OffcialJounaloftheEuropeanCommunitiesII(Actswhosepublicationisnotobligatory)COUNCILCOUNCILDIRECTIVEof13April1989ontheapproximationofthelawsoftheMemberStatesrelatingtothelateralprotection(sideguards)ofcertainmotorvehiclesandtheirtrailers(89/297/EEC)THECOUNCILOFTHEEUROPEANCOMMUNITIES,HavingregardtotheTreatyestablishingtheEuropeanEconomicCommunity,andinparticularArticle100athereof,HavingregardtotheproposalfromtheCommission(1),IncooperationwiththeEuropeanParliament(2),HavingregardtotheopinionoftheEconomicandSocialCommittee(3),Whereasitisimportanttoadoptmeasureswiththeaimofprogressivelyestablishingtheinternalmarketoveraperiodexpiringon31December1992;whereastheinternalmarketshallcompriseanareawithoutinternalfrontiersinwhichthefreemovementofgoods,persons,servicesandcapitalisensured;Whereasthetechnicalrequirementswhichvehiclesmustsatisfypursuanttonationallawsrelateinteraliatothesideguardsofmotorvehiclesandtheirtrailers;WhereastheserequirementsdifferfromoneMemberStatetoanother;whereasitisthereforenecessarythatallMemberStatesadoptthesamerequirements,eitherinadditionto,orinplaceof,theirexistingrulesinorder,inparticular,toallowthe:EECtype-approvalprocedurewhichwasthesubjectofCouncilDirective70/156/EECof6February1970ontheapproximationofthelawsoftheMemberStatesrelatingtothetype-approvalofmotorvehiclesandtheirtrailers(4),aslastamendedbyDirective87/403/EEC(5),tobeintroducedinrespectofeachtypeofvehicle;(1)OJNoC265,5.10.1987,p;21.(2)OJNoC94,11.4.1988,p.23.(3)OJNoC80,28.3.1988,p.17.(4)OJNoL42,23.2.1970,p.1.(5)OJNoL220,8.8.1987,p.44.共20頁第1頁歐洲共同體公報II（所公布法令為非強制）理事會理事會指令1989關(guān)于各成員國某些種類機動車及其掛車側(cè)向防護（側(cè)擋板）的法律協(xié)調(diào)（89/297/EEC）歐洲共同體理事會，在考慮到歐洲經(jīng)濟共同體成立時的條約，尤其是該條約第100條，委員會的提議（1）,以及歐洲議會的提議（2）,經(jīng)濟和社會委員會的意見，（3）,鑒于截止到1992年12月31日必須采取措施以逐步建立國內(nèi)市場；鑒于該內(nèi)部市場應(yīng)無內(nèi)部國界限制，在此區(qū)域內(nèi)應(yīng)能確保物品、人員、服務(wù)和資本自由流動；車輛的技術(shù)要求必須滿足相關(guān)的本國法令，特別機動車及其掛車的側(cè)擋板；各成員國之間的上述要求彼此不同；需要所有成員國采用相同的要求，除此之外，要替代現(xiàn)有法規(guī)，或者現(xiàn)有標(biāo)準(zhǔn)，允許對1970年2月6日發(fā)布的由指令87/403/EEC（5）最終修正的關(guān)于機動車及其掛車（4）的型式認(rèn)證的成員國近似法律的理事會指令70/156/EEC中的EEC組件型式認(rèn)證流程應(yīng)用于每一種車輛；(1)OJNoC265,，1987年10月5日，第21(2)OJNoC94，1988年4月11日，第23(3)OJNoC80，1988年3月28日，第17共20頁第2頁OffcialJounaloftheEuropeanCommunitiesWhereas,inordertoincreaseroadsafety,itisnecessarytofitsideguardstoallvehiclesinhigherweightcategoriesinordertoofferunprotectedroadusers(pedestrians,cyclists,motorcyclists)efficientprotectionagainsttheriskoffallingunderthesidesofsuchvehicles;Whereas,forpracticalreasons,itisfeltnecessarytoprovidefordifferentperiodsofapplicationfornewtype-approvalsandforallnewvehicles;WhereastheapproximationofthenationallawsrelatingtomotorvehiclesincludesthemutualrecognitionbytheMemberStatesofthecheckscarriedoutbyeachofthemonthebasisofcommonrequirements,HASADOPTEDTHISDIRECTIVE:Article1ForthepurposesofthisDirective,'vehicle'meansanymotorvehicleincategoriesN2andN3andtrailerincategories03and04,asdefinedinAnnexItoDirective70/156/EEC,designedforuseontheroad,withorwithoutbodyworkandwithamaximumdesignspeedexceeding25km/h.Article21.NoMemberStatemay,ongroundsrelatingtolateralprotection,refusetograntEECtype-approvalornationaltype-approvalinrespectofavehicleifsuchvehiclemeetstherequirementssetoutintheAnnex.2.NoMemberStatemay,ongroundsrelatingtolateralprotection,refuseorprohibitthesale,registration,entryintoserviceoruseofavehicleifsuchavehiclemeetstherequirementssetoutintheAnnex.Article3AMemberStatewhichhasgrantedEECtype-approvalshalltakethemeasuresnecessarytoensurethatitisinformedofanymodificationtoapartorcharacteristicreferredtointheAnnex.Thecompetentauthoritiesofthat共20頁第3頁歐洲共同體公報為了提高公路安全性，必須對所有較大重量的車輛安裝側(cè)擋板，以便對未加防護的道路使用者（行人、騎車人、騎摩托車者）提供受到側(cè)面沖擊時的有效防護；出于實用性原因，需要對新型式認(rèn)證以及所有新車提供不同的階段的應(yīng)用；有關(guān)機動車的本國家的法律協(xié)調(diào)，基于正常條件由各國家的進行檢查，包括各會員們國家的之間互相認(rèn)可，歐洲共同體委員已采用本指令：第1條本指令中，“車輛”指的是指令70/156/EEC中附錄I所定義的任一N2和N3類機動車以及03和04類掛車，，其設(shè)計用于道路行駛；有或者沒有車體，最大設(shè)計車速超過25公里/小時。第2條1.如果該車輛滿足附件中給出的要求，則各成員國不得以側(cè)向防護為理由拒絕發(fā)放EEC型式認(rèn)證或國內(nèi)型式認(rèn)證。2.如果該車輛滿足附件中給出的要求，則各成員國不得以側(cè)向防護為理由拒絕或禁止騎銷售、注冊、投入運營或使用。第3條發(fā)放EEC型式認(rèn)證的成員國應(yīng)該采取必要措施以便獲得相當(dāng)于附件中部件或特征的任何改動。成員國的主管當(dāng)局應(yīng)當(dāng)確定是否需要對已變更的型式進行新測試以及是否需要草擬新報告。如果該測試顯示不符合本指令的要求，則不應(yīng)批準(zhǔn)該變更。共20頁第4頁OffcialJounaloftheEuropeanCommunitiesArticle41.Witheffectfrom1June1990MemberStates:—maynolongerissuethedocumentprovidedforinArticle10(1),thirdindent,ofDirective70/156/EECinrespectofatypeofvehicleofwhichthelateralprotectiondevicesdonotmeettherequirementsofthisDirective,— mayrefusetograntnationaltype-approvalinrespectofatypeofvehicleofwhichthelateralprotectiondevicesdonotcomplywiththeprovisionsofthisDirective.2.Witheffectfrom1May1991MemberStatesmayprohibitthefirstentryintoserviceofvehiclesofwhichthelateralprotectiondevicesdonotcomplywiththeprovisionsofthisDirective.Article5TheamendmentsnecessaryinordertoadapttherequirementsoftheAnnexsoastotakeaccountoftechnicalprogressshallbeadoptedinaccordancewiththeprocedurelaiddowninArticle13ofDirective70/156/EEC.Article61.MemberStatesshallbringintoforcetheprovisionsnecessaryinordertocomplywiththisDirectiveby30October1989.TheyshallforthwithinformtheCommissionthereof.2.MemberStatesshallcommunicatethemainprovisionsofnationallawwhichtheyadoptinthefieldcoveredbythisDirectivetotheCommission.Article7ThisDirectiveisaddressedtotheMemberStates.DoneatLuxembourg,13April1989. P.SOLBES共20頁第5頁歐洲共同體公報第4條1.從1990年6月1日生效之日起，成員國：—不可再對側(cè)向保護裝置不滿足本指令要求的車輛型式發(fā)布指令70/156/EEC第10條（1）第三行中給出的文件，—可以拒絕為限側(cè)向保護裝置不符合本指令規(guī)定的車輛類型發(fā)放國內(nèi)型式認(rèn)證。2.從1991年5月1日生效之日起，成員國可以禁止側(cè)向保護裝置不符合本指令要求的車輛首次投入運營。第5條委員會應(yīng)該按照指令70/156/EEC第13條中的流程來采用針以便本指令技術(shù)進展的附錄要求而做出的必要修正。第6條1.成員國應(yīng)該執(zhí)行必要條例以便從1989年10月30日其執(zhí)行該指令。并應(yīng)進一步通知委員會。2.成員國應(yīng)該就采用的涵蓋本指令的本國法的主要規(guī)定與委員會進行溝通。第7條本指令通過寄送方式發(fā)給各成員國。在盧森堡制訂，1989.年4月13日 P.SOLBES共20頁第6頁OffcialJounaloftheEuropeanCommunitiesANNEXTECHNICALREQUIREMENTSFORLATERALPROTECTION1.Generalprescriptionsanddefinitions1.1.EveryvehicleofcategoriesN2,N3,O3andO4shallbesoconstructedand/orequippedastooffer,whenacompleteentity,effectiveprotectiontounprotectedroadusers(pedestrians,cyclists,motorcyclists)againsttheriskoffallingunderthesidesofthevehicleandbeingcaughtunderthewheels(1).TheDirectivedoesnotapplyto:—tractorsforsemi-trailers,—trailersspeciallydesignedandconstructedforthecarriageofverylongloadsofindivisiblelength,suchastimber,steelbars,etc.,—vehiclesdesignedandconstructedforspecialpurposeswhereitisnotpossible,forpracticalreasons,tofitsuchlateralprotection.1.2.Avehicleshallbedeemedtosatisfytherequirementsetoutinpoint1.1ifitssidepartsprovideprotectionconformingtotheprovisionsoftheparagraphsbelow.1.3.Definitions1.3.1.VehicletypeforthepurposesoflateralprotectionTheterm'vehicletypeforthepurposesoflateralprotection'meansvehicleswhichdonotdifferwithrespecttothefollowingmaincharacteristics:widthoftherearaxle,structure,dimensions,shapeandmaterialsofthebodyworkandchassis,characteristicsofthesuspensionofthevehicleinsofarastheyhaveabearingontherequirementsofpoint,'Unladenmass'meanstheweightofthevehicleinrunningorder,unoccupiedandunladenbutcompletewithfuelcoolant,lubricanttoolsandsparewheel,ifsuppliedbythevehiclemanufacturerasstandardequipment.(1)ThisDirectivedoesnotpreventanycountryfromhavingadditionalrequirementsforthevehiclepartsforwardofthefrontwheelsandrearwardoftherearwheels.共20頁第7頁歐洲共同體公報附件側(cè)向防護的技術(shù)要求1.通用說明與定義1.1.N2,N3,O3和O4類的所有車輛作為完整實體，其結(jié)構(gòu)和/或裝備均應(yīng)該為沒有防護的道路使用者（行人、騎車人、騎摩托車者）提供有效保護以避免受到車輛側(cè)面或下面的沖擊（1）。指令不適用于：—用于半掛車的拖車，—設(shè)計和結(jié)構(gòu)專用于長度不可分割的極長負(fù)載如木材、鋼條等運輸?shù)膾燔?；—設(shè)計和結(jié)構(gòu)用于特種用途的車輛，出于實用性原因，不能安裝這樣的側(cè)向防護。1.2.如果側(cè)面部件所提供的防護滿足下段中的規(guī)定，則視為車輛滿足1.1點中給出的要求。1.3.定義1.3.1.用于側(cè)向防護的車輛型式術(shù)語‘用于側(cè)向防護的車輛型式’指的時下列主要特征基本相同的車輛：對第2點要求有影響的后橋?qū)挾?、車體和底盤的結(jié)構(gòu)、尺寸、形狀和材料，車輛的懸架特征。1.3.2.‘空載重量’指的是處于工作狀態(tài)下的車輛重量，里面沒有人員、空載，但是裝備了完整的燃料、冷卻液、潤滑油、工具和備胎（如果這些是車輛廠商所提供的標(biāo)準(zhǔn)設(shè)備）。（）本指令不阻止任何國家對前輪前部及后輪后部的車輛部件提出附加要求。共20頁第8頁OffcialJounaloftheEuropeanCommunities1.4.PositioningofthevehicleWhentestedforcompliancewiththetechnicalspecificationssetoutinpoint2,thepositionofthevehicleshallbeasfallows:—onahorizontalandflatsurface,—thesteeredwheelsshallbeinastraight-aheadposition,—thevehicleshallbeunladen,—semi-trailersshallbepositionedontheirsupportswiththeloadingsurfacehorizontal.2.Lateralprotectionprovidedbyaspecificdevice(sideguard)2.1.Thedeviceshallnotincreasetheoverallwidthofthevehicleandthemainpartofitsoutersurfaceshallnotbemorethan120mminboardfromtheoutermostplane(maximumwidth)ofthevehicle.Itsforwardendmaybeturnedinwardsonsomevehiclesinaccordancewithpoints2.4.2and2.4.3.Itsrearwardendshallnotbemorethan30mminboardfromtheoutermostedgeofthereartyres(excludinganybulgingofthetyresclosetotheground)overatleasttherearmost250mm.2.2.Theoutersurfaceofthedeviceshallbesmooth,substantiallyflatorhorizontallycorrugateandsofaraspossiblecontinuousfromfronttorear;adjacentpartsmayhoweveroverlap,providedthattheoverlappingedgefacesrearwardsordownwards,oragapofnotmorethan25mmmeasuredlongitudinallymaybeleft,providedthattherearwardpartdoesnotprotrudeoutboardoftheforwardpart;domedheadsofboltsorrivetsmayprotrudebeyondthesurfacetoadistancenotexceeding10mmandotherpartsmayprotrudetothesameextentprovidedthattheyaresmoothandsimilarlyrounded;allexternaledgesandcornersshallberoundedwitharadiusnotlessthan2,5mm(testedasprescribedinDirective74/483/EEC(2)).2.3.Thedevicemayconsistofacontinuousflatsurface,orofoneormorehorizontalrails,oracombinationofsurfaceandrails;whenrailsareused,theyshallbenotmorethan300mmapartandnotlessthan:—50mmhighinthecaseofcategoryN2andO3vehicles,—100mmhighandessentiallyflatinthecaseofN3andO4vehicles.Combinationsofsurfacesandrailsshallformacontinuoussideguardsubject,however,totheprovisionsofpoint.Theforwardedgeofthesideguardshallbeconstructedasfollows:2.4.1.Itspositionshallbe:(2)OJNoL266,2.10.1974,p.4.共20頁第9頁歐洲共同體公報1.4.按照第2點給出的技術(shù)規(guī)范測試符合性時定位車輛，車輛的位置應(yīng)該如下：—在水平平整表面上，—轉(zhuǎn)向車輪應(yīng)該位于正向前方位置，—車輛應(yīng)該空載?！?fù)載平面水平時將半掛車定位在支架上。2.由特殊裝置（側(cè)擋板）提供的側(cè)向防護2.1.該裝置不應(yīng)增加車輛的總寬，并且其外表面的主要部件也不應(yīng)向內(nèi)超過車輛最外側(cè)平面（最大寬度）120毫米。按照2.4.2點和2.4.3點，在某些車輛上，前端可以向內(nèi)轉(zhuǎn)。至少在最后面250毫米以上，其后端不應(yīng)大于后輪胎最外邊緣內(nèi)側(cè)30毫米（輪胎接近地面的凸起除外）。2.2.裝置的外表面應(yīng)該平滑、基本水平或為水平紋狀，并盡可能從前延續(xù)到后；但是，如果重疊邊緣朝向后部或向下，則相連部件可以重疊，如果后部部件未伸出到前方部件外側(cè)，則可以留出不超過25毫米的縱向測量間隔；螺栓或鉚釘?shù)那蛐畏忸^可以伸到表面外10毫米以內(nèi)，其它平滑及相似圓形的部件也可以伸出同樣長度；所有外部棱角均應(yīng)修圓到2,5毫米半徑以上（如指令74/483/EEC進行測試（1））。2.3.該裝置可以由一個連續(xù)的平整表面、或者一個或多個水平導(dǎo)軌、或表面和導(dǎo)軌的組合所組成；如果使用了導(dǎo)軌、則各導(dǎo)軌不應(yīng)超過300毫米，并且不小于：—N2和O3類車輛50毫米高，—N3和O4類車輛100毫米高并且基本上水平。但是，平面和導(dǎo)軌的組合應(yīng)該構(gòu)成第2.2點所述的連續(xù)側(cè)擋板。2.4.側(cè)擋板的前向邊結(jié)構(gòu)如下；2.4.1.其位置應(yīng)為：（2）OJNoL266，1974年2月10日共20頁第10頁OffcialJounaloftheEuropeanCommunities.onamotorvehicle:notmorethan300mmtotherearofthetransverseverticalplanetangentialtotherearmostpartofthetyreonth
