________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________|________||________|________|________|________第二部分:第三方介入后的修正一、第三方定義在本合同中,“第三方”是指除甲方(借款人)和乙方(貸款銀行)之外的任何自然人、法人或其他組織,包括但不限于中介機(jī)構(gòu)、擔(dān)保機(jī)構(gòu)、評(píng)估機(jī)構(gòu)、律師事務(wù)所等。二、第三方介入方式1.中介機(jī)構(gòu):在貸款申請(qǐng)、審批及發(fā)放過程中,中介機(jī)構(gòu)提供協(xié)助,包括但不限于提供貸款咨詢服務(wù)、協(xié)助收集相關(guān)材料、協(xié)助溝通等。2.擔(dān)保機(jī)構(gòu):為甲方的貸款提供擔(dān)保,確保貸款安全。3.評(píng)估機(jī)構(gòu):對(duì)甲方擬裝修的住房進(jìn)行評(píng)估,提供評(píng)估報(bào)告。4.律師事務(wù)所:為甲乙雙方提供法律咨詢、合同起草等服務(wù)。三、第三方責(zé)任1.中介機(jī)構(gòu):(1)如實(shí)向甲方提供貸款信息,不得誤導(dǎo)甲方。(2)協(xié)助甲方按照乙方要求提供真實(shí)、完整、有效的申請(qǐng)材料。(3)不得收取甲方任何費(fèi)用以外的費(fèi)用。2.擔(dān)保機(jī)構(gòu):(1)按照擔(dān)保合同約定,履行擔(dān)保義務(wù)。(2)未經(jīng)乙方同意,不得擅自解除擔(dān)保。3.評(píng)估機(jī)構(gòu):(1)按照國家標(biāo)準(zhǔn)和規(guī)范進(jìn)行評(píng)估,確保評(píng)估結(jié)果的準(zhǔn)確性。(2)提供真實(shí)、客觀、公正的評(píng)估報(bào)告。4.律師事務(wù)所:(1)為甲乙雙方提供專業(yè)、高效的法律服務(wù)。(2)按照合同約定,及時(shí)履行律師職責(zé)。四、第三方責(zé)任限額1.中介機(jī)構(gòu):(1)如因中介機(jī)構(gòu)的原因?qū)е沦J款無法發(fā)放,中介機(jī)構(gòu)應(yīng)承擔(dān)相應(yīng)的責(zé)任。(2)中介機(jī)構(gòu)不得因自身原因影響貸款審批及發(fā)放。2.擔(dān)保機(jī)構(gòu):(1)擔(dān)保機(jī)構(gòu)因自身原因?qū)е聯(lián)J?,?yīng)承擔(dān)相應(yīng)的責(zé)任。(2)擔(dān)保機(jī)構(gòu)應(yīng)確保擔(dān)保期間貸款本息的償還。3.評(píng)估機(jī)構(gòu):(
