WhyGAODidThisStudy

Publichealthcanbeatsignificantriskduringemergencies,likeapandemicorhurricane.Stateandlocalgovernmentstypicallyleadthedomesticresponsetoapublichealthemergency.However,iftheircapabilitiesareoverwhelmed,HHSmayprovideadditionalsupport.Torespondimmediatelytosuchemergencies,HHShastworeservefundsdesignedtoholdfundingovermultiplefiscalyears,foruseasneeded.

ThePandemicandAll-HazardsPreparednessandAdvancingInnovationActof2019includedaprovisionforGAOtoreviewthePublicHealthEmergencyFund.Thisreportdescribes:(1)theavailableresourcesandspecificpurposesforwhichHHS’sreservefundshavebeenused;and(2)HHSofficials’perspectivesonthechallengesobtainingfundingtorespondtoimmediateneedsofpublichealththreatsoremergencies,andhowthereservefundshavehelpedaddressthesechallenges.

Toconductthiswork,GAOrevieweddocumentationandinterviewedcurrentandformeragencyofficialsabouttheiruseofthefunds,anychallengestheyfaced,andanyfundingcharacteristicsthathelpedaddresschallenges.Toidentifychallenges,GAOaskedHHSofficialsabouttheirexperiencesduringfourselectedpublichealthemergenciesthatwereinfectiousdiseasesorextremeweathereventsduringthepast20years—H1N1influenza,Zika,HurricaneMaria,andmpox.

WhatGAOFound

TheDepartmentofHealthandHumanServices(HHS)canuseavarietyoffundingoptionstohelpaddressapublichealthemergencyorthreat.Forexample,HHSmayuseannualorsupplementalappropriationsthatweremadeforspecificagencyprogramsandactivities.HHSalsohastworeservefundstoaddressimmediateneedsthatariseinthefirstdaysorweeksofanemergency.

ThePublicHealthEmergencyFund,establishedin1983,isareservefundtohelpHHSagencies,suchastheAdministrationforStrategicPreparednessandResponseandtheCentersforDiseaseControlandPrevention(CDC),torapidlyrespondtoanykindofpublichealthemergencyorthreat.Suchthreatsincludeextremeweather;diseases;radiologicalornuclearincidents;oractsofterrorism.However,thefundhasnotreceivedappropriationsorbeenusedinover25years.

ExamplesofPossibleImmediateNeedsduringPublicHealthEmergencies

TheInfectiousDiseasesRapidResponseReserveFund,establishedin2018,isanotherreservefundtoallowCDCtorapidlyrespondtoinfectiousdiseasethreats.Thisfundreceived$800millioninappropriationsfrom2019through2023,including$600millionin2020afterthebeginningoftheCOVID-19pandemic.Fromfiscalyear2020throughMay2023,CDCused$211millionfromthefundforactivitiessuchasdiagnostictestingandairportscreeningtohelpcontrolthespreadandseverityofthreeinfectiousdiseases:COVID-19,Ebola,andmpox(formerlyknownasmonkeypox).

HHSofficialsdescribedchallengesfundingimmediateneedsduringselectedpublichealthemergencies.Forexample,priortotheinfectiousdiseasefund,HHSofficialssaidittooktimetoidentifyandsecurefundingtoaddresstheimmediateneedsoftheZikaoutbreakin2016.TheywereultimatelyabletoidentifysomefundsfromanotherprogramtousefortheZikaresponse.

HHSofficialssaidthattheInfectiousDiseasesRapidResponseReserveFundhashelpedtoaddresssomeofthesechallenges,specificallyforCDC.Inparticulartheysaidthathavingreadilyavailable,flexible,andconsistentlyreplenishedfundinghashelpedCDCrespondquicklytoemerginginfectiousdiseasethreatsbeforetheyworsen.However,HHSofficialssaidtheycontinuetofacechallengesaddressingimmediateneeds,forexamplenotingthatthefundisavailableonlyforinfectiousdiseasesandnotforotherpublichealththreats.

Infectiousdiseases,hurricanes,tornadoes,floods,andwildfireshaveallthreatenedpublichealthandsafetyinrecentyears,andrequiredarapidresponsetosavelives.AstheCOVID-19pandemicillustrated,theUnitedStatesfacesanongoingriskfromthesethreats.Futurepublichealthrisksinclude,forexample,newdiseaseoutbreaks;extremeweatherevents;radiological,ornuclearincidents;oractsofterrorism.

Wehavepreviouslyreportedontheimportanceofpreparingfor,andurgentlyrespondingto,publichealththreats,andontheneedforsignificantimprovementsinhowthefederalgovernmentsupportsstateandlocalgovernmentsduringsuchtimes.

TheDepartmentofHealthandHumanServices(HHS)takestheleadinthefederalpublichealthandmedicalresponsetothesethreats,andtheSecretaryofHealthandHumanServicesmaydeclarewhenthesethreatsbecomepublichealthemergencies.Aswehavereported,notbeingsufficientlypreparedforapublichealththreatoremergencycanalsonegativelyaffectthetimeandresourcesneededtoachievefullrecovery.Basedontheresultsofthis

pastwork,wenamedHHS’sleadershipandcoordinationofpublichealthemergenciesasahighriskissueinJanuary2022.

Immediateneedssuchasdiseasetestingorasurgeininjurytreatmentmayariseduringthefirstdaysorweeksfollowingapublichealththreatoremergency.Torespondtotheseneeds,HHSmayuseavarietyoffundingsources.Theseincludetworeservefunds—thePublicHealthEmergencyFundandtheInfectiousDiseasesRapidResponseReserveFund(InfectiousDiseasesReserveFund)—thataredesignedtoholdfundingovermultiplefiscalyearssothatHHScanusethemasneeded.

ThePandemicandAll-HazardsPreparednessandAdvancingInnovationActof2019includedaprovisionforGAOtoreviewthePublicHealthEmergencyFund,includingtheresourcesavailableinthefund,andthefund’suses.

Inthisreport,wedescribe:

1.theavailableresourcesinandspecificpurposesforwhichHHS’sreservefundshavebeenused;

2.HHSofficials’perspectivesonthechallengesobtainingfundingtorespondtoimmediateneedsofpublichealthemergencies,andhowthereservefundshavehelpedaddressthesechallenges.

TodescribetheavailableresourcesandthespecificpurposesforwhichHHS’sreservefundshavebeenused,wereviewedlawsauthorizingandappropriatingfundstothePublicHealthEmergencyFundandtheInfectiousDiseasesReserveFund.Wealsoreviewedagencydocumentationontheamountoffundsappropriatedtoandobligatedfromthesereservefunds.

Weassessedthereliabilityofthesefundingdatabycomparingthemwithotheravailablesourcesofinformationanddiscussingthemwithagencyofficials.Basedonthisassessment,wedeterminedthatthesedataweresufficientlyreliableforthepurposesofthisengagement.WeinterviewedcurrentandformerofficialsfromHHS’sAdministrationforStrategicPreparednessandResponse(ASPR)andCentersforDiseaseControl

andPrevention(CDC)aboutthespecificactivitiesforwhichtheyusedthefunds,amongotherthings.FormerASPRandCDCofficialsweinterviewedhadexperiencewithpublichealthemergenciesthatoccurredsince2009.WeinterviewedcurrentofficialsfromHHS’sOfficeoftheAssistantSecretaryforFinancialResources,whichprovidesadviceandguidancewithinthedepartmentonfinancialmanagement.WealsointerviewedofficialsfromtheFederalEmergencyManagementAgency(FEMA)—withintheDepartmentofHomelandSecurity—thefederalagencywithprimaryresponsibilityforcoordinatingthefederalresponsetoandrecoveryfromemergenciesormajordisastersdeclaredbythePresidentundertheRobertT.StaffordDisasterReliefandEmergencyAssistanceAct(StaffordAct).FEMAalsooverseestheDisasterReliefFund,whichisavailableforsuchrecoveryandresponseefforts.

TodescribeHHSofficials’perspectivesonchallengesfundingimmediateresponseneedsofselectedpublichealthemergencies,andhowthereservefundshavehelpedaddressthesechallenges,weselectedfourofthe40publichealthemergenciesdeclaredfromAugust2005throughNovember2022:H1N1influenza(2009),Zika(2016),HurricaneMaria(2017),andmpox(previouslyknownasmonkeypox)(2022).

Weselectedthesefourpublichealthemergenciestoincludevarioustypesofemergencies,suchasthoseresultingfrominfectiousdiseasesandextremeweather.

WerevieweddocumentationaboutactionsHHSagenciestooktoaddresseachemergency,andanyfundingchallenges.WealsointerviewedcurrentandformeragencyofficialsfromASPRandCDCabouttheirexperiencesobtainingfundingtoaddressimmediateneeds,anychallengestheyfacedaddressingimmediateneeds,andtheirviewsabouthowthereservefundshavehelpedaddressthesechallenges.

WeconductedthisperformanceauditfromJune2022toAugust2023inaccordancewithgenerallyacceptedgovernmentauditingstandards.Thosestandardsrequirethatweplanandperformtheaudittoobtain

sufficient,appropriateevidencetoprovideareasonablebasisforourfindingsandconclusionsbasedonourauditobjectives.Webelievethattheevidenceobtainedprovidesareasonablebasisforourfindingsandconclusionsbasedonourauditobjectives.

Background

PublicHealth

Emergencies

Stateandlocalgovernmentstypicallyleadthedomesticresponsetoapublichealththreatoremergency.However,ifathreatissevereenoughthatstateandlocalcapabilitiesareoverwhelmed,stateandlocalgovernmentsmayseeksupportfromthefederalgovernment.Undersection319ofthePublicHealthServiceAct,theSecretaryofHealthandHumanServicesmaydeclareapublichealthemergencyiftheSecretarydetermines,inconsultationwithotherpublichealthofficialsasmaybenecessary,that(1)adiseaseordisorderpresentsapublichealthemergency;or(2)apublichealthemergencyotherwiseexists,includingsignificantoutbreaksofinfectiousdiseaseorbioterroristattacks.

Adeclarationofapublichealthemergencytriggerstheavailabilityofcertainauthoritiesunderfederallawthatmayallowthefederalgovernmenttoincreasesupporttoandreduceadministrativeburdensonstateandlocalgovernmentsaffectedbythepublichealthemergency.

ImmediateNeedsduring

PublicHealthEmergencies

Immediateneedsduringthefirstdaysorweeksfollowingapublichealththreatoremergencycanvary;forexampleparticularneedsmaydependonwhethertheemergencyresultsfromextremeweathersuchasahurricaneorflood;aninfectiousdisease;oraradiologicalornuclearincident.Figure1illustratesexamplesofpossibleimmediateneedsduringdifferenttypesofpublichealthemergencies.

7Forexample,uponrequestbyastategovernorortribalorganization,theSecretaryofHealthandHumanServicesmayauthorizethetemporaryreassignmentoffederallyfundedstateandlocalpublichealthdepartmentpersonnelfundedinwholeorinpartthroughprogramsauthorizedunderthePublicHealthServiceActtoaddresstheimmediateneedsofapublichealthemergencyinastateortribe.42U.S.C.§247d(e).

WithinHHS,ASPRistheleadagencyformedicalandpublichealthemergencypreparednessandresponse,policycoordination,andstrategicdirection.ASPRalsoservesastheprincipaladvisortotheSecretaryofHealthandHumanServicesonallmattersrelatedtofederalpublichealthandmedicalpreparednessandresponse.Inaddition,itmaintainsastockpileofresources,includingsuppliesimportantforrespondingtodifferenttypesofpublichealthemergencies.AnotheragencywithinHHS,CDC,alsohasaleadroleinaddressingpublichealthemergencypreparednessandresponse,includingdetectingandrespondingtonewandemergingdiseasethreats.CDCalsomaintainsexpertiseinaddressingpublichealthneedsresultingfromnaturaldisastersandsevereweather,radiationandchemical

ThePublicHealthEmergencyFundwasestablishedin1983andisavailabletoHHSanditsagencieswhentheSecretarydeclaresapublichealthemergency,orwhentheSecretarydeterminesthereisasignificantpotentialforapublichealthemergency.

ThepurposeofthefundistoallowtheSecretaryto“rapidlyrespondtotheimmediateneeds”resultingfromsuchemergenciesorpotentialemergencies,andauthorizedusesincludefacilitatingcoordinationamongentitiesaffectedbyapublichealththreatoremergency,facilitatingadvancedresearchanddevelopmentofcountermeasures,strengtheningbio-surveillancecapabilities,andcarryingoutotheractivitiesdeterminedtobeappropriate.

TheInfectiousDiseasesReserveFundwasestablishedin2018toprovideCDCwithfundsto“prevent,preparefor,orrespondtoaninfectiousdiseaseemergency.”

SimilartothePublicHealthEmergencyFund,theInfectiousDiseasesReserveFundmaybeusedwhentheSecretarydeclaresaninfectiousdiseaseemergencytobeapublichealthemergency,oriftheSecretarydeterminesthereisasignificantpotentialfortheinfectiousdiseaseemergencytoimminentlyoccurandtoaffectnationalsecurityorthehealthandsecurityofU.S.citizens.

DisasterReliefFund

Insomecases,circumstancesgivingrisetoapublichealthemergencydeclarationmayalsoleadtoapresidentialdeclarationofanemergencyormajordisasterundertheStaffordAct.TheDisasterReliefFund—administeredbyFEMA—maybeusedtoaddresscertainpublichealthandmedicalneedsforStaffordActemergenciesandmajordisastersthroughamissionassignmenttoHHSandotheragencies.Forexample,forHurricaneMaria,FEMAtaskedHHSwithamissionassignmenttoprovideemergencymedicalandpublichealthservicesinmultiplelocalitiesinPuertoRico.

TheInfectiousDiseasesReserveFundhasbeenusedbyCDCforthreedifferentdiseasethreatssincethefundwasestablishedin2018:COVID-

19startingin2020,Ebolavirusdisease(Ebola)startingin2021,andmpoxstartingin2022.

?Tousethefundineachofthesecases,officialstoldusthattheyconsideredthescale,scope,andnatureofthediseaseandwhetheritposedanimminentthreattopublichealthandsecurity.

?Tohelppreservefundingforfuturethreats,officialsalsosaidtheyconsideredtheavailabilityofotherresources,andgenerallyusedthefundwhenotherfundingoptionswerenotavailable.

?Ineachcase,officialssaidthattheyidentifiedspecificresponseactivitiesexpectedtohavethelargesteffectsincontrollingthespreadorseverityofthedisease.
