2、保險(xiǎn)條款、散裝油類保險(xiǎn)條款502 【閱讀次數(shù)】502 1995年11月1日協(xié)會(huì)船舶航次保險(xiǎn)條款(Institute Voyage Clauses, Hulls 1/11/95)This insurance is subject to English law and practice本保險(xiǎn)受英國(guó)法律和習(xí)慣制約第1條 航海條款(Navigation)1 NAVIGATION1.1 The Vessel is covered subject to the provisions of this insurance at all times and has leave to sail or naviga
3、te with or without pilots, to go on trial trips and to assist and tow vessels or craft in distress, but it is warranted that the Vessel shall not be towed, except as is customary or to the first safe port or place when in need of assistance, or undertake towage or salvage services under a contract p
4、reviously arranged by the Assured and /or Owners and/or Managers and/or Charterers. 6、 their agents accept or are compelled to accept such contracts in accordance which established local law or practice.13 The practice of engaging helicopters for the transportation of personnel, supplies and equipment to and/ or from the Vessel shall not prejudice this insurance.1.2 本保險(xiǎn)不因被保險(xiǎn)人簽訂限制或免除引

8、raft)no claim shall be recoverable under this insurance for loss of or damage to the Vessel or liability to any other vessel arising from such loading or discharging operations, including whilst approaching, lying alongside and leaving , unless previous notice that the Vessel is to be employed in su

10、ge of Voyage2 Held covered in case of deviation or change of voyage or any breach of warranty as to towage or salvage services, provided notice be given to the Underwriters immediately after receipt of advices and any amended terms of cover and any additional premium required by them be agreed.萬(wàn)一發(fā)生繞
11、航或航程變更或任何違反拖帶或救助服務(wù)的保證,如果知悉后立即通知了保險(xiǎn)人,且同意保險(xiǎn)人提出的修改承保條款并支付保險(xiǎn)人要求的任何附加保險(xiǎn)費(fèi),本保險(xiǎn)得續(xù)保。第3條 船級(jí)條款(Classification)3 CLASSIFICATION3.1 It is the duty of the Assured, Owners and Managers at the inception of and throughout the period of this insurance to ensure that 3.1.1 the Vessel is classed with a Classification S
12、ociety agreed by the Underwriters and that her class within that Society is maintained,3.1.2 any recommendations requirements or restrictions imposed by the Vessels Classification Society which relate to the Vessels seaworthiness or to her maintenance in a seaworthy condition are complied with by th
13、e dates required by that Society .3.2 In the event of any breach of the duties set out in Clause 3.1 above, unless the Underwriters agree to the contrary in writing, they will be discharged from liability under the insurance as from the date of the breach provided that if the Vessel is at sea at suc
14、h date the Underwriters discharge from liability is deferred until arrival at her next port.3.3 Any incident condition or damage in respect of which the Vessels Classification Society might make recommendations as to repairs or other action to be taken by the Assured, Owners or Managers must be prom

17、ubject-matter insured caused by 4.1.1 perils of the seas rivers lakes or other navigable waters 4.1.2 fire, explosion4.1.3 violent theft by persons from outside the Vessel4.1.4 jettison4.1.5 piracy4.1.6 contact with land conveyance, dock or harbour equipment or installation4.1.7 earthquake volcanic
18、eruption or lightning4.1.8 accidents in loading discharging or shifting cargo or fuel.4.2 This insurance covers loss of or damage to the subject-matter insured caused by 4.2.1 bursting of boilers breakage of shafts or any latent defect in the machinery or hull4.2.2 negligence of Master Officers Crew
19、 or Pilots4.2.3 negligence of repairers or charterers provided such repairers or charterers are not an Assured hereunder4.2.4 barratry of Master Officers or Crew4.2.5 contact with aircraft, helicopters or similar objects, or objects falling therefrom provided that such loss or damage has not resulte
20、d from want of due diligence by the Assured, Owners, Managers or Superintendents or any of their onshore management.4.3 Master Officers Crew or Pilots not to be considered Owners within the meaning of this Clause 6 should they hold shares in the Vessel.4 危險(xiǎn)4.1 本保險(xiǎn)承保下列原因造成的保險(xiǎn)標(biāo)的的滅失或損害:4.1.1 海上、江河、湖泊或其

22、并非由于被保險(xiǎn)人、船東、管理人或船技主管或其岸上管理人員未謹(jǐn)慎處理所致4.3 船長(zhǎng)、高級(jí)船員、船員或引航員擁有保險(xiǎn)船舶股份的,也不視作本條意義上的船東。第5條 污染危險(xiǎn)(Pollution Hazard) This insurance covers loss of or damage to the Vessel caused by any governmental authority acting under the powers vested in it to prevent or mitigate a pollution hazard, or damage to the environme
23、nt, or threat thereof, resulting directly from damage to the Vessel for which the Underwriters are liable under this insurance, provided that such act of governmental authority has not resulted from want of due diligence by the Assured, Owners ,or Managers to prevent or mitigate such hazard or damag
24、e, or threat thereof. 25、高級(jí)船員、船員或引航員持有保險(xiǎn)船舶的股份,不視為第5條意義上的船東。第6條 3/4碰撞責(zé)任條款(3/4 the Collision Liability ) 6.1 The underwriters agree to indemnify the Assured for three-fourths of any sum or sums paid by the Assured to any other persons by reason of the Assured becoming legally liable by way of damages for6.1.1 loss of or damag
26、e to any other vessel or property on any other vessel6.1.2 delay to or loss of use of any such other vessel or property thereon6.1.3 general average of, salvage of, or salvage under contract of , any such other vessel or property thereon,where such payment by the Assured is in consequence of the Ves
27、sel hereby insured coming into collision with any other vessel.6.2 The indemnity provided by this Clause 6 shall in addition to the indemnity provided by the other terms and conditions of this insurance and shall be subject to the following provisions:6.2.1 Where the insured Vessel is in collision w
28、ith another vessel and both vessels are to blame then, unless the liability of one or both vessels becomes limited by law, the indemnity under this Class 6 shall be calculated on the principle of cross-liabilities as if the respective Owners had been compelled to pay to each other such proportion of
29、 each others damages as may have been properly allowed in ascertaining the balance or sum payable by or to the Assured in consequence of the collision.6.2.2 In no case shall the Underwriters total liability under Clauses 6.1 and 6.2 exceed their proportionate part of three-fourths of the insured val
30、ue of the Vessel hereby insured in respect of any one collision.6.3 The Underwriters will also pay three-fourths of the legal costs incurred by the Assured or which the Assured may be compelled to pay in contesting liability or taking proceeding s to limit liability, with the prior written consent o
31、f the Underwriters.EXCLUSIONS6.4 Provided always that this Clause 6 shall in no case extend to any sum which the Assured shall pay for or in respect of6.4.1 removal or disposal of obstructions, wrecks, cargoes or any other thing whatsoever6.4.2 any real or personal property or thing whatsoever excep
32、t other vessels or property on other vessels6.4.3 the cargo or other property on, or the engagements of, the insured Vessel6.4.4 loss of life, personal injury or illness6.4.5 pollution or contamination, or threat thereof, of any real or personal property or thing whatsoever (except other vessels wit
33、h which the insured Vessel is in collision or property on such other vessels) or damage to the environment, or threat thereof, save that this exclusion shall not extend to any sum which the Assured shall pay for or in respect of salvage remuneration in which the skill and efforts of the salvors in p

37、除外不擴(kuò)展至被保險(xiǎn)人應(yīng)支付的有關(guān)救助報(bào)酬。第7條 姐妹船條款(Sistership)7 SISTERSHIPShould the Vessel hereby insured come into collision with or receive salvage service from another vessel belonging wholly or in part to the same Owners or under the same management, the Assured shall have the same rights under this insurance as t
38、hey would have were the other vessel entirely the property of Owners not interested in the Vessel hereby insured; but in such cases the liability for the collision or the amount payable for the services rendered shall be referred to a sole arbitrator to be agreed upon between the Underwriters and th

40、charges and/or general average, reduced in respect of any under-insurance, but in case of general average sacrifice of the Vessel the Assured may recover in respect of the whole loss without first enforcing their right of contribution from other parties.8.2 Adjustment to be according to the law and
41、practice obtaining at the place where the adventure ends, as if the contract of affreightment contained no special terms upon the subject; but where the contract of affreightment so provides the adjustment shall be according to the York-Antwerp Rules.8.3 When the Vessel sails in ballast, no under ch
42、arter, the provisions of the York-Antwerp Rules, 1994(excluding Rules XI(d),XX and XXI) shall be applicable, and the voyage for this purpose shall be deemed to continue from the port or place of departure until the arrival of the Vessel at the first port or place thereafter other than a port or plac
43、e of refuge or a port or place of call for bunkering only. If at any such intermediate port or place there is an abandonment of the adventure originally contemplated the voyage shall thereupon be deemed to be terminated.8.4 No claim under this Clause 8 shall in any case be allowed where the loss was
44、 not incurred to avoid or in connection with the avoidance of a peril insured against.8.5 No claim under this Clause 8 shall in any case be allowed for or in respect of 8.5.1 special compensation payable to a salvor under Article 14 of the International Convention on Salvage, 1989 or under any other
45、 provision in any statute, rule , law or contract which is similar in substance8.5.2 expenses or liabilities incurred in respect of damage to the environment, or the threat of such damage, or as a consequence of the escape or release of pollutant substances from the Vessel, or the threat of such esc
46、ape or release.8.6 Clause 8.5 shall not however exclude any sum which the Assured shall pay to salvors for or in respect of salvage remuneration in which the skill and efforts of the salvors in preventing or minimising damage to the environment as is referred to in Article 13 paragraph 1(b) of the I

48、衛(wèi)普規(guī)則(第19條(d)、第20條和第21條除外),為此目的的航程應(yīng)自起運(yùn)港或起運(yùn)地持續(xù)至除避難港口或地點(diǎn)或僅為添加燃料的掛靠港口或地點(diǎn)之外的船舶抵達(dá)的第一港口或地點(diǎn)為止。如果在上述任何一個(gè)中途港口或地點(diǎn)放棄原定冒險(xiǎn)時(shí),該航程應(yīng)視作在該處終止。8.4 如果損失不是為避免承保危險(xiǎn)而發(fā)生或與之有關(guān),根據(jù)本第8條提出的索賠在任何情況下均不予認(rèn)可。8.5 為下述各項(xiàng)或與之有關(guān)的根據(jù)本第8條提出的索賠在任何情況下均不予認(rèn)可8.5.1 根據(jù)1989年國(guó)際救助公約第14條或根據(jù)實(shí)質(zhì)上相似的任何成文法、規(guī)則、法律或合同中的任何其他條款,向救助人支付的特別補(bǔ)償。8.5.2 環(huán)境損害或其威脅引起的,或者由于從保險(xiǎn)

50、h measures as may be reasonable for the purpose of averting or minimising a loss which would be recoverable under this insurance.9.2 Subject to the provisions below and to Clause 10 the Underwriters will contribute to charges properly and reasonably incurred by the Assured their servants or agents f

General average, salvage charges (except as provided for in Clause 9.5), special compensation and expenses as referred to in Clause 8.5 and collision defence or attack costs are not recoverable under this Clause 9.9.3 Measures taken by the Assured or the Underwriters with the objec
52、t of saving, protecting or recovering the subject-matter insured shall not be considered as a waiver or acceptance of abandonment or otherwise prejudice the rights of either party.9.4 When expenses are incurred pursuant to this Clause 9 the liability under this insurance shall not exceed the proport
53、ion of such expenses that the amount insured hereunder bears to the value of the Vessel as stated herein, or to the sound value of the Vessel at the time of the occurrence giving rise to the expenditure if the sound value exceeds that value. Where the Underwriters have admitted a claim for total los
54、s and property insured by this insurance is saved, the foregoing provisions shall not apply unless the expenses of suing and labouring exceed the value of such property saved and then shall apply only to the amount of the expenses which is in excess of such value.9.5 When a claim for total loss of t
55、he Vessel is admitted under this insurance and expenses have been reasonably incurred in saving or attempting to save the Vessel and other property and there are no proceeds, or the expenses exceed the proceeds, then the insurance shall bear its pro rata share of such proportion of the expenses, or
56、of the expenses in excess of the proceeds, as the case may be, as may reasonably be regarded as having been incurred in respect of the Vessel, excluding all special compensation and expenses as referred to in Clause 8.5 ; but if the Vessel be insured for less than its sound value at the time of the
57、occurrence giving rise to the expenditure, the amount recoverable under this clause shall be reduced in proportion to the under-insurance. 9.6 The sum recoverable under this Clause 9 shall be in addition to the loss otherwise recoverable under this insurance but shall in no circumstances exceed the
58、amount insured under this insurance in respect of the Vessel.9 被保險(xiǎn)人的義務(wù)(施救費(fèi)用)9.1 若發(fā)生任何滅失或?yàn)?zāi)難,被保險(xiǎn)人及其雇員和代理人有義務(wù)采取合理措施,以便避免或減輕根據(jù)本保險(xiǎn)可獲賠償?shù)膿p失。9.2 依照以下條款和第10條各項(xiàng)規(guī)定,保險(xiǎn)人將補(bǔ)償由被保險(xiǎn)人、其雇員或代理人因此種措施而適當(dāng)、合理地產(chǎn)生的費(fèi)用。共同海損、救助費(fèi)用(除第9.5款規(guī)定者外)、第8.5款提及的特別補(bǔ)償和費(fèi)用、碰撞抗辯和訴訟費(fèi)用,均不能根據(jù)本第9條獲得賠償。9.3 被保險(xiǎn)人或保險(xiǎn)人為拯救、保護(hù)和恢復(fù)保險(xiǎn)標(biāo)的而采取措施,不應(yīng)視為放棄或接受委付,或者有損于
59、任何一方的利益。9.4 對(duì)根據(jù)第9條產(chǎn)生的費(fèi)用,本保險(xiǎn)的賠償責(zé)任,不超過(guò)此種費(fèi)用占約定保險(xiǎn)金額與約定保險(xiǎn)船舶價(jià)值的比例部分;如果發(fā)生該費(fèi)用時(shí)船舶完好價(jià)值超過(guò)約定的保險(xiǎn)價(jià)值,則不超過(guò)此種費(fèi)用占約定保險(xiǎn)金額與該完好價(jià)值的比例部分;假如保險(xiǎn)人已經(jīng)認(rèn)可全損索賠,而本保險(xiǎn)中的保險(xiǎn)財(cái)產(chǎn)又獲救時(shí),上述規(guī)定不適用,除非施救費(fèi)用超過(guò)此種獲救財(cái)產(chǎn)的價(jià)值,那么,上述規(guī)定僅適用于超過(guò)獲救價(jià)值的施救費(fèi)用。9.5 當(dāng)根據(jù)本保險(xiǎn)已認(rèn)可保險(xiǎn)船舶的全損索賠,為拯救或企圖拯救保險(xiǎn)船舶和其他財(cái)產(chǎn)已合理產(chǎn)生的費(fèi)用但無(wú)收益,或該費(fèi)用已超過(guò)收益時(shí),本保險(xiǎn)應(yīng)按比例賠償該費(fèi)用或超過(guò)收益的費(fèi)用中按具體情況確定為保險(xiǎn)船舶合理產(chǎn)生的那部分費(fèi)用;包
60、括第8.5款提及的所有的特殊補(bǔ)償和費(fèi)用;但是,如果保險(xiǎn)船舶按低于其引起此種費(fèi)用的事故發(fā)生時(shí)的完好價(jià)值投保,根據(jù)本條可獲得的賠償數(shù)額,應(yīng)按其不足額保險(xiǎn)部分的比例進(jìn)行賠償。9.6 根據(jù)本第9條可獲賠的數(shù)額,應(yīng)在本保險(xiǎn)負(fù)責(zé)賠償?shù)钠渌麚p失之外支付,但在任何情況下,不得超過(guò)保險(xiǎn)船舶的保險(xiǎn)金額。第10條 免賠額(Deductible)10 DEDUCTIBLE10.1 No claim arising from a peril insured against shall be payable under this insurance unless the aggregate of all such cla
