1、EMPLOYMENT CONTRACT雇傭合約(注:該雇傭合約由塞班政府有關(guān)部門(mén)制定并提供)This employment contract is entered into by and between _of_, hereinafter referred to as the Employer, and _ of _, hereinafter referred to as the Employee.此雇傭合約由 地址 以下簡(jiǎn)稱雇主和地址 以下簡(jiǎn)稱雇員,雙方同意而成立。The Employer hereby employs the Employee and the Employee hereby

DUTIES AND RESPONSIBILITIES: The parties hereto agree that the Employee shall be employed only in the job category of _ and

TERM: The term of this Contract shall be for a period of _ commencing upon the Employees arrival in the Commonwealth of the Northern Mariana Islands (“CNMI”) and e

PRINCIPAL PLACE OF WORK: The Employees principal place of employment shall be on _, CNMI. However, the Employee may be re

9、SPORTATION: The Employer shall be responsible for the payment of the Employees return airplane ticket to his/her point of hire at the expiration or termination of the Employment Contract, regardless of the nature of the termination.交通:在合約滿期或終止時(shí),無(wú)論終止的性 質(zhì)如何,雇主都要負(fù)責(zé)支付雇員回到原雇傭地點(diǎn)的回程機(jī)票。H. INSURANCE/MEDICAL

10、EXPENSES: The Employer shall be responsible and liable for the medical insurance or payment of all medical expenses of the Employee, including the cost of referral and evacuation of medical treatment outside the CNMI and, in the event of Employees death, the cost of embalming and transportation of t

11、he Employees corpse back to his/her point of origin.保險(xiǎn)/醫(yī)藥 費(fèi):雇主將負(fù)責(zé)支付雇員的醫(yī)藥保險(xiǎn)或支付所有的醫(yī)藥費(fèi)用,包括轉(zhuǎn)送外地醫(yī)治的運(yùn)送和醫(yī)療費(fèi)用以及萬(wàn)一雇員死亡,收殮和運(yùn)送尸體回國(guó)的費(fèi)用。I. NOTIFICATION OF NEXT-OF-KIN: In the case of an emergency involving serious illness, accident or death of the Employee, the Employer shall immediately notify the Employees nex

17、erformed or for work not performed when an Employer refuses to allow the Employee to continue working through the effective date of the termination and shall purchase a one-way ticket for the return of the Employee to his/ her point of hire.在合理解雇的情形下,雇主將支付雇員工作或提供服務(wù)的酬金或薪水,或當(dāng)雇主拒絕允許雇員在解雇生效期前繼續(xù)工作的 免工合約工

Termination for cause may include any of the following:合理解雇可包括任何下列理由:a. _ unauthorized absences and/or _ unauthorized tardiness to work by the Employee;雇員有_未經(jīng)批準(zhǔn)缺勤和/或_無(wú)故遲到b. Neglect, careless performance, non-performance or non-completion of assigned work by the Employee

Incompetence or misrepresentation of the qualifications, skills, physical or mental fitness to satisfactorily perform the duti

20、es for which the Employee was hired;雇員資歷不足或虛報(bào)資格,技術(shù),身體或精神健康足以執(zhí)行該雇員受 雇的任務(wù)f. Extreme cruelty or abuse, physical or otherwise;對(duì)身體 或其他方面 極度殘忍或虐待行為g. Unreasonable delays in the payment of the Employees wages or salary;不合理地延誤雇員的酬金或薪水16h. A breach of any provision of this Contract and not corrected within t

SETTLEMENT OF DISPUTE:解決爭(zhēng)議Grievance and Good Faith Settlement:冤屈和善意解決All grievances or dispute under this employment contract shall be subject to the following grievance procedure:

22、在這合約制衡下,所有的冤屈和爭(zhēng)議都要跟循以下申訴步驟:1. The Employee shall communicate to his/her supervisor, or if there is no supervisor, then directly to the Employer, any and all grievances or disputes he/she may have regarding his/her employment;雇員要將他/她任何和所有關(guān)于他/她雇傭的冤情或爭(zhēng)議告知主 管,如果沒(méi)有主管就要直接告知雇主。2. If the supervisor is unabl

23、e to resolve the matter immediately, the grievance or dispute shall be reduced to writing by the supervisor which shall state the section of the contract, law, or rules and regulations to have been violated. Management shall have five working days to resolve the grievance, dispute or state in writin

24、g his/her reasons why there is no violations.如果主管無(wú)法立刻解決問(wèn)題,就要把冤情或爭(zhēng) 議作書(shū)面報(bào)告其中列明違反合約,法律,或規(guī)則和條例的哪一條,管理當(dāng)局將有五個(gè)工作天時(shí)間去解決冤情,爭(zhēng)議或以書(shū)面提出他/她的理由解釋為何沒(méi) 有違犯。3. If the grievance or dispute is not resolved in step 1 or 2 above, the Employee may file a complaint with the Director of Labor or his designee.如果以上第一和第二步都仍不能解決

25、冤屈或爭(zhēng)議,雇員可向勞務(wù)局長(zhǎng)或其代理立案投訴。The Employee and Employer shall maintain the employment relationship during the pendency of any grievance or dispute unless the Director of Labor, his authorized designee, or a hearing officer grant a temporary work authorization.除非勞務(wù)局長(zhǎng),其代理人或聆訊官批發(fā)一封臨時(shí)工作授權(quán)書(shū),否則在冤屈或爭(zhēng)議未決期間,雇員和雇主將須

REMITTANCE/OTHER OBLIGATIONS: The Employee shall be responsible for remitting any money to his/her family and payment of any taxes as required by his/her government in his/her country of origin.匯款/其他義務(wù):雇員將自己負(fù)責(zé)匯款回家和支付其國(guó)內(nèi)政府要求的稅。O. ENTIRE AGREEMENT: The foregoing terms and conditions const
