8、.五、社會(huì)保險(xiǎn)及其他保險(xiǎn)福利待遇Social Welfare and Benefits第八條 甲方按國(guó)家和地方政策規(guī)定為乙方辦理社會(huì)保險(xiǎn)有關(guān)手續(xù),并 承擔(dān)相應(yīng)的義務(wù)。Article 8 : Party A shall deal with the releva nt formalities of social security for Party Baccordi ng to the country and local policies and take up the releva nt liabilities.第九條 乙方患職業(yè)病或因工負(fù)傷后的工資和醫(yī)療補(bǔ)助執(zhí)行按照國(guó)家和 地方的有關(guān)法律法規(guī)執(zhí)
9、行。Article 9: The salary and Medicare ben efits of Party B in case of occupati onaldiseases or work-related injuries shall be paid in accorda nce with the releva nt n ati onal andlocal laws and regulati ons.第十條 乙方患職業(yè) 病或因工負(fù)傷的待遇按國(guó)家的有關(guān) 規(guī)定 執(zhí)行。 Article 10: If PartyB suffers illness or non-work related inj
10、ury, Party A shall implement relevant stateprovisions.六、勞動(dòng)保護(hù)、勞動(dòng)條件和職業(yè)危害防護(hù)Labor protection, labor condition and occupational harm prevention and cure 第十一6條 甲方根據(jù)生產(chǎn)崗位的需要 ,按照國(guó)家有關(guān)勞動(dòng) 安全、衛(wèi) 生的規(guī)定為乙方配備必要的安全防護(hù)措施,發(fā)放必要的勞動(dòng)保護(hù)用 品。Article 11: Party A shall equip Party B with the necessary safety protection measuresan
11、d issue the necessary labor protection articles according to the needs of the post and therules of the labor safety and hygiene.第十 二條 甲 方應(yīng)當(dāng)建立、 健全 職業(yè)病防治責(zé)任制 度,加強(qiáng) 對(duì)職 業(yè)病防治的管理,提高職業(yè)病防治水平。Article 12 : Party A shall set up and optimize the occupational disease cureresponsibility system, enforce the manageme
12、nt over the occupational disease andpromote the cure level of the occupational disease.七、勞動(dòng)合同的解除、終止和經(jīng)濟(jì)補(bǔ)償Change, Cancellation, Termination and Renewal of the Labor Contract 第十 三條 甲乙雙方解除、變更、終止、續(xù)訂勞動(dòng)合同應(yīng)當(dāng)依照勞動(dòng) 合同法和國(guó)家及省、市等有關(guān)規(guī)定執(zhí)行。Article 13 :If the parties revoke, modify, terminate and extent the labor cont
13、ract, theyshall perform them according to the relevant rules of the LaborContract Law and the country, province and city etc.第十 四條 甲方應(yīng)在解除或者終止勞動(dòng)合同時(shí),為乙方出具解除或者終 止勞動(dòng)合同的證明,并在 15 日內(nèi)為勞動(dòng)者辦理相關(guān)手續(xù)。乙方應(yīng)在甲方出具 解除或者終止勞動(dòng)合同的證明后10 日內(nèi)辦理工作移交,如涉及經(jīng)濟(jì)補(bǔ)償?shù)陌?國(guó)家有關(guān)規(guī)定在辦結(jié)工作交接時(shí)支付。Article 14 :Upon the revocation or termination of th
14、e labor contract, Party A shall issuethe certification for revocation or termination of the labor contract to Party B and deal with the7relevant formalities for the laborer within fifteen (15)days. Party B shall make the workhandover within ten (10) days after issuance by Party A of the certificate
15、of revocation ortermination of the labor contract. Regarding any economic compensation, they shall be paidupon the handover of the work according to the rules of the country.八、勞動(dòng)爭(zhēng)議處理Labor Dispute Resolutions第十五條 雙方發(fā)生爭(zhēng)議,任何一方當(dāng)事人可向甲方所在地的勞動(dòng)爭(zhēng)議仲裁 委員會(huì)申訴,由仲裁委員會(huì)依法調(diào)解或裁決。 如對(duì)仲裁不服, 向甲方所在地人 民法院起訴, 一方當(dāng)事人期滿不起訴但又不執(zhí)行
16、裁決的, 另方當(dāng)事人可向人民 法院申請(qǐng)強(qiáng)制執(zhí)行。Article 15 :In case disputes arise between two parties, either party can appeal to labourdisputes arbitration commission at party A s location, subject to mediator adjudication by arbitration commission. In case of disobedience of arbitration result, eitherparty can sue to th
17、e court at party As locantieointh. eEritherparty brings the lawsuit during the valid period nor performs the adjudication; the other partyhas the right to apply for forcible execution to the court.第十六條 乙方承諾本合同乙方通訊地址為甲方向乙方寄送郵件信函的 地址,甲方按該地址寄送的郵件信函如無法送達(dá)被退回即視為該郵件已送達(dá)乙 方。Article 16 :Party B promises his c
18、orrespondence address of the contract shall be theaddress that Party A sends the letters or mails to Party B. If any letters or mails are notreturned or undeliverable after Party A sends them, it is deemed that they have arrived atParty B.第十七條 本合同未盡事宜,應(yīng)按國(guó)家現(xiàn)行法律、法規(guī)、規(guī)章執(zhí)行。本 合同條款如與國(guó)家法律、法規(guī)、政策相抵觸時(shí),以國(guó)家規(guī)定為準(zhǔn)。8Article 17 :Affairs unmentioned in this contrac
