Whereas:

(1)Tacklingclimateandenvironment-relatedchallengesandreachingtheobjectivesofthe

ParisAgreement3,adoptedon12December2015undertheUnitedNationsFramework

ConventiononClimateChange(UNFCCC),areatthecoreoftheCommission’s

communicationof11December2019onthe‘EuropeanGreenDeal’.Thenecessityand

valueoftheEuropeanGreenDealhaveonlygrowninlightoftheverysevereeffectsoftheCOVID-19pandemiconthehealthandeconomicwell-beingoftheUnion’scitizensandofRussia’swarofaggressionagainstUkraine.

(2)TheEuropeanGreenDealcombinesacomprehensivesetofmutuallyreinforcingmeasuresandinitiativeswhichaimtoachieveclimateneutralityintheUnionby2050,andsetsoutanewgrowthstrategythataimstotransformtheUnionintoafairandprosperoussociety

withamodern,resource-efficientandcompetitiveeconomy,whereeconomicgrowthis

decoupledfromresourceuse.Italsoaimstoprotect,conserveandenhancetheUnion’s

naturalcapital,andprotectthehealthandwell-beingofcitizensfromenvironment-relatedrisksandimpacts.Atthesametime,thattransitionaffectswomenandmendifferentlyandhasaparticularimpactonsomedisadvantagedandvulnerablegroups,suchaslow-incomehouseholdsandpersons,olderpeople,personswithdisabilitiesandpersonswithaminorityracialorethnicbackground.Itmustthereforebeensuredthatthetransitionisjustand

inclusive,leavingnoonebehind.

(3)FollowingtheadoptionbytheEuropeanParliamentandtheCouncilofessentialelementsofthe‘Fitfor55’legislativepackage,asproposedbytheCommissioninJuly2021,the

UnionsubmittedinOctober2023anupdatednationallydeterminedcontribution(NDC)oftheUnionanditsMemberStatestotheUNFCCC,confirmingthattheUnionwillcutits

netgreenhousegasemissionsbyatleast55%by2030comparedto1990levels.

(4)ThroughtheadoptionofRegulation(EU)2021/1119oftheEuropeanParliamentandoftheCouncil4,theUnionhasenshrinedinaUnionlegislativeacttheobjectiveof

economy-wideclimateneutralitywithintheUnionatthelatestby2050andtheaimof

achievingnegativeemissionsthereafter.Moreover,thatRegulationestablishesabindingUniondomesticreductiontargetfornetgreenhousegasemissions(emissionsafter

deductionofremovals)ofatleast55%comparedto1990levelsby2030.ItalsosetstheframeworkfortheestablishmentofintermediateUnionclimatetargetsandforthe

publicationoftheprojectedindicativeUniongreenhousegasbudgetforthe2030-2050period.

(5)Allsectorsoftheeconomyareexpectedtocontributetoachievingthoseemission

reductions,includingtheroadtransportsector.Initscommunicationof9December2020on‘SustainableandSmartMobilityStrategy–puttingEuropeantransportontrackforthefuture’,theCommissionsetsoutaroadmapforasustainableandsmartfutureforEuropeantransport,withanactionplantowardstheobjectiveofdeliveringa90%reductionin

emissionsfromthetransportsectorby2050.Heavy-dutyvehiclesarecurrentlyresponsibleformorethanaquarterofgreenhousegasemissionsfromroadtransportintheUnionandforover6%oftheUnion’stotalgreenhousegasemissions.

(6)The‘Fitfor55’legislativepackageaimstoimplementthe2030greenhousegasemissionsreductiontarget.Itcoversarangeofpolicyareas.TherevisionofRegulation

(EU)2019/1242oftheEuropeanParliamentandoftheCouncil5isanintegralpartofthatlegislativepackage.

(7)Initscommunicationof18May2022onthe‘REPowerEUPlan’,theCommissionoutlinedaplantomaketheUnionindependentfromRussianfossilfuelswellbeforetheendofthisdecade.Thatcommunicationhighlightstheimportance,interalia,offurtherincreasingtheefficiencyof,andreducing,fossilfuelconsumptioninthetransportsector,where

electrificationcanbecombinedwiththeuseoffossil-freehydrogentoreplacefossilfuels.

5Regulation(EU)2019/1242oftheEuropeanParliamentandoftheCouncilof20June2019settingCO2emissionperformancestandardsfornewheavy-dutyvehiclesandamending

(8)Inordertocontributetothereductioninnetgreenhousegasemissionsofatleast55%

comparedto1990levelsby2030andinconformitywiththeenergyefficiencyfirst

principle,itisnecessarytostrengthentheCO2emissionsreductionrequirementsfor

heavy-dutyvehiclessetoutinRegulation(EU)2019/1242.Aclearpathwayalsoneedstobesetforfurtheremissionreductionsbeyond2030fortheheavy-dutyvehiclessectortocontributetoachievingtheclimate-neutralityobjectiveby2050.

(9)ThestrengthenedCO2emissionsreductionrequirementsshouldincentiviseanincreasingshareofzero-emissionheavy-dutyvehiclesbeingdeployedontheUnionmarketwhilst

providingbenefitstousersandcitizensintermsofairqualityandenergysavings,aswellasensuringthatinnovationintheautomotivevaluechainandtheassociatedhigh-qualityjobscanbemaintained.Zero-emissionheavy-dutyvehiclescurrentlyincludebattery

electricvehicles,fuel-cellandotherhydrogen-poweredvehicles,andtechnologicalinnovationcontinues.

(10)NewstrengthenedCO2emissionsreductiontargetsshouldbesetfornewheavy-duty

vehiclesfrom2030onwards.Thosetargetsshouldbesetatalevelthatwilldeliverastrongsignaltoacceleratetheuptakeofzero-emissionheavy-dutyvehiclesontheUnionmarket,stimulateinnovationinzero-emissiontechnologiesinacost-efficientway,givethe

necessarysignaltoacceleratethedeploymentofchargingandrefuellinginfrastructure

acrosstheUnion,ensurethelong-termcompetitivenessoftheUnionindustryonaglobalmarket,andcontributetoreducingtherunningcostsfortransportcompanies,while

ensuringthattheUnionmeetsitsclimateobjectivesanditsobjectivetoalleviateairpollution.

(11)Airpollutionisaparticularlyacuteproblemincities,affectingthehealthofmillionsofEuropeancitizens.Transportisoneofthemainsourcesofurbanairpollution.The

acceleratedroll-outofzero-emissionheavy-dutyvehicles,throughstrengthenedCO2emissionsreductionrequirements,willcontributetoalleviatingtheurbanairpollutionproblem.

(12)TheCommission’scommunicationof5May2021on‘Updatingthe2020NewIndustrialStrategy:BuildingastrongerSingleMarketforEurope’srecovery’aimstoachievethe

co-creationofgreenanddigitaltransitionpathwaysinpartnershipwithindustry,public

authorities,socialpartnersandotherstakeholders.Inthatcontext,atransitionpathwayis

beingdevelopedforthemobilityecosystemtoaccompanythetransitionoftheautomotivevaluechain.Thetransitionpathwaypaysparticularattentiontosmallandmedium-sized

enterprisesintheautomotivesupplychain,andtotheconsultation,includingbyMemberStates,ofsocialpartners.ItalsobuildsontheEuropeanSkillsAgendawithinitiativessuchasthePactforSkillstomobilisetheprivatesectorandotherstakeholderstoup-skilland

re-skillEurope’sworkforceinviewofthegreenanddigitaltransitions,andbuildsontheTalentBoosterMechanismintheframeworkoftheHarnessingTalentsinEUregions

initiative.TheappropriateactionsandincentivesatEuropeanandnationalleveltoboost

theaffordabilityofzero-emissionvehiclesarealsobeingaddressedinthetransition

pathway.Thatcould,forexample,includethepossibilityforMemberStatestousethe

SocialClimateFundestablishedbyRegulation(EU)2023/955oftheEuropeanParliamentandoftheCouncil6(the‘SocialClimateFund’)toassistmicro-enterprisesinpurchasingzero-emissionheavy-dutyvehicles.Particularattentionshouldbegiventotheimpactthatthattransitionwillhaveonmicro,smallandmedium-sizedenterprises(SMEs)alongthesupplychain.TheCommission’scommunicationof1February2023on‘AGreenDeal

IndustrialPlanfortheNet-ZeroAge’aimstoenhancethecompetitivenessofEurope’snet-zeroindustryandtosupportthefasttransitiontoclimateneutrality.

ThatplanaimstoprovideamoresupportiveenvironmentforthescalingupoftheUnion’smanufacturingcapacityforthenet-zerotechnologiesandproductsrequiredtomeetthe

Union’sambitiousclimatetargets.Accesstotrainingandreskillinginnumeroussectors

thatneedtoundergofundamentalchanges,includingtheheavy-dutyvehiclesandthe

refuellingandrechargingsectors,iscrucialforasociallyjustandeffectivetransition.

Investmentsintheskillsneededforaneffectivetransitionareacollectiveresponsibility.

Employeesandjobseekersshouldhaveaccesstoreskillingandupskillingopportunities,

andtheirparticipationinthoselearningactivitiesshouldbesupported.MemberStatesareencouragedtorampupinvestmentsinreskillingandupskillingandtomapoutandanalysethepredictedchangesinthejobmarket.

(13)Togetherwithinitiativestoaccelerateamodalshifttowardsmoresustainabletransport

modes,thestrengtheningoftheCO2emissionsreductionrequirementsforheavy-duty

vehiclesandrolling-outthenecessaryrechargingandrefuellinginfrastructurewillplayakeyroleinreducingtheCO2emissionsoftheheavy-dutyvehiclessector.TheUnion

fleet-wideCO2emissionsreductiontargetslaiddowninthisRegulationarecomplementedbytherechargingandrefuellinginfrastructurerequirementssetoutinRegulation

(EU)2023/1804oftheEuropeanParliamentandoftheCouncil7.Unionfundingplaysanimportantroleintheinfrastructurerolloutatnationallevel.Thedeploymentofrecharginginfrastructureforheavy-dutyelectricvehiclesisequallyimportantinprivatelocationsthatarenotaccessibletothepublic,suchasinprivatedepotsandatlogisticscentreswhich

provideovernightanddestinationcharging.MemberStatesshouldconsidertaking

measuresinthecontextofsettinguptheirrevisednationalpolicyframeworkstoensurethatappropriateinfrastructureisprovidedforovernightanddestinationchargingfor

heavy-dutyelectricvehicles.Itisalsoappropriatetoconsider,inviewofpossible

infrastructuralconstraintsinthirdcountries,theimpactofthisRegulationonthepossibilityfornewheavy-dutyvehiclesregisteredinaMemberStatetooperateoutsidetheUnion.

7Regulation(EU)2023/1804oftheEuropeanParliamentandoftheCouncilof

13September2023onthedeploymentofalternativefuelsinfrastructure,andrepealingDirective2014/94/EU(OJL234,22.9.2023,p.1).

(14)In2015,followingtheadoptionofDirective2014/94/EUoftheEuropeanParliamentandoftheCouncil8,theSustainableTransportForum(the‘Forum’)wassetupbythe

Commission.TheForumassiststheCommissioninimplementingtheUnion’sactivities

andprogrammesaimedatfosteringthedeploymentofsustainablealternativefuels

infrastructure.FollowingtheadoptionofthisRegulation,theCommissionwillensurethattheForumsupportstheeffectiveandcost-efficientroll-outoftherechargingandrefuellinginfrastructureneededtomeetthestrengthenedCO2emissionsreductionrequirementsforheavy-dutyvehicles,andthatitinformsthereviewreferredtoinArticle24(2)of

Regulation(EU)2023/1804,sothatthetargetssetoutinthatRegulationarealignedwiththeambitionofthisRegulation.

(15)Thetransitiontoclimateneutralityrequiressignificantinvestmentintheelectricitygrid,

includingenhancedcapacity,resilienceandstorage,aswellasadditionalconnections.In

viewoftheCO2emissionsreductiontargetsforheavy-dutyvehiclesfortheyear2030

establishedunderthisRegulation,theshareofzero-emissionheavy-dutyvehiclesinthe

totalfleetofheavy-dutyvehiclesontheroadsandelectricityconsumptioninthesectorwillremainlimited.Therefore,therelatedimpactontheelectricitygridwillremainlimitedaswell.

(16)WhilethestrengthenedCO2emissionsreductiontargetswillacceleratetheuptakeof

zero-emissionheavy-dutyvehicles,asignificantpartofthetotalfleetofheavy-duty

vehiclesontheroadswillremaininternalcombustionenginevehicles.ForthatpartofthefleettocontributetotheachievementoftheUnion’sclimatetargets,furtherinnovationandanaccelerateduptakeofsustainablerenewablefuelsisessential.ExistingUnionpolicies

andlegalinstruments,inparticularDirective(EU)2018/2001oftheEuropeanParliamentandoftheCouncil9andtheEUemissionstradingsystemestablishedbyDirective

2003/87/ECoftheEuropeanParliamentandoftheCouncil10,willpromotethedecarbonisationoftransportfuels,withtheaimofphasingoutfossilfuels.The

Commissionshouldfurtherdevelopacoherentframeworkofincentivesforadvanced

biofuelsandbiogasandrenewablefuelsofnon-biologicalorigin.Thatframeworkshouldaddressbarrierstotheuptakeandsupplyinacomprehensiveway,takingintoaccount

demandacrosseconomicsectors,inthecontextoftheoveralleffortstoreachtheUnion’sclimatetargets.BuildingontheobjectivesforbiomethaneintheRePowerEUplan,the

Commissionshouldalsoaddresshowthescale-upoftheproductionofbiomethaneintheUnioncancontributetothedecarbonisationoftheeconomy,includingthetransportsector.

(17)Followingconsultationwithstakeholders,theCommissionwill,withinoneyearofthedateofentryintoforceofthisRegulation,assesstheroleofamethodologyforregistering

heavy-dutyvehiclesrunningexclusivelyonCO2neutralfuels,inconformitywithUnionlawandwiththeUnion’sclimate-neutralityobjective.

(18)Manufacturersshouldcontinuetobeprovidedwithsufficientflexibilitywhenadaptingtheirheavy-dutyvehiclefleetsovertimeinordertomanagethetransitiontowards

zero-emissionheavy-dutyvehiclesinacost-efficientmanner.Itisthereforeappropriatetomaintaintheapproachofstrengtheningtargetlevelsinfive-yearsteps.

(19)Duetotheheterogeneousstructureofthetotalfleetofheavy-dutyvehicles,itisnot

possibletofullypredictwhethertechnologicaldevelopmentswillbequickenoughto

ensurethatzero-emissiontailpipetechnologyisaviablechoiceforallnicheuses.This

couldincludeheavy-dutyvehiclesforcriticalsecurityandsafetyapplicationsthatcannotbefulfilledbyzero-emissiontailpipetechnologies.Suchvehiclesshouldconstitutea

limitedshareofthetotalfleetofheavy-dutyvehicles.InitsreviewofRegulation

(EU)2019/1242,theCommissionshouldassessthepossibilityofapplyingmeasurestoreduceCO2emissionsfromsuchvehicles.

(20)FortheirpublicprocurementprocedurescoveredbythisRegulation,contracting

authoritiesandcontractingentitiesarestronglyencouragedtouseanawardcriterionoratechnicalspecificationthatrelatestotheproportionoftheproductsoftendersoriginatingfromcountriesthatarenotpartiestotheWorldTradeOrganizationAgreementon

GovernmentProcurement(the‘GPA’)andthathavenotconcludedafreetradeagreementcontainingrulesonpublicprocurementwiththeUnion.Suchcriteriawillplayan

importantroleinfosteringthesupplyofzero-emissionurbanbusesbytheEuropeanindustry,ensuresustainableandresilientsupplychainsforurbanbusesandreinforcesecurityofsupplywithintheUnion.

(21)Contractingauthoritiesandcontractingentitiesareencouragedtouseanenvironmental

sustainabilitycriterionasanawardcriterionorasatechnicalspecificationfortheirpublicprocurementprocedurescoveredbythisRegulation.WithoutprejudicetoUnionlegislativeactsapplicabletoaspecifictechnology,includingRegulation(EU)2023/1542ofthe

EuropeanParliamentandoftheCouncil11andRegulation(EU)2024/…oftheEuropeanParliamentandoftheCouncil12+,whenevaluatingtheenvironmentalsustainabilityof

urbanbusesprocuredonthebasisofthisRegulation,itshouldbepossibleforcontractingauthoritiesandcontractingentitiestotakeintoaccountvariouselementswithanimpactontheclimateandtheenvironment.Thoseelementscaninclude,forinstance:thedurabilityandreliabilityofthesolution,theeaseofrepairandmaintenance,theeaseandqualityofrecycling,theuseofsubstances,theconsumptionofenergy,waterandotherresourcesinoneormorelifecyclestagesoftheproduct,theincorporationofusedcomponents,the

environmentalfootprintoftheproductanditslifecycleenvironmentalimpact,andtheamountofwastegenerated.

(22)WiththestricterUnionfleet-wideCO2emissionsreductiontargetsfrom2030onwards,manufacturersaretodeploysignificantlymorezero-emissionheavy-dutyvehiclesontheUnionmarket.Inthatcontext,theincentivemechanismforzero-andlow-emission

heavy-dutyvehicleswouldnolongerserveitsoriginalpurposeandwouldrisk

underminingtheeffectivenessofRegulation(EU)2019/1242.Thatincentivemechanismshouldthereforeberemovedfrom2030.

(23)ThepossibilitytoassigntherevenuesfromtheexcessCO2emissionspremiumstoaspecificfundorarelevantprogrammehasbeenevaluatedasrequiredpursuantto

Article15(4)ofRegulation(EU)2019/1242,withtheconclusionthatdoingsowould

significantlyincreasetheadministrativeburden,withoutresultinginanydirectbenefittotheautomotivesectorinitstransition.RevenuesfromtheexcessCO2emissionspremiums

shouldthereforecontinuetobeconsideredasrevenueforthegeneralbudgetoftheEuropeanUnioninaccordancewithArticle8(4)ofRegulation(EU)2019/1242.

(24)ThesubjectmatterofRegulation(EU)2019/1242shouldbeenlargedtoalsocoverthe

monitoringandreportingobligationswhichareintegratedintoRegulation(EU)2019/1242bymeansofthisRegulation.

(25)Regulation(EU)2019/1242shouldbeamendedinordertocoverthesamescopeasRegulation(EU)2018/956oftheEuropeanParliamentandoftheCouncil13.

(26)TheCO2emissionsforvehiclesthatarenotwithinthescopeofthevehicletype-approvallegislationoftheUnion,suchasagriculturalandforestrytractors,vehiclesdesignedandconstructedforusebynationaldefence,includingarmedservices,andtrack-laying

vehicles,arenotdetermined.Therefore,thosevehiclesarenotrequiredtomeettheCO2emissionsreductiontargetssetinthisRegulation.

designedandconstructedoradaptedforusebycivilprotectionservices,fireservicesandforcesresponsibleformaintainingpublicorderorurgentmedicalcareservices,which

wouldhavenegativesafetyandenvironmentalimplications,suchvehiclesthatare

voluntarilytype-approvedshouldalsobeexemptedfromtheobligationtomeettheCO2

emissionsreductiontargetssetinthisRegulation,unlessthemanufacturerrequests

otherwise.MemberStatesshouldalsobeentitledtoexemptheavy-dutyvehiclesfromtheobligationtomeettheCO2emissionsreductiontargetssetinthisRegulationwherethoseheavy-dutyvehiclesarenotspecificallydesigned,butareregistered,forusebycivil

protectionservices,fireservices,forcesresponsibleformaintainingthepublicorderor

urgentmedicalcareservices,suchasnormalcoachesusedforthetransportofpoliceor

armedservices,byconfirmingthatsuchexemptionwouldbeinthepublicinterest.

MemberStatesshouldalsobeentitledtoexemptvehiclesregisteredforthearmedservicesfromthisRegulationinitsentirety.
