1、工資專項(xiàng)集體合同COLLECTIVE CONTRACT ON SALARY第一條 本合同由 _ (單位)與 _ 工會(huì)根據(jù)中華人民共和國(guó)勞動(dòng)法、中華 人民共和國(guó)勞動(dòng)合同法、中華人民共和國(guó)工會(huì)法、江蘇省集體合同條例、江蘇省工資支付條例、勞動(dòng)和社會(huì)保障部工資集體協(xié)商試行辦法等有關(guān)規(guī)定, 通過(guò)對(duì)企業(yè)本年度的生產(chǎn)經(jīng)營(yíng)和經(jīng)濟(jì)效益狀況的分析與預(yù)測(cè),對(duì)照政府發(fā)布的工資指 導(dǎo)線、工資指導(dǎo)價(jià)位和本地區(qū)、行業(yè)職工的工資平均水平,經(jīng)雙方平等協(xié)商一致簽訂。Article 1 This con tract is made betweenand the Trade Union of, accord ingto “ Labo

3、rity“ as well as otherrelated regulati on s. It is sig ned after equal n egotiati on of both parties, based on the an alysis and forecast of the product ion and operati on of en terprises and econo mic situati on, compar ing the gover nment salary guideli ne, level and the average salary of the same
4、 area and same in dustry.第二條經(jīng)協(xié)商雙方就企業(yè)本年度職工工資、福利增長(zhǎng)水平和分配辦法形成如下意見:Articles 2 After consultations, the two parties decide the growth level of Company ssalary and ben efits and its distributi on pla n as follows:1. 在上年度企業(yè)職工人均工資元的基礎(chǔ)上,本年度企業(yè)職工人均工資增幅為% ;On the basis of previous year Company employees average

6、ard are:5. 企業(yè)支付職工工資時(shí)間為每月 _ 日 ,支付形式為貨幣(銀行轉(zhuǎn)賬);Company pays salaries to employees in a monetary form of bank transfer on the _ of every month.第三條 可以由雙方共同協(xié)商的條款還有:Article 3 Others items for two parties negotiations:1. 企業(yè)工資分配制度和分配方式 Company salary distribution policy and form2. 計(jì)件工資和勞動(dòng)定額; Piece rate and w
7、orking ration;3. 獎(jiǎng)金分配辦法; Bonus distribution plan;4. 津貼、補(bǔ)貼標(biāo)準(zhǔn); Allowance distribution standard;5. 保險(xiǎn)福利; Insurance and welfare;6. 其他雙方認(rèn)為需要協(xié)商的有關(guān)職工工資、福利的條款。Other items that both parties think should be negotiated concerned employee salary and welfare.第四條 工會(huì)依法對(duì)企業(yè)遵守工資支付規(guī)定的情況進(jìn)行監(jiān)督,發(fā)現(xiàn)違法違規(guī)行為,有權(quán) 要求改正。Article 4
8、Trade Union supervises company s implementation of salary distribution policy and is entitled to demand correction when founding violations of laws and regulations.第五條 本合同由集體合同監(jiān)督檢查小組負(fù)責(zé)監(jiān)督,企業(yè)應(yīng)每半年一次向職代會(huì)(職工 大會(huì))公布工資專項(xiàng)集體合同履行情況。Article 5 The supervision group of the collective contract is responsible for s
9、uperintending the execution of the present contract. Company should report theimplementation of Collective Contract on Salary to the Employees Representative Convention at least once every year.第六條 本合同簽訂后,遇有不可抗力或企業(yè)經(jīng)營(yíng)狀況發(fā)生重大變化,雙方可協(xié)商修改 合同,但每年只能一次。Article 6 This Contract can be modified but only once ev
10、ery year, since the signingdate of the contract, based on two parities negotiation when company suffers fromforce majeure or big changes.第七條 本合同有效期為一年,于 年 月 日起至 年 日止。并于期滿前三個(gè)月 內(nèi)進(jìn)行下一輪工資集體協(xié)商。Article 7 The validity of the contract is one year, starting from_ to , and thenext round of consultation on sal
11、ary shall begin within 3 months before the expiry thereof.第八條 本合同簽訂后,企業(yè)應(yīng)在 10 日內(nèi)報(bào)送當(dāng)?shù)貏趧?dòng)保障行政部門審查。勞動(dòng)行政 部門自收到本合同之日起十五日內(nèi)未提出異議的,本合同即行生效。Article 8 The contract should be delivered to local Labor and Social Security Bureau for censoring within 10 days since its signing. The contract will come into effect if no exception from local labor guarantee bureau within 15 days since it gets the contract.生效的合同一式四份,雙方各執(zhí)一份,一份由勞動(dòng)保障行政部門存檔,一份報(bào)上級(jí)工 會(huì)備案,并在 10 日內(nèi)向全體職工公布。The contract is made in four copies, each party holding one, Labor and Social Security Bureau and the superior Trade Union holding one each a
