2.Introduction

DN3000PipeJackingShaftsS17toS18hasatotalspanof189.4mandisincludedinSection1PartCoftheworks.

Thebreak-outoftheboringmachinestartedon24March2006,andfirstpipewasjackedon28thMarch2006.

PipejackingbetweenShaftsS17toS18wasacriticalactivityandliesontheCriticalPath.

Duringpipe-jacking,theelectricalcurrentofthereductiongearintheboringmachineincreasedsuddenly,thissituationmadeithardforthescrewconveyortoconveysoil.Severaldayslater,fivesteelbarswasconveyedout(fordetails,pleaseseethepicture).Becausethescrewconveyerhadbeenworkingatexcessloadforseveraldays,thebearinginreductiongearofthescrewconveyerbrokedownon11May2006,anewonewasreplaced,butitbrokedownagainon22May2006,replacedwithanewoneoncemore,finally,itworkednormally.Theboringmachinefinallybrokeintototheshaft18on28May2006.

Becauseoftheundergroundobstruction,theprogressofpipejackingsloweddownobviouslyfrom11May2006to27May2006.

TheDailyDairyandDailyPipeJackingRecordwerecontemporarilyrecordedforyourreferencetomakesuchaconclusionthattheundergroundobstructiondefinitelyhadgivenrisetothedelayoftheperiodofthisspanofpipejacking.

3.ContractProvisions

Clause12.2oftheGeneralConditionsofContractprovidestheContractorreliefintheeventofnotforeseeablephysicalobstructionsorconditionsbeingmet,namely:-

“If…duringtheexecutionoftheWorkstheContractorencounters…physicalconditions…which…conditionswere,inhisopinion,notforeseeablebyanexperiencedcontractor,theContractorshallforthwithgivenoticethereoftotheEngineer,withacopytotheEmployer.OnreceiptofsuchnoticetheEngineershall,ifinhisopinionsuch…conditionscouldnothavereasonablybe

foreseenbyanexperiencedcontractor,afterdueconsultation…,determine”

a)AnyextensionoftimetowhichtheContractorisentitledunderClause44,and

b)theamountofanycostswhichmayhavebeenincurredbytheContractorbyreasonofsuch…conditionshavingbeenencountered…”

Article1.08C5oftheTechnicalSpecificationprovidesthat:-

“Itshouldbeassumedthatmaterialsotherthanthosedisclosedbytheboringscanandwillbeencounteredduringconstructionandthat……….”

ThereisanambiguitybetweenArticle1.08C5andClause12.2.PursuanttoClause5.2thatinthecaseofambiguitiesPart1oftheConditions(GeneralConditions)takespriorityover“anyotherdocumentsformpartoftheContract”.

Clause12.2thereforetakespriorityovertheTechnicalSpecificationanditisconcludedthatitistheclearintentionoftheContracttermstocompensatetheContractorforanyadditionaltimeandexpenseincurredintheeventofencounteringnotforeseeableundergroundobstructions.

TheclaimforextensionoftimetothetimeforcompletionandadditionalcostsincurredisthusmadepursuanttoClause12.2oftheConditionsofContract.

4.NoticesofClaimandrelevantcorrespondence

ByletterJV-CDM-CP-108/06dated16thMay2006theContractorinformedtheEngineerthatpipejackingprogresshadsloweddownduetomeetingtheundergroundobstructionson20thApril2006.ThislettermeansanoticeofclaimgiventotheEngineerbytheContractor.

On29May2006(JV-CDM-CP-120/06)theContactorinformedtheEngineerthatpipejackinghadbeencompleted.

On26May2006(LO-06-586)theEngineeracknowledgereceiptoftheNoticeofClaimfromtheContractor.

On31May2006(LO-06-601)theEngineer’sreplytotheContractor’sletter.

5.Extensionoftime

Thejackingofthefirstpipestartedon28March2006,andendedon27May2006,theextensionoftimeforthisspanofpipejackingis10days.
