲方違約經(jīng)雙方協(xié)商解決，乙方也可終止合同，并賠償乙方相應(yīng)損失。2、乙方違約經(jīng)雙方協(xié)商解決，甲方可隨時終止合同，更換施工隊(duì)伍并要求乙方賠償相應(yīng)損失。3、未盡事宜，雙方協(xié)商解決。四、本合同一式肆份，甲乙雙方各執(zhí)貳份。合同自簽字之日起正式生效，有效期至工程結(jié)束。驗(yàn)收合格后交給甲方，甲方付清工程余款后廢止。 甲方： （蓋章）： 乙方： （蓋章）：身份證號： 身份證號：電 話： 電 話：年 月 日 年 月 日living standards, poor farmers in less than complete elimination of 4600 Yuan, 8949, 19008.
