DescriptionoftheDefect:BasicAutopilotisapackagethatincludesSAELevel2advanceddriver-

assistancefeatures,includingAutosteerandTraffic-AwareCruiseControl

(TACC),thatdriversmaychoosetoengagesubjecttocertaindefinedoperating

limitations.AutosteerisanSAELevel2advanceddriver-assistancefeature

that,incoordinationwiththeTACCfeature,canprovidesteering,brakingand

accelerationsupporttothedriversubjecttocertainlimitedoperating

conditions.Autosteerisdesignedandintendedforuseoncontrolled-access

highwayswhenthefeatureisnotoperatinginconjunctionwiththeAutosteer

onCityStreetsfeature.WhenAutosteerisengaged,aswithallSAELevel2

advanceddriver-assistancefeaturesandsystems,thedriveristheoperatorof

thevehicle.Asthevehicleoperator,thedriverisresponsibleforthevehicle’s

movementwiththeirhandsonthesteeringwheelatalltimes,remaining

attentivetosurroundingroadconditions,andintervening(e.g.,steer,brake,

accelerateorapplythestalk)asneededtomaintainsafeoperation.

WhenAutosteerisengaged,itusesseveralcontrolstomonitorthatthedriver

isengagedincontinuousandsustainedresponsibilityforthevehicle’s

operationasrequired.IfthedriverattemptstoengageAutosteerwhen

conditionsarenotmetforengagement,thefeaturewillalertthedriveritis

unavailablethroughvisualandaudiblealerts,andAutosteerwillnotengage.

Likewise,ifthedriveroperatesAutosteerinconditionswhereitsfunctionality

maybelimitedorhasbecomedeterioratedduetoenvironmentalorother

circumstances,thefeaturemaywarnthedriverwithvisualandaudiblealerts,

restrictspeed,and/orinstructthedrivertointerveneimmediately.

IncertaincircumstanceswhenAutosteerisengaged,theprominenceandscope

ofthefeature’scontrolsmaynotbesufficienttopreventdrivermisuseofthe

SAELevel2advanceddriver-assistancefeature.

-OnJune8,2022,NHTSAupgradedPE21-020toEngineeringAnalysis(“EA”)EA22-002.

-Overthenextyear,aspartofEA22-002,Tesla,infullcooperation,respondedtoextensiveinformation

requestsfromNHTSAandparticipatedinseveralmeetingswiththeagency.

-FromOctober16,2023,throughDecember4,2023,NHTSAandTeslaconductedseveralmeetingstodiscuss

theagency’stentativeconclusionsregardingEA22-002,astheyrelatedtotheissueofpotentialdrivermisuse

whenAutosteerisengaged,expectationstoaddresstheagency’sconcernsthroughavoluntaryrecall,and

Tesla’sproposedover-the-air(“OTA”)softwareremediesinresponse.

-Whilenotconcurringwiththeagency’sanalysis,intheinterestofresolvingEA22-002,Tesladeterminedon

December5,2023,tovoluntarilyadministerarecallandprovidetheremedydescribedbelow.

-AsofDecember8,2023,Teslahasidentified9warrantyclaims,receivedbetweenJuly13,2021,and

September17,2023,thatmayberelatedtotheconditiondescribedabove.

DescriptionofRemedyProgram:Atnocosttocustomers,affectedvehicleswillreceiveanover-the-air

softwareremedy,whichisexpectedtobegindeployingtocertainaffected

vehiclesonorshortlyafterDecember12,2023,withsoftwareversion

2023.44.30.Remainingaffectedvehicleswillreceiveanover-the-air

softwareremedyatalaterdate.Theremedywillincorporateadditional

controlsandalertstothosealreadyexistingonaffectedvehiclestofurther

encouragethedrivertoadheretotheircontinuousdrivingresponsibility

wheneverAutosteerisengaged,whichincludeskeepingtheirhandsonthe

steeringwheelandpayingattentiontotheroadway.Dependingonvehicle

hardware,theadditionalcontrolswillinclude,amongothers,increasing

theprominenceofvisualalertsontheuserinterface,simplifying

engagementanddisengagementofAutosteer,additionalchecksupon

engagingAutosteerandwhileusingthefeatureoutsidecontrolledaccess

highwaysandwhenapproachingtrafficcontrols,andeventualsuspension

fromAutosteeruseifthedriverrepeatedlyfailstodemonstrate

continuousandsustaineddrivingresponsibilitywhilethefeatureis

engaged.
