Bothpartieshavereachedanagreementonthefollowingtermsandconditionstoestablishanemploymentrelationshipandtoclarifytheirrightsandobligations.
1.BasicInformation:PartyA:[Employer’snameandaddress]UnifiedSocialCreditCode:[Employer’scode]Legalrepresentative:[Employer’slegalrepresentative]Contactnumber:[Employer’scontactnumber]PartyB:[Employee’snameandaddress]IDnumber:[Employee’sIDnumber]Contactnumber:[Employee’scontactnumber]
2.TermofEmployment:ThetermofemploymentforPartyBshallbefrom[Startdate]to[Enddate].Iftheemployeeisnotterminated,theemploymentcontractwillberenewedautomatically.
3.PositionandSalary:
3.1PartyAagreestohirePartyBas[Jobtitle].3.2Duringthetermofemployment,PartyAshallpayPartyBasalaryof[Salaryamount](beforetax)onamonthlybasis.
4.ProbationPeriod:TheprobationperiodforPartyBshallbe[Probationperiod].Duringtheprobationperiod,PartyAmayterminatetheemploymentcontractwithPartyBifPartyBisdeemedunsatisfactoryorthecompany'soperationrequirementschange.Ifnonoticeisgivenduringtheprobationperiod,itwillbedeemedaspassingtheprobation.
5.WorkinghoursandRest:5.1PartyB'sworkinghoursare[Workinghours].5.2Restdaysandholidaysshallbeprovidedinaccordancewiththenationallawsandregulations.
6.SocialInsuranceandHousingFund:PartyAshallprovidecomprehensivesocialinsuranceandhousingfundforPartyBinaccordancewithnationalandlocalregulations.
7.Confidentiality:7.1PartyBshallnotdiscloseanyconfidentialinformationorbusinesssecretsofPartyAtoanythirdparty,eitherduringorafterthetermofemployment.7.2AfterPartyBleavesPartyA,PartyBshallreturnanydocuments,materials,orpropertyrelatedtothecompany'sbusiness.
8.TerminationofEmployment:8.1Duringthetermofemployment,eitherPartyAorPartyBmayterminatetheagreementwithawrittennoticeof[Noticeperiod].8.2PartyAmayterminatetheagreementimmediatelyandwithoutnoticeinthefollowingsituations:(1)PartyBseverelyviolatestherulesandregulationsofPartyA;(2)PartyBcausesseriousdamagetothecompany'sinterestsduetoreasonssuchasdishonestyorincompetence;(3)PartyBseriouslyviolatesnationallawsandregulations.8.3PartyBmayterminatetheagreementimmediatelyandwithoutnoticeinthefollowingsituations:(1)PartyAfailstopayPartyB'ssalaryinatimelymannerinaccordancewiththeemploymentcontract;(2)PartyAfailstoprovidenormalworkingconditions.
9.LiabilityforBreachofContract:IfeitherPartyAorPartyBbreachesthetermsoftheagreement,theyshallbeliableforbreachofcontractandcompensatetheotherpartyforanylossesincurred.
10.OtherProvisions:10.1Anydisputesarisingfromorinconnectionwiththisagreementshallberesolvedthroughamicablenegotiation.Ifnegotiationfails,eitherpartymaybringalawsuitinaccordancewiththerelevantlaws.10.2ThisagreementisbindingandeffectiveafterbeingsignedandstampedbyPartyAandPartyB.10.3Thisagreementismadeintwocopies,oneforPartyAandoneforPartyB,bothofwhichhaveequallegaleffect.10.4Thisagreementshallcomplywithallrelevantlawsandr
