agraph3.ThatestimatedvalueshouldbeequaltooraboveEUR15000000netofVATforworksandconcessions,andequaltooraboveEUR5000000netofVATforgoodsandservices.IPI措施應(yīng)僅適用于估計價值超過歐委會根據(jù)調(diào)查和磋商結(jié)果并考慮到第3款規(guī)定的標(biāo)準(zhǔn)而確定的門檻的公共采購程序。對于工程和特許權(quán),該估計價值應(yīng)等于或超過15000000歐元(扣除增值稅),對于貨物和服務(wù),應(yīng)等于或超過5000000歐元(扣除增值稅)。5.TheIPImeasureshallapplyinthecaseofspecificcontractsawardedunderadynamicpurchasingsystemwheretheIPImeasurealsoappliestothosedynamicpurchasingsystems,withtheexceptionofspecificcontractstheestimatedvalueofwhichisbelowtherespectivevaluessetoutinArticle8ofDirective2014/23/EU,Article4ofDirective2014/24/EUorArticle15ofDirective2014/25/EU.TheIPImeasureshallnotapplytopublicprocurementproceduresfortheawardofcontractsbasedonaframeworkagreementortocontractsforindividuallotstobeawardedinaccordancewithArticle5(10)ofDirective2014/24/EUorArticle16(10)ofDirective2014/25/EU.IPI措施應(yīng)適用于根據(jù)動態(tài)采購系統(tǒng)授予的具體合同,而IPI措施也適用于這些動態(tài)采購系統(tǒng),但估計價值低于第2014/23/EU號指令第8條、第2014/24/EU號指令第4條或第2014/25/EU號指令第15條中規(guī)定的相應(yīng)價值的具體合同除外。IPI措施不應(yīng)適用于根據(jù)框架協(xié)議授予合同的公共采購程序,或根據(jù)第2014/24/EU號指令第5(10)條或第2014/25/EU號指令第16(10)條授予單個批次的合同。6.IntheIPImeasurereferredtoinparagraph1,theCommissionmaydecide,withinthescopeestablishedinparagraph8,torestricttheaccessofeconomicoperators,goodsorservicesfromathirdcountrytopublicprocurementproceduresbyrequiringcontractingauthoritiesorcontractingentitiesto:在第1款提及的IPI措施中,歐委會可在第8款規(guī)定的范圍內(nèi)決定限制第三國的經(jīng)濟經(jīng)營者、貨物或服務(wù)進入公共采購程序,要求訂約當(dāng)局或訂約實體:(a)imposeascoreadjustmentontenderssubmittedbyeconomicoperatorsoriginatinginthatthirdcountry;or對原產(chǎn)于該第三國的經(jīng)濟經(jīng)營者提交的投標(biāo)書進行評分調(diào)整;或(b)excludetenderssubmittedbyeconomicoperatorsoriginatinginthatthirdcountry.排除原產(chǎn)于該第三國的經(jīng)濟經(jīng)營者提交的投標(biāo)書。7.Thescoreadjustmentreferredtoinparagraph6,point(a),shallapplyonlyforthepurposeoftheevaluationandrankingofthetenders.Itshallnotaffectthepricetobepaidunderthecontracttobeconcludedwiththesuccessfultenderer.第6款(a)項提及的分?jǐn)?shù)調(diào)整應(yīng)僅適用于對投標(biāo)書的評審和排名的目的。它不應(yīng)影響根據(jù)與中標(biāo)者簽訂的合同所應(yīng)支付的價格。8.IntheIPImeasurereferredtoinparagraph1theCommissionshallspecifythescopeofapplicationoftheIPImeasure,including:在第1款提及的IPI措施中,歐委會應(yīng)明確IPI措施的適用范圍,包括:(a)thesectorsorthecategoriesofgoods,servicesandconcessionsbasedontheCommonProcurementVocabularyasestablishedbyRegulation(EC)No2195/2002oftheEuropeanParliamentandoftheCouncil,aswellasanyapplicableexceptions;根據(jù)歐洲議會和歐洲理事會第2195/2002號條例(18)確定的共同采購詞匯表的部門或貨物、服務(wù)和特許權(quán)類別,以及任何適用的例外情況。(b)thespecificcategoriesofcontractingauthoritiesorcontractingentities;訂約當(dāng)局或訂約實體的具體類別;(c)thespecificcategoriesofeconomicoperators;經(jīng)濟經(jīng)營者的具體類別;(d)thes?pecificthresholdsequaltoorabovethosesetoutinparagraph4;等于或高于第4條規(guī)定的具體門檻;(e)whereappropriate,thepercentagevaluesofascoreadjustmentreferredtoinparagraph6,point(a).在適當(dāng)情況下,第6款(a)點中提到的分?jǐn)?shù)調(diào)整的百分比值。Thepercentagevalueoftheadjustmentasreferredtoinpoint(e)ofthefirstsubparagraphshallbesetupto50%oftheevaluationscoreofthetender,dependingonthethirdcountryandsectorofenvisagedgoods,services,worksorconcessions.Forthepurposeofpublicprocurementprocedures,wherepriceorcostistheonlycontractawardcriterion,thescoreadjustmentshallbetwicethepercentagevalueassetoutinthefirstsentenceofthissubparagraph.AnIPImeasureshallindicatetherespectivepercentagevaluesseparately.第一項(e)點所述的調(diào)整百分比值,應(yīng)根據(jù)第三國和所設(shè)想的貨物、服務(wù)、工程或特許權(quán)部門的情況,設(shè)定為不超過投標(biāo)書評審分?jǐn)?shù)的50%。在公共采購程序中,如果價格或成本是唯一的合同授予標(biāo)準(zhǔn),分?jǐn)?shù)調(diào)整應(yīng)是本項第一句規(guī)定的百分比值的兩倍。一項IPI措施應(yīng)分別說明各自的百分比值。9.WhendeterminingtheIPImeasurebasedontheoptionsunderparagraph6,point(a)or(b),theCommissionshalloptforthekindofmeasurethatwouldbeproportionateandmosteffectivelyremedythelevelofimpairmentofaccessforUnioneconomicoperators,goodsorservicestothird-countrypublicprocurementorconcessionmarkets.當(dāng)根據(jù)第6條(a)點或(b)點的選項確定IPI措施時,歐委會應(yīng)選擇那種相稱的、最有效的補救歐盟經(jīng)濟運營商、貨物或服務(wù)進入第三國公共采購或特許市場的損害程度的措施。10.WheretheCommissionconsidersthatthethirdcountrytakessatisfactorycorrectiveactionstoeliminateorremedytheimpairmentofaccessforUnioneconomicoperators,goodsorservicestopublicprocurementorconcessionmarketsofthatthirdcountry,therebyimprovingsuchaccess,orifthethirdcountryundertakescommitmentstoendthemeasureorpracticeinquestion,theCommissionmaywithdrawtheIPImeasureorsuspenditsapplication.如果歐委會認(rèn)為第三國采取了令人滿意的糾正措施,以消除或補救對歐盟經(jīng)濟經(jīng)營者、貨物或服務(wù)進入該第三國公共采購或特許市場的損害,從而改善這種準(zhǔn)入,或者如果第三國承諾結(jié)束有關(guān)措施或做法,歐委會可以撤銷IPI措施或暫停其適用。WheretheCommissionconsidersthatthecorrectiveactionsorcommitmentsundertakenhavebeenrescinded,suspendedorimproperlyimplemented,itshallmakeitsfindingspubliclyavailableandreinstatetheIPImeasureatanytime.如果歐委會認(rèn)為所采取的糾正行動或承諾已被撤銷、中止或不適當(dāng)?shù)貓?zhí)行,它應(yīng)公開其調(diào)查結(jié)果,并立即恢復(fù)IPI措施。TheCommissionmaywithdraw,suspendorreinstateanIPImeasurebymeansofanimplementingactandinsuchcases,shallpublishanoticeintheOfficialJournaloftheEuropeanUnion.ThatimplementingactshallbeadoptedinaccordancewiththeexaminationprocedurereferredtoinArticle11(2).歐委會可以通過實施法案的方式撤銷、暫?;蚧謴?fù)一項IPI措施,在這種情況下,應(yīng)在《歐盟官方公報》上發(fā)布通知。實施辦法依照條款11第2條規(guī)定的審查程序執(zhí)行。Article8Obligationsuponthesuccessfultenderer第8條中標(biāo)者的義務(wù)1.InthecaseofpublicprocurementprocedureswhicharesubjecttoanIPImeasure,aswellasinthecaseofcontractsawardedonthebasisofaframeworkagreementwheretheestimatedvalueofthosecontractsisequaltoorabovethevaluessetoutinArticle8ofDirective2014/23/EU,Article4ofDirective2014/24/EUandArticle15ofDirective2014/25/EUandwherethoseframeworkagreementsweresubjecttotheIPImeasure,contractingauthoritiesandcontractingentitiesshallalsoincludeinpublicprocurementdocumentsthefollowingobligationsonsuccessfultenderers:1.如果公共采購程序受制于IPI措施,并且是在框架協(xié)議基礎(chǔ)上授予合同,且這些合同的估計價值等于或高于第2014/23/EU號指令第8條、第2014/24/EU號指令第4條和第2014/25/EU號指令第15條規(guī)定的價值,并且這些框架協(xié)議受制于IPI措施,訂約當(dāng)局和訂約實體還應(yīng)在公共采購文件中規(guī)定中標(biāo)人的下列義務(wù):(a)nottosubcontractmorethan50%ofthetotalvalueofthecontracttoeconomicoperatorsoriginatinginathirdcountrywhichissubjecttoanIPImeasure;不得將合同總價值的50%以上分包給原產(chǎn)于受IPI措施約束的第三國的經(jīng)濟經(jīng)營者。(b)forcontractswhosesubjectmattercoversthesupplyofgoods,toensureforthedurationofthecontractthatgoodsorservicessuppliedorprovidedintheexecutionofthecontractandoriginatinginthethirdcountrywhichissubjecttotheIPImeasurerepresentnomorethan50%ofthetotalvalueofthecontract,irrespectiveofwhethersuchgoodsorservicesaresuppliedorprovideddirectlybythesuccessfultendererorbyasubcontractor;對于標(biāo)的包括貨物供應(yīng)的合同,確保在合同有效期內(nèi),為執(zhí)行合同而提供的貨物或服務(wù)中,原產(chǎn)于受投資移民措施影響的第三國的貨物或服務(wù)不超過合同總價值的50%,無論這些貨物或服務(wù)是由中標(biāo)者直接提供還是由分包者提供。(c)toprovidetothecontractingauthorityortothecontractingentityupontheirrequestadequateevidencecorrespondingtopoint(a)or(b),atthelatestuponcompletionoftheexecutionofthecontract;向訂約當(dāng)局或應(yīng)訂約實體的要求提供與(a)或(b)點相應(yīng)的充分證據(jù),最遲在合同執(zhí)行完成后提供。(d)topayaproportionatecharge,intheeventofnon-observanceoftheobligationsreferredinpoint(a)or(b),ofbetween10%and30%ofthetotalvalueofthecontract.在不遵守(a)或(b)點所述義務(wù)的情況下,按比例支付合同總價值的10%至30%的費用。2.Forthepurposesofparagraph1,point(c),itissufficienttoprovideevidencethatmorethan50%ofthetotalvalueofthecontractoriginatesincountriesotherthanthethirdcountrysubjecttotheIPImeasure.Thecontractingauthorityorcontractingentityshallrequestrelevantevidencewherereasonableindicationsofnon-compliancewithparagraph1,point(a)or(b),existorwherethecontractisawardedtoagroupofeconomicoperatorscomprisingalegalpersonoriginatinginthethirdcountrysubjecttoanIPImeasure.就第1款(c)而言,只要提供證據(jù)證明合同總價值的50%以上來自受IPI措施約束的第三國以外的國家即可。如果有合理的跡象表明不符合第1款(a)或(b)點的規(guī)定,或者合同被授予由原產(chǎn)于受IPI措施約束的第三國的法人組成的經(jīng)濟運營商集團,訂約當(dāng)局或訂約實體應(yīng)要求提供相關(guān)證據(jù)。3.ContractingauthoritiesandcontractingentitiesshallincludeareferencetotheobligationssetoutinthisArticleinthedocumentsforpublicprocurementprocedurestowhichanIPImeasureisapplicable.訂約當(dāng)局和訂約實體應(yīng)在適用IPI措施的公共采購程序文件中提及本條規(guī)定的義務(wù)。Article9Exceptions第9條例外情況1.ContractingauthoritiesandcontractingentitiesmayonanexceptionalbasisdecidenottoapplyanIPImeasurewithrespecttoapublicprocurementprocedurewhere:訂約當(dāng)局和訂約實體可在特殊情況下決定不對某一公共采購程序適用IPI措施,條件是:(a)onlytendersfromeconomicoperatorsoriginatinginathirdcountrysubjecttoanIPImeasuremeetthetenderrequirements;o
