1、有產(chǎn)證二手房買賣合同補(bǔ)充條款、付款協(xié)議例文:上手無抵押,本手不貸款,要補(bǔ)足定金補(bǔ)充條款A(yù)ppe ndix Agreeme nt根據(jù)本合同第一條之規(guī)定,經(jīng)雙方友好協(xié)商,達(dá)成如下補(bǔ)充條款:Accord ing to the 11 term of the con tract, both Parties agree the suppleme ntary clauses below base on thefrien dly n egoiatio n:1、雙方均認(rèn)知:目前該房地產(chǎn)已設(shè)定抵押。甲方承諾于乙方全額支付首期房?jī)r(jià)款后十五個(gè)工作日內(nèi)完成還貸手續(xù)并將注銷抵押材料交予中介方。1. The both pa

2、rties are fully in formed the property has bee n mortgaged. Party A promised to fin ish the pay-off issues as well as hand over all the docume nts regardi ng the eras ing mortgage to the age ncy in 15 days after Party B pay ing the first payme nt.2、甲方應(yīng)支付和已支付發(fā)展商、物業(yè)管理公司及其他相關(guān)部門的維修基金、管理費(fèi)押金(若有)、煤氣初裝費(fèi)(若有)

3、、有線電視初裝費(fèi)(若有)、寬帶初裝費(fèi)(若有)、其他費(fèi)用(若有)已包含在本合 同第二條所述房地產(chǎn)轉(zhuǎn)讓價(jià)款內(nèi),雙方不再另行結(jié)算。甲方應(yīng)在本交易完成后五個(gè)工作日內(nèi)與乙方辦理上述事宜之戶名變更手續(xù),更名費(fèi)用由乙方承擔(dān)。2. The Party A should accompa ny with Party B to tran sfer the n ame to Party B in five day after th

5、e property has bee n han ded over. The Party B should affordthe tran sfer fee.3、雙方確認(rèn)該房地產(chǎn)之附屬設(shè)施、設(shè)備(詳見附件二)及現(xiàn)有裝潢已包含在本合同第二條所 述房地產(chǎn)轉(zhuǎn)讓價(jià)款內(nèi)。乙方于簽訂買賣合同前已對(duì)該房地產(chǎn)進(jìn)行驗(yàn)看,并同意甲方將該房地產(chǎn)按現(xiàn)狀交付乙方即可。甲方保證該房地產(chǎn)內(nèi)的管線暢通以及附屬設(shè)施設(shè)備的正常使用。3. The tran sacti on price which writte n in the sec ond term of the con tract also in eludes all the

6、 attached facilities, equipments and the existing decoration which listed in the Appendix II. And Party B agrees to accept the curre nt status of the property whe n handing over. The Party A should promise the tube and the attached facilities in good condition.4、 雙方確認(rèn)乙方可以向銀行申請(qǐng)貸款計(jì)人民幣貳佰零柒萬元整(RMB2,070,

7、000.0用于支付部分房?jī)r(jià)款。乙方應(yīng)于支付全額首期房?jī)r(jià)款后十五個(gè)工作日內(nèi)完成貸款審批,并將辦理抵押登記所需材料交至中介方,否則視作乙方逾期付款。若銀行未批準(zhǔn)乙方之貸款申請(qǐng)或貸款不足,則任何不足 部分均由乙方在知曉或應(yīng)當(dāng)知曉上述情況后五個(gè)工作日內(nèi)暫存至中介方,由中介方按付款協(xié)議規(guī)定的該筆房?jī)r(jià)款轉(zhuǎn)付時(shí)間付予甲方。4. The both Parties con firmed that Party B can apply the mortgage loa n from the bank, amount:RMB2,070,000.00, as the part of the payment. The P

8、arty B should finish the mortgage loan approval issues in 15 work days after pay off the first payment. In the mean time hand all the documents regarding the mortgage registration to the agency, any delay will be taken as delay of payment. If the bank refuse to loan to Party B or there is some short

9、age of the applying amount, the Party must pay the any shortage to the agency in 5 days after being in formed or should being in formed the result from the bank. The age ncy would tran sfer the payme nt to Party A base on the schedule writte n in the payme nt agreeme nt.5、甲、乙雙方同意,涉及本交易的各項(xiàng)稅費(fèi)由甲、乙雙方按國(guó)家

10、政策、法規(guī)的規(guī)定各自承擔(dān)(買賣合同公證費(fèi)由甲、乙雙方各半承擔(dān);貸款公證費(fèi)由乙方承擔(dān))。甲方提前還貸、注銷抵押產(chǎn)生的相關(guān)費(fèi)用包括銀行罰息(若有)由甲方自行承擔(dān)。乙方應(yīng)于支付首期房?jī)r(jià)款時(shí)一并提供本交易 所需稅費(fèi),甲方同意中介方于首期房?jī)r(jià)款中扣除本交易所需稅費(fèi)。甲方應(yīng)通過稅務(wù)機(jī)關(guān)出具全額房?jī)r(jià)款發(fā)票予乙方。若由于相關(guān)部門的法律、法規(guī)、政策變化,導(dǎo)致雙方應(yīng)當(dāng)承擔(dān)的稅費(fèi)增加或減少, 都由甲、乙雙方按變化后的規(guī)定各自承擔(dān)或享有。5. The both Parties agree to afford their respectivetax and fee according to the PRC policy

11、 and laws(the con tract no tarizati on fee would be shared in half by the two parties, the mortgage no tarizati on would be afforded by Party B). The Party A should also afford the fee which caused by eras ing the mortgage registration and the fine of breaking the mortgage loan contract(if has). The

12、 Party B should transfer all the tax and fee to the agency when pay the first payment. The Party A should agree to let the agency deduct the tax and fee from the first payment. The Party A should issue the full transaction price invoice authorized by the taxation bureau to Party B. If there is any f

13、loating of the tax and fee caused by the change of laws,policies,etc. The both parties should accepted it uncon diti on ally.6、甲、乙雙方應(yīng)于簽訂本合同后及時(shí)提供轉(zhuǎn)讓本交易所需的相關(guān)材料。甲、乙雙方確認(rèn),待取得經(jīng)公證的買賣合同及貸款合同后七個(gè)工作日內(nèi),自行或委托中介方向房地產(chǎn)交易中心申請(qǐng)辦理過戶轉(zhuǎn)讓手續(xù)。若因任何一方故意拖延或者不及時(shí)提供本交易所需材料及稅費(fèi)導(dǎo)致轉(zhuǎn)讓過戶手續(xù)延 遲辦理或無法辦理的,則該過錯(cuò)方應(yīng)承擔(dān)違約責(zé)任。6. The two parties shoul

14、d provide all the relative docume nts timely after sig ning the con tract. The both parties agree to transfer the name of the title deed by himself or done by the agency in 7 days after getting the no tarized con tract and the approved mortgage loa n agreeme nt. Any party would afford the faulty of

15、break ing the con tract if the said docume nts, tax and fee are not provided timely caus ing the delay of tran sacti on.7、本合同第九條所規(guī)定的違約責(zé)任同樣適用乙方未按時(shí)履行本合同及附件規(guī)定的其他義務(wù) 的情形。7. The 9h term of the con tract is effective to all the situati on which Party B do not obey his obligati ons stated in the con tract a

16、s well as the appe ndix agreeme nt.8、本合同第十條所規(guī)定的違約責(zé)任同樣適用甲方未按時(shí)履行本合同及附件規(guī)定的其他義務(wù) 的情形。8. The 1(th term of the con tract is effective to all the situati on which Party A do not obey his obligati ons stated in the con tract as well as the appe ndix agreeme nt.9、甲方承諾于該房地產(chǎn)交接前,向房屋所在地的公安派出機(jī)構(gòu)辦妥原有戶口(若有)的遷出 手續(xù)。9.

17、The Party A promise to move away the reside ntial registrati on (if has) recorded in the local police office before handing over the property.10甲方保證,上述買賣的房地產(chǎn)不存在產(chǎn)權(quán)爭(zhēng)議和其他人主張權(quán)利的情形。若由此造成乙方 無法按本合同買受該房地產(chǎn),甲方須承擔(dān)違約責(zé)任。10. The Party A guarantee to have the exclusive property right without any other right holder

The Party A should afford the faulty of break ing the con tract if there is property right problems.付款協(xié)議Payme nt Agreeme nt1、 簽訂本合同當(dāng)日,甲方應(yīng)將該房地產(chǎn)之上海市房地產(chǎn)權(quán)證暫存于中介方,乙方應(yīng)支付甲方計(jì)人民幣伍萬元整(RMB50,000.0),此外,乙方應(yīng)于簽訂本合同后五個(gè)工作日內(nèi)再 行支付甲方房?jī)r(jià)款計(jì)人民幣壹佰肆拾萬元整(RMB1,4OO,OOO.0Q以上合計(jì)人民幣壹佰肆拾伍萬元整(RMB1,450,000.Q0作為乙方支付給甲方的首期房?jī)r(jià)款。雙方同意上述款項(xiàng)

19、均暫存中介 方。1. The signing date, Party A should hand the title deed to the agencyand the Party B should pay RMB50,000.00 as the part of the first payment. Furthermore, Party B should pay RMB1,400,000.00 in 5 day after the signing date. The total RMB1,450,000.00 is taken as the first payment. The both pa

20、rties agree to keep the payme nt at the age ncy temporarily.2、乙方應(yīng)于簽訂本合同后五個(gè)工作日內(nèi)將房?jī)r(jià)尾款計(jì)人民幣伍萬元整(RMB50,000.00暫存于中介方。2. The Party B should pay the last payme nt, RMB50,000.00, to age ncy after the sig ning day.3、待乙方全額支付上述首期房?jī)r(jià)款后十五個(gè)工作日內(nèi),甲方應(yīng)在中介方陪同下提取首期 房?jī)r(jià)款至抵押權(quán)人處完成還貸手續(xù)(若有任何不足由甲方自行補(bǔ)足),并將辦理注銷抵押手續(xù)所 需材料交予中介方。中介方收

21、到上述材料后代為甲方辦理注銷抵押手續(xù)。3. In 15 work days after Party B paying the first payment, the Party A should finish the paying off mortgage loa n issues with the age ncy who will bring the first payme nt(if there is any shortage, the Party A should pay off by himself). In the meanwhile the agency will collect a

22、ll the documentsregarding the eras ing mortgage loa n. The age ncy will han dle the eras ing issues whe n get all the relative docume nts.4、待本交易經(jīng)房地產(chǎn)交易中心審核完畢后(即出具乙方為產(chǎn)權(quán)人的房地產(chǎn)權(quán)證,貸款銀行為抵押權(quán)人的上海市房地產(chǎn)登記證明(抵押權(quán))五個(gè)工作日內(nèi),乙方應(yīng)委托貸款銀行將 第二期房?jī)r(jià)款計(jì)人民幣貳佰零柒萬元整(RMB2,070,000.0D支付至甲方指定賬號(hào)。4. In 5 days after the tran sact ion bei

23、ng approved(issued the new title deed which the title is Party B),the Party B should man date the mortgage loan ba nk to lau nch the loan RMB2,070,000.00 as the seco nd payme nt to the acco unt which appo in ted by the Party A.5、 待貸款銀行將貸款發(fā)放到甲方指定賬號(hào)后三日內(nèi),甲、乙雙方應(yīng)對(duì)該房地產(chǎn)進(jìn)行驗(yàn)看、清點(diǎn),辦理物業(yè)交割手續(xù)并結(jié)清一切相關(guān)費(fèi)用。確認(rèn)無誤后,雙方簽訂房

24、地產(chǎn)交接書。甲方憑 房地產(chǎn)交接書到中介方領(lǐng)取房?jī)r(jià)尾款,乙方憑房地產(chǎn)交接書到中介方處領(lǐng)取房地產(chǎn)權(quán)證。本交易完成。5. In 3 date after the bank launch the loa n to the Party Bacco unt, the both parties should check the property together including checking, accounting and transferring the residential name in the management office as well as pay off the relative fee. After confirmation the things above, the both parties should sig n the property handin g-over agreeme nt.The n the Party A can get the last payme ntfrom the age ncy prod
