—2004年5月1日—007.001B鑒于各國(guó)機(jī)動(dòng)車輛相關(guān)法律的近似性使各成員國(guó)有必要相互承認(rèn)根據(jù)通用的要求進(jìn)行的檢測(cè)。歐洲共同體委員會(huì)采用本指令：第一條▼M31.各成員國(guó)應(yīng)向滿足本指令有關(guān)附件中的結(jié)構(gòu)和測(cè)試要求的各種型式的轉(zhuǎn)向指示燈授予歐共體零部件型式認(rèn)證。▼B2.成員國(guó)授予歐洲經(jīng)濟(jì)共同體型式認(rèn)證后應(yīng)采取規(guī)定步驟驗(yàn)證生產(chǎn)樣品是否符合已認(rèn)證型號(hào)，如有必要可與其它成員國(guó)管理機(jī)構(gòu)合作。該驗(yàn)證僅限抽樣檢查。▼M3第二條各成員國(guó)根據(jù)第一條對(duì)各種轉(zhuǎn)向指示燈進(jìn)行型式進(jìn)行認(rèn)證后，即可向該制造商發(fā)放歐共體零部件型式認(rèn)證標(biāo)志。標(biāo)志應(yīng)與附件1附錄3所示式樣相符。各成員國(guó)應(yīng)采取適當(dāng)舉措防止該標(biāo)志的使用在按照第一條通過(guò)型號(hào)認(rèn)證的轉(zhuǎn)向指示燈和其它裝置間造成混淆。第三條1.任何成員國(guó)不得以產(chǎn)品結(jié)構(gòu)和工作方式為由阻止帶有歐洲經(jīng)濟(jì)共同體零部件型式認(rèn)證標(biāo)志的轉(zhuǎn)向指示燈進(jìn)入市場(chǎng)。該成員國(guó)應(yīng)立即將其采取之措施通知其它成員國(guó)和歐盟委員會(huì)，并澄清相關(guān)決定之理由。2.共50頁(yè)第6頁(yè)1976L0759—N—01.05.2004—007.001M3Article4ThecompetentauthoritiesoftheMemberStatesshallinformeachother,bymeansoftheproceduresspecifiedinArticle4(6)ofDirective70/156/EEC,ofeachapprovalwhichtheyhavegranted,refusedorwithdrawnpursuanttothisDirective.▼BArticle51.IftheMemberStatewhichhasgrantedEECcomponenttype-approvalfindsthatanumberofdirectionindicatorlampsbearingthesameEECcomponenttype-approvalmarkdonotconformtothetypewhichithasapproved,itshalltakethenecessarymeasurestoensurethatproductionmodelsconformtotheapprovedtype.ThecompetentauthoritiesofthatStateshalladvisethoseoftheotherMemberStatesofthemeasurestaken,whichmay,wherethereisconsistentfailuretoconform,extendtowithdrawalofEECcomponenttype-approval.ThesaidauthoritiesshalltakethesamemeasuresiftheyareinformedbythecompetentauthoritiesofanotherMemberStateofsuchfailuretoconform.2.ThecompetentauthoritiesofMemberStatesshallwithinonemonthinformeachotherofanywithdrawalofEECcomponenttype-approval,andofthereasonsforsuchameasure.Article6AnydecisiontakenpursuanttotheprovisionsadoptedinimplementationofthisDirectivetorefuseorwithdrawcomponenttype-approvalforadirectionindicatorlamporprohibititsplacingonthemarketoruseshallsetoutindetailthereasonsonwhichitisbased.Suchdecisionsshallbenotifiedtothepartyconcerned,whoshallatthetimebeinformedoftheremediesavailabletohimunderthelawsinforceintheMemberStatesandofthetimelimitsallowedfortheexerciseofsuchremedies.Article7NoMemberStatemayrefusetograntEECtype-approvalornationaltype-approvalofavehicleongroundsrelatingtoitsdirectionindicatorlampsifthesebeartheEECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.共50頁(yè)第7頁(yè)1976L0759——2004年5月1日—007.001M3第四條各成員國(guó)管理機(jī)構(gòu)應(yīng)根據(jù)歐洲經(jīng)濟(jì)共同體第70/156號(hào)指令第4條第6款中的規(guī)定程序，將其依據(jù)本指令準(zhǔn)予、拒絕或者撤消的認(rèn)證相互告知。▼B第五條1.如果成員國(guó)發(fā)現(xiàn)大量獲得歐共體零部件型式認(rèn)證的帶有同一歐共體零部件型式認(rèn)證標(biāo)志的轉(zhuǎn)向指示燈與已認(rèn)證型號(hào)不符，則該成員國(guó)可以采取必要措施保證生產(chǎn)樣本與已認(rèn)證型號(hào)相符。該成員國(guó)管理機(jī)構(gòu)應(yīng)建議其它成員國(guó)管理機(jī)構(gòu)采取措施，若一直無(wú)法符合已認(rèn)證型號(hào)，則可撤銷其歐洲經(jīng)濟(jì)共同體零部件型式認(rèn)證。該成員國(guó)管理機(jī)構(gòu)若接到其它成員國(guó)管理機(jī)構(gòu)對(duì)此類事件的相關(guān)報(bào)告也應(yīng)采取同樣舉措。2.成員國(guó)的主管機(jī)構(gòu)應(yīng)在撤銷歐共體零部件型式認(rèn)證一個(gè)月內(nèi)通知其它成員國(guó)并說(shuō)明理由。第六條在執(zhí)行本指令過(guò)程中，根據(jù)已通過(guò)之規(guī)定對(duì)某種轉(zhuǎn)向指示燈做出的任何拒絕﹑撤銷零部件型式認(rèn)證或是禁止其進(jìn)入市場(chǎng)或使用的決定都應(yīng)給出詳細(xì)理由。該決定應(yīng)告知相關(guān)當(dāng)事人，同時(shí)應(yīng)告知該當(dāng)事人根據(jù)該國(guó)現(xiàn)行法律可做的補(bǔ)救措施及實(shí)施這些補(bǔ)救措施的時(shí)間限制。第七條若某種機(jī)動(dòng)車的轉(zhuǎn)向指示燈帶有歐洲經(jīng)濟(jì)共同體零部件型式認(rèn)證標(biāo)志，或符合歐洲經(jīng)濟(jì)共同體第76/756號(hào)指令中規(guī)定的要求，任何成員國(guó)不得以轉(zhuǎn)向指示燈為由拒絕授予該機(jī)動(dòng)車歐洲經(jīng)濟(jì)共同體型式認(rèn)證或國(guó)家型式認(rèn)證。共50頁(yè)第8頁(yè)1976L0759—N—01.05.2004—007.001BArticle8NoMemberStatemayrefuseorprohibitthesale,registration,entryintoserviceoruseofanyvehicleongroundsrelatingtoitsdirectionindicatorlampsifthesebeartheEECcomponenttype-approvalmarkandarefittedinaccordancewiththerequirementslaiddowninDirective76/756/EEC.M3Article9ForthepurposesofthisDirective,‘vehicle’meansanymotorvehicleintendedforuseontheroad,withorwithoutbodywork,havingatleastfourwheelsandamaximumdesignspeedexceeding25km/h,anditstrailers,withtheexceptionofvehicleswhichrunonrailsandofagriculturalandforestrytractorsandallmobilemachinery.BArticle10AnyamendmentsnecessarytoadjusttherequirementsoftheAnnexestotakeaccountoftechnicalprogressshallbeadoptedinaccordancewiththeprocedurelaiddowninArticle13ofDirective70/156/EEC.Article111.MemberStatesshalladoptandpublishtheprovisionsnecessaryinordertocomplywiththisDirectivebefore1July1977andshallforthwithinformtheCommissionthereof.Theyshallapplytheseprovisionsfrom1October1977atthelatest.2.OncethisDirectivehasbeennotified,theMemberStatesshallalsoensurethattheCommissionisinformed,insufficienttimeforittosubmititscomments,ofanydraftlaws,regulationsoradministrativeprovisionswhichtheyproposetoadoptinthefieldcoveredbythisDirective.Article12ThisDirectiveisaddressedtotheMemberStates.共50頁(yè)第9頁(yè)1976L0759——2004年5月1日—007.001B第八條若某種機(jī)動(dòng)車的轉(zhuǎn)向指示燈帶有歐洲經(jīng)濟(jì)共同體零部件型式認(rèn)證標(biāo)志，或符合歐洲經(jīng)濟(jì)共同體第76/756號(hào)指令中規(guī)定的要求，任何成員國(guó)不得以轉(zhuǎn)向指示燈為由拒絕該
