機(jī)械維修工簡易勞動合同合同編號：__________甲方（用人單位）：__________地址：__________法定代表人：__________聯(lián)系電話：__________乙方（勞動者）：__________身份證號碼：__________聯(lián)系電話：__________住址：__________鑒于甲乙雙方本著平等自愿、協(xié)商一致的原則，甲方同意employing乙方asamechanicalmaintenanceworker，乙方的employmentbeginsontheeffectivedateofthiscontractandshalllastforatermof______years/months/days(hereinafterreferredtoasthe"termofemployment").1.DutiesandResponsibilities1.1Duringthetermofemployment,the乙方("Employee")shallperformsuchdutiesasassignedthe甲方("Employer")andshallreporttothedesignatedsuperioroftheEmployer.1.2TheEmployeeshallfaithfully,conscientiously,andefficientlycarryoutthetasksassignedtheEmployer,andshallnotdelayorshirkworkduetopersonalreasons.1.3TheEmployeeshallstrictlyabidetheEmployer'srulesandregulations,andshallnotengageinanyactivitiesthataredetrimentaltotheinterestsoftheEmployer.2.WagesandBenefits2.1TheEmployeeshallreceiveamonthlysalaryof______RMB(taxincluded)duringthetermofemployment.Thesalaryshallbepaidonthelastworkingdayofeachmonth.2.2TheEmployeeshallbeendtothebenefitsprovidedtheEmployer,suchassocialinsurance,housingfund,paidleave,etc.,inaccordancewiththerelevantlaws,regulations,andpoliciesofthePRCandtheinternalregulationsoftheEmployer.3.WorkingHoursandRest3.1TheEmployeeshallwork______hoursperdayand______daysperweek,inaccordancewiththeworkinghoursandrestscheduleestablishedtheEmployer.3.2TheEmployeeshallbeendtothepaidleaveprovidedtheEmployerinaccordancewiththerelevantlaws,regulations,andpoliciesofthePRCandtheinternalregulationsoftheEmployer.4.TerminationofEmployment4.1Thiscontractshallterminateautomaticallyupontheexpirationofthetermofemployment.4.2Eitherpartymayterminatethiscontractinadvanceiftheotherpartybreachesthiscontractandfailstocuresuchbreachwithinareasonableperiodoftimeafterbeingrequiredtodosotheotherparty.4.4TheEmployeemayterminatethiscontractatanytimewithawrittennoticetotheEmployeriftheEmployeefindsthattheworkingconditions,salary,orbenefitsprovidedtheEmployeraresignificantlylowerthanthosepromisedinthiscontract.5.ConfidentialityandNonCompetition5.2TheEmployeeshallnot,withinaperiodof______yearsaftertheterminationofthiscontract,engageinanybusinessthatissimilartothebusinessoftheEmployerintheregionwheretheEmployeroperates,eitheraloneorincollaborationwithothers,withoutthepriorwrittenconsentoftheEmployer.6.DisputeResolutionAnydisputesarisingoutoforinconnectionwiththiscontractshallberesolvedthrough友好協(xié)商.Ifthepartiesareunabletoresolvethedisputesthrough友好協(xié)商,thedisputesshallbesubmittedtotherelevantpeople'scourtwithjurisdictionovertheEmployer'sregisteredaddressforresolution.7.Miscellaneous7.2Thiscontractmaybeamendedorsupplementedthemutualagreementofbothpartiesinwriting.7.3ThiscontractshallbegovernedandconstruedinaccordancewiththelawsofthePRC.INWITNESSWHEREOF,thepartiesheretohaveexecutedthiscontractasofthedatefirstabovewritten.甲方(用人單位)：__________By:_________________________Name:_________________________Title:_________________________Date:_________________________乙方(勞動者)：__________By:_________________________Name:_________________________Title:_________________________Date:_________________________一、附件列表：1.乙方身份證復(fù)印件2.乙方職業(yè)資格證書復(fù)印件3.社會保險參保證明4.公積金參保證明5.甲方公司規(guī)章制度6.甲方公司組織架構(gòu)圖7.工作地點示意圖8.工作設(shè)備清單9.乙方工作服尺寸表10.乙方體檢報告二、違約行為及認(rèn)定：1.乙方未按合同約定時間到崗上班，經(jīng)甲方通知后仍不改正的，視為違約。2.乙方未按合同約定完成工作任務(wù)，影響甲方正常運(yùn)營的，視為違約。3.乙方違反甲方公司規(guī)章制度，經(jīng)甲方處罰后仍不改正的，視為違約。4.乙方在合同期間內(nèi)，未經(jīng)甲方同意，擅自離崗的，視為違約。5.甲方未按合同約定時間支付乙方工資、福利的，視為違約。6.甲方未按合同約定提供乙方工作條件的，視為違約。三、法律名詞及解釋：1.勞動合同：勞動者與用人單位確立勞動關(guān)系，明確雙方權(quán)利義務(wù)的協(xié)議。2.用人單位：依法成立，具有獨立法人資格，雇傭勞動者提供勞動的自然人、法人或其他組織。3.勞動者：提供勞動力，接受用人單位管理的自然人。4.工資：勞動者按照合同約定，提供勞動后應(yīng)得的報酬。5.福利：用人單位為勞動者提供的，除工資以外的其他待遇。6.社會保險：國家為保障勞動者基本生活，減輕其生活壓力而設(shè)立的一種社會保障制度。7.公積金：用人單位和勞動者按照一定比例繳存的，用于住房消費(fèi)的長期儲金。四、執(zhí)行中遇到的問題及解決辦法：1.乙方延遲到崗：通知乙方按合同約定時間到崗，逾期不改正的，根據(jù)合同約定采取相應(yīng)措施。3.乙方違反公司規(guī)章制度：依照公司規(guī)章制度對乙方進(jìn)行處罰，情節(jié)嚴(yán)重者解除勞動合同。4.乙方擅自離崗：及時聯(lián)系乙方，了解原因，如屬于個人原因，可根據(jù)合同約定采取相應(yīng)措施。5.甲方未按時支付工資、福利：提醒甲方按時支付，如甲方仍不支付，可向勞
