TRANSACTIONS,CREATINGFORTHISPURPOSETHE

ELECTRONICCOMMERCEBUREAU,APPROPRIATING

FUNDSTHEREFOR,ANDFOROTHERPURPOSES

BeitenactedbytheSenateandHouseofRepresentativesofthe

PhilippinesinCongressassembled:

CHAPTERI

GENERALPROVISIONS

SECTION1.ShortTitle.-ThisActshallbeknownas

the"InternetTransactionsActof2023".

SEC.2.DeclarationofPolicy.-Itisthepolicyofthe

Statetopromoteandmaintainarobustelectroniccommerce

(e-commerce)environmentinthecountrybybuildingtrust

betweenonlinemerchantsandonlineconsumers.TheState

recognizesthevalueandpotentialofthedigitaleconomytoincreasecompetitionandimproveproductivity.Towardthisend,theStateshallguaranteeeffectiveregulationofe-commercetoprotectconsumerrightsanddataprivacy,encourageinnovation,promotecompetition,secureinternettransactions,upholdintellectualpropertyrights,ensureproductstandardsandsafetycompliance,andobserveenvironmentalsustainability.

SEC.3.ScopeandCoverage.-ThisActshallapplytoallbusiness-to-businessandbusiness-to-consumerinternettransactionswithinthemandateoftheDepartmentofTradeandIndustry(DTI),whereone(1)ofthepartiesissituatedinthePhilippinesorwherethedigitalplatform,e-retailer,oronlinemerchantisavailingofthePhilippinemarketandhasminimumcontactstherein:Provided,Thatonlinemediacontent,andconsumer-to-consumer(C2C)transactionsshallnotbecoveredunderthisAct.

SEC.4.DefinitionofTerms.-AsusedinthisAct:

(a)Business-to-businessTransactionreferstointernet

transactionsbetweenbusinesses,suchasbetweenamanufacturerandawholesaler,orawholesalerandaretailer,whetherthetransactingpartiesarenaturalorjuridicalpersons;

(b)Business-to-consumerTransactionreferstointernet

transactionsbetweenbusinessesandend-users;

(c)Consumer-to-consumer(C2C)Transactionsrefer

totransactionsbetweenend-usersdoneforpersonal,family,orhouseholdpurposesandnotdoneintheordinarycourseofbusiness;

d)DigitalPlatformsrefertoinformationandcommunicationtechnology-enabledmechanismsthatconnectandintegrateproducersandusersinonlineenvironmentswheregoodsandservicesarerequested,developed,andsold,anddataisgeneratedandexchangedsuchas,butnotlimitedto,e-marketplace,mobileapplicationplatforms,onlinedeliveryplatforms,socialmediaplatforms,andtravelplatforms;

(e)E-marketplacereferstodigitalplatformswhosebusinessistoconnectonlineconsumerswithonlinemerchants,facilitateandconcludethesales,processthepaymentoftheproducts,goodsorservicesthroughtheplatform,orfacilitatetheshipmentofgoodsorprovidelogisticsServicesandpost-purchasesupportwithinsuchplatforms,andotherwiseretainsoversightovertheconsummationofthetransaction;

(4)E-retailerreferstoanaturalorjuridicalpersonsellinggoodsorservicesdirectlytoonlineconsumersthroughitsownwebsite,webpageorapplication;

()Goodsrefertophysicallyordigitallyproduceditemsoverwhichownershiporproprietaryrightsmaybeestablishedandtransferredfromone(I)institutionalunittoanotherbyenteringintoatransaction;

(h)InternetTransactionreferstothesaleorleaseofdigitaiornon-digitalgoodsandservicesovertheinternet.ForpurposesofthisAct,internettransactionsshallalsorefertoe-commerce:

GOnlineConsumerreferstoanaturalorjuridicalpersonwhopurchases,leases,receives,orsubscribestogoodsorservicesovertheinternetforafee;

①OnlineMerchantreferstoapersonsellingnon-fnancialgoodsorservicestoonlineconsumersthroughane-marketplaceorthird-partydigitalplatform.Ane-retailershallalsobeconsideredanonlinemerchantifitoffersthesamegoodsorservicesoutsideitsownwebsitethroughathird-partydigitalplatformandtheonlineconsumerpurchases,leases,subscribesto,orobtainstheserviceofthee-retailerthroughthesaidthird-partyplatform;and

(k)Producerreferstothemanufacturerorimporterof

sp,tenticr

SEC.5.Extra-territorialApplication.-Apersonwhoengagesine-commerce,whoavalsofthePhilippinemarkettotheextentofestablishingminimumcontactsherein,shallbesuhjecttoapplicablePhilippinelawsandregulationsandcannotevadelegalliabilityinthePhilippinesdespitelackoflegalpresenceinthecountry

SEC.6.EqualTreatmentofOnlineandOffline

CommercialActivities.-Unlessotherwisespecified,thisAct

shallbeconstruedtoensurethatthosewhoengagein

e-commerceshallnotenjoyanybeneficialtreatmentthatis

morefavorable,norbeplacedatadisadvantage,inrelation

tootherenterprisesthatoffergoodsandservicesofflinein

thePhilippines.

CHAPTERII

E-COMMERCEBUREAU

SEC.7.CreationandCompositionoftheE-Commerce

Bureau.-Withinsix(6)monthsaftertheeffectivityofthis

Act,theE-CommerceBureau,hereinafterreferredtoasthe

Bureau,shallbecreatedundertheDTI.

TheBureaushallbeheadedbyaDirectorandatleast

one(1)AssistantDirectorwhomustpossesscompetenciesin

e-commerceandonlinetransactions,andallthelawsand

processesrelatedthereto.

TheDTISecretaryshalldeterminetheorganizational

structureandstaffingpatternoftheBureau,subjecttothe

approvaloftheDepartmentofBudgetandManagementand

consistentwiththecivilservicelaws,rulesandregulations.

SEC.8.FunctionsoftheE-CommerceBureau.-The

Bureaushallhavethefollowingpowersandfunctions:

(a)Formulatepolicies,plans,andprogramstoensure

therobustanddynamicdevelopmentofe-commerce;

(b)Implement,monitor,andensurestrictcompliance

withtheprovisionsofthisAct;

(c)Exerteffortstoenforcetheregistrationofdigital

platformsandonlinemerchantswiththeBureauand

torequirethesubmissionofinformationnecessaryfor

policy-makingandprogramdevelopmentpurposes,consistent,

however,withtheprinciplesofminimizationandproportionality

indataprivacy;

(d)Identifyregulatorygapsaffectingthee-commerceandrecommendappropriateexecutiveorlegislativemeasuresthatfosterthegrowthofthesector;

(e)Receiveandreferbusinessandconsumercomplaintsoninternettransactionstotheappropriategovernmentagency,consistentwiththeno-wrongdoorpolicyoftheDTI;

H)Coordinatewithorpetition,throughtheDTISecretary,wheneverappropriate,anyentity,governmentagency,orinstrumentalitytotakeactiononanymatterthatmayimpedee-commerce;

(g)Investigate,motuproprio,andrecommendthefilingoftheappropriatecaseforviolationsofthisAct;

(h)MonitortheimplementationofthisActforpolicy-makingandprogramdevelopmentpurposes;

Developconsumereducationandinformationprogramsforconsumersofdifferentages,incomesandliteracy,givingspecialattentiontotheneedsofvulnerableanddisadvantagedconsumers,byraisingawarenessonrights,responsibilities,andredflagsininternettransactions,withthegoalofenablingconsumerstomakeinformedchoicesandpreventingthemfromfallingpreytoonlinefraudsandscams; 6CollaboratewithBangkoSentralngPilipinas(BSP)andothergovernmentagenciestodevelopframeworkstoincentivizetheuseofdigitalpaymentsandpromotetheireducationandadoptionamongbusinessesandconsumers;and

(k)Engagewithlawenforcementandotherrelevantgovernmentagenciesinaformalizedinter-regulatorcooperationmechanismtoaddressallcross-cuttingissuesandconcernsthataffectonlineconsumersandthegeneralpublic.

ThepowersoftheBureaushallnotbeexercisedinamannerthatstiflesinnovation,restrictscompetition,createsbarrierstoentryintrade,orimpedestheeaseofdoingbusiness.

SEC.9.ReferralandTrackingofComplaints.-The

Bureaushallreferanycomplaintitreceivesinvolving

violationsofotherlawscommittedinthecourseofe-commerce

activitiestotheappropriateregulatoryauthorityforaction.In

appropriatecases,theDTImayinitiateaformalcomplaint

withtheappropriateregulatoryauthorities.TheBureaushall

trackanysuchcomplaintorreferralandcoordinatethespeedy

resolutionthereof.

SEC.10.OnlineBusinessDatabase(OBD).-Withinone

(1)yearfromtheeffectivityofthisAct,theBureaushall

establishadatabaseofdigitalplatforms,e-marketplaces,

e-retailers,andonlinemerchantsengagedine-commercein

thePhilippinesthatwillprovidethegovernmentandonline

consumersaccesstocontactinformationofonlinebusinesses.

InestablishingtheOBD,theDTIshallutilizeexisting

businessdatabasesandcoordinatewithotheragenciesthat

alreadymaintainedthesameorsimilardatabase.

TheDTI,inconsultationwiththeDepartmentof

InformationandCommunicationsTechnology(DICT),the

NationalPrivacyCommission(NPC),thePhilippine

CompetitionCommission(PCC),theSecuritiesandExchange

Commission(SEC),theCooperativeDevelopmentAuthority

(CDA),andotherconcernedagenciesshallissuetheregulations

togovernthedevelopment,management,operation,and

maintenanceoftheOBD,consistentwithRepublicAct

No.11032orthe“EaseofDoingBusinessandEfficient

GovernmentServiceDeliveryActof2018".

SEC.11.E-CommercePhilippineTrustmark.-Toprovide

assuranceofsafetyandsecurityininternettransactions,the

DTIshallencouragethedevelopmentofanE-Commerce

PhilippineTrustmark,hereinafterreferredtoasthe

“Trustmark,”whichmaybeestablishedandoperatedbyan

industry-ledprivatesectorgovernancebody.

CHAPTERIII

AUTHORITYOFTHEDEPARTMENTOFTRADEANDINDUSTRY

SEC.12.RegulatoryJurisdictionoftheDTI.-ForpurposesofthisAct,theDTIshallexerciseregulatoryjurisdictionastotheuseofinternetforconductinge-commercebye-marketplaces,onlinemerchants,e-retailers,digitalplatforms,andthird-partyplatforms.

Provided,however,ThattheregulatoryauthorityoftheDTIshallbeancillarytoanydulyconstitutedregulatoryjurisdictiongrantedtoanagencybyexistinglawssuchas,butnotlimitedto,theDICT,BSP,andNPC:Provided,further,Thatreasonablenoticeto,andcoordinationwiththeappropriateregulatoryagencyshallbemadebytheDTIpriortotheenforcementoftheprovisionsofthisAct.Unlessexpresslyspecified,nothinginthisActshallbeconstruedastodiminishordeprivetheregulatoryjurisdictionconferredbylawuponothergovernmentagenciesconcerningtheservicesthattheyregulate,notwithstandingane-commerceaspectorfeatureinsuchservices.

SEC.13.Subpoena.-IntheexerciseofitspowersunderthisAct,theDTiSecretaryshallhavethepowertoissuesummons,subpoenaadtestificandum,andsubpoenaducestecumtoallegedviolatorsorwitnessestocompelattendanceandtheproductionofdocumentsininvestigationsorproceedingsbeforetheBureau.FailuretocomplywiththesubpoenaadtestificandumandsubpoenaducestecumshallauthorizethefilingofacaseforcontemptundertheRulesofCourt.

AsubpoenaducestecumisvalidifissuedonmatterswithinthejurisdictionoftheDTI,isreasonablyrelevanttothesubjectmatterunderinvestigation,anddesignatesordescribestheinformationordocumentsoughttobeproduced,allowingittobeidentified.

SEC.14.AuthoritytoIssueComplianceOrder.-TheDTISecretaryshallhavethepowertoissueacomplianceordertorequireconformitywiththisAct,RepublicActNo.7394orthe"ConsumerActofthePhilippines",oranyotherapplicable

tradeandconsumerprotectionissuancespromulgatedby

theDTI.

SEC.15.AuthoritytoIssueTakedownOrder.-TheDTI

Secretary,afterinvestigationorverification,mayissuean

expartetakedownorderdirectingtheremovalofalistingor

offeronawebpage,website,platformorapplication,regardless

oftheintendednatureofthetransaction,whenanyofthe

followingispresent:

(a)Saleorleaseofgoodsorserviceswhichare

prohibitedorregulatedunderexistinglawssuchasendangered

animals,illicitdrugs,fireworksandotherexplosives,and

counterfeitgoods:Provided,Thattheprohibitednatureofthe

goodsandservicesisapparentfromthephotoordescription

inthepost;

(b)Saleorleaseofgoodsorservicessubjectofacease

anddesistorderissuedbyanappropriategovernmentagency;

(c)Saleorleaseofgoodsorservicesonlinepreviously

subjectofatakedownorderbutwhicharesubsequently

repostedandproliferatedonlinebythesellerunder

investigation;and

(d)Suchothertransactionsoractivitiesonline,within

thejurisdictionoftheDTI,purportingtosellorleasegoods

orservicesthatotherwisethreatenpublicorpersonalsafety,

compromisesfinancialorpersonalinformation.

Otherregulatorygovernmentagenciesmayrequestthe

DTItoissueatakedownorderfortheremovalofanonline

listingorofferinviolationoflaws,rulesorregulationsunder

theirjurisdiction.Nothinghereinshallprecludetheappropriate

agencyfromexercisingitsregulatoryauthority,including

theissuanceofordersdirectlytotheerringpersonorentity,

topreventorstopthesaleofgoodsorservicesunder

itsjurisdiction.

Theviolatingentityshallbegivenanopportunitytobe

heardwithinforty-eight(48)hoursfromtheissuanceofa

takedownorder.

Thetakedownordershallbedirectedagainstthee-retaileroronlinemerchant,andtheowneroroperatorofthee-marketplaceordigitalplatform.Copiesoftheordershalllikewisebeservedonentitieswhosecooperationwouldberequiredforitsenforcementsuchas,butnotlimitedto,thedulyregisteredinternetserviceproviderinvolved,relatedpaymentgateways,andothergovernmentagencies.

Theordershallremainineffectforamaximumperiodofthirty(30)daysunlessotherwiseextendedormadepermanentbyajudicialorderordecision.

SEC.16.BlacklistingofOnlineBusiness.-TheDTISecretaryshallhavetheauthoritytoestablishapubliclyaccessiblelistofwebsites,webpages,onlineapplications,socialmediaaccounts,orothersimilarplatformsthatfailtocomplywithacomplianceorder,oraresubjectofatakedownorderissuedunderChapterIIIhereoforofaceaseanddesistorderissuedbyanappropriategovernmentagency,indicatingthespecificviolationincurred.Shouldtheviolationconsistinfailuretoabidebyacomplianceorder,entryintheblacklistshallindicatetheactorrequirementsubjectofthecomplianceorder.Theblacklistshallbemadepubliclyavailableandshallbefurnishedtodigitalplatformsandfinancialregulators.Aftercomplianceorcorrection,the

DTI,motupropriooruponrequest,shallpromptlyremovetheentryfromthelist,withoutthenecessityofahearing.

SEC.17.OnlineDisputeResolution(ODR).-Withinsix(6)monthsfromtheeffectivityofthisAct,theDTIshalldevelopaplatformtofacilitateanalternativemodeofdisputeresolutionforonlineconsumers,onlinemerchants,e-retailers,e-marketplaces,andotherdigitalplatforms.TheDTI,inconsultationwithotherconcernedagencies,shallissuetheimplementingrulesandregulationsonODRprocedureandthedevelopment,management,operations,andmaintenanceoftheplatform.

CHAPTERIV

RIGHTS,OBLIGATIONS,ANDLIABILITIES

OFPARTIESININTERNETTRANSACTIONS

SEC.18.CodeofConduct.-TheDTI,inconsultation

withrelevantgovernmentagencies,shallprovideaCodeof

Conductforallbusinessesengagedine-commerceconsistent

withinternationaltrends,developments,standards,andbest

practicesandwhennecessary,issueguidelines,rulesand

regulationsincludingvoluntaryandbindingco-regulation

mechanismsconsideringtheirrole,size,andimpactininternet

transactions.

SEC.19.ObligationsofOnlineConsumers.-Theonline

consumershallexerciseordinarydiligenceinanyinternet

transaction.

Ifthetransactionincludesthedeliveryofthepurchased

goods,theonlineconsumershallnotcancelconfirmedorders

whenthesaiditemshavealreadybeenpaidforby,orthe

goodsareperishableinnatureandarealreadyinthe

possessionofathird-partydeliveryservice,orotherwisein

transittotheonlineconsumerunless:

(a)Theonlineconsumeruseselectronicordigital

paymentandauthorizedthecreditingoftheamountdespite

cancellation;

(b)The.onlineconsumerreimbursesthird-partydelivery

serviceasapre-conditionforthecancellationoftheorder;

(c)Thetransactionallowscancellationforafee;or

(d)Thepartiesagreeotherwise.

SEC.20.RemediesofOnlineConsumers.-Incaseof

defect,malfunction,orlosswithoutthefaultoftheonline

consumer,orfailuretoconformwithwarrantyoranyliability

oftheonlinemerchantore-retailerarisingfromthecontract,

theonlineconsumershallhavetherighttopursuerepair,

replacement,refundorotherremediesprovidedunderRepublic

ActNo.7394oranyexistingrelevantlaws.

Whentheonlineconsumeravailsreplacementorrefundasaremedy,theonlinemerchantisentitledtothereturnoftheoriginalgoodsdelivered,withoutanycosttotheonlineconsumer,withinareasonableperiodfromthereceiptthereof,unlessotherwiseagreeduponbytheparties.Incasetherefundisalreadypaid,butthegoodscannotbereturnedduetothefaultoftheonlineconsumer,theamountreceivedshallbeimmediatelyreimbursedtotheonlinemerchantore-retailersubjecttoproportionatereductioninprice,ifappropriate.

SEC.21.ObligationsofE-marketplaces.-Exceptas

otherwiseprovidedinthisAct,e-marketplacesshall:

(a)Ensurethattheinternettransactionsontheir

platform:

(1)Areclearlyidentifiableasane-commercetransaction;

(2)Identifythepersonorpersonsonwhosebehalfthee-commercetransactionismade;and

(3)Identifyanypromotionalofferincludinganydiscount,premium,orgift,andthatconditionsrequiredtoqualifyforitareaccessible,clear,andunambiguous.

(b)Require,asfaraspracticable,allonlinemerchants,whetherforeignorFilipino,tosubmitthefollowing,priortolistingwiththeirplatforms:

(1)Nameoftheonlinemerchantaccompaniedbyatleastone(1)validgovernmentidentifcationcardforindividualsorbusinessregistrationdocumentsforjuridicalentities;

(2)Geographicaddresswheretheonlinemerchantislocated;

(3)Contactdetailsoftheonlinemerchantwhichmust

ndcdl;dmobileorlandlinenumberandavalide-mail

(4)Ininstanceswhentheservicesofferedbyanonlinemerchantisconnectedwiththeexerciseofaregulatedprofession,thedetailsofmembershipinanyprofessionalbodyorsimilarrelevantinstitutionwithwhichtheonlinemerchantisregisteredorotherwiseisamemberof.

Exceptforthegovernmentidentificationcardsor

registrationdocumentsmentionedunderSection21(b)(1)and

thecontactdetailsoftheonlinemerchantasrequiredunder

Section21(b)(3),theinformationrequiredunderthisparagraph

shallbepublishedorpostedonthee-marketplaceordigital

platformfortransparency,unlessthee-marketplaceordigital

platformestablishesmeanstofacilitatecommunicationbetween

onlinemerchantsandonlineconsumersorprovidesalinkto

theOBDontheirplatform.

(c),Maintainalistofallonlinemerchantsregistered

undertheirplatform,containingtheinformationprovidedin

Section21(b).Thelistshallbeupdatedandverifiedregularly.

Ane-marketplaceshallberequiredtoprovidespecific

informationupontheissuanceofasubpoenabycompetent

authoritypursuanttoaninvestigationbasedonasworn

complaint,statingthatthee-marketplaceore-retailerisbeing

usedinthecommissionofacrimeorthatitwasutilizedas

ameanstocommitamalicious,fraudulent,orunlawfulact,

andthatthecomplaintisunabletoascertaintheidentityof

theperpetrator.

(d)Takethenecessaryprecautionstoprotectthedata

privacyofconsumers,atalltimes,inaccordancewithRepublic

ActNo.10173orthe“DataPrivacyActof2012”,andcomply

withtheminimuminformationsecuritystandardssetbythe

Bureau,NPC,andotherissuancesofrelevantgovernment

agencies.Digitalplatformsande-marketplacesshallbecovered

bytheprovisionsofRepublicActNo.10173andissuancesby

theNPC.

(e)Prohibitthesaleofregulatedgoodsunlessthey

providethenecessarypermitsandlicenseinformation,and

contractuallyobligatingtheircompliancewithsaleprocedures

andlimitations,andotherrelevantconditionsforthesaleas

maybeimposedbyanylaworlocalgovernmentregulation.

f)Provideaneffectiveandresponsiveredress

mechanismforonlineconsumersandonlinemerchantsto

reportauserorinformationpostedontheplatformthatare

deemedinviolationofrelevantlaws.

(g)Requireallonlinemerchantstoclearlyindicatethefollowingintheirproductoffersonline,regardlessofthenatureofthegoodsandservices:

(1)Nameandbrandofthegoodsorservices;

(2)Price;

(3)Description;and

(4)Condition.

Inperformingtheirobligationsunderthissection,e-marketplacesandotherdigitalplatformsarerequiredtoobserveordinarydiligence.FailuretodosowillsubjectthemtopenaltiesunderSection29ofthisAct.

SEC.22.ObligationsofOtherDigitalPlatformsThatDo

NotRetainOversightOvertheConsummationofthe

Transaction.-Otherdigitalplatformsthatdonotretainoversightovertheconsummationofthetransactionshallhavethefollowingobligations:

(a)Enableconsumerstodistinguishbetweencommercialandnon-commercialorprivateaccounts;

(b)Prohibitthesaleandadvertisementofregulatedgoodsunlesstheyprovidethenecessarypermitsandlicenseinformation,andcontractuallyobligatingtheircompliancewithsaleproceduresandlimitations,andotherrelevantconditionsforthesaleasmaybeimposedbyanylaworlocalgovernmentregulation;

(c)Requireonlinemerchantstoindicatethefollowingintheirproductoffersonline,regardlessofthenatureofthegoodsandservices:

(1)Nameandbrandofthegoodsorservices;

(2)Price;

(3)Description:

(4)Condition;and

(5)Contactinformationoftheonlinemerchant;

(d)Provideaneffectiveandresponsiveredress

eractudatohneliathtnatts

deemedinviolationofrelevantlaws;

(e)Maintain,asfaraspracticable,anupdatedlistof

accountsthatmakeuseoftheplatformfore-commerce.The

platformshallberequiredtoprovidespecificinformationupon

theissuanceofasubpoenabycompetentauthoritypursuant

toaninvestigationbasedonasworncomplaint,statingthat

theplatformcoveredunderthissectionisbeingusedinthe

commissionofacrimeorthatitwasutilizedasameansto

commitamalicious,fraudulent,orunlawfulact,andthat

thecomplaintisunabletoascertaintheidentityofthe

perpetrator;and

Inperformingtheirobligations,platformscoveredunder

thissectionarerequiredtoobserveordinarydiligence.Failure

todosowillsubjectthemtopenaltiesunderSection29of

thisAct.

SEC.23.ObligationsofE-retailersandOnline

Merchants.-Ane-retaileroronlinemerchantofdigitalor

non-digitalgoodsandservicesshallexercisethefollowing

responsibilities:

(a)Indicatethepriceofgoodsandservicesoffered

consistentwithArticle81ofRepublicActNo.7394;

(b)Ensurethatthegoodsarereceivedbytheonline

consumer:

(1)Inthesamecondition,type,quantity,andqualityasdescribedandstatedand,inapplicablecircumstances,possessthefunctionality,compatibility,interoperability,andfitnessforthepurposeforwhichtheywereintended;

(2)Inthesamecondition,type,quantity,andqualityofasample,picture,ormodelofthegoodsshownbythee-retaileroronlinemerchantuponrequestoftheonlineconsumer,orofadditionaldescriptionsorspecificationsprovidedbythee-retaileroronlinemerchantuponinquiriesmadebytheonlineconsumer;and

(3)Itmustalsobefitfortheparticularpurposeforwhichtheonlineconsumerrequiresthem,ascommunicatedtothee-retaileroronlinemerchantatthetimeoftheperfectionofthecontract,andwhichthee-retaileroronlinemerchanthasaccepted;

(c)Allthegoodsshall:

(1)Bedeliveredtogetherwithitsaccessories,includingallotherpackaging,installationinclusions,anyusermanual,orotherinstructionsasadvertisedordescribed,ifapplicable,withtherelevantinformationstatedinthepackaging,printedorwritteninFilipinoand/orEnglish;and
